Motion to Approve Publishing a Summary of Ordinance 2008-001 for Recreational Vehicle, Utility Trailer, and Watercraft Outdoor Storage as Permitted by Minnesota State Statute 412.191 Subd 4, Backl!:round In May 2007, Staff was directed by the Planning Commission and the City Council to examine the current zoning code regarding recreation vehicles, Staff was asked to clarify the definitions used for "recreational vehicle" as well as the methodology for measuring "length" and "height" of R V s, The primary goal of this amendment was to clarify the definitions and build consistency within the RV code. Staff was not directed to make significant policy changes to the existing ordinance at this time. A draft of a revised RV code was proposed in May; however, the project was delayed for additional research, City of Arden Hills City Council Meetingfor January 28, 2008 \\Metro-inet.us\ardenhillslPlanning\P/anning Cases\2007\07-025 RV Regulations Zoning Amendment (eC Tab/ed) \012808 - CC Report ~ Rv Regulations.doc Page 1 of4 In response to the Council and Planning Commission's request, Staff analyzed the current code and reviewed codes from fifteen other communities in the metropolitan area, Comments and discussion were elicited from other City Staff, including the code enforcement officer and the building official, Two work sessions were held with the Planning Commission, one on November 7th and another on December 5th. At each meeting additional questions and concerns were raised, In addition, two public hearings were held at which residents were invited to raise their own questions and concerns. The Planning Commission unanimously voted to recommend approval of the ordinance at their December 5, 2007 meeting, The City Attorney then examined the ordinance and made minor language changes dealing with redundancy within the document. The City Council tabled the proposed ordinance at their January 14, 2008, meeting in order to allow staff to respond to questions raised by the Council. At this time staff has not proposed any significant policy changes. If the City Council wishes to make these changes, staff recommends adopting an ordinance that will deal with the fundamental issues of the existing code so that the immediate enforcement concerns are addressed, and returning to broader policy questions at a later date, Proposed Chanl!es This memo highlights the changes that have been made to the proposed ordinance since the January 14, 2008 City Council meeting. In addition to the suggestions from the City Council, the proposed ordinance reflects additional review from the City Attorney who suggested grammatical revisions that would reduce redundancy within the ordinance, Definitions The definitions for Recreational Vehicle and Watercraft have been revised to exclude trailers, utility trailers or special purpose trailers, A definition for utility trailers has been added, It reads: Utility Trailer. Equipment used for recreational or utilitarian purposes that can be towed; such as special purpose trailers (i.e. boat trailers, A TV trailers) or other hauling trailers. In addition, throughout the ordinance the words "RV and watercraft" and "Recreational Vehicle and watercraft" were revised to read "RV, utility trailer, and watercraft, The definition for Recreational Vehicle has been revised to explicitly include riding lawn mowers; however for enforcement purposes this does not represent a change in previous City policy. These definitions now read: Height, Recreational Vehicles, Utility Trailers, and Watercraft, The distance as measured from the ground to the highest point of the recreational vehicle, utility trailer, or watercraft, including any covering, as stored. This does not including antennas and utility/mechanical systems provided they are accessory and take up no more than ten (10) percent of the roof surface area. Length, Recreational Vehicles, Utility Trailers, and Watercraft. The distance as measured from end to end of the recreational vehicle, utility trailer, or watercraft, including any hitch, motor, and covering, as stored. Subd. 1 and 2 Staff did not make any significant changes to either Subd, 1 or 2. The City Attorney made several grammar revision suggestions to reduce redundancy and these suggestions were applied, The meaning and intent of the regulations was not affected by these changes, For example, Subd, 2 Paragraph E was revised to be clearer regarding the prohibition ofRV, utility trailer, and watercraft storage in the front yard, It now reads: E. RVs, utility trailers, and watercraft shall not be stored closer to the street than the principal structure or attached garage on the lot where they are stored. Subd. 3 In order to accommodate properties with shorter than 43 foot driveways, both Paragraphs A and B of Subdivision 3 were revised to require that R V s, utility trailers, and watercraft be at least five feet from the curb. In addition, a requirement was added that the RV, utility trailer, or watercraft that is parked in the driveway not block a pedestrian walkway, A five foot clearance should be sufficient for safe sight lines while driving along a street. Subd. 4 Paragraphs B and C were amended to require that RVs, utility trailers, and watercraft be set back from the shoreline rather than the ordinary high water (OHW) mark. The same regulation is listed in Subdivision 2, Paragraph H, and as a residential lot, riparian lots would fall under the purview of that regulation, Options 1. Approve the proposal as submitted, 2. Approve the proposal with changes, 3, Deny the proposal. 4. Table for additional information. A 4/5 vote is required to approve a zoning code amendment. If approved, the Zoning Code amendment will not go into effect until it is published in the February 6,2008, edition of the Shoreview Arden Hills Bulletin, Staff will provide educational information on the website and for the next newsletter to inform residents of the changes. Recreational Vehicles (RV's), The restrictions set out in this section on the outdoor pmking and storage of recreational vehicles is necessary for the peace, health, saf-oty and welfare of the citizens of Arden Hills. Yet it is r-ecognized that there are so many kinds of recreational vehicles and so R'!any shapes and sizes of lots and land parcels within the City, that no matter what restrictions are placed upon their outdoor parking and storage, hardships "vill result to some owners of recreational vehicles and nuisances will result to some non owners. Therefore in an attempt to avoid such hardships and nuisances, a systeR'! for regulating the storage of RV's is hereby established, The unreQulated outside parkinQ and outside storaQe of recreational vehicles, utility trailers, and watercraft within a residential use district is found to create a nuisance, hazard and detrimental influence upon the public health, safety and Qeneral welfare of the community by obstructinQ the view on streets and on private property, brinQinQ noise and odors into residential areas, creatinQ cluttered and otherwise unsiQhtly areas, preventinQ the full use of residential streets for residential parkinQ, reducinQ the useable open space of streets and private property and otherwise adversely affectinQ residential property values and neiQhborhood maintenance and improvement. Subd. 1 General Regulations for RV!s Recreational Vehicles (RVs), Utility Trailers, and Watercraft in All Districts. A. Storage in an Enclosed Structure. RV~, utility trailers, and watercraft of any height or length may be kept within an enclosed structure which othel"\"Iise provided the structure conforms to the underlyina zoning requirements of the district. B. Attachment to Ground Not Permitted. RV~, utility trailers, and watercraft shall be mobile Lind shall not be permanently affixed to the ground in a manner that would prevent removal. RVs and watercraft not permitted to be operated on public streets shall be placed on or in a trailer or motor vehicle. C. D. RV Condition While Stored. ~lo such equipment shall be stored or parked unless it is in condition for safe and effective performanco and is currently licensed. RVs. utilitv trailers. and watercraft shall be stored or parked in a secure, safe. orderlv. and well-maintained condition that does not inhibit emeraencv vehicle access to any property. All RVs. utilitv trailers. and watercraft shall be currentlv licensed. if applicable. and operable at all times. E. Ownership. Pormitted storage shall only be allowed for RVs, utilitv trailers. and watercraft shall be owned by the owner or occupant of the property on which the RV is they are stored. F. RVs. utilitv trailers, and watercraft shall not be permitted on a vacant lot unless in conformance with Section 1325.11. Subd. 2 General Regulations for the Exterior Storage of RV's in Residential Districts. Permitted RV. Utilitv Trailer. and Watercraft StoraQe. Storina RVs, Utilitv Trailers. and Watercraft outdoors is permitted in all residential districts provided that all of the followinQ provisions are met: A. No more than three (3) RVs. utilitv trailers. or watercraft may be stored outside on a residential lot are permitted. RVs and watercraft on a trailer shall be considered as one. B. RVs, utilitv trailers. and watercraft shall not be areater than twentv-eiQht (28) feet in lenath or twelve (12) feet in height. C. RV's less than thirty four (34) foet in lengtl'l may be allol/ied by conditional uce permit in a rear or side yard, with a minimum side and rear yard setback of ten (10) foet, except when such a yard abuts a street, where no parl<ing is allowed. This conditional use permit procedure will allow the unique ciroumstancec of each lot to be considered and the most appropriate storage location determined, RVs. utilitv trailers. and watercraft shall not be stored within the principal structure side yard setback. and shall be at least ten (10) feet from the rear property line. If both side and rear yards are available for storaae. then the location with the least visibilitv from streets and neiahborina property. as determined bv the Zonina Administrator. shall be used for such storaae. E. RV's over seven (7) f-oet in height may be stored anywhere in the buildable portion of a residential lot. RVs. utilitv trailers. and watercraft shall not be stored closer to the street than the principal structure or attached aaraae on the lot where they are stored. F. The owner or occupant of any shoreline lot is permitted to ctore up to three (3) boats or watercraft, in addition to other permitted RV's, pr<Jvided that such boats or 'Natercrafl: 1. Are ctored in locationc permitted for other RV's ac regulated above, except that pormitted boats or 'Nateroraft may alE:o be stored in the required Iakeshore cotback area but not within fifty (50) foot of the water's edge, Lesser lakechore setbacks are pormitted when topographic conditiens, lot configuratien and/or the cize and bulk of the watercraft do not allow the normal fifty (50) foot setback to be met. For purposes of this provision, this permitted lakeshore setback encroachment shall be treated as part of the buildable portion of the lot. Watercraft shall include, but, shall not be limited to, power boats, cruisers, canoes, jet sldc, fiE:hing!hunting boats, pontoon boats and sail boats. RVs. utilitv trailers. and watercraft shall not be 4 stored closer to the principle buildinQ of an adioinina lot than to the principle buildinQ on the lot where they are stored. G. RVs. utilitv trailers. and watercraft located in the side yard and visible from the public riaht of way shall be screened with a six (6) foot privacy fence or landscapina of similar opacity. as determined bv the ZoninQ Administrator. unless they are kept on an improved hard surface. H. Alternative locations for storina a RV. utilitv trailer. or watercraft may be determined bv the Zonina Administrator with an administrative permit for UP to one (1) RV. utility trailer. or watercraft. when topoaraphic conditions or lot confiQuration do not allow for the normal location reaulations to be met and all of the followinQ criteria are met: 1. RVs, utility trailers, or watercraft may not be more than 28' in length or 12' in height. There are limited provisions that would allow a larger RV on your property. Call the City for more information. 4. RVs, utility trailers, or watercraft are not allowed in the front yard 5. RVs, utility trailers, or watercraft stored outside must be owned by the property owner. 6. RVs, utility trailers, or watercraft may not be used for living quarters or connected to utilities. 7, RVs, utility trailers, or watercraft must be currently licensed, well-maintained, and operable. 8, RVs, utility trailers, or watercraft must be stored farther away from the neighbor's house than the house on the lot where they are stored. 9. If RVs, utility trailers, or watercraft are parked in the side yard they must be 10' from the lot line in R-1 Districts, and 5' from the lot line in R-2 or R-3 Districts. Subd. 136 Recreational Vehicles (RVs). Vehicles for recreational or utilitarian uses that can be driven, towed, or hauled. Including, but not limited to, motor homes and travel trailers, snowmobiles, pull campers, riding lawn mowers, all terrain vehicles (ATVs), tent trailers, or other similar vehicles. Subd. 137 Recreational Vehicles, Utility Trailers, and Watercraft, Height. The distance as measured from the ground to the highest point of the recreational vehicle, utility trailer, or watercraft, including any covering, as stored, This does not including antennas and utility/mechanical systems provided they are accessory and take up no more than ten (10) percent of the roof surface area. Equipment used for recreational or utilitarian purposes that can be towed; such as special purpose trailers (i,e, boat trailers, ATV trailers) or other hauling trailers. 1325.12 Recreational Vehicle, Utility Trailer and, Watercraft Outdoor Storage. The umegulated outside parking and outside storage of recreational vehicles, utility trailers, and watercraft within a residential use district is found to create a nuisance, hazard and detrimental influence upon the public health, safety and general welfare of the community by obstructing the view on streets and on private property, bringing noise and odors into residential areas, creating cluttered and otherwise unsightly areas, preventing the full use of residential streets for residential parking, reducing the useable open space of streets and private property and otherwise adversely affecting residential property values and neighborhood maintenance and improvement. Subd.1 General Regulations for Recreational Vehicles (RVs), Utility Trailers, and Watercraft in All Districts. A. Storage in an Enclosed Structure, RVs, utility trailers, and watercraft of any height or length may be kept within an enclosed structure provided the structure conforms to the underlying zoning requirements of the district. B, Attachment to Ground Not Permitted, RVs, utility trailers, and watercraft shall not be permanently affixed to the ground in a manner that would prevent removal. RVs and watercraft not permitted to be operated on public streets shall be placed on or in a trailer or motor vehicle, C, Use, RVs, utility trailers, and watercraft shall not be used for temporary or permanent living, sleeping or housekeeping purposes, RVs and watercraft shall not be connected to sewer, water, or other utilities, unless otherwise permitted in Section 1325,12 Subd. 3B, D, Condition While Stored. RVs, utility trailers, and watercraft shall be stored or parked in a secure, safe, orderly, and well-maintained condition that does not inhibit emergency vehicle access to any property, All RVs, utility trailers, and watercraft shall be currently licensed, if applicable, and be operable at all times. E, Ownership, RVs, utility trailers, and watercraft shall be owned by the owner or occupant of the property on which they are stored, 2 F, R V s, utility trailers, and watercraft shall not be permitted on a vacant lot unless in conformance with Section 1325, II. Subd.2 Permitted RV, Utility Trailer, and Watercraft Storage, Storing RVs, utility trailers, and watercraft outdoors is permitted in all residential districts provided that all of the following provisions are met: A. No more than three (3) RVs, utility trailers, or watercraft are permitted, Not more than one (I) of the three (3) may be a motor home, travel trailer, camper, or other similar type of RV. RVs and watercraft on a trailer shall be considered as one. B. RVs, utility trailers, and watercraft shall not be greater than twenty-eight (28) feet in length or twelve (12) feet in height. C, One (I) motor home, travel trailer, camper, or other similar type ofRV that is greater than twenty-eight (28) feet, but not larger than thirty-four (34) feet, in length is permitted in the rear yard provided that all of the following criteria are met: 1. The RV meets the requirements of Section 1325,12 Subd, 2, D, E, and F, 2, The rear yard is fully enclosed by a six foot privacy fence or is substantially screened from adjacent properties as determined by the Zoning Administrator; which may include fencing, vegetation, or both, D, RVs, utility trailers, and watercraft shall not be stored within the principal structure side yard setback as required in the underlying zone, and shall be at least ten (10) feet from the rear property line. If both side and rear yards are available for storage, then the location with the least visibility from streets and neighboring property, as determined by the Zoning Administrator, shall be used for such storage, E. RVs, utility trailers, and watercraft shall not be stored closer to the street than the principal structure or attached garage on the lot where they are stored. F. RVs, utility trailers, and watercraft shall not be stored closer to the principal building of an adjoining lot than to the principle building on the lot where they are stored, G. RVs, utility trailers, and watercraft located in the side yard and visible from the public right-of-way shall be screened with a six foot privacy fence or landscaping of similar opacity as determined by the Zoning Administrator, unless they are kept on an improved hard surface. 3 H, Alternative locations for storing a RV, utility trailer, or watercraft may be determined by the Zoning Administrator with an administrative permit for one (1) RV, utility trailer, or watercraft, when topographic conditions or lot configuration do not allow for the norma110cation regulations to be met and all ofthe following criteria are met: 1, It is at least three feet from the side or rear property line; 2. Short-Term Parking with Permit. Administrative permits for a period of up to seven (7) days, renewable once during a twelve (12) month period, may be obtained from the Zoning Administrator that would permit a licensed and operable RV, utility trailer, or watercraft to park in the driveway, provided it is not within five (5) feet of the curb and does not encroach upon a pedestrian walkway. This permit would allow a motor home or other similar vehicle to be connected to water and electricity. Subd. 4 Riparian Residential Lots, A, In addition to RV, utility trailer, and watercraft storage permitted by Section 1325,12 Subd, 2, the owner or occupant ofa riparian lot is permitted to store two (2) additional watercraft, B, RVs and utility trailers shall not be stored within fifty (50) feet of the shoreline, C.
