Staff requests the City Council and Planning Commission discuss the drafts and provide comment and feedback back to staff. In addition, staff is requesting further direction on specific items to be discussed at the work session. Backl!round Staff has been directed by the Planning Commission and City Council to examine the current zoning eode regarding tree preservation. Currently the City has few regulations dealing with tree loss and tree replacement. Staff was asked to draft a tree preservation ordinance that would better handle tree loss and mitigation within the city. In response to this request, staff has examined a number of tree preservation ordinances throughout the metropolitan area. In addition, local and national sources have been consulted that offer potential best practices on developing a tree preservation ordinance. Staff met with the Planning Commission, the City Council, and the PTRC to discuss the goals and objeetives of a potential Tree Preservation Ordinance in Arden Hills. Based on this researeh, and meetings with other City staff and the City Attorney, Staff has drafted a Tree Preservation Ordinance and is requesting feedbaek from the City Council and Planning Commission. While tree preservation regulates what can be removed from a property, landseaping requirements regulate what can and should be planted. Staff found that there were opportunities to improve the City's existing landscaping requirements. Currently, the City's landscaping requirements are somewhat vague and spread throughout the Code. Staff is proposing amendments to the landscaping requirements and suggesting reformatting the requirements so that they are compiled together in Seetion 1325.05, the Design Standards section of the Zoning Code. Staff is also suggesting minor revisions to other subdivisions within Section 1325.05, such as screening and fencing regulations. Attached is a draft of these ehanges and new regulations. Staffhas included Section 1325.05 in its entirety to highlight the reorganization that is required. Staff met with the Planning Commission at a work session on February 6, 2008 to discuss the draft ordinanees. The Planning Commission provided excellent feedback, and staff has incorporated their comments in these updated drafts. In addition, both draft ordinances were sent to the City Attorney for review. While additional review with the City Attorney will be neeessary, his initial reaetion was that both ordinances are within the authority of the City to regulate. Tree Preservation and Landscaue Requirements The development of a tree preservation ordinance is closely impaeted by a need for balance within the regulations. While tree preservation and landscaping requirements provide added beauty, increased value, and improved environmental conditions, there is also a cost. Trees and landscaping take up space within a property, which reduces the buildable area and space for parking. Trees and other landscaping can also be expensive to install and maintain. Additionally, adopting regulations that are too restrictive or onerous eould hamper future development and redevelopment, which would have a long-term impact on property values. An effective and enforeeable ordinance will have regulations that address this balanee and provide for the property owner as well as the eommunity as a whole. Staff would also like to make clear that both the landscaping and tree preservation ordinances deal primarily with property owners that have come to the City seeking building or grading permits. These ordinances are not designed to address those properties on which no development is being proposed, with the exception of clear cutting, which is proposed to be prohibited on all parcels. Additionally, the draft tree preservation ordinance regulates that trees removed unnaturally within two years prior to a development application are counted as if they were present on the site at the time of the application. Staff recognizes the limitations of this regulation; however, it is in place to prohibit the most egregious cireurnstances where a developer removes trees prior to submitting an application. The tree preservation ordinance is not designed to prohibit the cutting of any trees. By requiring that a percentage ofremoved trees be replaee, regulating the type and size of the replaced trees, and allowing preserved trees to count towards landscape requirements, the City can effectively promote tree preservation and tree stock diversity with replacement trees. With this in mind, staff is requesting the City Couneil and Planning Commission discuss the draft ordinances for Design Standards and Tree Preservation. Staff would like feedback on the regulations. In addition, there are a few issues that staff requests further discussion and feedback from the Council and Commission on. These are: 1. Expanding uses versus new construetion. If the owner of an existing development wants to expand, is it appropriate to require the property to meet the same landscaping requirements as a new development? If the property is deficient in landseaping under the new code, does an expansion then require the property to meet the full code regardless of the size of the expansion? Is it possible that these requirements would discourage a property owner from expanding or remodeling? 2. What is an appropriate mitigation rate for tree replacement, taking into account space within a site and need for building pads, parking areas, and construction aceess? If a property needs to remove a significant tree, what is the proper replacement? 3. Should property owners be able to give the City cash in lieu for trees that are required for mitigation, but do not fit on the site? Funds from this fee would be restricted in their use; however, the City could use funds for tree maintenance, buckthorn removal, and tree planting elsewhere in the City, among other things. Options It is not necessary to make a motion or come to an agreement on the exact content of a tree preservation or landscape ordinance at this time. Staff is only requesting guidance. Our qoal is to require a tree preservation plan even when no development is proposed. but a larqe amount of trees are to be cut). 4) A plat or minor subdivision. 2 B. Tree Preservation Plan Submission Requirements. A Tree Preservation Plan must include a tree survev certified bv a reqistered land survevor. landscape architect. or forester. See Appendix A for details on the requirements of a Tree Preservation Plan. Proiects on residential sites of fewer than two lots are not required to have tree survevs certified. Applicants are encouraqed to consult with citv staff concerninq preservation of protected trees before developinq a Tree Preservation Plan. C. Review Process. The tree preservation plan shall be reviewed bv the citv to assess the best possible lavout to preserve siqnificant trees and to enhance the efforts to minimize damaqe to siqnificant trees. The applicant shall meet with citv staff prior to submission of the development application or prior to application for the qradinq permit. whichever is sooner, to determine the most feasible and practical!Jlacement of buildinqs. parkinq, drivewavs. streets, storaqe and other l)hvsica.lfeatures. in order that the fewest siqnificant trees are destroved or damaqed. Subd.3 Performance Guarantee. A. Anv applicant required to submit a tree preservation dla.~;shall provide the required performance quarantee followinq preliminarv aporoval of the tree preservation plan and prior toanv construction and/or qradinq to insure completion and maintenance of all landscapinq and trees in accordance with thea.pproved tree preservation plan required hereunder. Where this is not done. the city, at its sole discretion. mav use the broceeds of the performance quarantee to accomplish performance. U:Subd. 4 Compliance with Plan. The applicant shall implement the tree preservation ola.n prior to and'durinq anv construction. The tree protection measures shall remain inbla.ce until allqradinq and construction activitv is terminated. A.Tree Removal Prior to Approval.
