SUBJECT: Majority voting when three Council members are present
I presented the Council with a brief memo on this topic at your February 19 meeting. The
Council requested that I draft a policy to address the issue when only three members are present
and voting, specifically when an important and/or controversial issue is to be voted upon.
Your present Code provides in Section 2l0.04, Rules and Procedures, Subd. 5, Voting Generally,
the following language:
" Except as otherwise provided in this Code, or when a different vote is required by law,
a majority vote of those present shall be sufficient to approve any question posed to the
Council. " [emphasis added]
Based upon your comments at the February 19 meeting, the Council may wish to consider an
administrative policy that provides essentially the following:
"In the event that only three Council members are present and voting on a question
before the Council and providing that the question is deemed by at least one Council
member to be important and/or significant in terms policy implications, the question will
be deferred to the next Council meeting. "
