Flaherty Arden Bowl's original liquor license and proposed amendments ~ ~ EN HILLS MEMORANDUM DATE: May 5, 2008 TO: Mayor and City Council FROM: Dave Scherbel, Building Official Meagan Beekman, Planner I SUBJECT: Flaherty's Liquor License Amendment Background Flaherty's Arden Bowl has requested to amend their 2008 Liquor License to allow for the consumplion of alcohol in an enclosed outdoor patio area. The area proposed is adjacent to the establishments existing lounge, at the southwest comer of the building. The area is currently covered with 1,140 square feet of concrete and 308 square feet of grass. (Attachment A). A three foot high wrought iron fence will be constructed to enclose the concrete area and some of the grass area. Tables and chairs would be placed on the concrete portion of the patio and food and beverage service would be provided to patrons sitting at the tables. Flaherty's is currently paying the maximum amount for their Liquor license, which is based on a alcoholic beverage service area of 4,000 square feet or more, so no additional fee's are required. The applicant has submitted an amendment to their original liquor license application and a site plan indicating the service area to be added. Staff Review The City Attorney has reviewed this application and found that the City's existing liquor ordinance permils outdoor consumption of alcoholic beverages, as long as the service area is included in lhe square footage indicated on the establishments liquor license application, and the license fee is adjusted to reflect this additional square footage. According to the City Attomey, in the event that an outdoor service area is not included on an establishments' liquor license application, and the establishment wishes to add an outdoor service area, an amendment to the liquor license application is required. \\tvlctro-jnCI.us\ardcllhil]s\Building\~'lcmos\F]ahcrlY's liquor License alllcndmcnt.DOC The Assistant Planner has also reviewed this application and found that the outdoor patio area meets all of the City's Zoning Code requirements. The proposed patio area will not impact impervious coverage or setbacks, and complies with all fence regulations. She did note that a fence permit would be required to install the fence. In regards to the B-2 Development Moratorium, the proposed plans do not conflict with the restrictions of the moratorium, as no building expansion is being proposed. Flaherty's Arden Bowl is proposing some alterations to the building face that include moving a window and exit door to better accommodate the patio area. These changes will require a building pell11it, but meet the requirements of the design guidelines enacted by the City Council in the B-2 District and, therefore, do not require a Conditional Use Permit or Amendment. City Staff is currently working on updating and recodifying the City's Liquor Ordinance; however, since the CUITent ordinance permits outdoor consumption in designated patio areas, the recodification is not anticipated to impact this application. As part of the recodification process, City Staff is working on updating the liquor license application as well to better meet the requirements of the ordinance. Recommendation The proposed liquor license amendment is in compliance with the City's current Liquor Ordinance. The proposed patioare and building improvements meet the requirements of the City's Zoning Code. Based on this, City Staff recommends approval of Flaherty's Arden Bowl's request to amend their liquor license application to expand the licensed alcoholic beverage service area to include the enclosed outdoor patio.
