Backl!:round Mounds View Public School District is proposing to construct a baseball field in the southwest comer of the Mounds View High School property (Attachment C). As part of this application they are proposing to construct two dugouts which would have a footprint of 576 square feet together, with a roof area of 633 square feet, and a safety fence that would surround the ball field and range from eight feet to twenty-five feet in height. The ball field would be located on what is currently a soccer field. The ball field would be used only during the baseball season. During the baseball off-season the fence and field would be disassembled and used for soccer and football as it is now. No lighting is being proposed with this application request. According to the applicant the ball field will serve the needs of existing baseball teams already associated with the school and currently practicing off-site. This project wiII not increase the number of students at the school. School staff then met twice with neighbors and worked out a number of conditions that would address their concerns. These were presented at the May 7, 2008 meeting. During the public hearing residents spoke in support of the proposed conditions and overall proj ect. Findinl!s of Fact The Planning Commission offers the foIIowing sixteen findings offact for the City Council's consideration General Findings: I. The applicant is proposing to construct a baseball field, two dugouts, and related fencing. 2. Mounds View High School operates under a Conditional Use Permit in the R.l Zoning District. 3. The proposed baseball field was not included on the Master Plan approved in Planning Case 84-001. A CUP amendment is required to include the proposed baseball field. 4. Athletic fields are permitted under the original CUP for Mounds View High School. 5. The proposed dugout structures wiII not exceed the lot coverage limits for the property. 6. The proposed baIl field and dugout structures meet all setback requirements. 7. The applicant is not proposing to remove any vegetation from the site. 8. The proposed fence exceeds the six foot height regulation in the zoning code. 9. The use ofthe site as a school is an unusual circumstance in the R-l District. 10. The proposed fence height is required to maintain safety. On the Conditional Use Permit Amendment: 11. The proposed proj ect may impact traffic or parking conditions in the adj acent neighborhood; however, this is anticipated to be minimal since no change in the school population is expected and games would take place during off hours. 12. The proposed proj ect will not produce any permanent noise, glare, odors, vibration, dust, smoke, air pollution, heat, liquid, or solid waste. Temporary noise and dust may be created during construction. 13. The project will not impact storm water runoff since impervious surface is not significantly increased and no grading is taking place. 14. The proposed project is not expected to have any impacts on school population or density. 15. The park dedication fee is not applicable to this application. 16. The proposed project does not conflict with the City's Comprehensive Plan or the intent of the Zoning Code. City of Arden Hills City Council Meetingfor May 27,2008 \\Metro~inet.us\ardenhills\PlanninglPlanning Cases\2008\08~Oll MVHS CUP Amendment (PC Approved) \052708 - CC Report - MVHS CUP Amendment.doc Page 2 of 4 Recommendation The Planning Commission reviewed Planning Case 08-011 and unanimously recommends approval (6-0) of the Conditional Use Permit Amendment based on the findings of fact and the submitted plans as amended by the following fifteen conditions: 1. The applicant shaII continue to abide by the conditions of all previous permits and revIews. 2. The project shall be completed in accordance with the plans submitted as amended by the conditions of approval. Any significant changes to these plans, as determined by the City Planner, shall require review and approval by the City Council. 3. Building Permit Plans shall be submitted to the Building Official a minimum of two (2) weeks before the planned start of construction. 4. The project shall meet all ADA requirements. 5. The applicant shaII obtain all necessary permits from the Rice Creek Watershed District, MPCA, and other govemmental entities and provide the City with copies of such permits prior to the City issuing any building permits. 6. The ball field shall not be illuminated by any artificial means, now or in the future. 7. The School shall be responsible for locking the rear gate near the field from 2:30 to 5:30 in the evening on game days. 8. The School shaII communicate to the basebaII team, parents, and boosters of appropriate ingress and egress to the field. 9. The District shall provide signage at the site to identify appropriate parking and field access. The signage shall be subject to City Planner approval prior to installation. 10. The District shaII add a hood on the backstop to avoid foul balls. 11. If foul baIls are a problem after construction is completed, the District shall work with the City and the neighbors to find appropriate solutions. The District shall implement the solutions as determined by the City. 12. The demountable outfield fence shall be stored near the home bleachers at the football stadium. 13. The mound and home plate area shall have a tarp on during times the field is not in use. 14. The District shall repair and vandalism that occurs immediately upon notification. 15. The dugouts shall be patrolled by security on home football game nights. Options 1. Approve the proposal as submitted. 2. Approve the proposal with conditions. 3. Deny the application with reasons for denial. If the City denies the petitioners request, "...it must state in writing the reasons for the denial at the time it denies the request." 4. Pursuant to Minnesota State Statutes, the City provided written reasons for an additional 60 day review period. The City must act on this request by July 4,2008 (120 days), unless the City, with the consent of the applicant, extends the review period beyond the initial 120 days. PLANNING CASE #08-011- CONDITIONAL USE PERMIT AMENDMENT; MOUNDS VIEW HIGH SCHOOL- PUBLIC HEARING Ms. Beekman reported that the applicant submitted a Conditional Use Permit Amendment to construct a baseball field and safety fence in the southwest comer of the Mounds View High School property. She then provided background information and said Staff recommends approval subject to the following five conditions. 1. The applicant shall continue to abide by the conditions of all previous permits and reviews. 2. The project shall be completed in accordance with the plans submitted as amended by the conditions of approval. Any significant changes to these plans, as determined by the City Planner, shaII require review and approval by the Planning Commission. 3. Building Permit Plans shall be submitted to the Building Official a minimum of two (2) weeks before the planned start of construction. 4. The project shall meet all accessibility code requirements. 5. The applicant shall obtain all necessary permits from the Rice Creek Watershed District, MPCA, and other governmental entities and provide the City with copies of such permits prior to the City issuing any building permits. Chair Larson opened the floor to Commission questions. Commissioner Thompson inquired about the phone calls from neighbors. Ms. Beekman stated the calls were in regards to the traffic during construction and to spectators parking on the residential streets and then walking across the yards to the baseball fields. Commissioner Zimmerman inquired if walking across the fields is currently a problem to access the soccer fields. Ms. Beekman stated that one resident stated that it isn't currently a problem. Commissioner Holewa inquired ifthere is a path to the soccer fields. Ms. Beekman stated that currently spectators park in the school parking lot and then walk across the athletic field to the soccer fields. Chair Larson described the location of a paved walkway on the property between the stadium and the fence. Commissioner Holewa inquired about the location of where baseball is played currently. Ms. Beekman stated that they currently playoff site. Commissioner Holewa inquired if there would be a request for stands or bleachers in the future. Ms. Beekman stated that if the school would like to put temporary bleachers that are less than five levels, it wouldn't require a building permit. Commissioner Modesette inquired about the plans for bleachers and the expected amount of spectators. Larry Wacker, Sanders, Wacker, Bergerly, Inc. consultant, stated that there aren't any current plans for the bleachers, but it would be something for the future. Julie Wikelius, Mounds View High School principal, stated that current attendance tends to be about 50 to 100 fans at the high school baseball games. Commissioner Zimmerman inquired about the number of soccer fields currently on site. Mr. Wacker stated that there are three and the removable fence would aIIow all of the soccer fields to be utilized. Commissioner Zimmerman stated that the permanent fencing would remain and inquired about the safety of it. Mr. Wacker stated the distance from the edge of the soccer field is about 30 feet away from the permanent structure of the baseball field. Commissioner Modesette stated that there is a 6- foot fence that separates the residents from the fields. She inquired ifthere is a path south of the baseball fields. Mr. Wacker demonstrated the location of the existing fence and its gate. He stated it is used by students for access to school. He stated that he understands that there has been a request from residents to close or lock the gate during games. Commissioner Modesette inquired about the type of easement in that location. Mr. Wacker stated that he thinks it is a utility easement. Commissioner Zimmerman inquired if the field would also be used for the girls' softball team. Mr. Wacker stated that it would not be. Commissioner Modesette inquired about the base ofthe demountable fence. Mr. Wacker stated that it is placed on sleeves in the ground. He stated that when the fence isn't in the ground, the sleeves would be capped. He stated the size of the sleeve is similar to an irrigation cap and would be flush to the ground. Commissioner Modesette inquired if soccer fields are typically irrigated throughout the field. Mr. Wacker stated that they are typically irrigated because of the wear on the grass. He stated that they are set up on a grid system across the field. Commissioner Modesette inquired about the distance between the posts. Mr. Wacker stated that they are about 20 feet. He stated it may be possible to put a soft cushiony material on the cap, but it wouldn't be durable. Commissioner Zimmerman inquired ifthe caps would be even with the surrounding surface. Mr. Wacker stated that they would be close to the root mass of the grass. Commissioner Zimmerman inquired about the diameter. Mr. Wacker stated they are 2 Y, inches. Commissioner Zimmerman inquired ifthere are any drainage issues in that location of the field. Mr. Wacker stated there aren't and the area is very porous. He stated that there is infrequent drainage off of the field. Commissioner Modesette inquired ifthere is a plan to close or lock the gate during the games. Mr. Wacker stated he spoke with the school and they indicated that they would be willing to lock and unlock the gate. Commissioner Holewa inquired about where the fencing will be stored. Mr. Wacker stated that the panels will be stacked and stored on site. Chair Larson opened the public hearing at 6:53 p.m. Chair Larson invited anyone for or against the application to come forward and make comment. Tim O'Malley, 1851 Gramsie Road, stated that he has lived in this location for about 20 years and they have had a good relationship with the school. He stated that he is concerned about the placement of the stadium. He stated he is also concerned about the parking and traffic. He stated there used to be 3 baseball fields near the proposed area, which resulted in a lot of foot traffic. He stated the easement is a utility easement that adjoins his property. He stated when the fence was constructed he requested that there be a gate placed in the fence for the neighbors to use the fields. He stated that he doesn't think it is practical for the gate to be locked prior to and during games. He stated he is concerned about foul balls coming into his yard, dust, and wheelchair accessibility. He stated the location will be hard for spectators to access. He stated if the field is located at the other end, it would be closer to the concession stands and restrooms. Commissioner Holewa inquired ifMr. O'Malley would be in favor of eliminating the gate. Mr. O'Malley stated that he wouldn't because the gate is mutually beneficially. He stated it is nice for the neighborhood kids to have access to the fields, which he doesn't mind. Commissioner Modesette stated that the trade-off is to eliminate the gate or it wouldn't be open to the public. Mr. O'Malley stated that if the field were moved, then there wouldn't be a need to eliminate the gate. Chair Larson stated that it isn't pleasant to play on the soccer fields when there is a baseball field there. Mr. O'Malley stated that the soccer fields are great. Chair Larson inquired if Mr. O'Malley would be in favor offencing offthe entire property. Mr. O'Malley stated that he wouldn't be, but he doesn't want to have large crowds walk on his private property. Chair Larson stated that it is hard to know how many people wiII walk through the area with the gate. Mr. O'Malley stated that for him personally, it wouldn't matter if it were to be closed, but it is safer for the neighbor kids to walk through the gate instead of on the roads. He stated he would like the gate to be locked during the games. He stated that he would like the school to direct the other teams about the location of the proper place to park. Chair Larson inquired if Mr. O'Malley has experienced any other problems with Mounds View High School. Mr. O'Malley stated that they have had other problems and the school has tried to be responsive. Commissioner Holewa inquired about where the cross-country teams have been running. Mr. O'Malley stated that they run on the utility easement. He stated his understanding is that the utility easement doesn't give people the right to walk on his property. Commissioner Zimmerman inquired ifthere will be a charge to attend the games. Ms. Wikelius stated that there will be a charge. Commissioner Zimmerman stated that ifthere was a charge, then the school would need to lock the gate in order to prevent people from accessing it for free. Commissioner Stodola inquired ifMr. O'Malley still has a key to the gate. Mr. O'Malley stated that it hasn't been locked in several years. He stated that he didn't think that him locking it was the neighborly thing to do. Commissioner Stodola stated that ifthere was a game going on and there was an issue, he would have a key to go and lock the gate. Jim Hanton, 3947 Rolling Hills Road, stated he agrees with Mr. O'Malley's statements. He stated he thinks the fences will be stored near the 6- foot separation fence. He stated that would mean that they would be visible to the neighbors. He stated in the past the football equipment was stored there. He stated the permanent dugouts may provide a place for the kids to graffiti or smoke. He stated he thinks the infield should be located closer to the school. Commissioner Holewa inquired about Mr. Hanton's thoughts on the gate. Mr. Hanton stated that the kids don't come across his property and he doesn't feel the impact of it. He stated the gate is beneficial for the neighborhood kids. He stated he doesn't like the idea of spectators driving into the neighborhood and accessing the fields through the gate. He stated that he wonders ifthere will be a request for lighting in the future, which would be near their backyards. Steve Wraneschetz, 3947 Rolling Bills Road, stated that locking the gate during the baseball games for a year may be a way to find out how it is received. Commissioner Holewa inquired about Mr. Wraneschetz's thoughts on locking the gate. Mr. Wraneschetz stated he thinks the gate should remain and then try locking it fuII-time for the year. Greg Schneider, 1774 Gramsie Road, stated he has had a good relationship with the school. He stated the school has tried to communicate with the neighbors about various things in the past. He stated when his children were small, they used the recreation fields. He inquired if it is possible to move the baseball fields closer to the school. He stated he likes the idea of bringing the baseball fields back to the school. He stated it is a long distance from the parking lot to the baseball fields. He stated the proposed location wiII create traffic and parking Issues. Chair Larson stated that it isn't something the Planning Commission can dictate. He stated that they could deny the application and then the school could come back with a proposed new location. Mr. Schneider inquired if the Planning Commission knew the reason the high school wants to build the baseball field in that location. Chair Larson stated that they would have to ask Mr. Wacker about it. Mr. Schneider stated that there are cars parked in front of their houses during the football games. He stated he knows that other neighbors aren't in favor of people walking across their yards. Chair Larson inquired if Mr. Schneider would be in favor of fencing around the entire field and closing the gate. Mr. Schneider stated that the issue isn't the fencing, but it is the location of the field, which doesn't make practical sense. He stated he would like the neighborhood to be able to sit down with the school and discuss the location ofthe field. Commissioner Thompson inquired about the issue of parking during the football games noting that if the baseball field were relocated to be closer to the high school it would be in near proximity to the football field and parking may stiII be an issue. Mr. Schneider stated that there is a larger crowd for the footbaII games. Chair Larson inquired if the people who park on Gramsie avoid paying admission to the football games. Mr. Schneider stated he didn't know. Commissioner Modesette inquired about the nature of the communications from the school. Mr. Schneider stated he thinks that they have had mutuaIIy beneficial communications. He stated that this issue didn't have the Same communication. He stated it appears to be a good idea to have a look at the location. He stated the dugouts usually attract problems. He stated that he is wondering if the school wiII want lights next and ifthey could be prohibited. Mr. O'Malley stated that he misunderstood the role the Planning Commission could take on the design of the fields. He requested the Planning Commission table the item so the residents and the school would have a chance to discuss the concerns. Chair Larson stated the options the Planning Commission Can take are to approve, deny, or table the application. He stated they could add conditions such as fencing the entire field. Mr. O'Malley inquired if the Planning Commission could add a condition to affect any portion of the plan. Chair Larson stated that they could within reason. Mr. O'Malley inquired if they could add a condition to move the field by the school. Chair Larson stated that they couldn't do that. Council Member Grant stated that the Planning Commission could deny the application and then the applicant could appeal it to the Council. Chair Larson stated that he thinks denying the application based on the location of the field would be detrimental to the neighborhood. Ms. Beekman stated that the Planning Commission Can add conditions to mitigate concerns. She stated that moving the field would be a substantial change from the proposed plans. She stated that moving the location ofthe field would require the applicant to withdraw the application and resubmit it or the Planning Commission could choose to deny it and then it would move on to the City Council. Mr. O'Malley stated he would like to have the Planning Commission table the item. He stated that in the past when there was graffiti he would call the school and they would address it immediately. Mr. Schneider stated that he would also like the item to be tabled. Mr. Wacker stated that the reason the field is proposed for that location is to keep the north end ofthe field open for other activities; to keep the soccer fields as they have been historically; and because of the preferable angle of the sun for the baseball games. Chair Larson inquired if they have discussed fencing the facility. Mr. Wacker stated that fencing the entire field hasn't been discussed and the entire baseball area is fenced. He stated it would have gates that could be locked to prevent people from accessing the interior of the field. Commissioner Holewa stated that it would make sense to have the person who is collecting money be able to lock the fence. Ms. Wikelius stated that there would be a system set up to collect the fees. She stated there is a system set up for the double gates near the football field to eliminate a way to access the game without paying. Chair Larson inquired ifthe people parking on Gramsie have access to the football games without paying the fees. Ms. Wikelius stated that the gate is adjacent to the school. She stated that the people who park on Gramsie need to walk around to enter the football stadium. Commissioner Modesette inquired about the location of the concession stand and the ticket taking area for the football field. Ms. Wikelius demonstrated the location of these. Commissioner Holewa requested that the message be heard by the school that the relationship between the school and the community has been good and they would like it to continue. Ms. Wikelius stated that she has heard that message and the school also values the relationship. Commissioner Stodola inquired if the school has explored all of the options for the location of the field or if some of the concerns that have been expressed could be further considered. Ms. Wikelius stated that she has a high degree of confidence that they can address communicating with the community and their opponents' community about how to enter the fields. She stated they would be in favor of creating signage to identify the location of parking. She stated that attendance at the football games is between 3,000 to 5,000 spectators. She stated that the attendance at the basebaII games would not be that high. Mr. Wacker stated that he thinks with the proposed fencing is safe for the foul balls. He stated the dust from the in-fields is specified and wind can kick up the dust. He stated there haven't been accommodations for wheelchairs at this time, but it can be discussed. He stated that there are 64 parking stalls in the lot, which would provide adequate parking. Commissioner Zimmerman inquired if it would be possible to tarp the in-field when it is not in use. Mr. Wacker stated it is common to tarp the pitcher's mound and home plate and it could be discussed. Commissioner Zimmerman stated the height and length of the fence is the standard. He inquired ifthere have been any studies done about their adequacies. Mr. Wacker stated that he wasn't aware of any. Commissioner Zimmerman inquired if the school would consider additional netting ifthere was a problem with foul balls. Ms. Wikelius stated that iffoul balls prove to be a problem, they would explore other options. Commissioner Zimmerman stated that the parking on Gramsie will need to be addressed to control access. Commissioner Modesette inquired if Ms. Wikelius could dictate where the fencing would be stored. Ms. Wikelius stated that she would work with the activities director on the location of the storage to address the residents concerns. Commissioner Holewa inquired if there has been any thought about the location ofthe facilities in relationship to the baseball field. Mr. Wacker stated that the facilities weren't a high priority when considering the location. Commissioner Holewa inquired about the location of the parking. Mr. Wacker demonstrated the location. Commissioner Holewa inquired about the dugouts during the off-season. Mr. Wacker stated that they are masonry blocks with chain link fencing. Commissioner Holewa stated he is concerned about the activities that teenagers may do in the dugout. Ms. Wikelius stated that she thinks they will need to discuss it and explore ways to have it be secure. She stated that there are cameras throughout the school and the property and it may be a possibility to have them in that location. Commissioner Modesette inquired about temporary restrooms. Ms. Wikelius stated that portable restrooms would be placed near the fields. Commissioner Modesette inquired ifthere is access to the fields by a road. Ms. Wikelius stated that there is access. Commissioner Stodola inquired ifthere would be a benefit for the application to be tabled given the nature of the concerns. Ms. Wikelius stated that there has been a lot of consideration for the location of the field. She stated that they could help people understand how the school came to the decision when they chose the location. Commissioner Modesette inquired about the location of the previous baseball fields. Ms. Wikelius stated that she isn't sure. Mr. Wacker demonstrated the location of one ofthe fields, but he wasn't aware of the other two fields. Commissioner Modesette inquired if there was a plan to bring the baseball fields back at the time they were eliminated. Ms. Wikelius stated that the school had the opportunity to work with Ramsey County to create additional soccer fields. She stated that the team has not had a home field and have been playing in Vadnais Heights. Commissioner Zimmerman inquired ifthe chain link fence in front ofthe dugouts could have additional removable fencing to secure the dugouts when they are not in use. Mr. Wacker stated that there are gates on the dugouts and they could be secured. Mr. O'Malley stated he appreciates the Planning Commission's patience in considering the decision. He demonstrated how people access the footbaII games and the locations of the previous baseball fields. He stated he doesn't think that the fields are used often for P.E. or practice for other sports. He stated that the way the sun sets there would be another alternative for the location ofthe field. He stated he thinks the dugouts could cause a problem and accessing the parking stalls would be difficult. Mr. Schneider stated it would be helpful for the neighborhood to learn more about the 20 foot fence, the design of the dugouts, portable restrooms, concession stands and lighting. Chair Larson closed the public hearing at 8:10 p.m. Commissioner Holewa moved, seconded by Commissioner Modesette, to table Planning Case #08-011 for a Conditional Use Permit Amendment at 1900 Lake Valentine Road: for three specific reasons: access, security, and the community. Commissioner Holewa stated that he is stiII unclear about the access and control of the gate during the games. He stated he is concerned about the security of the dugouts. He stated that the community would really like to have a discussion with the school. Commissioner Zimmerman inquired if the entire baseball field is irrigated. Mr. Wacker stated that they would need to remove the sprinkling system and change it. Commissioner Zimmerman inquired ifit would be the same amount of work to move the sprinkling system regardless of the location of the baseball field. Mr. Wacker stated that reconfiguring the irrigation system would be similar work. Commissioner Zimmerman inquired ifthere was a plan for not sprinkling the baseball field in the proposed location in anticipation of it being built. Mr. Wacker stated that there wasn't a plan to not sprinkle that area. Commissioner Thompson stated she concurred with Commissioner Holewa. She stated that she thinks there needs to be a specific condition stating that lighting wiII not be included. She stated the security of the dugouts should be brought forward. She stated the issues about the gate and access to the fields need to be addressed. She stated she would like to see specific plans for the storage of the fence. Commissioner Modesette stated that the accessibility for wheelchairs and other access should be included. Chair Larson stated that it is a condition that is enforced by the Building Department and the Department of Justice. He stated it is not a condition that is enforced by the Planning Commission. Commissioner Modesette stated that the accessibility needs to be addressed because there are regulations. Commissioner Zimmerman stated that it would be appropriate to have handicap parking in the parking lot. Chair Larson stated that the Planning Commission would like the applicant to come back with further information about the field location; the possibility of lighting in the future; the security of the facility and dugouts; and the storage of equipment. He stated that the community would also like to have a neighborhood meeting. The motion carried unanimously (6-0). Draft Planning Commission Minutes from May 7, 2008 A. PLANNING CASE #08-011 - CONDITIONAL USE PERMIT AMENDMENT; MOUNDS VIEW HIGH SCHOOL- PUBLIC HEARING Ms. Beekman reported that the applicant submitted a Conditional Use Permit Amendment to construct a baseball field and safety fence in the southwest comer of the Mounds View High School property. She then provided background information and said Staff recommends approval of Planning Case #08-0 I I for a Conditional Use Permit Amendment to construct a baseball field, two dugouts, and related fencing at Mounds View High School subject to the following conditions. I. The applicant shall continue to abide by the conditions of all previous permits and reviews. 2. The project shall be completed in accordance with the plans submitted as amended by the conditions of approval. Any significant changes to these plans, as determined by the City Planner, shall require review and approval by the Planning Commission. 3. Building Permit Plans shall be submitted to the Building Official a minimum of two (2) weeks before the planned start of construction. 4. The project shall meet all ADA requirements. 5. The applicant shall obtain all necessary permits from the Rice Creek Watershed District, MPCA, and other governmental entities and provide the City with copies of such permits prior to the City issuing any building permits. 6. The ball field shall not be illuminated by any artificial means, now or in the future. 7. The School shaII be responsible for locking the rear gate near the field from 2:30 to 5:30 in the evening on game days. 8. The School shall commnnicate to the baseball team, parents, and boosters of appropriate ingress and egress to the field. 9. The District shall provide signage at the site to identify appropriate parking and field access. The signage shall be subject to the City Planner approval prior to instaIIation. 10. The District shall add a hood on the backstop to avoid foul balls. 11. If foul baIls are a problem after construction is completed, the District shaIl work with the City and the neighbors to find appropriate solutions. The District shaIl implement the solutions as determined by the City. 12. The demountable outfield fence shaIl be stored near the home bleachers at the footbaIl stadium. 13. The mound and home plate area shaIl have a tarp on during times the field is not in use. 14. The District shaIl repaIr and vandalism that occurs immediately upon notification. 15. The dugouts shaIl be patroIled by security on home footbaIl game nights. Chair Larson inquired if lighting could be requested in the future. Ms. Beekman stated that it could, but it would require an amendment to the Conditional Use Permit. Chair Larson inquired if it was tied to accepting the conditional use permit. Ms. Beekman stated that if an amendment was granted for the lighting, it would be required to meet the zoning code requirements. Chair Larson opened the floor to Commission questions. Commissioner Holewa noted a typo in condition fourteen that should be changed from "and" to "any." Chair Larson opened the public hearing at 6:43 p.m. Chair Larson invited anyone for or against the application to come forward and make comment. Jim Hanton, 3947 RoIling HiIls Road, stated that the school staff has been working weIl to respond to the issues raised by the neighbors. He stated there is a possibility of a scoreboard being erected in the future and thinks the neighbors concerns regarding that wiIl be heard by the school. He stated that the neighbors don't want to see a POD on the property near their houses for storage. Chair Larson inquired if Mr. Hanton thinks the neighbors are in consensus with his feelings about the school's efforts. Mr. Hanton stated that he thinks the neighbors are responding happily. Commissioner Holewa inquired about the location ofthe meetings. Mr. Hanton stated that they were held at the school. Commissioner Holewa suggested an annual or semi-annual meeting with the school. Chair Larson stated that the use of a shipping container for storage would not be permitted. Ms. Beekman stated that it wouldn't be permitted. Commissioner Zimmerman inquired if a storage shed or a scoreboard would require the school to come back. Ms. Beekman stated the shed would not, but she wasn't sure if the scoreboard would. Bob Madison, activities director at Mounds View High School, stated he appreciates the dialogue with the neighbors. He stated they would like a mobile or a portable scoreboard. He stated there may be more issues that arise. Commissioner Zimmerman inquired if the ball field would be On the southwest comer. Mr. Madison stated that it would be located on the southwest comer. Commissioner Zimmerman noted that there was a typo that states that it would be in the southeast comer. Commissioner Holewa stated that he was concerned about the dugouts being misused if they are not secure. Mr. Madison stated if they were closed from the front, people could go behind them. He stated that openings in the front of the dugouts allow staffto see in them. He stated that the school is concerned about inappropriate activities occurring on the school grounds and they do the best to educate the students about those situations. Commissioner Holewa inquired about how the school would address appropriate use ofthe dugouts. Mr. Madison stated that they would be for baseball use only. Commissioner Zimmerman inquired ifthere have been any problems with vandalism with the football field. Mr. Madison stated that there hasn't been. Tim O'Malley, 1851 Oramsie Road, thanked the school for meeting with the neighbors and stated he is in favor of the project as it is being presented. Jon Ward, Director of Operations for Mounds View School District, stated that the field will be rented out for community use during the summer and there will be the expectation that the renters will foIIow the same guidelines as the school. Chair Larson closed the public hearing at 7:00 p.m. Commissioner Stodola stated that it appears that many ofthe issues have been addressed by the school. Commissioner Holewa thanked the school and the residents for speaking their op1lllons. Commissioner Holewa moved, seconded by Commissioner Thompson, to recommend approval of Planning Case #08-011 for a Conditional Use Permit Amendment at 1900 Lake Valentine Road based on the findings of fact and the submitted plans, subject to the fifteen conditions as listed in staffs May 7, 2008 report.
