Chair Clayton Larson called the meeting to order at 6:35 p.m.

Also present were Council Member David Grant, City Planner 1 Meagan Beekman, and
Recording Secretary Kim Stoll.
APPROVAL OF AGENDA — MAY 712008
Chair Larson stated Council Member Grant requested item 5A be moved prior to item 3.
He stated the comprehensive plan work session for this evening is cancelled and will be
rescheduled.
APPROVAL OF MINUTES — APRIL 2, 2008 PLANNING COMMISSION MEETING
Commissioner Holewa requested the following corrections to the meeting minutes of
April 2, 2008: 1) page 8, paragraph 7, line 3, "...to continue and that when the notice
from the City was sent to the residents about the meeting it was the first the neighbors
heard about the ball field."
Commissioner Holewa moved, seconded by Commissioner Thompson, to approve the
April 2, 2008 minutes as amended above.
The motion carried unanimously (6-0).

APPROVAL OF MINUTES — FEBRUARY 6, 2448 SPECIAL WORK SESSION
Commissioner Zimmerman moved, seconded by Commissioner Holewa, to approve the
April 2, 2008 minutes.
The motion carried unanimously (6-0).
PUBLIC HEARINGS
A. PLANNING CASE ##48-411— CONDITIONAL USE PERMIT AMENDMENT;
MOUNDS VIEW HIGH SCHOOL- PUBLIC HEARING
Ms. Beekman reported that the applicant submitted a Conditional Use Permit
Amendment to construct a baseball field and safety fence in the southwest corner of the
Mounds View High School property. She then provided background information and
said Staff recommends approval of Planning Case #08-011 for a Conditional Use Permit
Amendment to construct a baseball field, two dugouts, and related fencing at Mounds
View High School subject to the following conditions_
1 _ The applicant shad continue to abide by the conditions of all previous permits and
reviews.
2. The project shall be completed in accordance with the plans submitted as amended by
the conditions of approval. Any significant changes to these plans, as determined by
the City Planner, shall require review and approval by the Planning Commission.
3. Building Permit Plans shall be submitted to the Building Official a minimum of two
(2) weeks before the planned start of construction.
4. The project shall meet all ADA requirements.
5. The applicant shall obtain all necessary permits from the Rice Creek Watershed
District, MPGA, and other governmental entities and provide the City with copies of
such pen -nits prior to the City issuing any building permits.
6. The ball field shall not be illuminated by any artificial means, now or in the future.
7. The School shall be responsible for locking the rear gate near the field from 2.30 to
5:30 in the evening on game days.
8. The School shall communicate to the baseball team, parents, and boosters of
appropriate ingress and egress to the field.

9. The District shall provide signage at the site to identify appropriate parking and field
access. The signage shall be subject to the City Planner approval prior to installation.
10. The District shad add a hood on the backstop to avoid foul balls.
11. If foul balls are a problem after construction is completed, the District shall work with
the City and the neighbors to find appropriate solutions. The District shall implement
the solutions as determined by the City.
12. The demountable outfield fence shall be stored near the home bleachers at the football
stadium.
13. The mound and home plate area shall have a tarp on during times the field is not in
use.
14. The District shall repair and vandalism that occurs immediately upon notification.
15. The dugouts shall be patrolled by security on home football game nights.
Chair Larson inquired if lighting could be requested in the future. Ms. Beekman stated
that it could, but it would require an amendment to the Conditional Use Permit.
Chair Larson inquired if it was tied to accepting the conditional use permit. Ms.
Beekman stated that if an amendment was granted for the lighting, it would be required to
meet the zoning code requirements.
Chair Larson opened the floor to Commission questions.
Commissioner Holewa noted a typo in condition fourteen that should be changed from
"and" to "any."
Chair Larson opened the public hearing at 6:43 p.m.
Chair Larson invited anyone for or against the application to come forward and make
comment.
Jim Hanton, 3947 Rolling Hills Load, stated that the school staff has been working well
to respond to the issues raised by the neighbors. He stated there is a possibility of a
scoreboard being erected in the future and thinks the neighbors concerns regarding that
will be heard by the school. He stated that the neighbors don't want to see a POD on the
property near their houses for storage.
Chair Larson inquired if Mr. Hanton thinks the neighbors are in consensus with his
feelings about the school's efforts. Mr. Hanton stated that he thinks the neighbors are
responding happily.

Commissioner Holewa inquired about the location of the meetings. Mr. Hanton stated
that they were held at the school.
Commissioner Holewa suggested an annual or semi-annual meeting with the school.
Chair Larson stated that the use of a shipping container for storage would not be
permitted. Ms. Beekman stated that it wouldn't be permitted.
Commissioner Zimmerman inquired if a storage shed or a scoreboard would require the
school to come back. Ms. Beekman stated the shed would not, but she wasn't sure if the
scoreboard would.
Bob Madison, activities director at Mounds view High School, stated he appreciates the
dialogue with the neighbors. He stated they would like a mobile or a portable scoreboard.
He stated there may be more issues that arise.
Commissioner Zimmerman inquired if the ball field would be on the southwest corner.
Mr. Madison stated that it would be located on the southwest corner.
Commissioner Zimmerman noted that there was a typo that states that it would be in the
southeast corner.
Commissioner Holewa stated that he was concerned about the dugouts being misused if
they are not secure. Mr. Madison stated if they were closed from the front, people could
go behind them. He stated that openings in the front of the dugouts allow staff to see in
them. He stated that the school is concerned about inappropriate activities occurring on
the school grounds and they do the best to educate the students about those situations.
Commissioner Holewa inquired about how the school would address appropriate use of
the dugouts. Mr. Madison stated that they would be for baseball use only.
Commissioner Zimmerman inquired if there have been any problems with vandalism
with the football field. Mr. Madison stated that there hasn't been.
Tim O'Malley, 1851 Gramsie Road, thanked the school for meeting with the neighbors
and stated he is in favor of the project as it is being presented.
Jon Ward, Director of Operations for Mounds view School District, stated that the held
will be rented out for community use during the summer and there will be the expectation
that the renters will follow the same guidelines as the school.
Chair Larson closed the public hearing at 7:00 p -m.

Commissioner Stodola stated that it appears that many of the issues have been addressed
by the school.
Commissioner Holewa thanked the school and the residents for speaking their opinions.
Commissioner Holewa moved, seconded by Commissioner Thompson, to recommend
approval of Planning Case ##08-011 for a Conditional Use Permit Amendment at 1900
Lake valentine Road based on the findings of fact and the submitted plans, subject to the
fifteen conditions as listed in staff's May 7, 2008 report.
The motion carried unanimously (6-0).
This Planning Case will be reviewed at the Monday. May 27, 2008, City Council
meeting.

Requested Action
Consider approving a Zoning Code text amendment related to ground mounted structures for
antennas on City water tower sites.
Background
At their May 27, 2008, meeting the City Council approved a Conditional Use Permit for T -
Mobile to place several antennas on the City water Tower located at 4251 Pernwood Street. As
part of the application T -Mobile proposed to construct a structure to house the ground equipment
required to operate the antennas. According to Section 1325.09 of the Zoning Code, the City
will construct and maintain a single ground structure at each water tower that would house all of
the necessary ground equipment for future antennas located on the towers, and no additional
ground structures would be permitted. The City never constructed these structures, and in order
to comply with City Code T -Mobile offered to construct the building and give it to the City to
operate and maintain. As part of the proposal, T -Mobile would require the cost of the
construction to be repaid via a credit on their lease agreement with the City.
Upon further review, the City Planner, City Attorney, and Public works Director all concurred
that owning and maintaining a building at each water tower site was not in the best interest of the
City due to cost and liability. Therefore, Staff recommended that the Conditional Use Permit be

approved subject to the condition that T -Mobile construct and maintain ownership over the
structure. In order for the condition to comply with the Zoning Code, the City must amend its
Code to set up alternative design criteria and allow antenna operators to construct and maintain
their own structures.
Ground Mounted Structures
Presently, Section 1325.09, Subd. 613, of the Zoning Code currently reads:
B. Screening City water tower sites.
1. Antennas attached to the water tower must be painted to match the
color of the water tower.
2. Ground mounted structures.
a. Red Fox Tower. The City will landscape the site to adequately
screen the existing ground structures at the time of the amendment
of this Code. All future applicants will conform to the City's
landscaping plan of the lot. The City will construct a ground
structure to house all future applicants requiring ground mounted
structures following amendment of this Code. Applicants will lease
space on the tower and within the ground mounted structure, as
specified in the lease agreement. No additional ground structures
will be permitted on this site.
b. Fernwood Tower. The City will construct a ground structure to
house all future applicants requiring ground mounted structures
following amendment of this Code. Applicants will lease space on
the tower and within the ground mounted structure, as specified in
the lease agreement. No additional ground structures will be
permitted on this site.
Ground Mounted Structures Amendment
Staff contacted the planners of several surrounding communities to find out if other City's
maintain ownership of the equipment structures for antennas located on public land. All of the
communities stated that they did not. Staff then examined the Zoning Codes of these
communities to determine different methods for regulating the design and screening of these
structures. Because the structures are located on City owned land, the City has much discretion
in regulating the location, size, and materials that can be used to construct them.

Based on this research as well as internal discussions with the Public works Department, Staff is
recommending the following amendments to the Zoning Code; that all of Subd. 613, paragraph 2
regarding the City's obligation to landscape the water tower sites and to construct ground
structures be removed, and that Subd. 613, paragraph 1 be moved to Subd. 71 Special
Requirements for City water Tower Sites. In addition, Staff is proposing to add certain design
criteria to Subd_ 7 regarding, not only ground mounted structures, but all types of ground
equipment. The proposed amendments are presented in full in Attachment 1. The design
criterion portion reads as follows:
E. There is sufficient room on the site to accommodate all ground
equipment and the following requirements for ground equipment are met'.
1. The base transceiver station and all other ground equipment
shall be housed in an existing on-site equipment building
whenever possible. If an existing equipment building is
unavailable, a new equipment building may be constructed_ If
the equipment is to be housed in a weather-proof cabinet -like
structure in lieu of a building, it shall be mounted upon a
suitable concrete pad.
2. The equipment building shall be constructed of brick; be of the
same or better construction, design, and appearance as any
existing on site structures; have the same or similar roof pitch,
and be of the smallest size necessary.
3.' To the extent possible, the equipment building or cabinet shall
be located adjacent to or near existing on-site buildings.
4. The equipment building or cabinet shad be screened from view
of adjacent properties by suitable vegetation, except where
non -vegetative screening (e.g., a decorative wail or fencing)
,better reflects and complements the character of the
neighborhood.
S_ The City shall require a suitable financial surety to ensure
future removal of the equipment building or cabinet upon
termination of the lease.

A change to the Zoning Code requires a public hearing before the Planning Commission. The
Zoning Code change would go into effect upon publication in the official City newspaper.

Subd. b Screening.
A. Screening shall be provided so as to prevent direct view of a dish
antenna from any street or from a public or private property within six
hundred (600) feet of the dish, as follows:
1. (hound Mounted Dishes. Screening for ground mounted dishes
shall consist of a fence, wall, earth berm or landscaping, or a
combination of these devices_
2. Roof or wall Mounted Dishes. Screening for roof or wall®
mounted dishes shall be in accordance with Section 1325.05 Subd 4
Subd. 7 Special Requirements for City Water Tower Sites. The placement of
licensed commercial wireless telecommunication services including cellular, personal
communication services (PCS), specialized mobilized radio (SMR), enhanced
specialized mobilized radio (ESMR), paging and similar services on water tower sites
will be allowed only when the City is fully satisfied that the following requirements
are met:
A. The applicant's access to the facility will not increase the risks of
contamination to the City's water supply;
B. There is sufficient room on the structure to
accommodate the applicant's faeef1-A equipment and all equipment
(antennas, exterior cables, etc) attached to the structure is painted to match
the color of the structure;
C. The presence of the €ac�y equipment will not increase the water
tower or reservoir maintenance costs to the City;
D. The presence of the firaeiflity equipment will not be harmful to the
health of workers maintaining the water tower or reservoir.
E. There is sufficient room on the site to accommodate all ground
equipment and the following requirements for ground equipment are met:
1. The base transceiver station and all other ground eauinment

The City Council reviewed the following Planning related cases at their May 12, 2008, meeting.
Overhead camera repair
The City Council voted unanimously to approve the replacement and repair of the multimedia system
in the Council Chambers. Tierney Brothers, Inc. will repair the camera and relocate the electrical
components for it into the equipment room.
The City Council reviewed the following items at their May 27, 2008, meeting.
Appointment of Daniel Reiff to the Planning Commission
The City Council unanimously approved the appointment of Daniel Reiff to the Planning
Commission for a three-year term. Welcome Commissioner Reiff!
Planninp, Case 08-011 for a CUP Amendment to construct a Ball Field at Mounds View
High School
The City Council unanimously voted to approve the Conditional Use Permit Amendment at
Mounds View High School for the construction of a ball field, two dugouts, and related fencing,
subject to 15 conditions. The Planning Commission unanimously recommended approval of this
item at their May 7, 2008, meeting.

The City Council unanimously voted to approve the Conditional Use Permit and Lease
Agreement to allow T -Mobile Communications to install nine panel antennas and construct a
ground structure to house equipment at the Pernwood City water Tower site. T -Mobile will
maintain ownership and responsibility for the ground structure. The Planning Commission
unanimously voted to recommend approval of this item at their March 51, 20081, meeting.
Other Planninp, Related Updates
Northwestern College has been issued their grading and erosion control permits from the City of
Arden Hills and their building permits from the City of Roseville for the construction of their
parking lot and roadway. Landscaping has already begun to be planted near the construction
area. It is anticipated that they will begin grading once the City Inspector has determined that all
the required landscaping is in place and the erosion control and tree protection measures are in
place.
Planning Case 08-005 for a Preliminary and Final Plat of the Traverse Business Center has been
delayed due to scheduling conflicts and negotiations over the park dedication fee. It is
anticipated that this item will come before the City Council at their June 9, 2008, meeting.
The B-2 Steering Committee has begun the process of developing the Small Area Plan for the B-
2 District. Commissioner Modesette is one of the committee members. A community meeting
was held on May 20 to being the visioning process for the area. Approximately 70-80 residents
and business owners participated. The Steering Committee will continue to meet throughout the
summer. while most of the meetings will not be broadly advertised throughout the community,
all are open to the public and the schedule will be posted on the City's website.
