AmendmenT of Section 3-16 of Arden Hills Code to Change Provisions Relating to Hours of Sale. Section 3-16-of the Arrlen Hills Code is hereby amended in iTs entirety to read as follows: "Sec. 3-16. Hours of Sale. The hours in which an establishment licensed hereunder may or may noT serve inToxicating liquors on or off sale are as fol lows: (a) Election Day Prohibition. No on or off sale of . intoxicating liquor shall be made between the hours of 1:00 a.m. and 8:00 p.m. on the day of-any state-wide election. (b) Regular On-Sale Hours. ExcepT as provided in the next subsection hereof, the on-sale of inToxica4ing liquors shall be made on the premises of any esTablish- . ment issued an on-sale liquor license pursuant To the . terms hereof only between the hours of 8:00 a.m. on every tlay of the week except Sunday and 1:00 a,m. and 8:00 a.m. on any Tuesday, Wednesday, Thursday, Friday and Saturday and between the hours of 12:00 Midnight and 8:00 a.m. on any Monday. (c) Sunday On-Sale Hours. NolwiThstanding Section 3- 16(b) to the contrary, the on-sale ot intoxicating liquors shall be made on the premises of any establishment which has been issued a Sunday on-sale liquor license pursuanT to the terms hereof only between the hours pf 10:00 a.m. and 12:00 Midnight on any Sunday. Thus, no omsale shall be made between the hours of 1:00 a.m, - and 10:00 a.m. on any Sunday. (d) Off-Sale Hours. Except as provitled in the next subsection hereof, the off-sale of intoxicating liquor shalf be made on the premises of any esTablishment issued an off-sale liquor license pursuant fo the terms hereof only between the hours of 8:00 a.m. and 8:00 p.m. on any Monday, Tuesday, Wednesday and Thursday and befween the hours of 8:00 a.m. and 10:00 p.m. on any Friday and Saturday except as provided in the next subsection hereof. Thus, no off-sale of intoxicating liquor shall be made befare 8:00 a.m. and after 8:00 p.m. . on any Monday ihrough 7hursday and before 8:00 a.m. and after 10:00 p.m. on any Friday and Saturday, and no such off-sales shal I take place aT al I on any Sunday. (e) Of(-Sales on Holidays Prohibited; ExTension of Off-Sale Hours on Evenings Prior to Hoiidays. Nof- wiThsianding Section 3-16(d) to the conirary, no off-sale of inioxicaTing liquor shall be made on the premises of any establishment issued an off-sale liquor license hereunder on New Year's Day, January 1; In- dependence Day, July 4; Thanksgiving Day; and Christmas Day, December 25. On the evening preceding any of such days, if the off-sale of intoxicating liquor is not otherwise prohibited on such evening, the off-sale may be made upon the premises of an establishment issued an off-sale liquor license under the terms hereof until 10:00 p.m. except ihaT no such off-sale shall be made on December 24 afTer 8:00 p.m." . Section 2. Amendmertt of Section 3-38(e) of Arden Hills Code.. Section 3-38(e) of the Arden Hills Code is hereby amended to read as follows: "(e) 'Sunday on-sale' licenses shall be issued only to - omsale licensees which have facilities for serving at least thirty (30) guests at any one time, which are in compliance with the requirements of the Minnesota Clean Indoor Air Act, and which shall serve intoxiwting liquors only in conlunction wiTh the service of food. A 'Sunday on-sale' license shall not be needed for on-sales made by on-sale wine licensees." Sec4eon 3. EffecTive Date. Amentlment of SecTion 3-16 of Arden Hitls Cade to Change Provisions Rela4ing to Hours of Sale. Section 3-16of the Arden Hills Code is hereby amended in its entirety to read as follows: ' "Sec. 3-76. Hours of Sale. The hours in which an establishment licensed hereunder may or may not serve inToxicating liquors on or off sale are as follows: (a) Election Day Prahibition. Notwithstanding Section 3- 16(b) to the conirary, the on-sale of intoxicating liquors shall be made on the premises of any establishmenT which has been issued a Sunday on-sale liquor license pursuant to the terms hereof only between the hours of 10:00 a.m. and 12:00 Midnight on any Sunday. Thus, no on-sale shall be made between the hours of 1:00 a.m. and 10:00 a.m. on any Sunday. (d) Off-Sale Hours. Excepi as provided in the rtexi subsection hereof, the off-sale of intoxicating liquor shatl be made on the premises of any es4ablishmenT issued an off-sale liquor license pursuant to the terms hereof only between the hours of 8:00 a.m. and 8:00 p.m. on any Monday, Tuesday, Wednesday and Thursday and between the hours of 8:00 a.m. and 10:00 p.m. on any Friday and Saturday except as provided in the nexT subsection hereof, Thus, no off-sale ot intoxicating liquor shall be made beEore 8:00 a.m. and after 8:00 p.m. on any Monday ihrough Thursday and before 8:00 a.m. and after 10:00 p.m. on any Friday and SaTurday, and no such off-sales shall take place at all on any Sunday. (e) Off-Sales on Holidays Prohibited; Extension of Off-Sale Hours on Evenings Prior to Holidays. Not- withstandinq Section 3-16(d) to the conirary, no pff-sale of inioxicating liquor shall be made on the premises of any esTablishment issued an off-sale liquor license hereunder on New Year's Day, January 1; In- dependence Day, July 4; Thanksgiving Day; and ChrisTmas Day, December 25. On the evening preceding . any of such days, if the off-sale of intoxicating liquor is not oTherwise prohibited on such evening,the off-sale may be made upon the premises of an establishment issued an off-sale liquor license under the terms hereof until 10:00 p.m. except ihaT no such off-sale shall be made on December 24 afTer 8:00 p.m." . Section 2. Amendment of SecTion 3-38(e) of Arden Hills Code.. SecTion 3-38(e) of the Arden Hilis Code is hereby amended to read as follows: "(e) 'Sunday omsale' licenses shall be issued only to on-salr_ licensees which have facilities for serving at least ihirty (30) guests at any one time, which are in compliance with the requiremenis of the Minnesota Clean Indoor Air Act, and which shall serve intoxicating liquors only in conjunction with the service of food. A 'Sunday on-sale' license shall not be needed for on-sales made by on-sale wine iicensees." Section 3. Effective Date.
