ORDINANCE NO. 163
. AN ORDINANCE REGULATING AND LICENSING
~ THE HANDLING, STORING, PREPARING, AND
OFFERING FOR SALE OF GROCERIES,
VEGETABLES, FRUITS, MILK AND DAIRY
PROOUCTS, BAKERY GOODS, CANDY AND MEATS,
WHETHER RETAIL OR WHOLESALE, INCLUDING SALE THEREOF BY ITINERANT VENDORS, AND
PROVIDING PENALTIES FOR VIOLATION.
The Village Council of the Village of Arden Hills does
hereby ordain as follows:
Section 1. Definitions. The word "person" as used in
This Ordinance shall include any anq all individuals, firms, associations, or corporaTions. The word "food"
, shall include iTems prepared or held for sale for human .
consumpfion as specifically mentionetl in the title
hereof or elsewhere in ihis Ordinance, buT excluding malf beverages, intoxicating liquors, soft drinks,
cigarettes, or oTher items similar ihereta if the same
are specifically covered by oTher regulatory and - or
licensing ordinances of ihis Village.
Section Y. License Required. No person shall sell or "
offer for sale, whether aT retail or wholesale, food in ,
Arden Hills without first obTaining license as provided
herein. Food iTems covered herein include, without
limitation, groceries, vegetables, fruits, milk, dairy
producis, bakery goads, candy, and meats, but
resTauranis and the like duly licensetl under oTher or-
dinances of ihis Village shall not be required to obtain
. ' IicensesunderihisOrdinanceforihesaleoffood. Section 3. License Application and Investigation. Any
person desiring a I icense To sell food hereuntler shal I file
an applicaTion Therefor with the Clerk - Administrator. .
Such applicaTion shall contain the name and place of
. residence of the applicant, the nature of his business,
the place where he carrys on said business or proposes
fo carry it on, the owner of the sublect premises and
residence of the owner. In addition such applicaTion _
shall include such other information as may be
reasonably required by the Clerk - Adminisirator To
effectively carry out the provisions hereof. Such ap-
plication shall be referred fa the HealTh Officer, who
shall make such investigation as he deems necessary
and endorse on the application his approval or disap-
proval with reference particularly To the saniTary and
healthful condiTion of the proposed place of business and
the manner in which such business is proposed To be
operated or has been operated in the past. Upon ap-
proval by the Council a license may then be issued by
the Clerk - AdminiSTrator.
Section a. Conditions of Operation. Licensees
hereunder must maintain iheir operation in clean and
sanitary condition at all times and in full conformance _
with all applicable requiremenTS of the State of Min-
nesota or agencies ihereof. Licensetl establishmenis
musT be open for inspecfion by the Healih Officer and
other agenis or representatives of the Village at all
reasonable times to insure healthful and saniTary
operaTion of the licensed establishment. V iolation of any
of the provisions hereof shall be cause for cancellation
of the license, in addition to oTher penalties provided -
herein, but unless the Council, upon recommendation of
the HealTh Officer, deems ihaT immetliate cancellaTion
is required for the public good, reasonable notice of
. inTenf fo cancel shall be given the holder of the license
and the licensee shall be given a public hearing before
the Council.
Section S. License Fees. The following license fees are
established for sale oi partiCUlar food iTems. HereafTer
license fees for licensees hereunder shall be contained
in the Table of License Fees (now Ortl. No. 151), as the
same may be amended, and reference should be made
ihereto for current fees. The license fees provided
herein shall not be cumulative; That is, for example, a
retail grocery license hereunder shall noT be required to
obTain additional license fees under ihis ordinance for
the oTher items covered in the following Table, and
unless specifically indicated to the contrary, no more
than one license tee shall be charged for the particular
iTem. Also, retail groceries are not required To obtain a
license for soft drinks sold other Than through a vending
machine. The fees are graduaTed on the basis of the
apparent regulatory problems involved, in the best
iudgment of the Council.
(a) Bakery - $25.
(b) Caterers - $25.
(c) Ifinerant food vendors, induding popcorn and ice
cream vendors - $25. _
(d) Milk: Pasteurizing Plant - $100.
Secondary Vendors - $25.
(3) Retail Candy - $25.
(f) ReTail grocery - $50. (g) Retail meaT, including meat locker planis - 825.
(h) Wholesale foods - $50.
Section 6. Penalties. In addition to possible can- cellation of a license issued hereunder, any violation of
• ' ihis Ordinance shail be deemed a misdemeanor
punishable by a fine of not more ihan 8300 and - or 90
days in iail.
Section 7. Effective Date. This ordinance shall be in
effect and in full force frOm and after January 1, 1973,
buT not before its passage and publication.
