Amendment of Section 9 of Ord. No. 186 <br /> Regardinq Spraying or Treatment of Shade Trees. Section 9 of <br /> Ord. No. 186s passed by the Council of the City of Arden Hills <br /> on March 31, 1975, is hereby amended to read as fallowsa <br /> Sectian 9. S raying or Treatment of Shade <br /> Treese Whenever the Forester determines that any <br /> shade tree or shade tree wood within the City of <br /> Arden Hi11s is infectecl vvith shade tree disease, <br /> he may spray or treat all nearby high value shade <br /> trees by such chemical or mechanical means as <br /> will be effective to prevent as fully as <br /> possible the spread of shade tree ctisease thereto. <br /> The Forester may also cause the diseased shade <br /> trees ar t,vood to be sprayecl or treated by chemical <br /> or anechanical zneans so as likewise to control the <br /> possible spread of shade tree disease to neighbar- <br /> ing, high value shade treeso Stzch grocedure sha1l <br /> be carried out in accordance with current <br /> technical and expert opinions and plans of the <br /> Minnesota Department af Agriculture and under the <br /> supervision of such Department whenever possible. <br /> The costs of such chemical means of treatment <br /> shall be borne by the Citym The casts of such <br /> mechanical means of treatment shall be borne by <br /> the owner or occupant of the premises, the shade <br /> trees upon which have been mechanically treated <br /> by the City. The owner or occupant of such <br /> premises shall be billed the costs of such <br /> mechanical treatment, and in the event of nonpayment <br /> of such bill within thirty (30) days of the date <br /> thereof, the Council may then assess the amount due, <br /> plus interest, in the manner provided in Section 7 <br /> hereof. <br /> The Forester shall notify, in the man~~ <br /> provided in Section 5 hereof, each owner~re 1 <br /> estate within the City of the date after which <br /> shade trees on his property shall be chemically _ <br /> or me.chanically treated, which date shall not be <br /> less than five (5) days from the date of mailing <br /> such notice. <br />
