AN ORDINANCE AMENDING CHAPTERS 8AATD 14 AND APPENDIX A
OF THE ARDEN HILLS CODE OF ORDINANCES
TO CHANGE NUMEROUS PROVISIONS CONTAINED THEREIN
The City Council of Arden Hills ordains:
1. Amendment ta Definition of "Domestic Animals" in
Section II.D.(8) of A endix A-Zoning of Arden Hills Code.
Section II.D.(8) of Appendix A-Zoning of the Arden Hills Code is
hereby amended to read as follows:
"(8) Animals, domestic. Common household
pets, such as dogs and cats, other animals kept for
amusement, companianship, decorati.on, or interest.
Animals which are normally wild, such as wolves,
tigers and poisonous snakes, shall not be
considered domestic animals."
2. Amendment to Definitian of "Farm Animals" in Section
II.D.(9) of Appendix A-Zoning of Arden Hills Code. Section
II.D.(9) of Appendix A-Zaning o€ the Arden Hills Code is hereby
amended to read as follows:
"(9) Animals, farm. Animals traditianally
kept ar raised on a farm for the purpase of
providing food or products for sale or use, such as
cattle, horses, goats, sheep, swine, fawl, bees,
and animals raised far fur."
3. Amendment ta Definition of "Building Height" in
Section II.D.(23) of Appendix A-Zoning of Arden Hills Code.
Section II.D.(23) of Appendix A-Zoning of the Arden Hi11s Code is
hereby amended to read as follows:
"(23) Building height. The vertical distance
from the average elevation of the grade along a
face of a building to the highest point of the roof
surface of flat roofs, the deck line of mansard
roofs, or the average height between the eaves and
highest ridge of gable, hig, or gambrel roofs. The
hefght of a stepped or terraced building shall be
the height of the tallest segment af the building."

4. Amendment to Definition of "Electronic Tower" in
Section II.D. 46) of Appendix A-Zoning of Arden Hills Code.
Section II.D.(46) of Appendix A-Zoning of the Arden Hills Code is
hereby amended to read as follows:
"(46) Electronic tower. A structure which is
higher in elevation than.its diameter, and is used
for transmission, relay or emission of electronic
waves. A ham radio tower and any other type of
private radio transmitter are included in this
definition."
5. Amendment to Definition of "Repair Garage" in Section
II.D.(54) of Appendix A-Zoning of Arden Hills Code. Section
II.D.(54) of Appendix A-Zoning of the Arden Hills Code is hereby
amended to read as follows:
"(54) Garage, repair. A building or space for
the repair or maintenance of motor vehicles,
including body work and painting and vehicle wash,
but not including factory assembly of such
vehicles, auto wrecking establishments, or
junkyards,"
6. Amendment to Definition of "Grade" in Section II.D.
(56) of A pendix A-Zoning of Arden Hills Code. Section II.D.(56)
of Appendix A-Zoning of the Arden Hills Code is hereby amended to
read as follows:
".(56) Grade. The lowest eleuation of the
finished surface of the ground, sidewalk, or other
paving within a five foot horizontal distance from
the face of the building."
7. Amendment to Definition of "Land Reclamation" in
Section II D(64) of Appendix A-Zvning of Arden Hills Code.
Section II.D.(64) of Appendix A-Zoning of the Arden Hills Code is
hereby amended to read as follows:
"(64) Land reclamation. The deposition of
more than four hundred (400) cubic yards of sand,
gravel, or other earth materials per single parcel
or per acre, whichever, is greater, on a site in
such a manner as to elevate the grade."
8. Amendment to Definition af "Manufacturing and
Processing" in Section II D(81) of Appendix A-Zoning of Arden
Hills Code. Section II.D.(81) of Appendix A-Zoning of the Arden
Hills Code is hereby amended to read as fol2aws:

"(81) Manufacturinq and processing. All uses
which include the compounding, processing,
packaging, treatment, or assembly of prodncts and
materials. Generally, these are industries
dependent upon Faw matezials refined elsewhere.
These uses include, but are not limited to:
fabrication of wood, metal, and plastic products;
assembly of electronic components, equipment, and
appliances; processing of -chemicals, plastics, food
products, and non-alcoholic beverages;
manufacturing of clothing and textile products;
distribution centers, lumber -yards, printing and
binding shops, machine shops, sheet metal shogs,
sign shops, contractor's shops and storage yards."
9. Amendment to Definition of "Mining" in Section II.D.
(84) of Appendix A-2oning of Arden Hills Code. Section II.D.(84)
of Appendix A-Zoning of the Arden Hi11s Code is hereby amended to
read as follows:
"t84) Mining. The extraction of more than
four hundred (400) cubic yards of sand, gravel, or
other earth material from a single parcel vr per
acre of land, whichever is greater, in such a
manner as to reduce the grade."
10. Amendment to Definition of "Mobile Home" in Section ,
II.D.(85) of Appendix A-Zoning of Arden Hills Code. Section
II.D.(85) of Appendix A-Zoning of the Arden Hills Code is hereby
amended to read as follows:
. "(85) riobile home. A manufactured home
designed, constructed, and•equipped for use as a
single-family dwelling, which has a width of less
than twenty (20) feet over more than twenty-five
percent (25$) of its iength; or which is not gZaced
on a permanent foundation complying with the
requirements of the State Building Code or which is
not continuous and solid for the entire perimeter
of the structure."
11. Amendment to Definition of "Retail Sales` in Section
II.D.(109) o€ A endix A-Zonin of Arden Hills Code. Section
II.D.(109) o Appendix A-Zoning of the Arden Hills Code is hereby
amended to read as follows: .
"(109) Retail sales. Stores and shogs
- selling, renting or leasing goods for uses away
from the point of sale. Includes the foliowing:
Antiques, art and school supplies, suto
accessories, bakeries, bicycles (not motorized),
books and stationery, candy, camera and photo-
graphical supplies, carpets and rugs, china and
, glassware, clothing and costume zental, +custom
dressmaking, department stores, dsugs, dry goods,
electrical and honsehold appliances, sales and

repair, florist, food, furniture, furrier shops,
garden supplies (year-round operation only), gi€ts,
hardware, hats, hobby shops, interior decorating,
. jewelry, leather goods and luggage, locksmith
shops, musical instruments, office supply ec;uip-
ment, optometrists, paint and wallpaper, phonagraph
recards, shoes, sporting•-goods, tobacco, tvys,
variety stores, wearing apparel, and similar type
uses. Motor vehicle sales, motor vehicle leasing
and rentals, and repair garages are not included in
this definition of retail sales:"
12. Addition of Definitioris of "Miscellaneaus Tower",
"Manufactured Home" and "Multiple-Occupancy Structure° to Section
II.D. of Appendix A-Zoning of Arden Hills Code. Section Ii.D. of
Appendix A-Zoning of the Arden Hills Code is herehy amended by
adding thereto the following new definitions:
"(147) Miscellaneous tower. A tower struc-
ture, and the equipment attached thereto, used for
purposes other than transmission, reZayF or
emission of electronic waves; including, but not
limited to a freestanding TV and radio receiving
antenna, an electronic receiving dish exceeding 30
inches in diameter, a windmill, and a wind power
generator.
(148) Manufactured home. A structure,
transportable in one or more sections, which in the
traveling mode is eight feet or more in width or 40
body feet or more in length, or, when erected on
site, is 320 or more square feet, and which is
built on a permanent chassis and designed to be
used as a dwelling with or without a germanent
foundation when connected to the required utili-
ties, and includes the plumbing, heating, air-
conditioning, and electrical system contained
therein; except that the term includes any
structure which meets all the requirements and with
respect to which the manufacturer fiies a
certification required by the Secretary of the U.S.
Department of Housing and Urban Develogment and
complies with the standards of the Manufactnred
Home Building Code as•defined in M.S. 327.31,
Subdivision 3.
(149) Multiple-occupancy structure. A
principal building housing two (2) or more
independent business or industrial uses which are
permitted in the district."
13. Amendment to Land IIse Chart in Sectiaa V.E. of

hereby amended to read as follows:

14. Amendment to Provision Regarding "Accessory Retail
Sales" in Section VI.A.(5) of Appendix A-Zoning of Arden Hills
Code. Section VI.A.(5) of Appendix A-Zaning of the Arden Hills
Code is hereby amended to read as follows:
"(5) Accessory retail sales, processing, and
storage. Accessory retail sales shall be germitted
in industrial districts, and aceessory processing,
assembly, repair, and storage of materials shall be
permitted in business districts when such uses are
directly associated with the principal use, and
when such incidental sales, processing, assembly,
repair, and storage are necessary to conduct a
permitted principal or special use. Such accessory
use shall not exceed thirty percent (30%) of the
floor space of the principal structure or use, and
shall be enclosed within the'princigal structure."
15. Amendment to Section VI.A. af Appendix A-Zoning of
Arden Hills Code by Adding a New Paragraph (8) Designating
Certain Day Care Facilities as Accessory Uses for Houses of
Worship and Schools. Section VI.A. of Appendix A-Zoning of the
Arden Hills Code is hereby amended by adding thereto a new
Paragraph (8) whieh is entitled and reads as follows:
"(8) Certain day care facilities as accessory
uses for houses of worship and schools. Day care
facilities for over 10 persons shall be considered
as accessory uses for houses of worship and schools
within all residential districts."
16. Amendment to Section VI.B. (2) (c) of Appendix A-Zoning
of Arden Hills Code b Addin "Patios" as Permitted Encraach-
ments. Section VI.B. 2)(c) of Appendix A-Zoning of the Arden
Sills Code is hereby amended to read as follows:
•"(c) R+ecreational equipment, picnic tables, patios,
. uncovered outdoor Qatinq facilities and
' clothes drying equipment may be located in

rear yards provided these are not less than
two (2) feet from any lot line."
17. Amendment to Provision Regarding Exceptions to Height ,
Limitations in Section VI.B. (3) (a) of Appendix A-Zoning of Arden
Hills Code. Section VI.B.(3)(a) of Appendix A-Zoninq of the
Arden Hills Code is hereby amended to read as follows:
"(a) Exceptions. Height limitations shall not apply to church spires, belfries, cupolas and
domes; chimneys and sinokestacks; public
monuments and flagpoles; public and private
utility facilities; electronic transmissian
towers; roof-mounted television and radio
antennae and parapet walls extending not more
than four (4) feet above the limiting height
of the building, except as hereina€ter
provided."
18. Amendment to Table Concerning Off-Street Parking
Spaces in Section VI.E.(1)(f) of Appendix A-Zoning of Arden Hills
Code. Section VI.E.(1)(f) of Appendix A-2oning of the Arden
Hr 1 s Code is hereby amended by adding to the table contained
therein, under the "Use" column, the term "Multiple-occupancy
structures" and by also adding to such table, under the "Number
of Spaces" column across from "Multiple-occupancy structures",
the phrase "Spaces equal to the sum of the separate parking
requirements for each use contained therein".
19. Amendment to Section VI.E.(1) of Appendix A-Zoning of
Arden Hills Code by Adding New Paragraph (g) Concerning
Conversion or Alteration of Approved Uses. Section VI.E.(1) of
Appendix A-Zoning of the Arden Hills Code is hereby amended by
adding thereto a new Paragraph (g) which is entitled and reads as
follows:
"(g) Conversion or alteration of approved uses. A
commercial or industrial building which
received site plan approval and was issued a
building permit for a use, or uses, and which
is.later converted, remodelled, or modified to
accommodate another permitted use, or uses,
which has a greater off-street parking
requirement shall 'be required to apply for
site plan review and approval to assure the
adequacy of off-street parking."
20. Deletion of Provision Regarding Exteriar Storage in
Section VI,E.(9) of Appendix A-Zoning of Arden Hills Code.
Section VI.E.(9) of Appendix A-Zoning of the Arden Hills Code,
entitled "Exterior Storage", is hereby deleted in its enti.rety.

21. Revision of Bulk Liquid Storage Provision in Section
VI.E.(10) of Appendix A-Zoning of Arden Hills Code. Section
VI.E.(10) of Appendix A-Zoning of the Arden Hills Code is hereby
amended to read as follows:
"(10) Storage of Flammable•and Combustible Liquids.
(a) Compliance with Uniform Fire Code. All
bulk storage of fZammable and combus-
tible liquids shall conform to the
Minnesota Uniform Fire Code as adapted
by Ordinance 229, and all other provi-
sions of Ordinance 229.
(b) Permits. Permits shall be required as
provided in Section 5 of Ordinance 229.
(c) Discontinuance of hazardous existing
storage tanks. Any existing storage
tank that constitutes a hazard to the
public safety shall be discontinued.
(d) Screening. Al1 above-ground storage
tanks, except tanks used for liquefied
petroleum, shall be screened from view.
Such screening shall conform to the
Uniform Fire Code and the setback
requirements of this Ordinance."
22. Amendment to Section VI.E. of Appendix A-Zoning of
Arden Hills Code by Adding a New Paragraph (14) Concerning Design
Standards for Principal Structures in Residential Zoning
Districts. Section VI.E. of Appendix A-Zoning of the Arden Aills
Code is hereby amended by adding thereto a new Paragraph (14)
which is entitled and reads as follows:
"(14) Design Standards for Principal Structures in
Residential Zoning Districts.
(a) Minimum Width. All principal structures
in residential zoning districts, except
mobile homes in approved mobile home
parks, shall-have a minimum width of
twenty (20) feet measured from face to
face of principal exterior walls.
(b) Foundation. All principal structures in
residential zoning districts, except
mobile homes in approved mobile home
. . parks, shall be placed on permanent
foundatians which compl.y with the
requirements of the State Building Code
and which are continuous aad solid for
the entire peri.meter of the structure.'

23. Amendment to Provision Concernin Ino erable Vehicles
in Section VI.F.(3) a) of Apgendix A-Zoning of Arden Hills Code.
Section VI.F.(3)(a) of Appendix A-Zoning of the Arden Hills Code
is hereby amended to read as follows:
"(a) Inoperable and unlicensed vehicles. Passenger
vehicles and trucks that are in an inoperable
condition or are unlicensed or in storage
shall not be parked outdoars in the City for a
period exceeding seven (7)-•days. 'Inoperable'
shall mean incapable of movement under its own
power or in need of repair or disposal in a
junkyard."
24. Amendment to Provision Regarding Boats, Trailers and
Utility Vehicles in Section VI.F.(4)(b) of Appendix A-Zoning of
Arden Aills Code. Section VI.F.(4)(b) of Appendix A-Zoning of
the Arden Hills Code is hereby amended to read as follows:
"(b) Boats, trailers and utility vehicles.
Exterior storage of boats, trailers and
utility vehicles is not permitted in any
residential district, except those less than
twenty (20) feet in length which may be stored
in the side or rear yard."
25. Amendment to Section VI.F.(4) of Appendix A-Zaning of
Arden Hills Code by Adding Thereto a Provisian Concerning
Exterior Storage in Business and Industrial Districts. Section
VI.F.(4) of Appendix A-Zoning of the Arden Hills Code is hereby
amended by adding thereto a new..Subparagraph (c) which is
entitled and reads as follows:
"(c) Business and industrial districts. Ail
permitted exterior storage in the business and
industrial districts shall be screened from
public view, except materials and equipment
being used for on-site construction. Trucks
parked in public view and utilized for storage
for more than a period of seven (7) days shall
be prohibited."
26. Amendment to Section.Vl. of A endix A-Zonin of Arden
Hills Code by Adding Thereto a New Subsection A) Concerning
Filling and Excavation. Section VI. of Appendix A-Zoninq of the
Arden Aills Code is hereby amended by adding thereto a new
Subsection (H) which is entitled and reads as follows:
"H. FILLING AND EXCAVATION.
(l) Permit Required. An administrative permit
shafl-be required for any filling or
' excavation of up to 400 cubic yards per

parcel, or 400 cubic yards per aere,
whichever is greater. Operations o€ Qver
the above-described amonnts shall be
considered land reclamation or mining, and
shall require a Special Use Permit in
accordance with Chapter 8 of the Arden
Hills Code of Ordinances.
(2) Exceptions. The following operations are
excepted from the preceding permit
requirements:
(a) Excavation related to the construc-
tion of a building with a duly issued
building permit;
(b) Filling, excavation, and grading
associated with site improvements and
site preparation for a duly aggroved
subdivision or site plan;
(c) Excavation for construction of public
streets and utilities;
(d) Filling, excavation, or movement of
less than 100 cubic yards of earth
for landscaping purposes on a lot
already occupied by a residential
structure;
(e) Minor agricultural or conservation
operations.
(3) Perforrtance Time. Filling and excavation
operations for which a permit has been
issued shall be completed within a period
of 120 days from the commencement of the
operation, and within one year af the
issuance of the permit, unless an
extension is requested of and granted by
the City Council.
(4) Periodic Operations. Periadic filling or
excavation of amounts less than 400 cubic
yards per parcel or per acre shall be
allowed under separate administrative
permits until the composite total o€ such
periodic operations exceeds 400 cubic
yards. Further operations wiii then be
subject to the requirements of Chapter 8
of the Arden Hills Code of Ordinances.

(5) Submissions. The agplicant for a germit
shall submit the fallawing infortnation:
(a) A legal deseription, plat, ar survey
of property to be alterea.
(b) A statement af purpose for the
filling or excavation.
(c) A plan identifying the areas of the
site to be altered, the estimated .
quantity of material to be moved, the
degree of grade adjustment, the
proposed finished grade, the existing
and proposed drainage pattern, and
proposed erasion eontrol measures. A
complete grading glan may be required
if considered necessary to the
evaluation of the request.
(d) A list of local streets to be used to
transport the materials.
(6) Review Procedure. The permit application
shall be reviewed by the City Engineer and
other members of the administrative staff
to determine the impact of the proposed
operations upon drainage patterns,
adjacent properties, wetlands, and bodies
of water. The permit may be approved as
submitted, approved"with modifications, ar
rejected because of specifically stated
adverse impacts. If denied, the applicant
may appeal the administrative decision to
the City Council within 10 days."
27. Amendment to Definition Provision in Section 8-2 of
Arden Hills Code by Changing Definition af "Land Reclamation" and
Adding Definition of "Mining". Section 8-2 of the Arden Hills
Code, which is in Chapter 8(entitled "Excavations") thereof, is
hereby amended to read as follows:
"Sec. 8-2. Definitions.-.
For the gurposes of this chagter, the followiag
terms shall be given the followiag meanings:
(a) Land reclamation. The deposition af more
than four hundred (400) cubic yards of sand, gravel,
or other earth materials ger single parcel or per
acre, whichever is greater, on a site in such a
manner as to elevate the grade.

(b) Mining. The extraction of more than four
hundred (400) cubic yards of sand, gravel, or ather
earth material from a single parcel or per acre of
land, whichever is greater, in such a aanner as to
reduce the grade."
28. Amendment to Section. 'I4-1 of Arden Hills Code by
Adding Thereto a Definition of "Manufactured Home" and Reuising
the Definitian of "Mobile Home". Sectian 14-1 of the Arden flills
Code, which is in Chapter 14 (entitl.ed "Mobile Homes") thereof,
is hereby amended by adding a definition of "manufacture8 home"
and revising the definition of "mobile home" as follows:
°Manufactured home. A structure, transportable
in one or more sections, which in the traveling mode
is eight feet or more in width or 40 body feet or
more in length, or, when erected on site, is 320 or
more square feet, and which is built on a permanent
chassis and designed to be used as a dwelling with
or without a permanent foundation when connected to
the required utilities, and includes the plumbing,
heating, air-conditioning, and electrical system
contained therein; except that the term includes any
structure which meets all the requirements and with
respect to which the manufactvrer files a certifica-
tion required by the Secretary af the U.S. Depart-
ment of Housing and Urban Development and comglies
with the standards of the Manufactured Home Building
Code as defined in M.S. 327.31, Subdivision 3.
Mobile home. A manufactured home designed,
constructed, and equipped for use as a single-family
dwelling, which has a width of less than twenty (20)
feet over more than twenty-five percent (25%) of its
length; or which is not placed on a permanent
foundation eomplying with the requirements af the
State Building Code or which is not continuous and
solid for the entire perimeter of the structure."
29. Amendment to Chapter 14 of Arden Hills Code by Adding
a New Section 14-6 Thereto Concerning Manufactured Homes.
Chapter 14 of the Arden Hills Code, entitled "Mobile Homes", is
hereby anrended by adding a new Section 14-6 thereta which is
entitled and reads as follows:
"Manufactured homes. Manufactured homes which have a minimum width of twenty (20) feet over at
least seventy-five percent (75%) of their lenqth and
which are placed on permanent foundations which
comply with the requirements of the State Building
. Code and which are continuous and solid for the
entire perimeter of the structure shall be permitted
± 'outside of mobile home parks in all residential

zoning districts, subject to ail applicable require-
ments of the Zoning Ordinance of the City of Arden
Hills."
30. Effective Date. This Ordinance shall be effective
from and after its adoption by the Arden Hills City Council and
publication in the New Hrighton Bulletin.
