HomeMy WebLinkAbout#161 Licensing Commercial, Recreation, Amusements STATE OF MINNESOTA COUNTY OF RAMSEY , VILLAGE OF ARDEN HILLS ORDINANCE N0.161 AN ORDINANCE REGULATING AND LICENSING . ~ VARIOUS FORMS OF AMUSEMENTS AND COM- MERCIAL RECREATION, AND PROVIDING PENALTIES FOR VIOLATION. The Village Council of the Village of Arden Hills does hereby ordain as follows: Section 1. Purpose. I1 is the intention of the Council To . provide herein regulatory procedures covering various forms of commercial recreation in the Village of Arden Hills, to the end ihat the public welfare shall be protecTed and promoted. License fees provided herein may be varied from Time To time in the ardinance esTablishing a Tableof License Fees for the V illage, and - reference should be made to such ordinance and amendments Thereof with respect to current license fees after iheeffectivedateof ihisordinance (Ord. No. 151 as , . amended). The "businesses" proposed To be regulaTed herein are those conducted for a profiT in which fees or . charges of some kind are customarily made or are proposed to be made. Section Y. License Required. Any person or persons, company, parinership, or corporation which shall engage or propose to engage in the business of con- ' tlucfing or operating bingo games, bowling alleys, children's amusement devices (coin-operaTed, mechanical kitldy rides), dance halls, miniatuee golf courses, pinball machines, pool or billiard TAbles, roller or ice skaTing rinks, 'indoor shooting galleries, Tennis club, squash, curling or handball lanes or courts, cir- cuses or carnivals, movie iheatres or private clubs for profits shall first apply for and obtain a license . hereunder. Section 3. License Appliwtion. Applicati0n for a ' license shall be made to the Clerk-Administrator. Such application shall state the full name and address of the owner or owners of the business, the proposed locaTion . of the business, the nature of the business and such other relevanT information as the Clerk•Administrator may require for the purposes hereof. Section 4. Litense Fees. SublecT To revision hereafTer by the ordinance establishing the Table of License Fees for Arden Hills, (now Ord. No. 15]), reference To which ordinance should be made after the effective date of This ortlinance as To current license fees, the fees for the activities regulaTed herein shell be as follows: (a) Bingo - SSforeachdayofplay. (b) Bowling Alley - $10 per lane. (c) Children's amusement devices - $S (liability insurance required). (d) Dance Hall - $50. (e) Miniature Golf Course - $10. (f) Pinball machines - $10 per machine. (g) Pool antl Billiard Tables:FirsT table - $10. Each add'I table - $5. (h) Roller skating or Iceskating rink-550. (i) Indoor shooting gallery - $25. (i) Tennis Club, Curling, Squash, handball - $10 per , lane or court. (k) Movie iheatres: Less ihan 450 seats - 8100. 450 seats or more - 8300. Drive.ln - $300. Section 5. Children's Amusement Oevices - Liability Insurance Required. No license shall be issued for operation of children's amusement devices unless the applicant shall firsT obTain and file with the Village of _ Arden Hills a policy of liability insurance or a cer- Tificate of such a policy in an insurance company authorized fo do business in Minneota. The policy shall insure the applicant in the sum of E25,000 for each person; $100,000 for each accident; and $10,000 for properTy damage. The policy or certificate shall furiher provide ihat no}ice of cancellaTion ihereof shall be given the Village of Arden Hills at leasT 30 days bMare the effective date of the cancellation. Failure To keep a policy in force shall be grountls far immediate can- cellation of license. Section 6. Regulatory Provisions. Licensees hereunder musT maintain the subjecT business premises in safe and sanitary condiTion and in full compliance with all applicable federal and staTe laws and or- dinances of ihis Village. All license applications must receive the approval of the Police Depariment of Arden Hills and approval of TheCouncil of Arden Hills before issuance of the same by the Clerk-Administrator. In the event of recommendaTion to the Council for denial or cancellation oi any license hereunder the Council shall, unless immediaTe cancellation is required by pressing public interest, give the licensee or applicanT an op- portunity for public hearing before the Council with respect to the application or license. In the evenT can- cellation is necessary immediately, such cancellation shall be Temporary until the licensee is given the op- portunity for such hearing. Section 7. Penalties Provided. Any violaTion of This Ordinance shall be grounds for cancellaTion of the subiect license, if any, and shall furiher be deemed a misdemeanor punishable by a fine not more than f300 I and-or 90 days in jail. Section S. Effective Date. This ordinance shall be in effect from and after January 1, 1973, but not prior to its passage and publication.
