NANCE NUMBER 32, RELATING TO
THE SALE OF INTOXICATING LI-
QUOR, BY REDEFINING GENERAL

ON-SALF1 LICENSEES, CHANGING
THE LIMITATION ON THE NUMBER
OF ON-SALE LICENSES WHICH MAY
BE ISSUED, AMENDING THE PRO-
VISIONS RES.ATING TO HOURS OF
SALE, AND REPEALING ORDINANCE

THE VILLAGE COUNCIL OF THE
VILLAGE OF ARDEN HILLS DOES
HEREBY ORDAIN AS FOLLOWS:
$ECTION 1. GENERAL CONSIDERA-
TIONS PERTAINING TO "ON-SALE" '
LICENSE FEES.
Subdivision 1 of Section 4 of Ordinance
Number 32 is hereby amended to rea@

Subdivision 1. General Coneiderationa
ftelating to "on sale" License Fees.
The Council has determined that the
licensing of "on sale" liquor eatab-
lishments within the Village of Ar-
den Hills imposes additional respon-
sibilities and burdens on the Village
with reapect to policing and super-
vising of such establishments, and
that it is in the interest of public
welfare that license fees on such
eatablishmenta should be imposed on
a basis which has a direct relation
to the traffic and activity in such
establishments. Accordingly °on
sale" liquor license fees shall be
based upon gross liquor receipte
in sueh establishments as hereinafter
sPeeifically set forth.
SECTION 2. ELIGIBILITY AND
NUMBER OF ON-SALE LIQUOR LI-
CENSEB IN THE VILLAGE
Subdiviaion 2 of Section 2 of Ordi-
nance Number 32 is hereby amended to
read as followa, to-wit:
"On Sale" licenaes aha11 be isaued
only to hotels, clwbs and esclusive
liquor stores and shall permit "bn
sales" of liquor only, except as here-
inafter provided.
Notwithstanding the foregoing, and
pursuant to the Provisions of Chap-
ter 53 of the 1961 Extra Seasion
Laws of the State of Minnesota,
any estabtishment in the Villsge of
Arc}en Hills which' holda a combina-
tion "on asle" and "bff sale" li-
cenae for the sale of intoxicating
liquor may sell food. Accordingly in
addition to the foregoing eligible
licenaees, "on sale" licenses maq be
iasued by the Council to a properly-
qualWied applicant pmposing to
serve food on the premises which are
. . the subject of the. application, in . . . the event that anapplication for an . `bff sale" license at the asme estab-
'i lishment is also submitted and ia
. grantedby the Council,unleas such "off sale" license has previously
been granted for said establishment.
For the purpose of this provision
"eatablishment" ahall mean two sep-
arate businesses which are located in
the same building or in adjacent
buildings.
The Couneil may, in its @iscretion,
grant "bn sale" licenses to the max-

SECTION 3. ORDINANCE NUMBER
62 REPEALED.
Ordinance Number 62, amending Ordi-
nance Number 32, is hereby expressly
repealed.
SECTION 4. AMENDMENT RE
HOURS OF SALE.
Section 9 of Ordinance Number 82
is hereby amended to read as followe,
to-wit :
SECTION 9. Hours of Operation. No
' . . sale of intoxicating liquor shall be ma3e after 1:00 A.M. on Sunday,
nor between the houra of 1:00 A.M.
. and 3:00 P.M. on any Memorial
Da9, nor between the hours of 1:00
. A.M. an@ 8.:00 P.M. on any Election
Day. No "on sale" shall be made
between the hours of 1:00 A.M. and
8:00 A.M. on any weekday. No "off
sale" shall be made before 8:00 A.M.
or after 8:00 P.M. of any day ex-
~ ~ cept Saturday or except the da9s
preceding the holidays hereinafter
~ apecifically set forth on which days
and on Saturdays "off sale° may be
made until 10:00 P.M. No "off sale"
shall be made on New Year's Day,
Januery 1; Mexnorial Day, May
80: Indepenr}ence Day, Julq 4;
Thanksgiving Day ; or Christmas
Day, December 26, but "off sale"
may be made until 10:00 P.M. on
the evenings preceding such days,
unless the sale of liquor is other-
wise prohibited on such evenings,
