HomeMy WebLinkAbout#250 Licensing V STATE OF MINDtE50TA COUNTY OF RAMSEY CITY OF AIiDEN HILLS ORDINANCE N0: 250 AN ORDINANCE AMENDING SECTION 13-24 OF ARDEN HILLS CODE BY DELETING THEREFROM AND ADDING THERETO CEItTAIN LICENSES ANB PROVIDING FOR THE ESTABLISFIlMENT OF INVESTIGATIVE FEES BY RESOLUTION; SECTION 13-26 BY DELETING PRORATING OF CONTRACTORS LICENSES CONTAINED THEREIN;AND SECTION 6-62 AND SECTION 6-148 BY CHANGING INSURANCE REQUIREMENTS The City Council of Arden Hills ordains: Section 1. Amendment to Sectian 13-24 of Arden Hills Code. Section 13-24 of the Arden Hills Code is hereby amended to read as follows: "Sec. 13-24. Establishment of Fees bv resol.ution. License and investigative fees for all licenses required by the City pursuant to the provisions of this code and for the following types of licenses shall be from time to time established in a resolution adopted by the council: (a) Alcoholic beverage (intoxicating liquor); (b) On-sale wine and beer; . (c) Malt beverage; (d) Amusement facility (including bowling alley, arcade, dance hall, movie theater, pool/billiard tables and/or hall, indoor tennis and/or racquetball and/or squash facility, skating facility, outdoor tennis facility, driving range, shooting gallery and facilities for similar functions or activities); (e) Mechanical/electronic recreation devices-(including mechanical amusement device, mechanical amusement ride, mechanical musical device and devices of a similar nature); (f) Bulk storage plant or dealership; (g) Cigarette vending machine; (h) Dog kennel operator; (i) Garbage and refuse collector; (j) Heating, ventilating and air conditioning (HVAC) and gas installer; (k) Construction or building contractor; (1) Excavating contractor; (m) Retail sales vendor or dealer including, but not limited to, antique dealer, boat dealer, optometrist, laundry, mortuary, video sales and rental dealer, candy vendor, butcher, dry cleaning establishment, eQuipment rental dealer, caterer, automobile dealer, and dealers and vendors selling or renting goods not otherwise listed; (n) Restaurant/cafe/public dining room or eating house; (o) Service station and self service gas/diesel station and convenience store; (p) Sign/billboard; (q) Taxicab; (r) Hotel/motel; (s) Grocery, food market or supermarket (s) Drive-through or -in restaurant and fast food restaurant; (t) Rendering plant; and ' (u) Charitable gambling. Section 2. Amendment to Section 13-26 of Arden Hills Code. Section 13-26 of the Arden Hills Code is hereby amended to read as follows: "Sec. 13-26. Proratinq fees. Subject to the minimum fees established herein, all fees shall be issued on a calendar year basis and all fees,, except fees for HVAC and gas installers and excavating and canstruction or building contractors, shall be prorated, on the basis of the portion of the calendar year remaining after the date of issuance of the license. In cases of a fractional month, sixteen (16) days or more shall be considered to be a month hereunder. Upon tfie expiration of existing licenses granted on other than a calendar year basis, the license shall be renewed for the balance of the calendar year only, but in such cases the minimun fees established hereunder shall not apply. Section 3. Amendment to Section 6-62 and Section 6-148 of Arden Hills Code. Section 6-62 and 6-148 of the Arden Hills Cade are hereby amended to read as follows: "Sec. 6-62 Insurance. Before any permit shall be issued under the grovisions of this article, for plumbing work, the applicant therefor shall present evidence of liability insurance, unless exempt under State law, as required by a resolution adopted by the council from time to time." "Sec. 6-148. Bond Required. No license granted under the provisions of this article shall become effective until the iicensee shall have filed with the clerk-administrator a surety bond in the genal sum of five thousand dollars ($5,000.00), naming the city as abligee thereon, and conditioned such that the city shall be saved harmless and indemnified against any loss or damage by reason of improper or inadequate work performed hy the licensee. In lieu of said bond the licensee shall file a memorandum or certificate showing that it carries public liability and property damage insurance in such amounts and coverages as are established by a resolution adopted by the council from time to time, for accidents resulting from work perfarmed by the licensee in the city. Any such policy of insurance shall name the city as an additional insured and shall contain a provision that it shall not be cancelled during the term of the license without ten (10) days prior written notice to the city. Cancellation of such insurance policy shall be sufficient cause for revocation af any license granted hereunder less the licensee supplies other adequate insurance coverages as are required by said resolution before expiration of such notice. Section 4. Effective Date. This Ordinance shall be effective from and atter its passage and pubZication. Passed by the Council this 12th day of October, 1987. Robert L. Woodburn. Morrison Clerk Administrator STATE OF MINNESOTA GOUNTY OF RAMSEY CITY OF ARDIIV HILLS RESOLUTION Aff?. 87-63 RESOLUTION ESTABLISHING LICIISSE AND PERMIT FEES AND LIABILITY INSi3RANCE REQUIREMENTS WHEREAS, Section 13-24 of the Arden Hills Code provides that permit/license fees and insurance requirements be established from ti.me to time by resolution adopted by the City Council, and; WfiEREAS, the Finance Comittee, after careful consideration, has recommended changes in the present fee schedule, and; WHF.REAS, the Council has determined that Iiability insurance coverage for certain licenses shouZd be increased; NOW, THEREFORE, BE IT RESOLVED, that the following fees and liability insurance requirements are hereby established: Alcoholic BeveraRes On Sale (Bond - $5,000) 1,999 sq. ft. or less $3,000 2,000 to 2,999 sq. ft.- 4,000 3,000 to 3,999 sq. ft. 5,000 4,000 sq. ft. or more 6,000 Sunday 200 Off Sale (Bond - $3,000) 150 Club 300 Investiqative Fee $ 100 Liquor License Applicants Charitable Gambling Applicants Wine (On Sale) - 1/2 of Qn Sale Liquar Lieense Fee or 2,000 whichever is less. Comprehensive General Liability A. Bodily injuries, including death resulting therefrom sustained by any one person -$100,000, and $300,000 per any one occurrence, or combined single limit of $300,000 for bodily injury and praperty damage. B. Property damage liability -$100,000 per occurrence. C. XCU (Excavation, Collapse, Underground) Exclusion deleted where permittee or licensess work involves risks or exposure. 2. Comprehensive Auto Liability A. Bodily injuries, including death resulting therefrom sustained by any one person -$100,000 and $300,000 per any one occurrence, or combined single limit of $300,000 for bodily injury and property damage. B. Property Damage LiabiZity $100,000 per any one occurrence. C. Hire car and non-ownership coverage. 3. Worker's Compensation A. Coverage as required by Section 276.181, Subd. 2, of the Minnesota Statutes. BE IT FLTRTHER RESOLVED, that the above fees and insurance ,requirements shall be effective January 1, 1988.
