future streets which have been planned
by the Village;
4. The subdivision will not be detrimental
to the public welfare or injurious to
adjacent tracts in the area in which the
subdivision tract is located;

just residential development, so
that the Village's present vast
amount of privately owned open spaces
with potential for development do
not become exclusively filled with
residential, industrial, commercial,
and other uses; to secure for the
residents of the Village of Arden
Hills the social and physical advan-
tages resulting from the provision
of orderly park, recreational and
• open space facilities; to insure
that in fact such facilities wi11 be
provided; and to preserve, enhance,
and improve the quality of the
physical enviranment of the Village
of Arden Hills.
In accordance with the purpose and
intent of this Sub-paragrph, the
developer of any tract of land in
the Village of Arden Hills which is
to be developed for any ot the uses enumerated in the first sentence
of this sub-paragraph shall dedicate
to the public for public use as
parks, playgrounds, public open
space, or storm water holdzng areas
or ponds, such portion of his develop-
ment tract, not to exceed 15% thereof,
as the Village Council deems to be
reasonable and in fihe public interest,
, taking into consideration the locale
, of the development tract and the
accessibility and serviceability
which the proposed area to be dedicated
i for such public uses will provide
! for existing and future residents
' of the Village.

! 3. Delineation of Area to be Dedicated.
The actual area to be dedicated for
public use as parks, playgrounds,
public open space, or storm water
' holding areas or ponds shall be
' delineated, in the case of a resi-
dential subdivision under Sub-
c paragraph 1 above, on the subdividers
~ preliminary plat as required by
~ Section 6(C)8 hereof, and, in the
case of a development %Tithin the
purview of Sub-paragraph 2 above,
~ on the developer's site plan in addi-
tion to those items required therein
in Section V(C)2.c. of Ord. No. 99,
the Zoning Ordinance, and any provisions
amendatory thereof. A copy of such
preliminary plat or site plan shall
be referred to the Parks. and Recrea-

tion Committee for its scrutiny and
report to the Village Council of its
findings, conclusions, and recommenda-
tion, this referral being in addition
to the referral to the Planning
Comnission required in both Ord. No.
- 98 and 99.
If the Village Council, after
receiving the reports of both the
Parks and Recreation Conunittee and
the Planning Coimr,ission, 'shall
determine that such area is unsuit-
~ able for such purposes, it may
require the subdivider or developer
to relocate or rearrange such area
or to make such changes or revisions
in the proposed dedication as it
aeems necessary, reasonable, and in
the interests of the health, safety,
general welfare, and convenience of
the Village.
4. Cash in Lieu of Dedication. In lieu
of the dedieation of land required
by either Sub-paragraph 1 or 2 of
this Section, for the purposes enumerated
therein, the Village Council may
require the subdivider or developer
to pay to the Village, as an equivalent
contribution, an amount in cash equal
to the product of the percentage of
land required to be dedicated, deter-
, mined pursuant to the provisions`of
; Sub-paragraphs 1 and 2 of this Section,
multiplied by the undeveloped land
' value of the tract to be so subdivided
~ or developed.
, 5. Undeveloped Land Value Defined.
"Undeveloped land value" as used
, herein, shall be the market value of
the subject land at the time of the
application, to be determined by the
Village Council in its reasonable
discretion. As a basis for its
decision, the Council may request an
, appraisal at the expense of the sub-
~ divider or developer which shall be
, rn addition to the appraisal required
under Section 6(D)7 hereof. Such
! additional appraisal shall be obtained,
if the Council deems it advisable,
from an appraiser selected by the
Council. Thereafter the Council,
~ with the aid of both appraisals, shall
determine the "undeveloped land value"
hereunder.
6. Restriction on Use of Cash Contributions.
All cash contributions received by the
Village pursuant to Sub-paragraph 4
of this Section shall be placed in a
~ special fund and used only for the
~ acquisition of land for parks, play-
' grounds, pub],ic open space, and storm

water holding areas or ponds,
development of existing park
and playground sites, public
open space, and storm water
holding areas or ponds, and
debt retirement in connection
with land previously acquired
for such public purposes.
; 7. Proposed Park, Playground, Open

just residential development, so
that the Village's present vast
amount of privately owned open spaces
with potential for development do
not become exclusively filled with
residential, industrial, commercial,
and other uses; to secure for the
residents of the Village of Arden
Hills the social and physical advan-
tages resulting from the provision
of orderly park, recreational and
open space facilities; to insure
that in fact such facilities will be
provided; and to preserve, enhance,
and improve the quality of the
physical environment of the Village
of Arden Hills.
In accordance with the purpose and
intent of this Sub-paragrph, the
developer of any tract of land in
the Village of Arden Hills which is
to be developed for any of the uses
enumerated in the first sentence
of this sub-paragraph shall dedicate
to the public for public use as
parks, playgrounds, public open
space, or storm water holding areas
or ponds, such portion of his develop-
ment tract, not to exceed 15$ thereof,
as the Village Council deems to be
; reasonable and in the public interest,
; taking into consideration the locale
~ of the development tract and the
accessibility and serviceability
which the proposed area to be dedicated
; for such public uses wi11 provide
~ for existing and future residents
of the Village.

~ 3. Delineation of Area to be Dedicated.
The actual area to be dedicated for
public use as parks, playgrounds,
public open space, or storm water
holding areas or ponds shall be
; delineated, in the case of a re5i-
dential subdivision under Sub-
~ paragraph 1 above, on the subdividers
preliminary plat as required by
~ Section 6(C)8 hereof, and, in the
case of a development within the
purview of Sub-paragraph 2 above,
on the developer's site plan in addi-
tion to those items required therein
in Section V(C)2.c. of Ord. No. 99,
the Zoning Ordinance, and any provisions
amendatory thereof. A copy of such
preliminary plat or site plan shall
be referred to the Parks. and Recrea-

tion Committee for its scrutiny and
repart to the Village 6ouncil of its
findings, conclusions, and recommenda-
tion, this referral being in addition
to the referral to the Planning
Commission required in both Ord. No.
98 and 99.
If the ViZlage Council, after
receiving the reports of both the
Parks and Recreation Comnittee and
the Planning Conur.ission,*shall
determine that such area is unsuit-
~ able for such purposes, it may
require the subdivider or developer
. to relocate or rearrange such area
or to make such changes or revisions
in the proposed dedication as it
deems necessary, reasonable, and in
the interests of the health, safety,
general welfare, and convenience of
the Village.
4. Cash in Lieu of Dedication. In Zieu
r of the dedication of land required
4 by either Sub-paragraph 1 or 2 of
~ this Section, for the purposes enumerated
therein, the Village Council may
require the subdivider or developer
to pay to the Village, as an equivalent
~ contribution, an amount in cash egual
to the product of the percentage of
~ land required to be dedicated, deter-
mined pursuant to the provisions! of
Sub-paragraphs 1 and 2 of this Section,
F, multiplied by the undeveloped land
' value of the tract to be so subdivided
or developed.
S. Undeveloped Land Value Defined.
~ "Undeveloped land value" as used
herein, shall be the market value of
i the subject land at the time of the
` application, to be determined by the
Village Council in its reasonable
discretion. As a basis for its
decision, the Council may request an
appraisal at the expense of the sub-
divider or developer which shall be
tn addition to the appraisal required
under Section 6(D)7 hereof. Such
; additional appraisal shall be obtained,
if the Council deems it advisable,
from an appraiser selected by the
' Council. Thereafter the Council,
with the aid of both appraisals, shall
determine the "undeveloped land value"
hereunder.
6. Restriction on Use of Cash Contributions.
Al1 cash contributions received by the
Z7illage pursuant to Sub-paragraph 4
of this Section shall be placed in a
; special fund ar.d used only for the
; acquisition of land for parks, play-
' grounds, public open space, and storm
