USE OF THE WATERS OF LAKE JOHANNA
(62-78), It4POSING PENALTIES FOR
VIOLATIONS THEREOFF AND REPEALING
ORDINANCES Nos. 9 AND 33
The City Council of Arden Hills ordains:
Section 1. Purpose, Intent and Application. As
authorized y SectioT 3'7$ .32, Su-bd. 1 of Minnesota Statutes,
as now in effect and as hereafter amended, this Ordinance is
! enacted for the purpose and with the intent to control and
~ regulate the use af the waters of Lake Johanna (62-78), T. 30, ; R. 23, S. 33-34, Ramsey County, Minnesota, a body of water
located entirely within the boundaries of the City of Arden
! Hi11s, to promote its fullest use and enjoyment by the public
in general and the citizens of the City of Arden Hills in
particular; to insure safety for persons and property in
connection with the use of said waters; to harmonize and integrate
the varying uses of said waters; to fulfill a demand for the
regulation of said waters as indicated by citizens of the City of Arden Hills who responded to
questionnaires circulated by the City as ta the need far such
regulations; and to promote the general health, safety and
welfare of the citizens of Arden Hills.

Watercraft Safety Laws, Sections 361.01-361.29, as they now
exist and are hereafter amended, and the Boat and Water Safety Rules and Regulations promulgated by the State of Minnesota
Department of Natural Resources, NR 200-212, as the sariie now ,
exist and are hereafter amended, are hereby adopted, incorporated
herein by reference, and made a part hereof as if set forth in
their entirety. At least three copies of said Waters and Water-
craft Safety Laws and Boat and Water Safety Rules and Regulations,
so adopted, shall be marked as official copies and filed in t:le
office of the Clerk-Administrator of the City of Arden Hills
along witli this Ordinance.

incorporated herein by reference, shall be subject to the penalties

marked by the placement of buoys at

demarcate said Zone.

~ Section 5. Non-sanctioned Racing Prohibited. Racing--
that is, t e participat-ion o two or more operators o rnotorboats
a opera ing their motorboats in a competition of speed--shall be
prohi ited on the waters of Lake Johanna unless the same takes
~ place as part of a scheduled or public race, regatta, tournament
or other competition or exhibition duly sanctioned by the Sheriff
of R sey County pursuant to Section 361.20 of Minnesota Statutes,

+ Section 6. Enforcement and Notification of Public. The

` and irected to make such arrangements with the County of Ramsey, ~ incl ding entering into a joint powers agreement therewith, if
' necessary, to insure the placement of the buoys demarcating tYie
Rest icted 5peed Zones, the notification of the public of the exist-
ence of this Ordinance and the enforcement of the provisions of
this Ordinance by the Ramsey County Sheriff's office. Notwith-
stan ing anything herein to the contrary, officers of the Arden
Hill Police Department shall be authorized and entitled to enforce
the rovisions of this Ordinance in conjunction with and in addi-
tion to officers and deputies of the Ramsey County Sheriff's office,
~ whet er or not said officers of the Arden Hills Police Department
are eputized by the Ramsey County Sheriff's office.
Section 7. Penalties. Any person who shall violate any
of t e provisions of this Ordinance sha11 be guilty of a misdemeanor,
and pon conviction thereof shall be punished by a fine 'of not.more
than $300.00 or by imprisonment for not more than 90 days, or both.

repe led in their respective entireties.
Section 9. Effective Date. This Ordinance shall be in

The City Council of Arden Hills ordains;
Section 1. Purpose, Intent and Application. As

as now in effect and as hereafter amended, this Ordinance is
enacted for the purpose and with the intent to control and
regulate the use of the waters of Lake Johanna (62-78), T. 30,
R. 23, S. 33-34, Ramsey County, Minnesota, a body of water
located entirely within the boundaries of the City of Arden
Hiils, to promote its fullest use and enjoyment by the public
in general and the citizens of the City of Arden Hills in
particular; to insure safety for persons and property in
connection with the use of said waters; to harmonize and integrate
the varying uses of said waters; to fulfill a demand for the

Section 2. Adoption and Incorporation by Reference

Watercraft Safety Laws, Sections 361.01-361.29, as they now
exist and are hereafter amended, and the Boat and Water Safety .
Rules and Regulations promulgated by the State of Minnesota
Department of Natural Resources, NR 200--212, as the same now
exist and are hereafter amended, are hereby adopted, incorporated
herein by reference, and made a part hereof as if set forth in

Arden Hills Council on the 30th day of June, 1958, are hereby
repealed in their respective entireties.

Subd. 3. No watercraft or other marine conveyance upon the
waters of the State of Minnesota shall be equipped with any marine
toilet unless also equipped with a retention device acceptable to
the pollution control agency ofthe State of Minnesota.
