The City Council of Arden Hills ordainss
Section l. Amendment of Section 4 Subdivision A. of
Ora. No. 49 to Incorporate b Reference N~I3D 3 of r^innesota
Plumbin~ Code. Subclivision A. , entitled"Platerials , of Section
5., entitled "Construction Requirements", of Ord. No. 49 is
hereby arnended to reacz as follows :
Subdivision A. Naterials. The provisions of
MLHD123, entitled "Materials", of the 1linnesota
Plurnbing Code, as adoptea by the Niinnesota
Department of Health pursuant to M.S.A. §326.37,
as f iled witYi tiie Minnesota Secretary of State
and the Minnesota Department of Administratian
in June, 1969, ancl as tlie same now exists or is
hereafter amended, is hereby adopted and
incorPoratecl herein by reference and shall
apply with respect to all materials used in
sanitary sewer installations within the City of_
Araen Hills. At least one copy of said Niinnescta
Plumbing Code shall be marked as the official
copy of the City of Arden Hills, shall be fileu
in t:ie office of the Clerk-Adrainistrator of the
City of Arden Hills, and shall be available ior
inspectian. Section 2. Amenament of Section 5., Subdivision B. of
Ord. No. 49 to Incorporate by Reference MHD12 of_ Minnesota.~

of Section 5., entitled "Construction Requiren:ents", of Ord. No.
49 is hereby amended in its entirety to read as follows:
Suudivision B. Joints and Connections. Z'he pro-
visions of 14FiD124 , entitleci "Joints and Connections",
of the Plinnesota Plumbinq Coc?e, as the same is cited
in the preceding Subdivision A. of this Section 5.,
is adopted and incorporated herein by reference and
shall be applicable to all joints and connections to
be made in or to the sanitary sewer system o.f the
City of Arden Hills.
Section 3. Amendment of Section 5., Subdivision C. of

"Grades", of Section 5., entitled "Construction Requirements",
of Ord. No.. 49 is hereby amended to reaa as follows:
Subdivision C. Grades. Tne provisions of_
MHD131 (b)(1) and Table 131(a) (2) (A) o.f_ the
~ Nlinnesota Plumbing Code, as cited in
Subdivision A. of this Section 5., is
adopted and incorporated herein by refer-
ence and shall be applicable to the installa-
tion of all sanitary sewer piping within trie
City of Arden Hills. 4dherever possible, the
connectinq sewer shall join the building at
an elevation which is below the basertent
floor of such building.
Section 4. Arlendraent of Section 5., Subdivisioii D. of
Ord. No. 4 to Incorporate y Re erence MiD ~T2T and 3 and
125(b) of Minnesota Plumbing Code. Subdivision D., entitled
'Alignment , of Section 5., entitled "Construction Requirernents",
of Ord. No. 49 is hereby amended to read as follows:
Subdivision D. Alignment. The provisions
of MHD131 (b) (2) and (3) and 125 (b) of the
N2innesota Plurnbing Code, as cited herein-
above in Subdivision A. of this Section 5.,
are incorporated and adopted herein by
reference and shall be applicable to t7ie
alignment of connecting sewers and the
construction of cleanouts in the City of
Arden Hills. In addition tliereto, no
connecting sewer shall be laid parallel
to any bearing wall or footing unless
further distant than three (3) feet from
any such bearing wall or footing. No
connecting sewer shall be laid witlzin
twenty (20) feet of any existing well
except in a manner specifically approved by
~ the City Plumbinc Inspector.

conflict therewith.

Subdivision A. Incorporation by Reference of
Provisions of Article V. of Sewage and Waste
Control Rules and Regulations for the Metro-
politan Disposal System. It shall be unlawful
to discharge any waste$ or cause or allow any
wastesto be discharged into the municipal
sanitary sewer system of the City of Arden
Hills which do not comply with the waste dis-
cnarge regulations and limitations on such
discharges set forth in Sections 5-3 and 5-4
of Article V. of the Sewage and Waste Control
Rules and Regulations for the Nietropolitan
Disposal System, dated Decenber 1, 1971, as
now in effect and as hereafter amendeci, whieh
provisions are incorporated anct adopted herein
by reference and at least one (1) copy of said
Rules and Regulations shall be marked as the
official copy of the City of Arden Hills and
filed in the office of the Cleric-Administra.tor.
Subdivision B. Grease, Oil and Sand Interceptors
or Traps. To ensure the pr.oper disCharge of
waste containing excessive aRiounts of grease, oil
or sand, the City Plumbing Inspector may require
that grease, oil and sand traps or interceptors
be provicied, which traps or interceptors shall
comply in all respects with the requirements set
forth in MHD126 of the iviinnesota Plumbing Cide,
as cited herein in Section 5., Subdivision A.

interceptors shall not be required for private
dwellinq units which discharge on1y normal wastes
therefrom. Such traps or interceptors shall be.
maintained by the owner, at his expense, and sha.ll
be regularly cleaned and maintained for adequate
performance and efficient operation at all times.
Any subsequent alterations or additions to such
traps or interceptors shall not be made without
due notice to and approval by the City Plumbin,
Inspector.
Siibciivision C. Discharge of Industrial Waste
Subject to Procedures and Requirements of lvletro-
politan Sewer Board. With respect to the dis- charye or potential discharge of "industrial
waste", which for purposes of this Ordinance is
defined as any solid, liquid, or gaseous waste,
including cooling water, resulting from any
industrial or manufacturing process or from the
development, recovery or processing of natural
reseurces, the discharger or potential discharger
of suciz industrial waste shall be ssbject to the.
requireirients and procedures of the Nletropolitan
Sewer Board set forth in Sections 5-9 through
5-14 of Article V. of the Sewage and C;faste Control
Rules and Regulations for the Metropolitan Dis-
posal System, as cited herein in Subdivision A.
of this Section 6., and shall obtain the approval
of the Chief Administrator of the Metropolitan
Disposal System of plans and specifications for
any and all facilities to be used in discharging
such industrial waste, including meters and
sa.inpling facilities (if required), prior to
construction and installation of sucYi facilities;
provided, however, that the City Engineer shall

to be or being used prior to the submission
of such plans to the Chief Administrator of
the Metropolitan Disposal System for his
appraval of same.
Subdivision D. Discharge of Drainage uJater

Subdivision E. Accidental Discharges.
Section 5-15 of Article V. of the Sewage
and Waste Control Rules and Regulations for
the Nietropolitan Disposal System, as citect
nerein in Subdivision A. of tiiis Section G.,
is incorporated and adopted herein by refer-
ence and shall be applicable to an1T and all.
accidental discharges of prohibited waste
into the sanitary sewer system of the City
of Arden Hills which either directly or
indirectly eventuates in such prohibited
waste flowing into the Metropolitan Disposal
SySt.eIl1.
Section 7. Amendment of Section 12 of Orci. No. 49.
Section 12, entitled Penalties , is hereby amended tT s
entirety to read as follows:
SECTION 12. PENALTIES.
Any person, partnership, firm or corporation
guilty of violating any provision of this
Ordinance shall be guilty of a misdemeanor
and upon conviction thereof shall be punished
by a fine not to exceed Three Hundred and
no/100 Dollars ($300.00) or by imprisonment
in the county jail for a period not to exceed
ninety (90) days, or by both. Eacti and every
day or portion thereof-during which anv sucii
violation of the provisions of this Ordinance is committed, continued or permitted shall
be deemed a separate offense.
Section fi. Amendment of Ord. No. 49 by Substitutinq

and the word "City" shall be substituted therefor.
Section 9. Effective Date. Tizis Ordinance shall take
