AP1 ORDINANCE AMENDING CHAPTER 3 OF ARDEN HILLS CODE, THE ALCOHOLIC BEVER.AGES CHAPTER, BY DELETING SECTIONS THEREIN PROHIBITIPIG SALES OF ALCOHOLIC BEVERAGES ON ELECTION DAYS The City Council of the City of Arden Hills hereby ordains: Section 1. Deletion of Sectian 3-16(a) and Relettering of Remaining Subsections Therein. Section 3-16 of the Arden Hills Code is hereby amended by deleting therefrom Subsection (a) and relettering Subsections (b) through (e) as Subsections (a) through (d). Section 2. Amendment to Section 3-71 of Arden Hills Code to Delete Prohibition of Sales of Beer on Election Days. Section 3-71 of the Arden Hills Code is hereby amended to read as follows: "Sec. 3-71. Clasing hours. No sale of beer shall be made on any Sunday between the hours of 1:00 a.m. and 12:00 noon, and no sale thereof shall be made between the hours of 1;00 a.m, and 8:00 a.m, on any other day." Section 3. Effective Date. This Ordinance shall be effective from and after its adoption by the Arden Hills City Council and publication in the New Brighton Bulletin. Robert Woodburn, Mayor Attest: ~ ~ Charlotte McNiesh, Clerk-Administrator Election Day Liquor Sales McNiesh reported that State law now permits the sale of liquor on the day of any state-wide election, but unless municipalities have amended their ordinances accordingly, municipalities may re- strict the sales on days of State-wide elections. McNiesh ` reported that Arden Hills has not amended its ordinance; conse- quently, liquor establishments have been advised that liquor may not be sold on September llth (Primary Election)• After discussion, Rauenhorst moved to amend the sections of the Arden Hills Code and to specifically allow the sale of liquor on the day of the Primary Election, September 11, 1984. Motion was seconded by Hicks and carried unanimously.
