ORDINANCE NO. 71
AN ORDINANCE LICENSING AND
REGULATING THE ESTABLISH-
MENT, MAINTENANCE AND OPER-
ATION OF PUBLIC DRIVING TEES
' AND PROVIDING PENALTIES FOR
VIOLATION THEREOF.
TI3E VILLAGE COUNCIL OF ARDEN
HILLS DOES HEREBY ORDAIN AS
FOLLOWS :
3ECTION 1. No peraon, firm or cor-
poration shall establish, maintain or op-
erate a public driving tee, as hereinafter
defined, in the Vi]]age of Arden Hills
without first having obtained a license
therefor as hereinafter provided.
3ECTION 2. For the purpose of this
Ordinance a public driving tee shall
~ mean any area within the Village of
Arden Hills arranged or used for driv-
ing of golf balls by the public for s
fee.
SECTION 3. Any peraon desiring s
license to establiah, maintain or operate
a public driving tee shall make applica-
tion in writing to the Village Council
' by lette! addressed to the Village Clerk
or, if forms for such applications are
supp2ied by the Village Clerk, by com-
pleting such form. The follawing in-
formation is to be set forth in the ap-
plication :
(s) Name and address of the applicant.
(b) The location and legal deacription of
the Froposed driving tee site.
(c) tl etatement as to whether the ap-
plicant owns the property or, if
leased, s copy of said lease, together
- with a statement of the name of the .
property owner, if it is not owned
by the applieant.
(d) The location of the driveways to be
used for ingreas and egresa from
said site.
(e) A atatement as to the Froposed
hours of operatian.
3FCTION 4: The applieant shall de-
posit with the Village Clerk at the time
of the filing of his application the sum
' of Fifty Dollars ($50.00), which is here-
' by set as the license fee to operate a .
publie driving tee, and the Clerk shall
there upon deliver to each applicant
duplicate reeeipts therefor containing a
atatement of the purpose for which such
deposit is made, one of which receipta
shall be attached to and filed with said
. application. SECTION 5. No license for s public
driving tee shall be granted unlesa the
distance from the place of driving to
the nearest bwilding or road in the
direction in which the balla are driven
is 900 feet or more. Such tees shall be
so designed as to permit driving of
golf balls in one general direction, which
direction shall be away from the near-
. est gublic road. SECTION 6. The public driving tee
shall be so lighted as to effectively
illuminate all entrancea and exits, and
lighta used upon the premises shall be
. . placed in such a manner as not to shine upon or unreasonably interfere _
with surrounding property.
SECTION 7. In no event shall such
public driving tees operate between
the hours af 1 A.M. and S A.M.
SECTION 8. The Council may direct
such investigation of said areas as it
may deem neceasary, and the apBlicant
shall permit any representative of the
Village to inspect and examine the place
deacribed in the application. The Coun-
cil may grant such application if, after
making such investigation as it deem9
reasonably necessary, it determines that
the granting of said license is conaiatent
with the orderly development of the non-
reaidential areas of the V iilage and will
not unreasonably interfere with the de-
velopment and use af property adjoin-
ing or in the vicinity of the property
which is the aubject of the application.
No License shall be Sranted uniesa the
praperty ia properly zoned for such use
in accordance with the terma of the Zon-
ing Ordinance.
SECTION 9. The licenae herein pro-
vided shall expire on December 31 fol-
lowing the date of isauance, and if is-
sued for a period ahorter than one
' calendar year the license fee shall be
pro rated on a monthly basis. For the
purpose of pro rating any period in ex-
cess of fifteen days shall conatitute a
month.
SECTION 10. Any person violating the
Droviaions of this ordinance shall be
guilty of a misdemeanor and ahall be
' punished by a fine not to exeeed One
Hundre8 Dollara ($100.00) or by im-
prisonment not to exceed ninety days.
SECTION il. This ordinance shall be
published in the official yillage news-
paper and shall take effect and be in
force from and after its passage and
publicatian.

THE VSLLAGE COUNCIL OF ARDEN
HILLS DOES HEREBY ORDAIN AS
FOLLOWS :
SECTION 1. No peraon, firm or cor-
poration shall establish, maintain or op-
erate s public driving tee, as hereinafter
defined, in the Village of Arden Hilla
without first having obtained a license
therefor as hereinafter provided.
3ECTION 2. Far the purpose of this
Ordinanee a public driving tee ahall
' mean any area within the Village of
Arden Hilis arranged or used for driv-
~ ing of golf balls by the public for a
fee.
SECTION 3. Any person desiring a
license to establiah, maintain or operate
a publia driving tee shall make applica-
tion in writing to the Village Council
by lettei addreased to the Village Clerk
or, if forms for such applications are
aupplied by the Village Clerk> by com-
pleting sueh form. The following in-
~ formation is to be set forth in the ap-
ylieation : (a) Name and addresa of the applicant.
(b) The lceation and legal description of
the proposed driving tee site.
(c) A statement as to whether the ap-
. plicant owna the property or, if ]eased, a copy bf,said lease, together
with.a atatement of the name of the
. . property owner, if it is not owned .
by the applicant.
(d) The ]ocation of the driveways to be
used for ingresa and egreae from

SECTION 4. The applicant shall de-
