General Provisi.ons. 1.1 Purpose. This nrdinance is enacted for the purpose and with the intent to regulate the use of the Arden Hills Parks System by memhers of the public in order to promote the fullest use and enjoyment of the System by the public in general and the citizens of the City in particular, to insure safety f.or persons and property in conneetion with the use of the System, to harmonize and integrate the varying uses of the System, to protect public property and resources for posterity, and to enhance the general health, safety and welfiare of the citizens of the City. 1.2 Definitions. a. "City" shall mean and refer to the City of Arden Hills, Ramsey County, N!innesota. h. "Council" shall mean and refer to the City Council of the City. ' c. "Open Space Site" shall mean and refer to any public park including the narking area and . driveways appurtenant thereto, any pathway, any trail, or any other similar public open space area owned, improved, maintained, operate:d or otherwise controlled bv the City, or by the County of Ramse,y, or by any other public agency. , d. "System" shall mean and refer to all of the open space sites located within the City. e. "Director" sha11 mean and refer to eithPr the Parks and Recreation Dir.ector of the City or its Clerk-Administrator. f. "Per_son" shall mean and refer to any individual, firm, partnership, corporation or assaciation of persons. g. "Department" shall mean ancl refer to the Parks and Recreation Department of the City. h. "Open Spar_e Waters" shall mean and refer to any shoreline included in the System and those waters lying within 350 feet and immediately abutting such shoreline. e. No person shall possess, carry onto or scatter cn any beach, any glass bottle, broken glass, metai can, or other debris which could be a safety hazard. f. Na person shall use any beach area for pur- poses of picnlcking. , g. No person shall launch, dock or operate any watercraft Iri any designateC swlmming area. 3.3 Fishtnq. No person shall take any fish, frog, turtle or crayfish by angling, speartng, archery, netting or trapping from any Open Space Waters or trom any shoreline, pler or dock (ncluded In the 5ystem except In specificalty designated areas, and then only ln accardance with Chapters 98 and 101, Minneso#a Statutes 1974, as amended. 3.4 Btcyciing. - a. No person shall ride or operate a bicycle In any Open Space Site except on desfgnated bikeMays or surfaces normally prov(ded for vehicular traffic. b. No- person shall ride or operate a bicycle In vlolation of Chapter 169, Mlnnesota Statutes 1974, as amended. Persans riding a b(cycle shall observe and obey all traffic and dlre4t(onal . s(gns. c. No person shalt launch or land any boat, canoe, raft or other aatercraffi on or from any shore- Ilne which Is part ot the System except at taca- ttons specifically designated for such purposes. b. No person shall operate any watercraft withln an area which has been deslgnatedas a srlmming area. ' c. No person shalf drop or throw from any wator- crnft garbage, Ifitter or other debris. d. No persan shall stand up in, rock or operate any wntercraft In a careless or reckless manner. - 3 - 4.2 Animals. a. No person in custody of any pet or animal shall allow said animal to disturb, harass or interfere with other opPn space users or their " property. b. A11 state and local ordinances relating to the licensing and muzzling of animals and pets shall applv to same brought into any Open Space Site. 4.3 Hunting, Fishing and Molesting Wildlife. a. No person sha11 kill, hunt, trap, pursue, injurP, molest ar unnecessarily disturh ar have in possession sny species of wildlife including hirds, waterfowl, fish or other animals found within the confines af any npen Space Site, except that fishing ma,y be per- mitted in designated areas subject to laws and rPgulations as established by the State of MinnPsota. b. No per.son shall rob, disturb, or molest the nest, eggs or young of any birds or other animals within the confines of any npen Space Site. 4.4 Fires. a. Tlo person shall star_t or maintain a fire in any Open Space Site except small recreational fires in fireplaces, fire r.ings, and grills provided for that purposP in areas specific- a11y designated for such use.- Private grills may be used in designated areas provided that all ashes and residue therefrom be disposed of in containers provided for such disposal. b. Any person who starts or maintains a fire in an authorized area shall exercise continuous supervision from the time the f.ire is kindled until it is extinguished. 4.5 Waste and Litter. a. No person shall allow the release of any sub- stance which shall result in the pollutian of open space waters, or endanger the health of the public. b. No person shall dePosit, scatter, drop or. ' abandon in any Open Space Site any paper, bottles, cans, sewage, caaste, trash or other debris except in receptacles provided by the Department for such purposes. No person shall deposit in any receptacle in any Open Space Site any accumulation of waste or trash generated outside the boundaries of the site. 4.6 Firearms, Weapons, Fireworks. No person excegt a law enforcement officer shall possess or carry a firearm of any description, any airgun, bow and arrow, knife with a blade greater than three (3) inches, slingshot, dart or projectile thrower, or - 5 - . , ~ 4.14 Unlawful Sales. No person shall sell, offer for sale, hawk, peddle or_ lease any object, merchandise or service or carry on an,y manner of business or commercial enterprise except those concessions authorized or operated by the City. 4.15 Soliciting Alms. No person shall beg or solicit . alms, danations or contributions. 4.16 Construction. The construction of any above or below ground structure shall be subject to the approval ot tlie Council. 4.17 Posted Regulations, Directional Signs and Graphics. No person shall disregard or fail to complv with any posted regulations, directional signs and graphics, barriers or other control devices located within any Open Space Site or on any parkway. Section 5. Traffic Rules. a. No person shall drive or operate a motor vehicle within any Open Space Site except upon roadways, parking areas, parkways or other areas designated for such use. b. No person shall park, stop, or leave a vehicle in any Open Space Site or on any parkway during that period of time 30 minutes after sunset and 30 minutes befoxe sunrise. Exceptions may be ' made at the discretion of the Director in the case of emergency or when special use permita have been authorized or for other reasons the Director may determine necessar,y or desir.able. c. No person shall wash, grease, change oil, ser- vice or repair any vehicle in any Qpen Space Site. AI1 disab3ed vehicles sha11 quick3y be made operational or removed from the Open Space Site. Section 6. Penalties for Violation. 6.1 Misdemeanor. Any person violatinq any of the provi- , sions of this ordinance shall be acljudged guilty of . a misdemeanor. 6.2 Ejection. Any person violating any of the provi- sions of this Ordinance may be expelled, ejected or ousted at such tirne from an Open Space Site at the discretion of a law enforcement officer or Department employee. Section 7. Separability. The provisions of this Ordinance shall be separable, and the invalidity of any section, paragraph, subparagraph, subdivision or other part thereof sha11 not make void, impair, invalidate or affect the remainder thereof. Section B. Repeal.
