HomeMy WebLinkAbout#254 Dog Impound STATE OF MINNESOTA COUNTY OF RAMSEY CITY OF ARDEN HILLS QRDINANCE N0. 254 AN ORDINANCE AMENDING CHAPTER 5, I?ItFISION 2, SECTIONS 5-46(A) 5-47(b), 5-59, AND 5-61 OF ARDEId HILLS CODE AUTHORIZING POUNDKEEPER TO ISBUE DOG LICENSES, AND ALLOWING REDEMPTION QF DOGS WITHIN FIVE BUSINESS DAYS The City Council of the City of Arden Hills hereby ordains: Section 1. Amendment to Section 5-46(a) of Arden Hills Code. Section 5-46 of the Arden Hills Code is hereby amended to read as follows: "Sec. 5-46. License required; form. (a) Every owner of a dog more than six (6) months of age shall cause such dog to be registered, numbered, described and licensed through the office of the clerk-administrator of the city, or, the contracted poundkeeper. Such registration, numbering and licensing shall be for two (2) years for such dog while owned and kept by the same person while Iiving at the same address. (b) The license shall be a metal tag issued by the clerk-administrator." Section 2. Amendment to Section 5-47(b) of Arden Hills Code. Section 5-47 of the Arden Hils Code is hereby amended to read as follows: "Sec. 5-47. Initial fee; fee for duplicate tag. (a) The fee for registration, numbering, description and licensing shall be as established from time to time by the council in a resolution adopted thereby. (b) Duplicate licenses for lost tags or the changed address of the owner shall be issued upon application to the clerk-administrator, or, the contracted poundkeeper, and payment of such fee as is reQuired from time to time by the council in a resoZution adopted thereby." Section 3. Amendment to Section 5-59 of Arden Hills Code. Section 5-59 of the Arden Hills Code is hereby amended to read as follows: "Sec. 5-59. Redemption by owner; fee. Any dog impounded pursuant to the provisions of this division may be redeemed from the pound by the owner thereof within five (5) business days, excluding holidays, after such impoundment upon payment to the clerk-administrator of such impoundment fee as has been from time to time established by the city council by resolution, plus the license fee required pursuant to section 5-47 hereof in the event the dog is not licensed." Section 4. Amendment to Section 5-61 of the Arden Aills Code. Section . . 5-61 of the Arden Hills Code is hereby amended to read as follows: "Sec. 5-61. Redemption by person other than owner. If the owner of any dog impounded under this division shaZl fail to redeem such dog within five (5) business days after its impoundment, excluding holidays, any other person may, upon complying with the provisions of this division, redeem such dog from the pound and be the lawful owner of such dog thereafter. If the dog has been requested by a licensed educational or scientific institution under Section 35.71 of Minnesota Statutes, then it shall be given to such institution and shall not be sold." Section 5. Effective Date. `Fhis Ordinance shall be effective from and after its passage and publication.. Adopted by the Arden Hills Cauncil this ~~day of 1987. Robert L. Morrison Clerk-Administrator Crty of Arden Hil1s City Hall 1450 West Highway 96 Arden Hills, Minnesota 551 12 Re: Proposed Ordinance Amending Chapter 5 of Arden Hills Code Dear Pat: I have reviewed the above-referenced Ordinance and feel that the only change you need make thereta is to delete the phrase "not including Sundays or hoiidays" in the second and third lines of the revised Section 5-61 and to substitute therefor the phrase "excluding holidays", I do not think that Sunday would be considered a"business day".
