STATE OF MINNESOTA COUNTY OF RAMSEY VILLAGE OF ARDEN HILLB ORDINANCE NO. 95 - AN ORDINANCE PROVIDING FOR APPOINTMENT OF A PLANNING COMMISSION AND PRESCRIBING OFE POWERS AND DUTIES THERE- The Village Council of the Village of Arden Hills does hereby oxdain as fo]- _ lowa : 3ection I: Appointment of Planning Commissiun. At the first Council meet~- ing after the effective date of this ordi- nanee, and thereafter at the first bus- iness meeting of the calendar year, the ~ Mayor shall appoint a Planning Commis. sion to consist of nine members, and shall designate one of the members as Chairman of the PlanninK Commission, Such appointment ahall be submitted to the Council at such Council meeting and shal] become effective on approval by majority vote of the entixe Council. Va- - cancies on the Commission occwrring during the calendar year shaII be filled by the Mayor as soon as conveniently . possible, watL the approval of the ms- jority of the entire Council. The term of each member shall be for the calendar year or the baIance thereof following his apAaintment. Section II. Powers and Dutiee of the Plahning Commission. The Planning Commission shall have all of the powers and dutiea prescribed for the planning agency in the Municipal Planning Act, Chapter 670 of the Lawa of 1965. The Ptanning Commission shall consider amendmenta to the Zoning Ordinance, variancea ta the Zoning Ordinance upon . reports from the Board of Appeals, such other matters as are required to be re- . . ferred to it by the Municipa] Planning Act or other atatutea of the -State of . Minnesota, and in addition thereto the Planning Commission shall con5ider a11 other matters referred to it by the Vil- Iage Council. Recommendationa and findinga of the Planning Commiseibn shall in all casea . be advisory to the Village Council, which may take such action thereon as itdeema ' proper. 3ectian III. Procednre uf the Plan- ning Commissiun. The Planning Com- mission ahall prescribe its own rulea of procedure Eo the exEenE permissib7e - under statute and to the extent thet such rules are consisent with village or- dinsnces. The memUers may eleet a vice chairman, a secretary, and sueh other officera as they shall deem appropriate. The Commission shall provide a written record of its proceedings, including the minutes of its meetinge, findings, and the action taken by the Commission on each matter referred to it or heard bY it, fnc2uding the final recommendafion. Hearing shall be held by the Commis- aion in all mattera where public hear- inga are required by the statutes of the State of IvIinnesota or the ordinances of this Village, and hearinga may be af- forded to any interested parties on any other matter where tbe Commission , deems it appropriate. - , The Commission shall aubmit reports directly to the Village Council, which reports shall inc]ude the recommenda- - . tions of the Commission as to action - to be taken by the Council. In addition thereto, the Commisaion shall send cap- iea of its reports on variances of the Zoning Ordinance to the Board of Ap- peals In the absenee of an adverse written recammendation by the Plan- ning Commission regarding any report on the variancea suhmitted tq the Plan- ning Commission bp the Board of Ap- peals, iF the report of the Board of Appeals has been duly filed with the Planning Commission and the Planning Commission has thereafter met without taking action thereon, it shal] be con- elusively presumed that the Planning Commission concurs in the recommend- ation made by the Board oP Appeala to the Planning Commission and to the Village Council.
