HomeMy WebLinkAbout#096 Firearms ~ STATE OF MINNESOTA COUNTY OF RAMSEY VILLAGE OF ARDEN HILL3 ORDINANCE NO. 96 AN ORDINANCE RELATING TO THE DTSCHARGE OF WEAPONS AND THE , USE OF OTHER DANGEROUS DE- VICES, REGi3LATING THE USE , THEREOF, PROVIDING FQR SPECIAL PERMITS IN SPECIFIED CASES, AND PROVIDING PENALTIES FOR VIOLA- TIONS. The Village Counci] of the Village of Arden Hilla doeg hereby ordain as fol- ]ows : Section 1. Aefinitiona. Deadly Weapons. The term "deadly weapone" as used here- in shall include the following: (1) all firearme; (2) bows and arrows when the arrows are pointed or tiPPed; (3) - " all instruments used to expell at high velocity any pellets of any kind, includ- ing, but not limited to, BB guns and air rifles; (4) sIfng shots; (5) meta] knuckl- - - . - , es; and (6) switchblade knivea, being knives with retractable blades. Section 2. ExcePt as herein specifically suthorized, the disehsrging or use of deadly weapons within the Village of Arden Hills is hereby prohibited. Section 3. The siming of any deadly weapon, whether loaded or not, at or - - towards any human being, is hereby pro- hibited. Section 4. The selling, givinS> loaning, or furniahing in any way of any deadiy weapon to a minor under the age of 18 yeara withbut the written consent of his parents or guardisn is hereby pro- hibited. Section 5. No minar under the age of 14 years shall handle or have in his possession o= under his control, excePt - wLile accompanied by or under the im- mediate charge of hia parent or guar- dian, any deadly weapon. Section 6. The nosaeasion by any per- sona other than a public officer of any , deadly weapon concealed on his or her person is hereby prahibited. Section 7. 7`he firing of a gun or use . ef other dexdly weapon in the lawful de- fense of the person, property or family of the user of said weapon is excepted from the prohibitions set 4orth in this ' Ordinance, and similarly, the firing of a gun or uae of other deadly weapons in the necessary enforcement of the law, whether by a police officer or a private individual, is also excepted from the pro- hibitions contained herein. Section S. The Village Council may pxomulgate regulations for the suitable ~ protection of Persona and property and, . subject to such regulations, the Council may issue speeial permits to du19-organ- ized clubs and their members for shoot- ing or the uae of the use of sir rifles or bow and arrows on landa owned or leased bg aueh clubs. Such permits shall be issued by the Village Clerk upon dir- ection of the Council, shall be in writing, and shall be valid only when in the pos- seasion of the peraon to whom isaued. Section 9. Any peraon violating any of the proviaiona of this Ordinance ahall be guilty of a miademeanor, and upon conviction thereaf shall be punished by a fine not exceeding $100.00 or imprison- ment in the county jail for a term not to exceed 90 days, Section 10. The, Village Gowncil of the Village of Arden Hills does hereby ordain as fo]- lows : Section 1. Definitions. Deadly Weapona. - - The term "deadly weapons" as used here- in shatl inctude the following: (1) all firearms; (2) bows and arrows when the arrows are pointed or tipped; (3) all instruments used to expel] at high velocity any pellets of any kind, includ- ing, but not limited to, BB guns and air rifles; (4) sling shota; (5) metal knuckl- es: and (6) switchblade knives, being knives with retractable blades. Section 2. Except as herein specifically . aelthorized, the discharging or use of . deadly weapons within the Village of Arden Hills is hereby prohibited. Section S. The aiming of any deadly weapon, whether loaded or not, at or towards any human being, is hereby pro- hibited. ~ Section 4. The Selling, giving> loaning, or furniahing in any wap of any deadly weapon to a minor- under the age of 18 yesrs without the written consent of his parents or guardian is hereby pro- • hibited. Section 5. The firing of a gun or use of other dexdly weapon in the lawful de- fense of the person, property or family of the user of said weapon is excepted from the prohibitions aet forth in this Ordinance, and similarly, the firing of a gun or use of other deadly weapone in the necessary enforcement of the Iaw, whether by a Police officer or a private individual, is also excepted from the pro- , hibitions contained herein. Section 8.
