ORDINANCE NO. 225
AN ORDINANCE AMENDING THE ARDEN HILLS COI?E BY
CREATING A NEW DIVISION 4 IN ARTICLE I OF CHAPTER 4
THEREOF ENTITLED "GAMBLING DEVICES", WHICH CONTAINS
PROVISIONS FOR THE LICENSING AND REGULATION OF THE
OPERATION OF CERTAIN GAMBLING DEVICES; AND
PROVIDING PENALTIES FOR THE VIOLATION THEREOF
The City Council of the City of Arden Hills hereby
ordains:
Section 1. Amendment to Article I of Chapter 4 of the
Arden Hills Code by Adding a New Division 4 Thereto Entitled
"Gambling Devices". Article I of Chapter 4 of the Arden Hills
Code is hereby amended by adding thereto a new Division 4 which
is entitled and reads as follows:
"DIVISION 4. GAMBLING DEVICES.
Sec. 4-25. Definition of gambling device.
The term 'gambling device' as used herein means
those devices known as 'paddlewheels', 'tipboards',
'pull-tabs' (or 'ticket jars'), or apparatus used
in conducting 'raffles' as those various devices
are described and defined in Section 349.26 of
Minnesota Statutes, as amended.
Sec. 4-26. Incorporation by reference of Section
349.26 of Minnesota Statutes, as
amended.
Unless the provisions of Chapter 13 and of this
Division 4 of Article I of Chapter 4 of the Arden
Hills Code are inconsistent, in which case those
provisions shall control, all the terms, provisions
and subdivisions of Section 349.26 of Minnesota
Statutes, as amended--which regulate and provide
for the licensing of the operation of gambling
devices--are hereby adopted and incorporated herein
by reference.
Sec. 4-27. License required.
No person shall keep, operate, maintain or
permit to be operated or maintained upon premises
within his direct or indirect control any gambling
device without having first procured a gambling
device license.
Sec. 4-28. License fee.
As provided in Section 13-24 of the Arden Hills
Code, the fee for various types of gambling device
licenses shall be established in a resolution from
time to time adopted by the Council.

Sec. 4-29. Issuance of license; investigation by
olice.
A Iicense ta operate a gambling device shall be
issued by the Clerk-Administrator no Barlier than
fifteen (15) days after the application has been sub-
mitted. If requested by the Clerk-Administrator, however,
the Police Department of the City shal) investigate any
application and shall submit a recommendation to the
Clerk-Administrator prior to issuance or denial of the
license as provided in Section 13-8 of the Arden Hilis
Code."
Section 2. Amendments to Section 13-24 ot the Arden Hills
Code to Add a New Subsection (ss) Thereto. Section 13-24 of the
Arden Hills Code is hereby amended by striking the conjunction
"and" at fihe end of Subssction (qq) and the period at the end of
Subsection (rr) thereof, substituting e semicalon and the con-
junction "and" at the end of Subsection (rr) #hereof, and adding
a new Subsection (ss) thereto which reads as follows:
"(ss) Gambling device licenses."
Section 3. Penalt . Any person violating any provisions _
of this Ordinance, or the provisions of the Arden Hills Code
added hereby, shall be guilty of a misdemeanor, and upon conv(c-
tion thereo# shall be punished by a fine of not more than F(ve
Hundred Dollars ($500.00), or imprisonment for not to exceed
ninety (90) days, or both.
Section 4. Effectfve Date. This Ordinance shall take
effact and be in force from and after its passage and publica-
tion.
Passed by the Arden Hills City Council this 26th day of
July 01 1982.
