AL7ERATION. LOCATION OR MAINTENANCE OF SIGNS WITHIN THE CITY OF ARDEN HILLS, PROVIDING FOR THE ISSUANCE OF PERMITS. INSPEGTION AND FEES, AND PROVIDING PENRLTIES FOR VIOLATION. THE CITY COUNCIL OF THE CITY OF ARDEN HILLS DOES ORDAIN: SECTION 1 TITLE,"PURPOSE AND INTENT A., Title. This Ordinance shall be known, cited and referred to as the Arden Hills Sign Ordinance except as referred to herein, where it shall be known as "this Ordinance." B. Purpose and Intent._ 7his Ordinance is established to protect health, safety, general welfare and order within the City of Arden Hills through the establishment of a comprehensive and impartiai series of standards, regulations and procedures governing the type, numbers, size, structure, location, height, lighting, erection, use and/or display of devices, signs or symbols serving as a visual comnunication media to persons situated within or upon public right-of-ways or properties. ' The provisions of this Ordinance are intended to encourage opportunity for effective, orderly communication by reducing confusion and hazards resulting f rom unnecessary and/or indiscriminate use of corrmuni cati on faci 1 i ties. C. Separability. It is hereby declared to be the intention of the City that the several provisions of this Ordinance are separable in accordance with the follawing: 1. If any court of competent jurisdiction shall adjudge any provision of this Ordinance to be invalid, such judgement shall not affect any other provisions of this Ordinance not specifically inciuded in said judgement. 2. If any court of competent 3urisdiction shall adjudge invalid the application of any provision of this Ordinance to a particular property, building, or other structure, such judgement shall not affect the application of said provision to any other property, building, or structu re not specifically included in said judgement. 1 . . , , SECTIQN II RULES AND DEFINI'TIONS A. Ru1es. The language set forth in the text of this Ordinance shall be interpreted in accordance with the following rules of construction: 1. The sinsular number includes the plural and the plural the singular. 2. The present tense includes the past and the future tenses and the futu re the present. 3. The word "shall" is mandatory while the work "may" is permissive. 4. The masculine gender includes the feminine and neuter. 4r.' ' 8. Definitions. -1. Administrator: The C]erk Administrator of the City of Arden Hills or t at person's duly authorized deputy. , 2. Alteration: Any major alteration to a sign, but shall not include rautine maintenance, paintzng or change of copy of an existing sign. . 3. Biliboard: (See Sign, Advertising). 4. Building: Any structure erected for the support, shelter or enclosure of persons, animals, chattels or movable property of any kind. In addition, when said structure is divided by party walls without openings, each portion of such building:so separated shall be deemed a separate building. 5. Bui.lding Facade: That portion of any exterior elevatian of a building ex- tending from the ground surface at the base of the wall to the top of the parapet wall or eaves and for the entire width of the building. 'For the purpose of calculating permitted area for wall signs, the facade shall ic?clude all walls of an exterior elevation within an 8 foot horizontal • distance of the plane upon which the sign is located. 6. Business: Any establishment, occupation, employment or enterprise wherein merchandise is manufactured, exhibited or sold, or where services are offered for compensation. 7. Canopy.(or marquee~: A permanent roof structure attached to and supported by a bui ding and projecting over public or private property, not including projectqng roof eaves. 2 . . • , . , - g, District: Refers to a specific zoning district as detined by the Arden Hil ' . onrdinance, as amended. g., Dwellinq: A buiiding or portion thereof, designed exclusively for residen- tfat occupancy. inc)uding one-family, twa-family and multiple family dwell- ings. but not including motels, hotels and boarding'houses. 10. Frontage: That portion of a lot abutting a public right-of-way. 11. Mar uee: (See "Canopy") . . ' 72. Multip7e-Occupancy Structure: A principal building housing two or rrore independent businesses or industrial uses. 13, Setback: The minimum horizontal distance between a sign or other structure and a street right-of-way line or lot line. Setbacks shall be measured from the most outwardly extended portion of the sign or structure, 14. S_?~= Any identificntion, description, display, i]lustration or devtce aftixed to or painted upon a building, structure, or surface, including the ground, which directs attention to a business, place, activity, object, product, person, institution, or organizatinn and is intended to be viewed . 75. Sign, Area of: The area of the smallest geometric figure which entirely encloses a sign, including the copy, graphic etements, background, borders, and frame. 16. 5ign, Neight of: The vertical distance from the elevation of the street upon which the sign f ronts. measured at the centerline, to the top of the sign or its support structure, whichever is hi gher. For si ns fronting on Int rstate Highway Nos. 35-W and 694 and State ~runk Hi hway No. 5~, the hezght of a sign shall be shn or oits surface at the base ofatheesifnoto ~the etavaofothef i whichevergis higher. P . g pport structure, 77. Sign, Non-conforminq: a. Legal. A sign which lawfully existed at the time of the passage of this Ordinance or amendment thereto but which doe5 not conform with the regulations of this Ordinance. b? Illegat. A sign which was constructed after the passage of this Ord- inance or amendments thereto and does not conform with the regulations of this Ordinance. 18. Sign, Width of: The horiiontal distance from"the outer edges of the smallest rectangle which entirely encloses a sign, including the copy, graphic elements, background, borders, and frame. 19, ' Support Structure: The uprights, bracing, and #he framework reQuired to support a sign. This definition sha11 not include a building to which a sign,ls attached. - 3 - - 20, Wall Graphics: A design or illustration painted directly upon an exteriai- " wall surface intended to create a decorative effect. The wall graphic may or may not be of an advertising nature. 21, 7ypes of Signs by function: A. Advertising Signs: A billbaard, sign, or other communicative device which directs attention to a business, product, or service not ex- clusively related to the premise upon which the sign is located. b. Area Identification Sign: A freestanding sign located on the iden- tified premises which identifies the name of a residential subdivision consisting of thirty (30) or more lots; a multiple residential complex consisting of three (3) or more principal structures; an office. business or industrial structure containing two (2) or more independent concerns; a single business and/ar industrial complex consisting of three (3) or more separate structures existing on individual platted. lots or as a planned unit development; ar any integrated combination of the above. - , c. Business Sign: A sign which identifies a business or profession con- ducted or promotes a product or service offered or sold upon the premise where the sign is located. ' d. Construction Sign: A temporary sign placed at a construction site identifying the project, name of the architect, engineer, contractor, financier or other.involved parties. e. Directiona] Sign: Incidental signs designed to guide or direct pedestrians or vehicular traffic on the premises upon which the sign is located. Such sign may include the identification of the business, industry, institution, or residential complex to which it applies, but shall not include advertising copy. f. Garaqe Sale Sign: A temporary sign advertising a garage sale , or rummage sale occuring on t•he premises upon which the sign is located. g. Informational Sign: A sign giving information to employees, visitors or delivery vehicles on the premises upon which the sign is located. Such sign may include the identification of the business, industry, institution, or residential complex to which it applies, but shall not include advertising copy. h. Institutional Sign: A sign which identifies the name and other charac-. teristics of a public or semi-public institutian on the site where the sign is located. i. Personal Identification Sign: A sign which identifies the name(s), address, and/or occupation of the occupant(s) of the premises on which the sign is located. 4 • . , Political Sign: A temparary sign promoting the interests of bona fide candidates for elective, political office or far promoting an election issue. k. Public Sign: A sign e rected by a governmental unit for directing traffic, issuing warnings, identifying locations, or for other official identification. 1. Real Estate Sign: A temporary sign erected for purposes of advertising for sale, rent or lease a particular building and/or parcel of property. M. Special Events Sign: A temporary sign advertising an event or program sponsored by the Gity, a school, a church, or civic organization; a temporary sign for a grand apening, special sale, or similar even related to a commercial establishment. n. Street Directory Sign: A sign ideniia ~Sactor addresses streete dwellings which are located on a cu 22. Types of Signs by Structure or Design: a. Animated Sign: A sign which creates an effect of action or motion. This definition shali nat include banners, pennants, flags, or flash- ing signs, or rotating signs. b. Banners, Pennants, and Streamers: A temporary sign or attention- getting device generally made of flexible materials, such as paper, clath, or plastic. National and state flags shall not be included in this definition. c. Changeable Copy Sign: A sign which is designed to allow for periodic changes in copy or symbals, either by manual or electronic means. This definition shall include time and temperature signs. Changeable copy signs shall be conside red as Business Signs for the purpose of caiculating allowable sign area. d. Flashing Sign: A sign which contains light which is not maintained in a stationary position or at a constant intensity or color. This definition shall not include changing copy of a time and temperature sign. e. Free Standing Sign: A sign which is independently supported by a support structure in or upon the ground and is not affixed to any part of a building. This definition shall include ground signs. 5 ~ • f. Ground Sign: A sign which is attached to or is an integral part of an independent architectual wall or feature which is attached directly to the ground. g. Multiple-faced Sign: A sign which contains informaition oti two or more separate faces or planes. ' . h. Portable Sign: A sign which is constructed or placed upon a Ci1c1551S with wheels or skids in order to be movable f rom one location to another, such as may be mounted on an autornobile or traiier. This definition shall not include permanent identi- fication signs painted directly on vehicles which are principaily • used for transportation. i, Pro'ectin Si n: A sign with a face perpendicular to the wall of a ui ing upon which it is attached. Rotating Sign: A sign which revolves or rotates on its axis either by wind or other mechanical means or produces a rotating effect through use of illumination. k• ~Roof Si gn: A sign erected upon or above a roof or parapet wall of a uilb dirig and which is wholly or partially supported by said building. 1. Temporary Sign: A sign which is intended to advertise community or civic projects; construction projects; real estate for sale, rent or lease; garage sales; candidates for political office; or special events on a temporary basis, with a specified period of time for use. M. Wall Mounted Sign: A sign attached to, erected against, painted upon, or constructed as an integral architectual feature of a wall of a building or surface of a canopy or marquee. n• Window Sign: A sign mounted within the window area of a building and intended for viewing from the exterior of the building 6 ' . SECTION III PERMITTED ANO-PROHIBITED SIGNS A. Permitted Siqns. All permitted signs ltsted"in this Section shall be constructed installed, erected, placed. located, altered, recan- structed, or relocated in accordance with the prn visions of Section il of, this Ordinance. 1. Signs Nat Requiring a Sign Permit. The fallowing signs shali not require a sign permit: a. Public signs b. Fe rsonal identification signs , c. Window signs . d. Temporary signs (1) Real Estate Signs ~2) Political Signs 3) Garage Sale Signs" 2. Signs Requiring Sign Permit. The following signs shall be allDwed only after the City has issued a sign permit. Planning Comnission review and Council approval shall not be required. a. Business Signs b. Construction Signs , c. Directional'Signs (maximum of 2 per site) d. Informational Signs (maximum of 2 per site) ~ e. Advertising Signs (Billboards) 3. Siqns Requiring Planning Cammission Review and Council Approval. The following signs shall reguire Planning Corrmission review and Council approval before a permit will be issued: a. Area identification signs b. Institutional signs c. Street di rectory signs d. Directional signs (if more than 2 per site) e. Informational signs (if mare than 2 per site) f. Flags cantaining logos, symbols, or names of a private business or institution. g. Groupings of three or mare flags, including national and ' state flags. h. Si n pl ans for:, (l~ Multiple occupancy business and industrial structures (2) Shopping centers (3) Office and industrial parks (4) Planned Unit Developments consisting of two (2) or more StructUreS 4. Signs Requiring Special Use Permit. The following signs shall requfre a Special Use Permit: a. Roof Signs b. Wall graphics c. Signs not specifically permitted by this Ordinance. 7 l . - . `5. Signs RecLuiring Council Approval Only. The followtng temporary signs and adve rtising devices shall require City Councii app roval without Planning Commission review. a. Special event signs and adve rtising devices b. E c~er qnc~ t~mporary signs as described in Section IV-E o t~is rd~.nance. B. Prohibited The following signs and advertising devices shail be prohibited. 1. Any sign which obstructs the vision of drivers or pedestrians or detracts from the visibility of a tra€fic control device. 2. Signs that resemble official markers or traffic control signs except fo r on-site directional signs. 3. Flashing, rotating, or animated signs. 4. Arojecting signs. 5. Signs painted on or attached to trees, rocks, or other naturai surfaces, or attached to public utility poles, bridges, or similar public structures. 6. Signs created by the arrangement and/or forming of plants or other landscaping materials. 7. SigRS consisting of banners, pennants, ribbons, streamers, strings of light bulbs, except as Special Event Signs as allowed by Councii' approval. - 8. Portable signs, except as Special Event Signs as allowed by Council approval. g, Searchlights. _ _8 SECTION IV GENERAL FROVISIONS A. Public signs shall be permitted in all districts. B. A1l signs as required by Occupational Safety Hazards Act shall be per- mitted in ail districts. C. No signs other than public signs shall be erected ar temporarily placed within any street right-of-ways or upon any public lands or easements or right-of-way. U. No sign permitted by this Ordinance shall, by reason of its location, color or intensity, create a hazard to the safe, efficient movement of vehicular or pedestrian traffic. No private sign shall contain words which might be construed as traffic controls, such as "Stop", "Caution". "Warning", etc. uniess such sign is intended to direct traffic on the premises. E• The City Council may approve the construction of a temporary sign not specifically defined in this Ordinance if a valid need is shown to exist by virtue of an emergency or special situation, such as highway construction. The duration, location, size and other conditions upon the sign shall be estabTished by the Council at the time of approval. F. For the purpose of calculating the area of a sign under this Ordinance, the fo]lowing rules shall apply: l. Sign area shall include the copy, graphic elements, background, borders, and frame. 2. Changeable copy signs shall be considered as part of the area of a business sign and shall not exceed 50 per cent of the allowable area for a business sign. 3. 7he maximum area for multiple-faced signs shall be twice the allawable area indicated in'Sectian V of this Ordinance. 4. The area of a ground sign shall include the architectual wall or feature to which it is attached. 5. Sign support structures which are an integral part of the design of the identification device shall be calculated as part of the allowable sign area and may be permitted only by Planning Commission review and Council approval. 9 ~ . ~ . . , • , SECTION V SCHEDULE OF DISTRiCT PROVISIONS The following 1s a schedule of the substantive and procedurai requirements for the construction, installation, erection, placement, location, alteration, reconstruction, and reloc-ation of signs within the various districts of the City and the Special Sign Districts designated and established in Section VI hereof. The requirements set forth below are subject to the additional general and specific regulations and procedures contained in Sections IV. VI. VII and VIII hereof. 10 'mnnN r. Service Stations Signs far autorrpbile service stations shall be regulated by the sign pro- visions fnr the zoning district in which the station is located. 1n addition, automobi]e service stations may display signs which identify current fuel prices and car wash facilities. Said signs shall be limited ta a maximum of twelve (12) square feet each and shall be limited to a maximum height of ten (14) feet. This additional sign area, however, sha11 be considered part of the maximum allewable sign area for the subject • property. Where possible, the additianal signs shall be attathed ta the primary business sign structure. B. The plan shall be reviewed by the Planning Commission and approved by the City Counci]. No sign shall be const ructed far an individual use unless it is consistent with - the approved sign p1an. 1. The above described developments may display area identifieation signs consistent with applicable district provisions of this Ordinance. 2. Individual tenants of a multiple occupancybusiness ar industrial struciure shall be allowed a separate identification sign only if the tenants' business has an exclusive exterior entrance. The signs shall be limited to ont wall mounted sign per entrance. If 4 or less signs are provided, the composite area shall not exceed the maximum area allowed for wall mounted signs in the distritt. If 5 or more signs are provided, the maximum size of each sign shall be 50 square feet. 3. Far any multiple occupancy business or industrial structures, directory signs shall be permitted for each corrmon public entrance. Each directory sign area shall not exceed a total of fifty (50) square feet and shall be located within fifty (50) feet of the corrmon public entrance being served. ~ z 13 ' . , " . . • . 4. An office or industria] planned unit developm'ent or shopping center consisting of two (2) or more individual structures shall be allowed, in addition k~s the area identification sign, one sign per structure. The area of such individual signs shall not exceed the maximum area allowed by the applicable district provisions of this Ordinance. f . 5. A residentiaZ planned unit development shall be allowed, in addition to the temporary area identification sign, personal identification signs for indiyidual dwellings or for multiple dwelling structures with individual entrances. Multiple dwelling structures with common entrances shall be allowed building identigication signs not exceeding 12 sguare feet in area. 1C.Highway Advertising District Advertising signs (bil)boards) shall be permitted within all L-I. Limited Industry Districts with frontage upon Interstate Highway 35W, subject to the following requirements: 1. The height of any sign shall not exceed 35 feet. 2. The a rea of any sign face shall not exceed 700 square feet. 3. The maximum aggregate area of advertising signs within the Nighway Advertising District shal] not exceed a ratio of .60 square feet of sign area per lineal feet of Interstate . Highway frontage. • 4. The width of any sign shall not exceed 50 feet. 5. Signs sha11 be setback a minimum of 40 feet f rom the Inter- state Nighway right-of-way line. 14 . . - • SECTION VII CONSTRUCTION, MAINTENANCE AND INSPECTION A. Construction • 1. The construction of all signs permitted by this Ordinance shall be made in accordance with the provisions of the Uniform Sign Code published by the International Conference of Building Offitials. 2. No sign or sign structure shall be erected in such a manner that any portion of its surface or supports will interfere in any way with the free use of any fire escape, exit, or stand-pipe. No sign shall obstruct any window. Signs shall be so located as to maintain all required clearances from overhead power and service lines. • 3. The source of light for illuminated signs shall be shielded and directed in such a manner that it is not directly visible from ad- joining property and will not create a traffic hazard. 4. Sign support structiures for all free standing signs-except ground signs shall be limited to posts or columns not in excess of that commonly required to support the size and weight of the sign. B. Maintenance All signs and sign structures shall be properly maintained and shall be•kept in a safe orderly condition. In addition, all parts and supports shall be properly painted. Any sign or sign structure which is rotted, unsafe, de- teriorated, defaced or otherwise altered, shall be repainted, repaired or replaced by the licensee, owner or agent of the owner of the property upon which the sign stands, upon written notice of the Administrator. C. Inspection 1. Every sign hereafter erected shall have painted or designated in a con- spicuous place thereon, the permit number of the City of Arden Hills. 2. All signs for which a permit is required shall be subject to inspection by the Administrator. The Administrator is hereby authorized to enter upon any property o r premises to ascertain whether the provisions of this Ordinance a re being obeyed. Such entrance shall be made during business hours unless an emergency exists. 3. If the Administrator determines that a sign is dilapidated or a public nuisance, he shall submit to the City Council and the Owner of-the sign such finding in writing, enumerating the • conditions and reasons-for his finding Thereupon, the City Council shall notify the Owner and hold a hearing at which the Owner of the sign shall be heard. If the CityCouncil upholds. the finding of the Aclministrator it mav order immediate removal byproviding the Owner with written notice-of such order setting forth the reasons therefor. 11 5 . SECTION VIII_ APPLICATION* PERMIT. AND VARIANCf PROCFDURES ' A. Sign Permits 1. Appl ication Procedure a. Any person propasing to erect, pl nce, reconstrutt. alter, or relocate any sign except those listed in Section III-A1 sha11 make appiication for a sign permit. b. The application sha)1 be submitted on forms prescribed or requfred by the Administrator and shall be accompanied by the following information plus whatever additional information or documenta- tion the Administrator shall require: (i) The dimensions of the sign and, where applicable, the dimensions of the wal] surface of the bullding to which it is to be attached. ffl The maximum height and c]earance of the sign, . The proposed location of the sign in relation to the face of the building, in front of which or above whi ch i t i s to' be e rected. (4) The proposed location of the sign in relation to the boundaries of the iot upon which it is ta be situated. (5) If the sign is to be illuminated , the technical means by which this is to be accomplished. (6) Where the sign is to be attached to an existing building, a description or photograph of the face of the building to which the sign is to be attached. (7) The name and address of the user of the sign and the location of the sign. 2. Issuance of Sign Pe rmit a. Upon fi2,ing of an app]ication, the Administrator shall examine the plans and accompanying data and determine if it is in compliance with the provisions of this Ordinance. If it is found to be in conformance, the Administrator shall issue the requested sign permit for signs not requiring Council approval. b. For signs requiring Planning Comnission review and/or Council approval. the Administrator shall refer the application to the appropriate body. For signs requiring Planning Commissian review: the Building Permit procedure described in the Zoning Ordinance 7 of the City of Arden Hills sha71 be followed. Upon P]anning - ~ Comniss9on review and/or Council approva], the Administrator shall issue the requested sign permit. 3. Permit Fees a. An initial application fee shall be required with the application for any siyn permit. The amount of such fee shall be as established from time to time by resolu- tion adopted by the City Council. b. An annual sign permit fee shall be required for alI signs except the fallowinq: (1) Signs listed in Section III-A1 (2) Directional Signs . (3) Informational Signs The amount of said annual sign periuit fee shall be as established~from time to time by resolution adopted by the City Council. 16 . , B. Special Use Permits. For signs requiring a Special Use Permit, the Special Use Permit procedure described in the Zoning Ordin- ance of the City of Arden Aills shall be followed. C. Variances. In order to provide additional flexibility in the eri€orcement of this Ordinance and to alleviate hardship and injustice, the City Council may grant variances from the dimensional reguirements of this Ordinance. Upon application from the person seeking a permit for the erection or installa- tion of a sign, the request for variance shall be processed in accordance with applicable provisions of Arden Hills Zoning Ordinance as amended. -Such variance shall require a finding of fact that an undue hardship exists if the Ordinance were strictly enforced and shall be based upon the following considerations: l. That the hardship is attributable to the partieular pfiysical surroundings, topographical conditions or shape of the specific parcel of land involved. 2. That the granting of the variance would not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity or zone in which the property is located. 17 cc: _ SECTION IX NONCONFORMING SIGNS 1. Any nonconforming temporary or portable sign existing at the time of adoption of this ordinance shall be made to comply with the requirements set fo rth herein or shall be removed within 60 days after the adoption of this ordinance. 2. Nonconforming permanent signs lawfuliy existing at the time of adoption of this ordinance shall be allowed to continue in use, but shall not be rebuilt, altered other than to change the message, or reiocated without being brought into compliance with the requirements of this ordinance. After a nonconforming sign has been removed, it shall not be repiaced by another nonconforming sign. 3. Whenever use of a nonconforming sign has been discontinued for a period of three months, such use sha11 not thereafter be resumed unless in conformance with the provisions of this ordin- ance. ' 4. Existing signs which will require Special Use Permits after the enactment of this Ordinance but are otherwise in conformance with the provisions of this Ordinance shall apply for a Special Use Permit within one year of the effective date of this Ordinance. 5. Nothing in this Sectionshal l re] ieve the owner or user of a legal nonconfo rniing sign or owner of the property on which the legal nonconforming~sign is located from the provisions of this Ordinance regarding safety, maintenance and repair of signs, provided that any repainting, cleaning and othe r normal mainten- ance or repair of the sign or sign structure shall not modify the sign structure or copy in any way which makes it more nonconforming. SECTION X ENFORCEMENT AND PENALTIES A. This Ordinance sha]1 be administered'and enforced by the Administrator who is appointed by the City Council. The Administrator may institute in the name of the City of Arden Hills any appropriate actions or proceedings against a violator as provided by statute or ordinance. In the event that a sign or billboard in violation of the provisions of this Ordinance is not removed, repaired or licensed, if eligible for a license, within the time stated in the violation notice, within the same may be removed by the City after condemnation in the same manner as provided for the condemnation and destruction of buildings or structures in the Buiiding Code, and the expense of such conderrnation and destruction including the expense of necessary legal proceedings, shall be imposed as a lien upan said premises, 18 _ , ~ • B. Any person, firm or corporation who violates, disobeys, omits, neglects ar refuses to comply with, or resists the enforcement of any of the provisions of this Ordin- ance shall, upon conviction thereof, be fined or penalized not more than the maximum levels established by the State of Minnesota for misdemeanor offenses. SECTION XI REPEAL OF CHAPTER 21; SUBSTITUTION OF THIS ORDINANCE Chapter 21 of the Arden Hills Code, and all ordinances amending the pravisions thereof heretofore adopted, are hereby repealed. The terms and provisions of this Ordinance shall be inserted in the Arden Hills City Code as a new Chapter 21 and substituted for the terms and provisions of that Chapter, and ordinances amenda- tory thereof heretofore adopted, which have been hereby repealed. , . SECTION XII EFFECTIVE DATE This Ordinance shall take effect and be in force from and after its passage and publication in accordance with law.
