Gentlemen:
As I advised at the Council meeting on June 24,
1974, an ordinance is invalid if it has not been published
in the official newspaper of the Village (M.S.A. §412.191,
Subd. 4). Since Ordinance No. 172 was never published,
it has never become a valid ordinance of the Village.
Although it probably was not necessary, the motion rescinding
this ordinance unanimously adopted by the Council fortifies
the invalidity of the ordinance.
I would suggest that the Council not use "NoR 172"
for ordinances subsequently adopted.
