CITY COUNCIL TCAAP WORKSESSION MEETING
JULY 28, 2008
6:00 P.M. - ARDEN HILLS CITY COUNCIL CHAMBERS
CALL TO ORDER/ROLL CALL
Pursuant to due call and notice thereof, Mayor Stan Harpstead called to order
the City Council Work Session meeting at 6:20 p.m.
Present: Mayor Stan Harpstead; Council Members David Grant, Brenda
Holden, Fran Holmes, and David McClung.
Absent: None.
Also present: City Administrator Ron Moorse; Assistant City Administrator
Noah Simon; Finance Director Susan Iverson; City Planner James Lehnhoff;
Stacy K vilvang, Ehlers & Associates; Steve Bubul, Kennedy & Graven;
Mike Comodeca, Spencer Fane Britt & Brown, LLP; Gen McJilton, Ryan
Companies; Tom Reppe, Ryan Companies; and Sara Peterson, Dorsey &
Whitney, LLP.
1. AGENDA ITEMS
A. Discussion of Public Relations Piece Associated with Release of
Remedial Investigation Report to MPCA
Stacie K vilvang, Ehlers & Associates noted a report was being written to provide
information to the public to address any questions they may have regarding the
remedial investigation report and the clean up to be done on the TCAAP site. Ms.
Kvilvang indicated the City will work jointly with RLD to create a press release.
Ms. Kvilvang reported this press release would be printed in the local newspaper
first and then passed along to the local media. She indicated the intent of this
release was to announce a public meeting that would be held to review all

information regarding the remedial investigation data along with inviting residents
to an open house.
Councilmember Holden questioned when an open house would be held.
Ms. Kvilvang stated this would stem off when the remedial investigation report is
sent to the MPCA and when the information was made public. She indicated the
Council would be kept informed as to the timeline to assure all members can be
present at the open house.
Councilmember Holmes asked what information would be released to the MPCA
and asked for the purpose of such an open house.
Ms. Kvilvang stated the RI data would be released and that the open house would
allow the City to present and explain the data, and allow time for the Council to
field questions.
Mayor Harpstead stated that this process would allow the Council to provide its
residents with the same information being provided to the MPCA.
B. Overview of Documents Related to Transfer of the TCAAP Property
Mike Comodeca, Spencer Fane Britt & Browne, LLP handed out a spider
diagram addressing the TCAAP property transaction. He stated this diagram lays
out in the most organized fashion possible the various parties and documents
involved in the transfer of the TCAAP property from the Army to the City of Arden
Hills. Mr. Comodeca reviewed the diagram with the Council in great depth and
detail explaining how each party worked together to make this transaction possible.
Councilmember Holden questioned why there was not a PP A between RRLD and
MPCA.
Mr. Comodeca explained the document between these parties was the Response
Action Agreement (RAA), which contains a lot of the same terms and provisions
that the PP A will.
Councilmember Holden asked what significance the line from the FF A to the
EP A had.

Mr. Comodeca stated this was showing that the EPA and MPCA both signed the
FFA.
Mayor Harpstead questioned if all of the parties involved had to be in agreement
before the deed was transferred.
Mr. Comodeca stated this was the case.
Mayor Harpstead asked if, following the deed transfer, there would be certain
restrictions on land uses.
Mr. Comodeca indicated this was the case and that the Response Action
Agreement (RAA), MOA and PP A would spell out those restrictions and how they
would be lifted. He noted the same process would be used in all of these
documents.
Councilmember Holden questioned if any permanent land restrictions were to
arise, if that information would have to be written into each land deed.
Mr. Comodeca stated this would be the case.
It was the consensus of the City Council to direct staff to proceed with the activites
necessary for the transfer of deed as presented.
