Requested Action
Consider Ordinance 2008-012 to amend Section 1325.09 and Section 1325.05 Subd. 8 of the
Zoning Code to apply the recently adopted B2 District design standards to the B3, Service
Business District.
Background
On October 27, 2008, the City Council adopted the "Guiding Plan for the B2 District." Chapter
5 of that Plan included design guidelines for development and redevelopment in the B2 District.
As a result of the adoption of this plan, Staff drafted Ordinance 2008-010, which adapted the
design guidelines in the Guiding Plan and integrated them with existing design standards into the
City's Zoning Code, adding significant detail as needed. On November 5, 2008, the Planning
Commission recommended approval of Ordinance 2008-010. The City Council approved the B2
District design standards at their November 24, 2008, meeting.
During the process of drafting and approving the B2 District design standards, Staff recognized
an opportunity to apply the same standards to the B3, Service Business District, as well. The B3
District is located north of the B2 District along Lexington Avenue to Hwy 694. Both the B3
and B2 Districts are primarily commercial in nature and have a similar purpose as defined in the

Zoning Code. The B3 District is currently without any meaningful design standards. As a result
it is difficult for the City to ensure the quality design and architecture that will now be required
in the adjacent B2 District.
B3 District Design Standards
The recently adopted Guiding Plan for the B2 District addresses detailed development principals,
design standards, and calls for long-term transportation and public improvements along County
Road E. The B3 District was not part of the study area for this plan and is not proposed to be
included in the long-range vision for the B2 District. Staff feels that the B3, B4, and I -Flex
Districts require their own long-range visioning process, similar to the one recently completed
for the B2 District. However, Staff also feels that adopting design guidelines for the B3 District,
which is a highly visible commercial corridor in the City, would help forward the principals of
the B2 District and improve the quality of the development that takes place there.
1320.09 —Special Requirements for the B3 Service Business District
Section 1320.09 of the City's Zoning Code (Attachment B) describes the special
requirements for the B3 District. Subdivision one outlines the procedure for evaluating new
development, redevelopment and significant modifications to a site, which will now be
required to go through the PUD process. As such, procedural references to the Conditional
Use Permit process have been removed from this section. Staff is proposing to adopt the
same procedures for reviewing and approving development proposals in the B3 District was
recently adopted in the B2 District.
In order to promote other minor improvements and upgrades to a site, certain types of
changes are not considered significant modifications and are recommended to be exempt
from the PUD Process. The exemptions are listed in subdivision one. This provides some
flexibility so that minor changes can move forward in a timely fashion with administrative
review and approval.
In addition, "drive -up windows" in the B3 District would now be subject to the same special
regulations for drive-in business and fast food restaurants. Like other districts, there is a
procedure for waiving the 1,320 foot proximity requirement if certain conditions are met.
Subdivision four of Section 1320.09 has also been added. This refers directly to the recently
adopted design standards in Section 1325 of the City's Zoning Code. It is the intent of Staff
that these newly adopted regulations would apply to both the B2 and B3 Districts. In
addition to the new design standards, all other design standards previously existing in the
Code would continue to apply.

1325.05 Subd. 8 — Design Standards
The most significant amendment being proposed is to add the B3 District to the recently adopted
B2 District design standards in Section 1325.05 Subd. 8. The additional language, while
grammatically minor, would subject new development within the B3 District to the same design
standards as currently apply to the B2 District. The amendment would read as follows:
Subd. 8 Additional Design Standards for New Development, Redevelopment,
and Modifications to Existing Sites in the B2 and B3 District. Unless preempted
by the standards in this section, all other zoning provisions shall apply:
In addition to the added reference to the B3 District, and in order to make the subdivision
grammatically correct, Staff is also proposing to remove any reference to the phrase "B2
District" elsewhere in this subdivision and to change any reference to the word "District" to the
plural form.
Findings of Fact
Staff offers the following findings for consideration:
1. The B3 District currently has no meaningful design standards.
2. The B3 District is a major commercial corridor in the City and acts as a gateway into
the B2 District.
3. The City Council adopted design standards in Section 1325.05 of the Zoning Code
on November 24, 2008, that was in substantial conformance with the Guiding Plan
for the B2 District.
4. The proposed amendment to add the B3 District to the recently adopted design
standards would work toward implementing a unified commercial area within the
City and promote high quality architectural design.
Notice
Notice was published in the Arden Hills/Shoreview Bulletin and notice was prepared by the City
and mailed to properties within the B2 District.
Public Comments
The City did not receive any public comments prior to releasing this report.

Subd. 1 'Procedure. To further accomplish the stated -purpose of the B3

A. Proposals for new construction, redevelopment of a site, and

D. The architecture and the site, grading, circulation, landscaping,
screening and signage plans shall unify the appearance and
function of the complex or building.
E. A "fast food court" or "drive-in business court" may consist of
one or more buildings on one or more parcels if the intent of
providing a unified appearance and function is not compromised.
F. The applicant shall submit a circulation plan that demonstrates
that the use will not interfere or reduce the safety of non -motorized

1325.05 Design Standards. The standards established in this section are designed to
encourage a high standard of development by providing assurances that neighboring land
uses and neighboring properties will be compatible. The standards shall also apply to all
future development and shall apply to existing development where so stated. Before any
applications for development or construction under the City Code are approved, it shall
be determined that the proposal will be in conformance with these standards unless a
deviation has been granted. It shall be the responsibility of the applicant to demonstrate
such conformance. Revised April 28, 2008.

ORDINANCE 2008-012
AN ORDINANCE AMENDING THE SPECIAL REQUIREMENTS AND DESIGN
STANDARDS FOR THE B-3: SERVICE BUSINESS DISTRICT
The Arden Hills City Council hereby ordains that Section 1320.09 is hereby amended, and
Section 1325.05 Subd 8 is hereby amended, and all subsequent references to the phrase "B2
District" removed and the word "District" be reformatted to the plural, in the Arden Hills City
Code to read as follows:
1320.09 Special Requirements for the B-3 Service Business District. The aesthetic and
transportation impacts from new developments and redevelopments must be evaluated to help ensure
the long-term viability and success of the B-3 District. Accomplishing the purpose of the B-3
District requires particular concern for the design of buildings, site features (such as landscaping,
lighting, and signage), site layout, building materials, site design, and other related design elements.
To that end, new development and redevelopment shall conform to the standards in this and related
zoning requirements. In reviewing and approving land use applications, the City Council shall make
the final determination on the compatibility and consistency with all provisions in this and related
sections of the Zoning Ordinance.
Subd. 1 Procedure. To further accomplish the stated purpose of the B3 District, the
following procedures shall be used:
A. Proposals for new construction, redevelopment of a site, and significant
modifications to existing sites shall use the Planned Unit Development
(PUD) process. The PUD proposal shall identify any requested modifications
from the applicable zoning requirements as well as the reasons why the
modifications would be in the public interest and would be consistent with
the purpose of the B-3 District. Modifications to these requirements maybe
granted by the City without a variance through the PUD process. Conditional
use permits may also be required for uses list in Section 1320.05.
B. Conditional Use Permits, Site Plans, and other development agreements
that were approved for development sites before December 8, 2008, shall
remain in effect but shall use the Planned Unit Development Process for
future site amendments.

C. The following items shall, not be considered significant modifications to
an existing site and shall be exempt from the PUD process but shall be
subject to administrative review and approval:
(i) Internal alterations to buildings that do not result in a change to the
building height, roof line, or footprint unless the changes will have a
notable increase in traffic and/or parking needs as determined by the
Community Development Director or their designee;
(ii) Replacement, maintenance, or repair of existing materials, including
exterior finishes, signage, landscaping, and parking lots;
(iii) Minor modifications to the exterior of a building or a site that
substantially conforms to the design standards in Section 1325 and has no
discernable impact on traffic as determined by the Community
Development Director or their designee;
D. The provisions in this Section may be modified by the City Council to
allow planning flexibility without the need for a variance to encourage
cooperative dialogue between the applicant and the City. Minor
improvements to existing uses should be encouraged without costly upgrades
or complete changes to a site.
Subd.2 Uses.
A. Permitted uses (as specified in the Land Use Chart, Section 1320.05, for
the B-3 District) that occupy existing buildings do not require a conditional
use permit prior to occupancy. Other city permits maybe required.
B. Conditional uses (as specified in the Land Use Chart, Section 1320.05, for
the B-3 District) require an approved conditional use permit prior to
occupancy. Other city permits maybe required.
Subd, 3 Special Regulations for Drive -Up Windows, Drive -In Businesses, and Fast
Food Restaurants in the B-3 District. Section 1325.04 of this Code, specifies additional
requirements for drive-in businesses, drive -up windows, fast food restaurants and

Backiround

Districts are primarily office and light industrial in nature. As part of the long-range vision for

these areas, Staff recommends that a study be undertaken, similar to the recently adopted
Guiding Plan for the B2 District, within each of the remaining three districts. In the interim, staff
feels that in order to improve the process and review of minor and insignificant changes within
the B4 and I -Flex Districts there is an opportunity for small amendments to the special
requirements for these districts.
Special Requirements for the B4 and I -Flex Districts
Section 1320 of the City's Zoning Code outlines the purpose, land uses, and specific provisions
for each of the City's zoning districts. Within this section special requirements are outlined that
include the procedural process for reviewing applications in each zoning district and also any
additional regulations that may apply.
The existing procedure for both the B4 and I -Flex Districts requires any exterior modification of
a building or site to get a conditional use permit (CUP) or a CUP Amendment. This requires a
submittal of a formal land use application and review from the Planning Commission and the
City Council, as well as a public hearing.
Staff is not proposing to change this procedure for significant modifications to a building or site;
however, in order to promote minor improvements and upgrades to a site, certain types of
changes not considered significant modifications, would be exempt from the CUP process. The
exemptions are listed in subdivision one (Attachment B), but would include such things as
replacing a door, adding a window, or minor reconfigurations of a parking lot. This provides
some flexibility so that minor changes can move forward in a timely fashion with administrative
review and approval, and does not hinder property owners from making minor improvements to
their properties.
In addition to the procedural changes explained above, the language within the B4 District for
the special regulations for drive-in businesses, and fast food restaurants were also amended
(Attachment B). The intent and purpose of this subdivision has not been altered, but the phrase
"drive -up windows" has been added and the review procedure has been updated to better match
that of the recently amended B2 District.
Recommendation
Staff recommends the approval of the proposed zoning code changes. The purpose and intent of
the B4 and I -Flex Districts is not proposed to be altered; however, the procedure for approving
minor and insignificant building and site modifications would be exempt from the current CUP
process. Staff feels that this would better promote minor site upgrades and improvements while
maintaining the intent of the regulations. All site and building modifications would continue to

Subd. 2 Permitted Uses. Due to the replacement, reuse or redevelopment
nature of potential development in this district, the list of I -2p ermitted uses as
of April 1991, that are not permitted in the B-4 District, will be allowed in
buildings existing in April 1991 as permitted uses until redevelopment or
replacement of the building or buildings housing such uses occurs. Such uses
will not be allowed in buildings constructed after April 1991. The permitted
uses on the Land Use Chart, Section 1320.05, in the B-4 District will be
permitted either as replacement uses in buildings existing as of April 1991 or
as uses in replaced or redeveloped buildings.
Subd.3 Uses Allowed by Conditional Use Permit. Due to the
replacement, reuse or redevelopment nature of potential development in this
district, the existing I-2 uses allowed by conditional use permit as of April
1991 will be allowed to continue as conditional uses until redevelopment or
replacement of the building or buildings housing such uses occurs. No new
I-2 uses by conditional use permit will be allowed unless those uses are
permitted or allowed by conditional use permit in the B-4 District. The uses
allowed by Conditional Use Permit on the Land Use Chart, Section 1320.05,
in the B-4 District will be allowed by conditional use permit either as
replacement uses in buildings existing as of April 1991 or as uses in replaced,
redeveloped or new buildings.
Subd 4Special Re ulat:ions for Drive-Up.,windows Drive -In Busine55es
and Fast Food Restaurants in the B-4 District. Section 1325.04 of this Code.
s ecifies additional requirements fo:r drive-:i.n businesses, drive -up windows-,
.fast food restaurants and automobile service stations. The p rovi.sion whereby
theproximity requirement of one thousand three hundred and twenty
feet between drive-in businesses, drive -up windows, or fast food restaurants

Subd. 5 District Requirements. The requirements below are established for
development of individual "lots" and for the overall development of "planned
projects". "Lots" are individual parcels on which may be placed a single
building (either single or multiple -occupancy). "Planned projects" are sites on
which may be placed (a) A single or multi -occupancy retail center; (b) Two or
more free-standing, single or multiple -occupancy buildings; or (c) A
combination of (a) and (b).
A "retail center" is a single building housing either several retail outlets or a
single retail outlet with several departments. In a "planned project" individual
lots may be created for separate buildings or parts of buildings but separate
buildings are not required to be located on separate lots. To allow maximum
development creativity and flexibility, regulations such as lot area, side and
rear yard building and parking setbacks, Floor Area Ratio (F.A.R.), number of
parking spaces, percent of landscape area, etc., may be modified for individual
parcels and interior lot lines within a project. However, the regulations for
these same items must be met for the total project area and exterior project lot
lines.
A. Minimum Lot Area Requirements:
1. Multiple -occupancy retail center: 5 acres
2. Free-standing, single or multiple -occupancy building: 2
Acres
B. Maximum Bulk Requirements:
1. Height: 35 feet
2. Floor area ratio (F.A.R.): .30
3. Lot coverage by structure: 25%

Subd. 6 Building Exteriors, Site Features and Site Development.
Accomplishing the stated purpose of the B-4 District requires particular
concern for the design of buildings, site features (such as landscaping, lighting
and signage) and site design. The arrangement, geometry, massing, materials
and colors shall be responsive to existing buildings. The City Council will
make the final determination on the compatibility and consistency with this
provision.
A. Landscaping (Section 1325.05, Subd 1, shall apply)
B. Parking (GB District regulations, Section 1320.13, shall apply)
C. Signs (GB District regulations, Section 1320.13, shall apply)
D. Lighting (GB District regulations, Section 1320.13) shall
apply)
E. Pedestrian Circulation: All development within the B-4 District
shall incorporate pedestrian improvements, which may include
more specific City requirements that become apparent in the plan
review process.
F. Drainage /Water Management Plan: A plan must be submitted
with each project or lot development in the B-4 District. The plan
must be approved by the Rice Creek Watershed District, other
agencies as required, and by the City Engineer. On-site ponding is

AN ORDINANCE AMENDING THE SPECIAL REQUIREMENTS AND PROCEDURES
FOR THE B-4: RETAIL CENTER DISTRICT AND THE I -FLEX DISTRICT
The Arden Hills City Council hereby ordains that Section 1320.10 and 1320.12 are hereby
amended, in the Arden Hills City Code to read as follows:
1320.10 Special Requirements for the B-4 Retail Center District.
Subd. 1 Procedure. To further accomplish the stated purpose of the B-4 District, the
following procedures shall be used:
A. Proposals for new construction, redevelopment of a site, and significant
modifications to existing sites shall use the Planned Unit Development
(PUD) or the Conditional Use Permit (CUP) process. The proposal shall
identify any requested modifications from the applicable zoning requirements
as well as the reasons why the modifications would be in the public interest
and would be consistent with the purpose of the B-4 District. Modifications
to these requirements may be granted by the City without a variance through
the PUD process. Conditional use permits may also be required for uses list
in Section 1320.05.
B. Conditional Use Permits, Site Plans, and other development agreements
that were approved for development sites before December 8, 2008, shall
remain in effect.
C. The following items shall not be considered significant modifications to
an existing site and shall be exempt from the PUD or CUP process but shall
be subject to administrative review and approval:
(i) Internal alterations to buildings that do not result in a change to the
building height, roof line, or footprint unless the changes will have a

potential development in this district, the list of I-2 permitted uses as of April 1991, that
are not permitted in the B-4 District, will be allowed in buildings existing in April 1991
as permitted uses until redevelopment or replacement of the building or buildings
housing such uses occurs. Such uses will not be allowed in buildings constructed after
April 1991. The permitted uses on the Land Use Chart, Section 1320.05, in the B-4
District will be permitted either as replacement uses in buildings existing as of April
1991 or as uses in replaced or redeveloped buildings.
Subd. 3 Uses Allowed by Conditional Use Permit. Due to the replacement, reuse or
redevelopment nature of potential development in this district, the existing I-2 uses
allowed by conditional use permit as of April 1991 will be allowed to continue as
conditional uses until redevelopment or replacement of the building or buildings housing
such uses occurs. No new I-2 uses by conditional use permit will be allowed unless those
uses are permitted or allowed by conditional use permit in the B-4 District. The uses
allowed by Conditional Use Permit on the Land Use Chart, Section 1320.05, in the B-4
District will be allowed by conditional use permit either as replacement uses in buildings

existing as of April 1991 or as uses in replaced, redeveloped or new buildings.
Subd. 4 Special Regulations for Drive -Up Windows, Drive -In Businesses, and Fast
Food Restaurants in the B-4 District. Section 1325.04 of this Code, specifies additional
requirements for drive-in businesses, drive -up windows, fast food restaurants and
automobile service stations. The provision whereby the proximity requirement of one
thousand three hundred and twenty (1,320) feet between drive-in businesses, drive -up
windows, or fast food restaurants may be waived if the following conditions are met:
A. The architectural treatment, circulation plan, and signage system of such
businesses shall be designed to visually and functionally integrate the
building and the site on which it is located.
B. The applicant shall submit a circulation plan that demonstrates that the
use will not interfere or reduce the safety of non -motorized movements,
specifically pedestrian and bicyclists.

C. Requested modifications to the provisions in section 1325.04 shall be
stated in writing along with an explanation of why the modifications would
be in the public interest and would be consistent with the purpose of the B-4
District.
Subd.5 District Requirements. The requirements below are established for
development of individual "lots" and for the overall development of "planned projects".
"Lots" are individual parcels on which may be placed a single building (either single or
multiple -occupancy). "Planned projects" are sites on which maybe placed (a) A single or
multi -occupancy retail center; (b) Two or more free-standing, single or multiple -occu-
pancy buildings; or (c) A combination of (a) and (b).
A "retail center" is a single building housing either several retail outlets or a single retail
outlet with several departments. In a "planned project" individual lots maybe created for
separate buildings or parts of buildings but separate buildings are not required to be
located on separate lots. To allow maximum development creativity and flexibility,
regulations such as lot area, side and rear yard building and parking setbacks, Floor Area
Ratio (F.A.R.), number of parking spaces, percent of landscape area, etc., may be
modified for individual parcels and interior lot lines within a project. However, the
regulations for these same items must be met for the total project area and exterior
project lot lines.
A. Minimum Lot Area Requirements:
1. Multiple -occupancy retail center: 5 acres
2. Free-standing, single or multiple -occupancy building: 2 Acres
B. Maximum Bulk Requirements:
1. Height: 35 feet
2. Floor area ratio (F.A.R.): .30
3. Lot coverage by structure: 25%
C. Minimum Landscaped Area: 25%
D. Minimum Building Setbacks:
1. Front yard and exterior project lines: 50 ft
2. Side yard: 20 feet
3. Rear yard: 20 feet

project or lot development in the B-4 District. The plan must be approved by
the Rice Creek Watershed District, other agencies as required, and by the City
Engineer. On-site ponding is encouraged as a visual and functional amenity.

Requested Action
Consider Ordinance 2008-014 to amend Section 1325.04, Subd 1 and Subd 2 to apply the term
"drive -up windows" for clarification purposes, as proposed in the November 5, 2008, Planning
Case Report.
Background
On October 27, 2008, the City Council adopted the "Guiding Plan for the B2 District."
Following the adoption, Staff recommended several ordinance amendments to adapt the design
guidelines in the Guiding Plan for the Zoning Code to integrate them with existing design
standards and add detail where needed. For one of the amendments, to clarify the intent of the
existing regulations, staff proposed to add a definition for "drive -up windows" and extend the
regulations for drive-in businesses and fast food restaurants to drive -up windows. This motion
was recommended for approval by the Planning Commission on November 5, 2008, and
approved by the City Council on November 24, 2008.
The purpose of this action is to further clarify the intent of Ordinance 2008-014 by applying the
now -defined term "drive -up windows" to Section 1325.04, Subd 1 and Subd 2 of the Code. The

1325.04 Additional Minimum Requirements for Drive -In Businesses, Drive -u
Windows Fast Food Restaurants and Automobile Service Stations. Because drive-in
businesses, drive -up whidows, fast food restaurants and automobile service stations
present certain unusual problems, they are hereby required to meet the following
requirements in addition to the general requirements applicable to them in the zoning
district in which they are to be located, unless otherwise regulated in this Code:
Subd.I Location.
A. Proximity to Schools, Churches, Public Recreational Areas and
Residential Lots. No drive-in business, drive -pp window, or fast
food restaurant shall be located on a site that is within four hundred
(400) feet of a public, private or parochial school, a church, a
public recreation area, or any residentially zoned property.
B. Proximity to Other Establishments. No drive-in business,
drive -up window, or fast food restaurant shall be located on a site
that is within one thousand three hundred twenty (1,320) feet of the
boundaries of another one.
C. Unreasonable Traffic Volume. No drive-in business, dr ve-gp
window or fast food restaurant shall be located on a site if the
probable result of such location would be to unreasonable increase
traffic volume on nearby streets.
D. Size of Lot. No drive-in business, drive -up windoNw or fast
food restaurant shall be located on a lot of less than twenty-four
thousand (24,000) square feet.
Subd. 2 Site Development Standards.
A. Landscaping. A lot to be used for drive-in business, drive -u
window fast food restaurant or automobile service station
purposes shall be landscaped at least to the following depths from
each lot line:
1. Twenty (20) feet from the front lot line, except for
approved access drive.
2. Ten (10) feet from each side lot line.
3. Fifteen (15) feet from rear lot line.
B. Electronic Devices. Electronic devices such as loudspeakers or
devices, and similar instruments, shall not be located within fifty
(50) feet of any adjacent lot regardless of use or zoning district.
C. Snow Storage. Adequate area shall be designed for snow
storage such that clear visibility shall be afforded from the property
to any public street.
D. Screening. A suitable screening fence shall be erected along
all property lines except those which are also public right-of-way
lines. Said fence shall be of a type and design approved by the
Council. Planting of a type approved by the Council may also be
required in addition to or in lieu of fencing.
E. Design. The design of all structures shall be compatible with
other structures in the surrounding area.
F. Signs. No permanent or temporary signs visible from a public
street shall be erected without approval from the Council.
G. Traffic Circulation. No site plan shall be approved which will
in any way constitute a hazard to vehicular or pedestrian
circulation.
H. Access. Access shall be to public streets from at least two (2)
points on the subject premises. A divided entry with a center
island may meet the requirements of this provision.
I. Rules and Regulations of State Fire Marshal. With respect to
automobile service stations, any building proposed to be used as a
service station shall be constructed and maintained as required by
the rules and regulations of the state fire marshal governing the
handling, storage and transportation of flammable liquids. Every
facility, whether underground or above ground and whether
indoors or out-of-doors, for the handling, storage and movement of
flammable liquids, shall likewise be constructed and maintained in
accordance with the rules and regulations of the State Fire Marshal
and the Pollution Control Agency (PCA).

D. Size of Lot. No drive-in business, drive -up window, or fast food
restaurant shall be located on a lot of less than twenty-four thousand
(24,000) square feet.

Subd. 2 Site Development Standards
A. Landscaping. A lot to be used for drive-in business, drive -up window,
fast food restaurant or automobile service station purposes shall be
landscaped at least to the following depths from each lot line:
1. Twenty (20) feet from the front lot line, except for approved access
drive.
2. Ten (10) feet from each side lot line.
3. Fifteen (15) feet from rear lot line.
B. Electronic Devices. Electronic devices such as loudspeakers or
devices, and similar instruments, shall not be located within fifty (50) feet
of any adjacent lot regardless of use or zoning district.
C. Snow Storage. Adequate area shall be designed for snow storage such
that clear visibility shall be afforded from the property to any public street.
D. Screening. A suitable screening fence shall be erected along all
property lines except those which are also public right-of-way lines. Said
fence shall be of a type and design approved by the Council. Planting of a
type approved by the Council may also be required in addition to or in lieu
of fencing.
E. Design. The design of all structures shall be compatible with other
structures in the surrounding area.
F. Signs. No permanent or temporary signs visible from a public street
shall be erected without approval from the Council.
G. Traffic Circulation. No site plan shall be approved which will in any
way constitute a hazard to vehicular or pedestrian circulation.
H. Access. Access shall be to public streets from at least two (2) points
on the subject premises. A divided entry with a center island may meet
the requirements of this provision.
I. Rules and Regulations of State Fire Marshal. With respect to
automobile service stations, any building proposed to be used as a service
station shall be constructed and maintained as required by the rules and
regulations of the state fire marshal governing the handling, storage and
transportation of flammable liquids. Every facility, whether underground
or above ground and whether indoors or out-of-doors, for the handling,

storage and movement of flammable liquids, shall likewise be constructed
and maintained in accordance with the rules and regulations of the State
Fire Marshal and the Pollution Control Agency (PCA).

Effective Date. This Ordinance shall become effective the day following its publication.
Adoption Date. Passed by the City Council of the City of Arden Hills the 8th day of
December, 2008.

SUBJECT: City Council Planning Case Update
On -Going Projects
The City has executed the final documents for the Lake Johanna Woods Final Plat, which was
approved by the City Council on March 12, 2007. The park dedication fee has been paid in full
and all conditions of approval met. The Plat has been sent to Ramsey County and is awaiting
document numbers and filing.
The City has also executed the final documents for the Traverse Business Center Plat, which was
approved by the City Council on July 14, 2008. All conditions of approval have been met and
the easement and right-of-way vacations successfully filed. The Final Plat has been sent to
Ramsey County and is awaiting document numbers and filing.
November 10, 2008, City Council Meeting
The City Council approved a Resolution vacating several easements and a right-of-way as part of
the Traverse Business Center Plat.
November 24, 2008, City Council Meeting
PC# 08-032 —Five Year Extension of Boston Scientific's Temporary Walkway
The City Council unanimously approved a request from Boston Scientific to extend the timeline
on the temporary walkway located along Innovation Way for an additional five years.

PC# 08-033 —City Code Amendment regarding the placement of Garbage, Refuse, and
Recycling Containers
The City Council unanimously voted to approve an amendment to Section 660.05 of the City
Code regarding the location of garbage, refuse, and recycling containers stored on residential
lots. Containers maybe stored in side or rear yards, adjacent to a structure, and no longer are
required to be screened. .
B2 Design Standards
The City Council unanimously approved Ordinance 2008-010 and Ordinance 2008-011 to adopt
the B2 Design Standards in Section 1320 and 1325 of the Zoning Code and to amend the City's
Sign Code. The Planning Commission recommended approval for this item at their November 5,
2008, meeting.
