Scientific at 4100 Hamline Avenue Based on the Findings of Fact and the Submitted Plans as
Amended by the Four Conditions in the October 27, 2008, Memo to the City Council.

The applicants have requested a PUD (9th) Amendment and Site Plan Review to construct a
nitrogen storage tank that would be ten feet in diameter and 28 feet in height. The tank would be
located on a concrete pad, adjacent to an existing outdoor nitrogen storage tank, on the east side
of Building 14, which is located on the north side of the campus (Attachment C). In addition to
the. storage tank, and on an existing concrete pad, the applicant would install a liquid nitrogen
vaporizer. The vaporizer would be five feet, nine inches square, and fifteen feet, nine inches in
height. The tanks are necessary in order to meet the demand of Boston Scientific's
manufacturi~g process. All of the new equipment would be surrounded by fencing similar to
what is currently surrounding the existing equipment in that area. Since the installation of the
nitrogen tank and vaporizer were not included on the original approved Master Plan, a Master
Plan PUD amendment and site plan review are needed for the proposal to go forward.
Currently there are several storage tanks, a vaporizer, and generator to the east of Building B
which house the liquid nitrogen that Boston Scientific uses for research and development of their

products, including a 50 foot tall storage tank that was approved in October of 2004 by the City.
Additionally, there is currently a 500 gallon tank and related equipment located east of Building
14 in the same location as the proposed tank.
The applicant has submitted a letter addressing describing the project, a site plan, pictures of
similar generator units and storage tanks on site, and pictures of the location for the proposed
tank and vaporizer (Attachment C).
Findin!!s of Fact
The Planning Commission offers the following eight findings of fact for review:
General Findings:
1. The proposed plans meet all of the requirements of the 1-1 Zoning District
2. The proposed storage tank and vaporizer are permitted accessory uses and are also
permitted by the Boston Scientific PUD Master Plan
3. The proposed storage tank and vaporizer are compatible with the character of the nature
of the industrial area and will not adversely impact the surrounding properties
4. The proposed storage tank and vaporizer would be effectively screened by the existing
landscaping and trees located to the west and north of the site
5. The proposed storage tank and vaporizer would be visible from the Boston Scientific
property to the south and east
6. The proposed plans are not anticipated to negatively impact traffic, parking, access, or
circulation on the property
7. The proposed plans are not anticipated to have a negative impact on noise
8. The proposed plans would not impact drainage or grading on the site
Recommendation
The Planning Commission reviewed Planning Case 08-025 and unanimously recommends
approval (7-0) of the PUD Amendment and Site Plan Review based on the findings of fact and
the submitted plans as amended by the following four conditions:
1. The applicant shall continue to abide by the conditions of approval as stated in the
approved Master Plan PUD except as amended by the eight subsequent amendments.
2. The project shall be completed in accordance with the plans submitted as amended by
the conditions of approval. Any significant changes to these plans, as determined by
the City Planner, shall require review and approval by the Planning Commission and
City Council.
3. All equipment and tanks shall be enclosed in a fence of similar height and materials
to the existing fencing in that area.

4. Permits shall be obtained for the project prior to installation.
5. A PUD Amendment drafted by the City Attorney shall be signed by the applicant
prior to the issuance of any building permits.
Options
1. Approve the proposal as submitted.
2. Approve the proposal with conditions.
3. Deny the application with reasons for denial. If the City denies the petitioners request, "... it
must state in writing the reasons for the denial at the time it denies the request. "

Deadline for A2encv Actions
The City of Arden Hills received the completed application for this request on September 19,
2008. Pursuant to Minnesota State Statue, the City must act on this request by November 18,
2008 (60 days), unless the city provides the petitioner with written reasons for an additional 60
day review period. The City may, with the consent of the applicant, extend the review period
beyond the initial 120 days.

PLANNING CASE # 08-025 - PUD AMENDMENT AND SITE PLAN
REVIEW - BOSTON SCIENTIFIC - 4100 HAMLINE AVENUE - PUBLIC
HEARING
City Planner Meagan Beekman reported that Boston Scientific is requesting
approval of a Planned Unit Development (PUD) Amendment and Site Plan
Review to construct a nitrogen storage tank and a liquid nitrogen vaporizer on the
east side of Building 14 located on the north end of the Boston Scientific Campus.
She explained the storage tank would be ten feet in diameter and 28 feet in height
and would be located on a concrete pad adjacent to an existing outdoor nitrogen
storage tank. She stated in addition to the storage tank, the applicant would install
a liquid nitrogen vaporizer that is 5'9" square and 15'9" in height. She indicated
the entire area will be enclosed by a fence. She stated staff is recommending
approval of the PUD and site plan subject to the four conditions contained in the
staff report.
Commissioner Thompson asked if staff received any comments from adjacent
property owners.
Ms. Beekman replied no comments were received by staff.
Commissioner Sand requested information regarding the proposed height of the
storage tank in relation to the building.
Ms. Beekman stated the proposed tank would be approximately eight feet taller
than the adjacent building. She also stated that extensive screening from existing
landscaping and trees would effectively screen the tank from view.
Chair Larson opened the public hearing at 7:40 p.m.
As no one wished to appear, Chair Larson closed the public hearing at 7:40 p.m.
Commissioner Reiff moved, seconded by Commissioner Holewa, to recommend
approval of Planning Case #08-025 for a PUD (9th) Amendment and Site Plan
Review at 4100 Hamline Avenue based on the findings of fact and the submitted
plans as amended by the four conditions in the October 1, 2008 Planning Case
report.
The motion carried unanimously (7-0).

9th PUD Amendment
PLANNED UNIT DEVELOPMENT PERMIT
MASTER PLAN AMENDMENT NO.9
CITY OF ARDEN HILLS
BOSTON SCIENTIFIC CORPORATION
1 .0 Parties. This Agreement is dated the 27th day of October, 2008, and is
entered into by and between the City of Arden Hills, a Minnesota
municipal corporation (herein "City"); and Boston Scientific Corporation, a
Minnesota corporation, its successors and assigns (herein "Boston
Scientific") .
2.0 Recitals.
A. On November 12, 2002, the City's Council approved a master plan
entitled "Guidant Campus Master Plan - Prepared by Guidant
Corporation for City of Arden Hills, September, 2002" (the "Master
Plan") which guides the future development of the property platted
as Lots 1 and 2, Block 1, Guidant First Addition.
B. On March 31,2003, the City's Council approved the first
amendment to the Master Plan ("Master Plan Amendment No.1").
C. On June 30, 2003, the City's Council approved the Planned Unit
Development Permit which incorporated the Master Plan, Master
Plan Amendment No.1 and other documents.
D. On September 29,2003, the City's Council approved the second
amendment to the Master Plan ("Master Plan Amendment No.2")
subject to certain conditions as documented in Planning Case File
No. 03-25. Master Plan Amendment No.2 authorized an increase in
the size of Building N.
E. On February 23, 2004, the City's Council approved the third
amendment to the Master Plan ("Master Plan Amendment No.3")
subject to certain conditions as documented in Planning Case File
No. 04-04. Master Plan Amendment No.3 authorized an increase in
the size of Building J.
Fa On July 12,2004, the City's Council approved the fourth
amendment to the Master Plan ("Master Plan Amendment No.4")
subject to certain conditions as documented in Planning Case File
No. 04-17. Master Plan Amendment No.4 authorized site plan
changes for parking lot modifications.
G. On the 25th day of October, 2004, the City's Council approved the
fifth amendment to the Master Plan ("Master Plan Amendment No.
5") subject to certain conditions documented in Planning Case File
No. 04-18. Master Plan Amendment No.5 authorized the addition of
a nitrogen generator system to the east of Guidant Building B.
H. On the 24th day of April, 2006, the City's Council approved the sixth
amendment to the Master Plan ("Master Plan Amendment No.6")
subject to certain conditions document in Planning Case File 06-010.
Master Plan Amendment No.6 authorized a new parking lot at the
Guidant Campus, parking modifications to the Arden Woods office
building, and removal of the Lexington Avenue access to the Arden
Woods office building.
I. On the 28th day of August, 2006, the City Council approved the
seventh amendment to the Master Plan ("Master Plan Amendment
No.7") subject to certain conditions in Planning Case File 06-024.
Master Plan Amendment No.7 authorized the construction of a
10,225 square foot addition to the west side of Building N in the
northwestern portion of the Boston Scientific Campus. This approval
was declared null and void by the approval of Planning Case File
06-033.
J. On the 27th day of November, 2006, the City Council approved the
eighth amendment to the Master Plan ("Master Plan Amendment
No.8") subject to certain conditions in Planning Case File 06-033.
Master Plan Amendment No.8 authorized the construction of a
2,250 square foot addition to the north side of Building N in the
northwestern portion of the Boston Scientific Campus.
I. At a public hearing on the 1 st day of October, 2008, the City's
Planning Commission reviewed the plans in Planning Case File 08-
025, staff's recommendations, the comments of the public and
recommended approval of Master Plan Amendment No.9 subject
to certain conditions.
3.0 Approval of Master Plan Amendment No.9. On the 27th day of October,
2008, the City's Council considered the application for Master Plan
Amendment No.9 in Planning Case File 08-025, the recommendations of
the City's staff and planning commission, and approved Master Plan
Amendment No.9 subject to the following conditions:

A. The applicant shall continue to abide by the conditions of approvol as
stated in the approved Master Plan PUD except as amended by the

submitted as amended by the conditions of approval. Any significant
