A height variance is also being requested for the building to exceed the 35 -foot height limit in the R-1 Zoning District. This project is Phase II of the approved Master Planned Unit Development (PUD). Background 1. Overview of Request: The applicant is proposing to construct the Northwestern College Community Life Commons (CLC), a two-story, 70,639 square foot building that would include food service, copy center, bookstore, offices, classrooms, and a prayer chapel (Attachment D). The structure would be LEED certified, though the level of certification was not established at the time of this report. The height of the majority of the structure would be between 28 and 42 feet; however, the highest point of the building would be approximately 48 feet measured from an attached prayer tower. There is a 35 -foot height limit in the R-1 Zoning District. The campus green adjacent to the Community Life Commons would be renovated as part of the project, which includes landscaping a total area of 174,240 square feet. Finally, an additional 480 square feet will also be added to Nazareth Hall containing a 100 square foot elevator shaft. The elevator is necessary to make the building fully accessible. Northwestern College operates under a Master Planned Unit Development (PUD) that was approved by the City in Planning Case #06-037 (Attachment B). Construction projects and changes to the campus that are substantially consistent with the approved Master PUD require only a site plan review with the Planning Commission and City Council prior to implementation. However, the Master PUD also requires Northwestern College to comply with all provisions of the Zoning Code unless a variance is granted. This is the second application to go before the Planning Commission and City Council since the Master PUD was approved on October 29, 2007. The prior (Planning Case #08-006) was a site plan review for Phase I of the Master Plan for the construction of a ring road and parking spaces in three places throughout the Northwestern College campus, replacing an existing access road and parking lot that would be removed by the construction of this project (Phase II). The applicant has submitted a narrative describing the project, a site plan, utility and grading plans, landscaping and tree removal plans, architectural elevations of the future parking structure, and renderings of the proposed landscaping (Attachments A and E). The applicant is also submitting a photometrics plan that was not received in time to be included in the packet. 2. Site Data: PSI: Public & Institutional Institutional: Higher Education R-1: Single Family Residential 42.69 Acres in Arden Hills, 45.31 Acres in Roseville for a total of 88 Acres To be determined based on how many students equals one FTE Variable. Steep slope toward Lake Johanna and Little Lake Johanna. Generally flat in the central portions of the campus. Plan Evaluation 1. Applicable Northwestern College Master PUD Review Criteria A. Code Compliance (Condition #5) —Meets Requirements Condition five of the PUD Master Plan requires Northwestern College to meet all regulatory requirements and standards in place at the time of construction unless a variance is granted. As Community Life Commons will exceed the 35 -foot height limit for the R-1 Zoning District, Northwestern College is applying for a height variance as required by this condition. All other requirements of the Zoning Code are met by the proposal. B. Lake Setbacks (Condition #12) —Meets Requirements Condition twelve of the PUD Master Plan requires, with the exception of walkways, that no impervious surfaces be located within 50 feet of the ordinary high water mark (OHW) Lake Johanna or within 75 feet of the OHW for Little Lake Johanna. Neither the Community Life Commons nor campus green will encroach on any lake OHW setbacks. C. Property Setbacks (Condition #13) —Meets Requirements Condition thirteen of the PUD Master Plan states, "All structures, including parking ramps and roads, shall be at least seventy-five (75) feet from the eastern property line and thirty (30) feet from the western property line." Neither Community Life Commons nor campus green would encroach on any property setbacks. D. Building Height (Condition #14) —Needs Variance Condition fourteen of the PUD Master Plan states, "Any building exceeding the height limit of the underlying R-1 Zone shall require an approved height variance prior to City of Arden Hills Planning Commission Meeting for April 8, 2009 IlMetro-inet.uslardenhillslPlanninglPlanning Cases 12009109-005 NWC Site Plan Review1040809 - PCReport - NWC Site Plan Review Meg.doc Page 3 of 10 construction." The highest point of Community Life Commons is the prayer tower with the halfway point between the eave and highest point measuring just under 48 feet. A height variance is necessary as this figure exceeds the 35 -foot height limit of the R-1 Zoning District. It is worth noting that much of the prayer tower is not an occupied space and thus does not create sight lines into other nearby properties. It is important to note that this height variance only applies to the tower and not the building as a whole. The flat roofline of Community Life Commons is approximately 28 feet tall, which is in compliance with the regulations of the R-1 Zoning District. The building also has three pavilions that range from 40 to 42 feet in height, which exceeds the height limit though not to the same degree as the prayer tower. The tower and pavilions are located along the south and western edges of the building, facing towards the campus green and Nazareth Hall. The portion of the building with the flat roofline would be closest to the ad j acent residential properties. The height of Community Life Commons does not represent a departure from nearby buildings. Nazareth Hall ranges from 35 feet to as high as 115 feet with the tower (the height of the majority of the building being 60 feet), while Riley Hall is approximately 45 feet tall. E. Lighting (Condition #15) —Meets Requirements Condition fifteen of the PUD Master Plan requests that lighting: (a) is prohibited from shining directly onto adjacent properties and (b) shall not exceed the lighting limitations of the Arden Hills Zoning Code. For the Community Life Commons, there will be no exterior lights shining on any building walls. While the prayer tower would be internally lit and is potentially visible from adjacent properties, the lights would be strictly utilitarian would not be used when the tower was not occupied. There will be exterior pedestrian lighting along walkways in the campus green and loading dock, but these shall be obscured from adjacent properties by the surrounding buildings and vegetative screening. The applicants are also proposing a seven foot six inch high fence along the rear of the building that would screen the loading dock further. There will also be some electrical outlets installed near the Totino Arts Center (south side of the green) for holiday tree lights. It is expected that the project shall neither increase ambient light off of campus nor shine any lights on adjacent properties. F. Lot Coverage (Condition #16) —Meets Requirements Condition sixteen of the PUD Master Plan limits the portion of the campus within Arden Hills to 35 percent lot coverage. Currently, impervious coverage makes up 528,186 square feet, or 33 percent of the 1,598,216 square feet of campus within the City. The proposal will actually decrease the amount of impervious coverage to 504,708 square feet, a net reduction of 231948 square feet. As a result, impervious coverage post - construction will only constitute 31.6 percent of the Arden Hills portion of campus. I. Tree Preservation (Condition #17) —Meets Requirements City of Arden Hills Planning Commission Meeting for April 8, 2009 IlMetro-inet.uslardenhillslPlanninglPlanning Casesl200M9-005 NWC Site Plan Review1040809 - PCReport - NWC Site Plan Review Meg.doc Page 4 of 10 Condition seventeen requires a tree inventory and preservation plan to be submitted with the application, which Northwestern College has done. A total of 65 significant trees with 1,033 caliper inches were identified within the construction area. Of those, 53 trees (702 caliper inches) will be removed and 134 new trees (300 caliper inches) will be planted, meeting the requirements of the City's tree preservation ordinance. The proposal will also meet the requirements of the City's design standards in Section 1325.05 the Zoning Code. J. Storm Water Management (Condition #20) —Meets Requirements Condition twenty requires a storm water management plan to be submitted with the application. Phase I of the PUD Master Plan (Planning Case #08-006) included the construction of storm water drainage pipe and underground infiltration basin. This project would utilize this installed system while increasing overall water infiltration on site through a net reduction in impervious surface coverage. In addition, Rice Creek Watershed District review is required. K. Energy Efficient Design (Condition #21) —Meets Requirements Condition twenty-one states, "Each phase shall use as many Leadership in Energy and Environmental Design (LEED) principles as the College deems possible." Northwestern College states that Community Life Commons will be LEED certified, though the applicant did not include any information on the type of certification that would be sought or how certification would be achieved. L. Outdoor Events (Condition #26) —Meets Requirements Condition twenty-six requires that events on the campus green cannot continue past 9:OOPM, except for once a semester when an event may continue until l OPM. Northwestern College states the campus green will not be used as a performance space, but maintained as an outdoor student study and recreational area. It is not expected that any of the activities on the campus green would generate high levels of noise or would extend past the times required by this condition. 2. Additional Review The Building Official and Fire Marshal reviewed the proposal with their comments included as Attachment C. The Fire Marshal expressed concerns about access to the front side of buildings along the campus green, noting that any such access roads or paved surfaces must meet specific size and weight bearing requirements. Northwestern College will also have to verify the location of the Fire Department Connection (FDC) and proximity to fire hydrants. Northwestern College has been made aware of these comments and are working with the Fire Marshal to meet the requirements. The City Engineer was unable to review this project in time for this report. Staff is introducing a conditional of approval requiring City Engineer review prior to construction, with any additional conditions to be met by the applicant. 3. Variance for Building Height Section 1325.03 Subd 3.0 A request for a height variance is not subject to the typical undue hardship criteria in State Statutes and Section 1355.04 Subd 4 of the Zoning Code. Instead, Section 1325.03 Subd 3.0 of the Zoning Code sets the four criteria that are used to evaluate height variance requests: Section 1325.03 Subd 3.C. Variances for Certain Structures. Any structure, other than as noted above, that is proposed to exceed the maximum height imposed by provisions of this Code may be permitted by a variance, provided it is determined that: 1. Adequate fire protection and other safety features are provided. 2. The height and bulk of the structure will not destroy a scenic or other appropriate view, nor will it shut off light and air from surrounding properties, or otherwise be detrimental to the public welfare. 3. The proposed structure will not exceed a floor area ratio of 0.5. 4. The proposed structure will have setbacks equal to or greater than the height, and the distance between any two (2) principal buildings must be no less than one-half (1/2) the sum of the heights of the two (2) structures. Based on the review by Staff, the proposed Community Life Commons meets or exceeds all four height variance evaluation criteria. The specific findings are in the below Findings of Fact section. Findings of Fact Staff offers the following twenty findings of fact for the Northwestern College Site Plan Review and Variance for the Planning Commission's consideration: General Findings: 1. The Proposed location of the Community Life Commons is in conformance with the approved Master Plan. 2. Community Life Commons will be two stories and include 70,639 square feet of space. 3. The proposed use of the building is in conformance with the R-1 Zoning District. 4. The adjacent campus green will consist of 174,240 square feet of landscaped space. 5. The loss of parking spaces and an access road as part of this project is included in the approved Master PUD Plan (Planning Case #06-037) and was previously replaced with City of Arden Hills Planning Commission Meeting for April 8, 2009 IlMetro-inet.uslardenhillslPlanninglPlanning Cases 12009109-005 NWC Site Plan Review1040809 - PCReport - NWC Site Plan Review Meg.doc Page 6 of 10 the construction of a campus ring road and additional parking spaces (Planning Case #08- 006). 6. An additional 425 square feet containing an elevator shaft will be added to Nazareth Hall to bring the building in compliance with the Americans with Disabilities Act (ADA). 7. Community Life Commons and campus green meets all setback and lot coverage requirements for the R-1 Zoning District. 8. The height of the Community Life Commons' prayer tower is 47 feet ten inches, which exceeds the height limit of 35 feet for the R-1 Zoning District. 9. The heights of the Community Life Commons' three pavilions range in height between 40 and 42 feet. On the Site Plan Review: 10. In accordance with the PUD Master Plan, any deviations from the regulations and standards must be approved through a variance. 11. The project will meet all setbacks from the OHW of Lake Johanna and Little Lake Johanna. 12. The project will meet all required property setbacks. 13. Community Life Commons exceeds the height limit for the R-1 Zoning District, requiring a height variance. 14. There will be no external lights used on Community Life Commons. Lights internal to the building and the pedestrian lights on the campus green will not shine on adjacent properties. 15. The project will reduce overall impervious surface coverage on the Arden Hills portion of campus by 23,948 square feet. 16. The project will remove 702 total caliper inches of significant trees from the campus within the construction area. The replacement planting of 300 caliper inches meets the City's tree preservation ordinance. 17. The project will utilize a storm water drainage pipe and underground infiltration basin constructed in Phase I (Planning Case ##08-006), and will reduce overall runoff through net decreases in impervious surface coverage. 18. Community Life Commons will be LEED certified. On the Height Variance: 19. Community Life Commons will have lire sprinklers and all adjoining buildings will have sprinkler coverage in conjunction with this project. 20. The project would be screened by trees from adjacent properties and Lake Johanna, not impacting scenic views. 21. Community Life Commons would have a floor area ratio under 0.5 and would not cause the campus to meet or exceed an overall floor area ratio of 0.5. 22. Community Life Commons meets the setback requirements from adjacent Nazareth Hall as calculated by Section 1325.03 Subd 3.C.4. At its closest point, the average of the height of the two buildings (35.5 feet) is less than the distance (38 feet) between them. City of Arden Hills Planning Commission Meeting for April 8, 2009 IlMetro-inet.uslardenhillslPlanninglPlanning Cases 12009109-005 NWC Site Plan Review1040809 - PCReport - NWC Site Plan Review Meg.doc Page 7 of 10 Notice Notice was published in the Arden Hills/Shoreview Bulletin and notice was prepared by the City and mailed to residents within one thousand (1,000) feet of the subject property. Northwestern College also held a community meeting on March 23, 2009, to present the project to adjacent property owners. Public Comments Staff met with two residents that had additional questions about the building height, use of the campus green, and screening of the loading dock. Northwestern College helped answer these questions and conditions were added to ensure proper noise mitigation and screening techniques were used to minimize impacts on nearby residential properties. Northwestern College held a community meting with the neighbors to present the plans and answer questions. Staff Recommendation Based on the submitted plans and findings of fact, Staff recommends approval of Planning Case #09-005 for a Site Plan Review and Variance for Phase II (Community Life Commons and campus green) in accordance with the PUD Master Plan for Northwestern College. The recommendation for approval is subject to the following sixteen conditions: 1. The applicant shall continue to abide by the conditions of all previous permits and reviews. 2. The project shall be completed in accordance with the plans submitted as amended by the conditions of approval. Any significant changes to these plans, as determined by the City Planner, shall require review and approval by the Planning Commission and City Council. 3. A Site Plan Agreement, drafted by the City Attorney, shall be sub j ect to City Council approval and signed by the property owner prior to any work being done on the site. 4. The applicant shall submit a financial surety in a form acceptable to the City Attorney for 125 percent of the cost of materials and installation of the landscaping plan prior to the City issuing any permits. The City shall retain the financial surety for at least two year after full implementation of the landscaping plan. The financial surety shall only be released upon successful inspection of the landscaping by the City Planner, which shall only occur during the growing season. 5. A temporary fence shall be placed between the construction area and the trees that are to be retained on drawing L200 in Attachment E. The fence shall be subject to City Planner inspection and shall be in place prior to the issuance of any building permits. The fence shall be maintained and shall not be removed without City Planner approval. 6. The replacement vegetation shall be subject to City Planner and City Forester review and approval. 7. The plans shall be subject to City Engineer review and approval prior to any site preparation and the execution of the Site Plan Agreement. The applicant shall comply with any conditions set by the City Engineer. 8. A fire apparatus road shall be provided to Nazareth Hall and Riley Hall, subject to the approval of the Fire Marshal and City Planner. 9. The applicant shall verify the location of hydrants on the northeastern side of the structure. 10. The loading dock for Community Life Commons will be properly screened as to not be visible from adjacent properties. Garbage and delivery trucks shall be prohibited to the Community Life Commons between the hours of 6:00 pm and 6:00 am. 11. The loading dock lighting shall not be permitted to be in use when the loading dock is not in use. 12. There shall be no electricity used on the campus green area with permission from the City with the exception of seasonal Christmas Lights on trees and shrubs. 13. A seven foot six inch fence shall be constructed to screen the loading dock from adjacent residential properties. 14. Upon completion of the project, the City may require additional vegetation, berming, fencing, and/or other types of screening to further reduce or eliminate light from the site if the City finds that the lighting is not in conformance with the approved Master PUD. 15. The applicant shall obtain all necessary permits, including, but not limited to, NPDES, Rice Creek Watershed District, Ramsey County and City Erosion Control permits, prior to the execution of the Site Plan Agreement. 16. Northwestern College shall continue to be responsible for regular maintenance of the underground infiltration basin. 17. Any direct, untreated pipe discharges into Lake Johanna and Little Lake Johanna located within this phase's construction limits shall be eliminated. The remaining direct, untreated discharges shall be eliminated in subsequent phases. 18. The City of Roseville shall receive a set of plans for review. 19. The applicant shall supply the required number of ADA accessible parking spaces prior to the issuance of the occupancy permit for the University Commons. 20. The applicant shall supply the City with as -built plans upon completion of construction. Options & Proposed Motion Lan�ua�e 1. Deadline for Auncy Actions The City of Arden Hills received the completed application for this request on March 19, 2009. Pursuant to Minnesota State Statue, the City must act on this request by May 18, 2009 (60 days), unless the city provides the petitioner with written reasons for and additional 60 day review period. The City may, with the consent of the applicant, extend the review period beyond the initial 120 days. Unless waived by the City Planner or Planning Commission, a certified survey of the property is required for all applications. The Planning Commission and/or City Council may still require a certified survey. A checklist for other required information is also available. Complete/incomplete Applications An incomplete application will delay the processing of land use requests. The application approval time commences and an application is considered officially filed when the City Planner has received and examined the application and determined that the application is complete. A decision on whether the application is complete or incomplete shall be made within fifteen (15) working days following the submittal of the application. When the application is deemed to be "complete" it shall be placed on the agenda of the first possible Planning Commission meeting provided that all required public notices have been sent and published. Payment of Fees The undersigned acknowledges that she/he understands that before a land use application can be deemed complete, all required information and fees (including all deposits) must be paid to the City. If additional fees are required to cover costs incurred by the City, the City Planner has the right to require additional payment from one or more of the undersigned, who shall be jointly liable for such fees. The CLC is a 2 level building consisting of 66,000 square feet of space including a basement that is part of a connecting tunnel from Riley Hall to Nazareth Hall. The building will contain food service, copy center, bookstore, mail center, offices, classrooms, and a prayer chapel. The building will be L EED certified. The Nazareth Hall Connection consists of a connecting tunnel from the CLC to the academic wing of Nazareth Hall. This will provide ADA accessibility to that part of Nazareth Hall on all levels. Also, this will allow food service access to the Blue Room which is the campus main banquet room. This PUD Master Plan Permit is dated the 10th day of December, 2007, and is issued by the City of Arden Hills, a Minnesota statutory city (the "City"), to Northwestern College, a Minnesota corporation, its successors and assigns ("Northwestern College"), for the Planned Unit Development of the Northwestern College Campus subject to the p terms and conditions contained herein. 2.0 Recitals. On the 29th day of October, 2007, the Arden Hills City Council reviewed the Application, the reports and comments of the Arden Hills staff and consultants, the comments of the Northwestern College representatives and members of the public who chose to speak, the recommendations of the Planning Commission, and approved the PUD Master Plan for the Northwestern College Campus, subject to the terms and conditions contained herein. 3.0 Terms and Conditions. A. PUD Master Plan. The PUD Master Plan for the Northwestern College g Campus consists of the Northwestern College Master Plan, PUD Application report September 10, 2007, which is retained at the City of Arden Hills administrative offices and Planning Case File No. 06-037 and is referred to herein as Exhibit B. B. Development Compliance. The Northwestern College Campus shall be developed in compliance with the PUD Master Plan except as hereinafter modified. 1. Enrollment Limit. Enrollment shall not exceed 2400 full-time equivalent students. Full-time equivalent student shall be calculated using the following formula: full-time student headcount + (part-time student headcount/3) = full-time student equivalents. 2. PUD Master Plan Implementation Updates. The Northwestern College PUD Master Plan shall be subject to a review by the Planning Commission and City Council every five years in order to review general activity on the campus and to evaluate compliance with the Master Plan, the conditions associated with the PUD Master Plan, and the conditions of any other projects constructed after the PUD Master Plan was approved. These reviews shall include, but not be limited to, reviewing enrollment numbers for full-time equivalent students, parking conditions, landscaping/screening, site plans, construction projects, other needed mitigation measures, and overall progress on and compliance with the PUD Master Plan. The first review shall occur by October 29, 2012. 3. Site Plan Review. Construction projects and changes to the campus that are substantially in conformance with the PUD Master Plan shall only require a site plan review with the Planning Commission and City Council prior to implementation. 4. PUD Amendments. Amendments to the PUD Master Plan shall conform to the provisions within the Arden Hills Zoning Code and shall require a public hearing. 5. Code Compliance, Northwestern College shall meet all regulatory requirements and standards in place at the time of construction unless the Northwestern College receives an approved variance that is in accordance with State Statutes, City Codes, Rice Creek Watershed District, and other regulatory agencies. 6. Code Compliance and Permitting. All construction activities shall require a permit from the Rice Creek Watershed District and any other applicable regulatory agency prior to any building permits being issued by the City. 7. Parking Structure Design. The parking structure (Building 23 on the PUD Master Plan Scope) shall be designed so that vehicles are 2 not required to traverse the relocated ring road when entering or exiting the parking structure. Lights from vehicles shall not shine onto adjacent properties when exiting, entering, or on the parking structure. Lighting from the parking structure shall not shine onto adjacent properties. The design of the structure shall be responsive to other buildings on the campus and compatible with the residential character of the surrounding neighborhood. 8. Ring Road Review Process. Constructing or relocating any campus roads or surface parking lots shall require a site plan review and public hearing before the Planning Commission and approval from the City Council prior to construction. A landscaping plan to significantly screen the road from the adjacent residential properties shall be required. 9. Prohibited Road Connection. A road connection to Asbury Avenue and Shorewood Drive from the campus shall be strictly prohibited. 10. Permitting and Inspections. The City of Arden Hills and the City of Roseville shall jointly determine which municipality is responsible for issuing permits and inspecting construction sites for any project that crosses the municipal border. 11. Permittin , . Construction of new buildings entirely on the Roseville portion of the campus shall not require a permit from Arden Hills but construction plans shall be submitted to Arden Hills at least two weeks prior to construction to be included in the Northwestern College address file. 12. Lake Setbacks. Except for walkways, no impervious surfaces shall be constructed within the 50 feet of the ordinary high water mark for Lake Johanna and 75 feet from the ordinary high water mark for Little Lake Johanna. The use of pervious surfaces for walkways shall be encouraged. 13. Property Setbacks. All structures, including parking ramps, and roads shall be at least seventy-five (75) feet from the eastern property line and thirty (30) feet from the western property line. 14. Building Height. Any building exceeding the height limit of the underlying R-1 Zone shall require an approved height variance prior to construction. 15. Lighting. Lighting from any new or remodeled structures, parking lots, roads, vehicular traffic, or other campus features shall be 3 prohibited from shining directly onto adjacent properties and shall not exceed the lighting limitations in the Arden Hills Zoning Code. 16. Lot Coverage. The portion of the campus within Arden Hills shall not exceed 35 percent lot coverage without an approved variance or PUD amendment as required by the Zoning Code at the time of review. The lakes shall not be included in the lot coverage calculations. 17. Tree Preservation. A tree preservation plan shall be submitted with each site plan review and shall be in compliance with any current and future tree preservation standards. 18. Buckthorn Removal. Northwestern College shall continue to implement a buckthorn removal program to protect the native landscaping in and around the College's property. 19. Trash/Recycling/Refuse Handling. All trash, recycling, and other refuse handling shall be in conformance with Section 620.04 of the City Code and as amended in the future. 20. Storm water Management. Northwestern College shall be required to conform and implement the following as a part of their storm water management plan for this development: a. Each development phase must meet the regulatory standards in place at the time of building permit application. All stages of development should recognize the others to ensure that a comprehensive storm water management plan is constructed for the site. b. Site impervious coverage shall be consistent with the provisions of City Zoning and Shoreland Ordinances. C. Northwestern College will identify and eliminate all direct, untreated piped discharges into Lake Johanna and Little Lake Johanna as a part of the campus expansion plans. 21. Energv Efficient Design. Each phase shall use as many Leadership in Energy and Environmental Design (LEED) principles as the College deems possible. 22. City of Roseville Conditions. The PUD Master. Plan shall be subject to all conditions and regulations set by the City of Roseville. Conditions imposed by the City of Arden Hills shall not be deemed to invalidate any conditions set by the City of Roseville. 4 23. Environmental Review. The City of Arden Hills reserves the right to request an updated environmental assessment with future construction and site plan review processes. 24. Landscaping Layering and Light Buffer. Landscape screening shall take a multi -layered landscape approach and shall be required to prohibit lights from shining onto adjacent properties. 25. Ring Road and Parking Structure Landscaping. Landscaping plans shall be substantially similar in size and quality as in attached Exhibit B for the parking garage and Ring Road and subject to site plan review. 26. Outdoor Events. Year-round outside events on the Campus Green shall not continue after 9:00 p.m. except once per semester an event may continue to 10:00 p.m. Exceptions may be granted subject to City Council approval. Backiround 1. Overview of Request: Bethel University operates under a CUP Master Plan. As the College comes forward with plans, they are reviewed against the Master Plan for consistency. While building plans consistent with the Master Plan only require a site plan review, those not included in the original plan must be approved through a CUP Amendment. In 2004, Bethel University submitted an application (Planning Case #04-010) for a CUP Amendment to install a temporary modular classroom building to serve as additional classroom space on the campus until the University Commons building was completed. It is located just north of Robertson Center in the northeastern portion of the campus. The Planning Commission recommended approval of the request at their May 5, 2004, meeting with the City Council subsequently approving the CUP Amendment at their May 24, 2004, meeting. The University Commons building has recently finished construction, though Bethel University has submitted an application to retain the temporary classrooms for a period of time not to exceed three years due to the financial constraints of setting up the new classrooms and moving the facilities. An adjustment to the original CUP Amendment requires approval through an additional CUP Amendment. The conditions of the original 2004 CUP Amendment would remain in effect, except for Condition H which originally required the classrooms be removed by May 2011, or when the University Commons building was completed, whichever came first (Attachment Q. On the Conditional Use Permit Amendment/Site Plan Review: 8. Extending the use of the temporary modular classroom building is not expected to affect traffic or parking conditions. 9. Extending the use of the temporary modular classroom building will not produce any additional levels of permanent noise, glare, odors, vibration, smoke, dust, air pollution, heat, liquid, or solid waste. Temporary noise and dust may be created during demolition. 10. Extending the use of the temporary modular classroom building will not alter drainage patterns. 11. Extending the use of the temporary modular classroom building is not expected to have any impacts on campus population or density. 12. The park dedication fee is not applicable to this application. 13. Staff Recommendation Based on the submitted plans and findings of fact, Staff recommends approval of Planning Case #09-006 for a Conditional Use Permit Amendment to extend the use of a temporary modular classroom building on Bethel University's campus for a period of time not to exceed three years. The conditions of the original CUP Amendment, with the exception of Condition H, will continue to apply and are listed below: A. Openings in the Robertson Center shall be ninety (90) minute protected and Permittee shall verify this with the Building Official and Fire Marshall. F. Revised utility, grading, and erosion control plans shall be submitted to the City Engineer for approval prior to the issuance of building permits. G. Upon removal of the temporary modular classroom building, Permittee shall replant the area of the temporary modular classroom building or the area of the adjacent Kresge Courtyard to include up to fifty (50) caliper inches of trees to replace those removed during the installation of the temporary modular classroom building. I. Upon removal of the temporary modular classroom building, all of the footings shall be removed and the sod shall be restored. These classrooms were originally approved by a CUP amendment in April of 2004. It was our plan that the units would be removed once the Commons was completed and replacement classrooms could be built in the vacated spaces. However, we have found that the university is now in a significantly different financial position than we had anticipated. Bethel University, along with the rest of the nation, finds itself in totally uncharted economic territory. This uncharted territory has had a major impact on not only our financial position but also on that of our donors. Many donors who made commitments to the Commons project, our annual fund, as well as other related projects, find themselves unable to fulfill their pledges on the timeline they had anticipated. Historically our donors have had a sterling record in fulfilling their pledges. However, many of them have suffered loses in their portfolios over the past year. We expect that they will once again fulfill their pledges but we are uncertain about the timing. In addition to the challenges faced by our donors we face similar internal challenges. Enrollment, which is a key factor in institutional budgeting, is still unclear for this coming year. Although historically recessions have had a positive impact on college enrollment there is a sense in which this recession is different. Many of our sister schools around the country have already experienced declines in their enrollment. Although we are hopeful about our fall enrollment we do not want to make any overly optimistic assumptions. As we look ahead to our next fiscal year we are taking significant steps to insure that Bethel remains financially healthy. In a move that reflects the seriousness of the current economy, all employees have been informed that salaries will be frozen for this coming year and non-critical positions will not be filled. Other areas of our budget are under similar scrutiny. As a result of these economic stresses, Bethel is requesting an extension on our use of the modular classrooms for up to three years. While we are committed to our agreement to remove these classrooms, the extension would allow us much needed flexibility in planning and budgeting for the expense of removal and construction of replacement classrooms. This was originally recommended for approval by the Planning Commission at their February 4, 2009, meeting. As part of the approval, an addition to the clear vision area diagram was made illustrating a T -intersection. Ordinance 2009-003 went into effect on the date of itsublishin p g, March 18, 2009. March 16, 2009, City Council Work Session As part of this work session, the City Council was presented the revised plans for the Arden Plaza shopping center on the southwest corner of County Road E and Lexington, giving them an additional opportunity to make comments. Pete Keely from Collage Architects discussed the changes to traffic flow, drive-thru placement, and design of the buildings. These plans were previously presented to the Planning Commission at their March 4, 2009, work session. To date, there has been no formal application submitted as this presentation was only intended to collect additional comments and feedback from the City Council. If a formal application is submitted, a full public hearing will be required with the Planning Commission. TTM Operating Corporation is a communications company that provides high speed fiber optic services to cellular towers. Their proposal was to install communications equipment at the base of the City's south water tower site at 1230 Red Fox Road for an annual fee. As this case was only for a lease agreement, it only required City Council review.
