Back2round The applicant is proposing to construct the Northwestern College Community Life Commons (CLC), a two-story, 70,639 square foot building that would include food service, copy center, bookstore, offices, classrooms, and a prayer chapel (Attachment C). An underground passageway would connect the building with Riley Hall to the southeast and Nazareth Hall to the west. The structure would be LEED certified, though the level of certification was not established at the time of this report. The height of the majority of the structure would be between 28 and 42 feet; however, the highest point of the building would be approximately 48 feet measured from an attached prayer tower. There is a 35-foot height limit in the R-l Zoning District. The campus green adjacent to the Community Life Commons would be renovated as part of the project, which includes landscaping a total area of 174,240 square feet. Finally, an additional 480 square feet will also be added to Nazareth Hall containing a 100 square foot elevator shaft. The elevator is necessary to make the building fully accessible. Construction projects and changes to the campus that are substantially consistent with the approved Master PUD require only a site plan review with the Planning Commission and City Council prior to implementation. However, the Master PUD also requires Northwestern College to comply with all provisions of the Zoning Code unless ..a variance is granted. This is the second application to go before the Planning Commission and City Council since the Master PUD was approved on October 29, .2007. The prior (Planning Case #08-006) was a site plan review for Phase I of the Master Plan for the construction of a ring road and parking spaces in three places throughout the Northwestern College campus, replacing an existing access road and parking lot that would be removed by the construction of this project (Phase II). The applicant has submitted a narrative describing the project, a site plan, utility and grading plans, landscaping and tree removal plans, architectural elevations of the future parking structure, and renderings of the proposed landscaping (Attachment C). Buildio2 Official and Fire Marshal Review The Fire Marshal expressed concerns about access to the front side of buildings along the campus green, noting that any such access roads or paved surfaces must meet specific size and weight bearing requirements. The applicant is aware of this requirement and is working with the Fire Marshal to meet it. Condition 8 has been added that will require the Fire Marshal and Building Official to approve any fire access solution prior to the issuance of any building permits. While this change may impact the impervious surface coverage on the site, it is not anticipated to increase the coverage beyond the 35 percent maximum. Findin2S of Fact The Planning Commission offers the following twenty-two findings of fact for the Northwestern College Site Plan Review for the City Council's consideration: General Findings: 1. The Proposed location of the Community Life Commons is in conformance with the approved Master Plan. 2. Community Life Commons will be two stories and include 70,639 square feet of space. 3. The proposed use of the building is in conformance with the R-1 Zoning District. 4. The adjacent campus green will consist of 174,240 square feet of landscaped space. 5. The loss of parking spaces and an access road as part of this project is included in the approved Master PUD Plan (Planning Case #06-037) and was previously replaced with the construction of a campus ring road and additional parking spaces (Planning Case #08- 006). An additional 425 square feet containing an elevator shaft will be added to Nazareth Hall to bring the building in compliance with the Americans with Disabilities Act (ADA). 7. Community Life Commons and campus green meets all setback and lot coverage requirements for the R-l Zoning District. 8. The height of the Community Life Commons' prayer tower is 47 feet ten inches, which exceeds the height limit of 35 feet for the R-l Zoning District. 9. The heights of the Community Life Commons' three pavilions range in height between 40 and 42 feet. On the Site Plan Review: 10. In accordance with the PUD Master Plan, any deviations from the regulations and standards must be approved through a variance. 11. The project will meet all setbacks from the Ordinary High Water Mark (OHW) of Lake Johanna and Little Lake Johanna. 12. The project will meet all required property setbacks. 13. Community Life Commons exceeds the height limit for the R-l Zoning District, requiring a height variance. 14. There will be no external lights used on Community Life Commons. Lights internal to the building and the pedestrian lights on the campus green will not shine on adjacent properties. 15. The project will reduce overall impervious surface coverage on the Arden Hills portion of campus by 23,948 square feet. 16. The project will remove 702 total caliper inches of significant trees from the campus within the construction area. The replacement planting of 300 caliper inches meets the City's tree preservation ordinance. 17. The project will utilize a storm water drainage pipe and underground infiltration basin constructed in Phase I (Planning Case #08-006), and will reduce overall runoff through net decreases in impervious surface coverage. 18. Community Life Commons will be LEED certified. On the Height Variance: 19. Community Life Commons will have fire sprinklers and all adjoining buildings will have sprinkler coverage in conjunction with this project. 20. The project would be screened by trees from adjacent properties and Lake Johanna, not impacting scenic views. 21. Community Life Commons would have a floor area ratio under 0.5 and would not cause the campus to meet or exceed an overall floor area ratio of 0.5. 22. Community Life Commons meets the setback requirements from adjacent Nazareth Hall as calculated by Section 1325.03 Subd 3.C.4. At its closest point, the average of the height of the two buildings (35.5 feet) is less than the distance (38 feet) between them. The applicant shall continue to abide by the conditions of all previous permits and reVIews. 2. The project shall be completed in accordance with the plans submitted as amended by the conditions of approval. Any significant changes to these plans, as determined by the City Planner, shall require review and approval by the Planning Commission and City Council. 3. A Site Plan Agreement, drafted by the City Attorney, shall be subject to City Council approval and signed by the property owner prior to any work being done on the site. 4. The applicant shall submit a financial surety in a form acceptable to the City Attorney for 125 percent of the cost of materials and installation of the landscaping plan prior to the City issuing any permits. The City shall retain the financial surety for at least two year after full implementation of the landscaping plan. The financial surety shall only be released upon successful inspection of the landscaping by the City Planner, which shall only occur during the growing season. 5. A temporary fence shall be placed between the construction area and the trees that are to be retained on drawing L200. The fence shall be subject to City Planner inspection and shall be in place prior to the issuance of any building permits. The fence shall be maintained and shall not be removed without City Planner approval. 6. If any of the retained trees on drawing L200 are removed or damaged by any natural or manmade force prior to Staffs final inspection of the fully implemented landscaping plan, Northwestern College shall replace 125 percent of the removed caliper inches of trees. The replacement vegetation shall be subject to City Planner and City Forester review and approval. 7. The plans shall be subject to City Engineer review and approval prior to any site preparation and the execution of the Site Plan Agreement. The applicant shall comply with any conditions set by the City Engineer. 8. A fire apparatus road shall be provided to Nazareth Hall and Riley Hall, subject to the approval of the Fire Marshal and City Planner. 9. The applicant shall verify the location of hydrants on the northeastern side of the structure. 10. The loading dock for Community Life Commons shall be properly screened so as to not be visible from adjacent properties. Garbage and delivery trucks shall be prohibited to the Community Life Commons between the hours of 7:00 pm and 7:00 am. 11. The loading dock lighting shall not be permitted to be in use when the loading dock is not in use. 12. If sound amplifying equipment is used on the campus green it shall be directed away from neighboring residential properties. Upon completion of the project the City may require additional sound mitigation measures to further reduce or eliminate noise impacts from the site if the City finds that noise generated from the site is causing a nuisance. If any complaints regarding noise are made to the City, the applicant shall be responsible for providing decibel measurements from the property line. 13. A seven foot six inch fence shall be constructed to screen the loading dock from adjacent residential properties. 14. Upon completion of the project, the City may require additional vegetation, berming, fencing, and/or other types of screening to further reduce or eliminate light from the site if the City finds that the lighting is not in conformance with the approved Master PUD. 15. The applicant shall obtain all necessary permits, including, but not limited to, NPDES, Rice Creek Watershed District, Ramsey County and City Erosion Control . permits, prior to the execution of the Site Plan Agreement. 16. Northwestern College shall continue to be responsible for regular maintenance of the underground infiltration basin. 17. Any direct, untreated pipe discharges into Lake Johanna and Little Lake Johanna located within this phase's construction limits shall be eliminated. The remaining direct, untreated discharges shall be eliminated in subsequent phases. 18. The City of Roseville shall receive a set of plans for review. 19. The applicant shall supply the required number of ADA accessible parking spaces prior to the issuance of the occupancy permit for the University Commons. 20. The applicant shall supply the City with as-built plans upon completion of construction. Options 1. Approve the proposal as submitted. 2. Approve the proposal with conditions. 3. Deny the application with reasons for denial. If the City denies the petitioners request, "... it must state in writing the reasons for the denial at the time it denies the request. " 4. Pursuant to Minnesota State Statue, the City must act on this request by May 18, 2009 (60 days), unless the city provides the petitioner with written reasons for and additional 60 day review period. The City may, with the consent of the applicant, extend the review period beyond the initial 120 days. City Planner Beekman displayed a computerized presentation pointing out where the improvements would take place. She advised that based on resident concern with noise, staff felt that Condition 12 should be amended. Staff recommended approval of the request subject to the following conditions: 1. The applicant shall continue to abide by the conditions of all previous permits and reviews. 2. The project shall be completed in accordance with the plans submitted as amended by the conditions of approval. Any significant changes to these plans, as determined by the City Planner, shall require review and approval by the Planning Commission and City Council. 3. City Planner Beekman advised that occasionally a class may be held on the green, as well as other outdoor activities such as Frisbee or touch football. She advised that the campus held a meeting with adjacent residents in regard to the project, and City Staffhad also met with neighbors of the campus. She advised that although this was not a public hearing, notice was sent to the surrounding residents of tonight's meeting. She advised that staff recommended approval of the request. Commissioner Reiff requested clarification to the amendment suggested to Condition 12 in regard to whether the 9:00 p.m. time referred to amplified sound equipment or all activities. City Planner Beekman advised that sound amplification equipment could not be used after 9:00 p.m. She advised that already listed in the PUD is the requirement that no activities could be held on the campus green after 9:00 p.m., with the exception of an extension until 10:00 p.m. once per semester. Chair Larson clarified that the need for the variance is because the property is zoned R-1, which is commonly used for schools and churches. He thought that perhaps a zoning district should be created for this specific use to avoid the common violations that they encounter. City Planner Beekman advised that staffhad discussed that possibility. Mr. Schroder, CFO of Northwestern, advised that common activities for the green currently are frisbee, football, and occasional outdoor classes. He thought that outdoor classes would occur more often with the addition of seating. He stated that the outdoor activities for the students would remain a priority. He stated that the extensions in time past 9:00 p.m. would be orientation in the fall, and graduation in the spring. Commissioner Reiff questioned if Mr. Schroder was comfortable with the amendment to Condition 12. Mr. Schroder requested that the two times permitted for an extension listed in the PUD also be included in Condition 12. Commissioner Holewa thought that Northwestern was a good member of the community and the City and appreciated all the hard work that they do. Commissioner Holewa moved, seconded by Commissioner Modesette, to recommend approval of Planning Case 09-005, Site Plan Review for Northwestern College, based on the 20 conditions in the April 8, 2009 Planning Case report. Commissioner Reiff moved, seconded by Commissioner Thompson, to amend the motion to recommend approval of Planning Case 09-005, Site Plan Review for Northwestern College, based on the 20 conditions in the April 8, 2009 Planning Case report with Condition 12 amended to read: "If sound amplifying equipment is used on the campus green it shall be directed away from neighboring residential properties. Activities on the campus green shall not extend past 9 pm, except once per semester when they can extend until 10 pm. Upon completion of the project the City may require additional sound mitigation measures to further reduce or eliminate noise impacts from the site if the City finds that noise generated from the site is causing a nuisance." Further discussion: City Planner Beekman advised that members of the public would like to speak. Chair Larson opened the floor for public comment. Nancy Jacobson, 3188 Asbury, advised that her property faces the college. She displayed a photo taken from her garage to show the view of the college. She ~ stated that the college does not have the same needs as the neighborhood and also holds different activities. She did not support a change in zoning, as she believes the restrictions allow for a better fit into the residential area. She stated that in regard to Condition 12, she was still concerned with the college having audio or visual displays until 9:00 p.m.. She was very concerned with additional noise from the activities taking place on the campus green. Barbara Unicell, 1574 Glen Hill Road, thanked the college for the trees that had been planted to help shield the neighborhood. She thanked the college for also replacing the trees that have died. She did not feel that the trees provided much of a barrier.. She stated she had to keep her shades closed in the morning because of the constant activity in that area. She was concerned with noise and lights. She was also concerned with the expansion and was not in favor of changing the zoning district for the college. She thought that there were reasons that the R-l zoning should be kept. Chair Larson clarified that it was merely a proposal and that nothing had been seriously considered at this time.. He explained that there was not a great need to rezone at this time and was something that was merely mentioned. Barbara Unicell felt that the increase in height would affect the entire neighborhood.. She saw a recurring pattern in the increase in size requests. She thought although the situation was difficult it should be mutually beneficial. The motion carried unanimously (5-0). May 11, 2009, City Council Meeting Attachment B Site Plan Agreement SITE DEVELOPMENT AGREEMENT NORTHWESTERN COLLEGE CAMPUS CITY OF ARDEN HILLS P .C. FILE NO.: 09-005 1.0 Parties. This Site Development Agreement is dated the 11 th day of May, 2009, and is entered into by and between the City of Arden Hills, a Minnesota statutory city (the "City"), and Northwestern College, a Minnesota corporation, its successors and assigns ("Northwestern College"), subject to the terms and conditions contained herein. 2.0 Planned Unit Development Master Plan. On December 10, 2007, the Arden Hills City Council approved a Plan Unit Development ("PUD") Master Plan for the development for the Northwestern College Campus as contained in Arden Hills Planning Case No. 06-037. Section 2.0(b )(3) of the PUD, provides that the construction projects and changes to the campus that are substantially in conformance with the PUD Master Plan shall only require -a site plan review by the Planning Commission and the City Council. 3.0 Site Plan Review Application. On March 2, 2009, Northwestern College ("Applicant") submitted an application for a site plan review. On March 19, 2009 the application was deemed complete. The application included the following drawings and schematics ("Plans") which are contained in Arden Hills Planning Case File No. 09-005 and were prepared by Perkins & Will Architecture Firm: A. Cover Sheet and Drawing Index (G-OOO) dated January 13,2009. B. Demolition Plan (C-100) dated January 13,2009. C. Erosion Control Plan (C-200) dated January 13, 2009. D. Grading and Drainage Plans (C-201-C-204) dated January 13,2009. E. Paving Plan (C-301) dated January 13, 2009. F. Landscape Site Plans (L-100-L-103) dated January 13, 2009. G. On April 8, 2009, the Arden Hills Planning Commission reviewed the application, considered the recommendations of the Arden Hills City staff, consultants and recommended approval of the application subject to certain conditions. On May 11, 2009, the Arden Hills City Council reviewed the application, the recommendations of the Arden Hills staff, the Arden Hills consultants, the Arden Hills Planning Commission; and approve the application for the development described herein subject to the following conditions: A. The plans shall be subject to City Engineer review and approval prior to any site preparation and the execution of the Site Plan Agreement. The applicant shall comply with any conditions set by the City Engineer. 7. A fire apparatus road shall be provided to Nazareth Hall and Riley Hall, subject to the approval of the Fire Marshal and City Planner. 8. The applicant shall verify the location of hydrants on the northeastern side of the structure. 9. Any direct, untreated pipe discharges into lake Johanna and little lake Johanna located within the construction limits located within the 2 above listed plans shall be eLiminated. The remalnlng direct, untreated discharges shall be eliminated in subsequent phases. 10. The City of Roseville shall receive a set of plans for review. 11. The applicant shall supply the required number of ADA accessible parking spaces prior to the issuance of the occupancy permit for the University Commons. 12. The applicant shall obtain all necessary permits, including, but not limited to, NPDES, Rice Creek Watershed District, Ramsey County and City Erosion Control permits, prior to the execution of the Site Plan Agreement. B. Conditions relating to use of site: 1. The loading dock for Community Life Commons will be properly screened as to not be visible from adjacent properties. Garbage and delivery trucks shall be prohibited to the Community Life Commons between the hours of 7:00 pm and 7:00 am. 2. The loading dock lighting shall not be permitted to be in use when the loading dock is not in use. 3. If sound amplifying equipment is used on the campus green it shall be directed away from neighboring residential properties. Activities on the campus green, in accordance with the approved Master PUD, shall not extend past 9 pm, except once per semester when they can extend until 10 pm. Upon completion of the project the City may require additional sound mitigation measures to further reduce or eliminate noise impacts from the site if the City finds that noise generated from the site is causing a nuisance. If any complaints regarding noise are made to the City, the applicant shall be responsible for providing decibel measurements from the property line. 4. A seven foot six inch fence shall be constructed to screen the loading dock from adjacent residential properties. 5. Upon completion of the project, the City may require additional vegetation, berming, fencing, and/or other types of screening to further reduce or eliminate light from the site if the City finds that the lighting is not in conformance with the approved Master PUD. 6. Northwestern College shall continue to be responsible for regular maintenance of the underground infiltration basin. 7.
