Motion to approve addendum number one to the original Kimley-Horn contract, which
includes an additional amount not to exceed $28,100 in engineering fees, in order to include a

SUBJECT: Addendum No.1 to Kimley-Horn contract for the County Road E project
BACKGROUND
At the May 26, 2009 Regular City Council Meeting, Kimley-Horn and Associates was selected
from our Engineering pool to proceed with an application for funding through the 2009 Regional
Federal Transportation Program for the County Road E pedestrian/bicycle overpass of Snelling
Avenue (TH51). On June 8, 2009, the City Council adopted a resolution supporting the
application. At that meeting, City Council directed staff to include a trail from Old Snelling to
the proposed pedestrian bridge structure over Snelling Avenue (TH51) in this application. In
order to include this section of trail, the City Council was informed that the contract for Kimley-
Horn would need to have an addendum approved for the additional engineering services related
to the trail. Staffhas included the addendum in the amount of$28,100 for review.
COUNCIL ACTION REQUESTED
Motion to approve addendum number one to the original Kimley-Horn contract, which includes
an additional amount not to exceed $28,100 in engineering fees, in order to include a connecting

AMENDMENT NUMBER ONE (1) TO THE AGREEMENT
BETWEEN THE CLIENT AND KIMLEY-HORN AND
ASSOCIATES, INC.
AMENDMENT NUMBER ONE (1) DATED JUNE 23,2009 to the agreement between
The City of Arden Hills, ("Client") and Kimley-Hom and Associates, Inc., ("Consultanttt) dated
June 12, 2009 ("the Agreementn) concerning County Road E Bridge Pedestrian Improvements
project (the "Project").
The Consultant has entered into the Agreement with Client for the furnishing of
professional services, and the parties now desire to amend the Agreement.
Therefore, it is mutually agreed that the Agreement is amended to include Additional
Services to be performed by Consultant and provisions for additional compensation by the Client
to the Consultant, all as set forth in Exhibit A hereto. The parties ratify the terms and conditions
of the Agreement not inconsistent with this Amendment, all of which are incorporated by
reference.

Scope of Work
The scope of work included in the Agreement shall be amended as follows:
A. Trail Final Design
The scope of proposed improvements under Task 2.5, Final Design Plans & Teclmical
Special Provisions, shall be amended to include a trail from Old Snelling Avenue to the
new structure over Snelling Avenue. Additional plan sheets including details, erosion
and sediment control, traffic control, plan/profile, and cross sections will be included
detailing the proposed improvements associated with this segment of trail. We will also
prepare teclmical special provisions for the trail. Based on field investigations, we
anticipate the improvements required for the trail will include retaining walt We have
assumed that the proposed retaining wall will be modular block consistent with Mn/DOT
and Federal Aid standards.
B. Project Manual
Task 2.5 shall be amended to include preparation of the project manual, which will
include bidding documents, general contract conditions, and technical specifications
required for the bidding of the proposed improvements.

Upon authorization of work tasks, we will provide these additional services as expeditiously as
practicable to meet a mutually agreed upon schedule"
Fee
Consistent with the Agreement, Kirnley-Horn will provide the scope of services on a labor fee
plus expense basis. Labor fee will be billed according to our 2009 standard hourly rate schedule,
which is subject to annual adjustment. An amount equal to 6.0% of Kimley-Hom labor fee will
be added to each invoice to cover certain other expenses such as in-house duplicating, local
mileage, telephone calls, facsimiles, postage, and word processing. All permitting, application,
and similar project fees will be paid directly by the Client. The following is a summary of our
estimated cost for the additional work identified in this Amendment.
