Supporting Documents: 1, Memorandum from Civil Engineer Kristine Giga dated June 23, 2009. 2, Resolution 2009-016 3, Proposed Deferred Assessment Roll .vI\ MEMORANDUM DATE: June 23, 2009 TO: Mayor and City Council Ron Moorse, City Administrator FROM: Kristine Giga, Civil Engineer SUBJECT: 2009 PMP Improvements- Adoption of Deferred Assessment Roll BACKGROUND On May 11, 2009, the City Council set June 8, 2009, as the date to hold public hearings for the purpose of establishing special assessments for the 2009 PMP Improvements. At the June 8, 2009 meeting, the City Council adopted the assessment roll for the project, and provided direction to staff regarding the terms of the deferred assessment. DISCUSSION As discussed at earlier meetings, four properties within the 2009 PMP are large enough where they could be subdivided, according to the current City Code. These properties are: 3544 North Snelling Avenue 1400 Forest Lane 1433 Forest Lane 3438 Glenarden Court The City Council directed staff to defer the second assessment on these properties until such time that a subdivision occurs. A deferred assessment roll was prepared following Minn. Stat. 429.061, Subd. 2. A future subdivision of the property would trigger the payment of the deferred assessments. Deferred assessments are certified to the county auditor but collection is deferred. A certificate of the deferred assessment must contain the legal description and the parcel identification number (Pill) of the affected property and the amount deferred. Deferred assessments constitute liens on the property and must be paid within 30 years of the assessment levy even if the subdivision has not occurred within that time. The City Council directed staff to set the assessment period at the maximum term allowable, 30 years, and to forgive the interest on the assessment. The resolution has been prepared accordingly. RECOMMENDED COUNCIL ACTION Approval of resolution 2009-016, adopting deferred assessments for the 2009 PMP improvements, \ \Metro-inet\ardenhills\Admin \Council\Agendas & Packet Information \2009\06-29-09 09Memo2009PMP _ DeferredAssessment-adopt.doc Regular\Packet Information\7.A - 6-29- ~ ~~HILLS CITY OF ARDEN HILLS COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION NO. 2009-016 RESOLUTION ADOPTING DEFERRED SPECIAL ASSESSMENT ROLL FOR THE 2009 PMP IMPROVEMENTS WHEREAS, pursuant to proper notice duly given as required by law, the City Council has met and heard and passed upon all objections to the proposed assessment for the improvement of the City of Arden Hills 2009 Pavement Management Program improvement of the following streets: Arden Place, from Old Snelling to Glenarden Road, Glenarden Court, from Skiles Lane to Glenarden Road, Glenarden Road, from Old Snelling to cul-de-sac, Forest Lane, from Old Snelling to Glenarden Road, Skiles Lane, from Old Snelling to Glenarden Road, Snelling Avenue N, from Arden Place to cul-de-sac, WHEREAS, the following properties abut the project: 343023210050 343023210074 343023240020 343023210014 1400 FOREST LANE 1433 FOREST LANE 3438 GLENARDEN COURT 3544 SNELLING AVENUE N WHEREAS, according to current City Code, these properties could be further subdivided, and WHEREAS, the Arden Hills City Council determined that the Special Assessment for the above properties would be deferred until the further subdivision of the property, or the expiration of 30 years from the date of the adoption of this Deferred Special Assessment Roll, which ever event occurs first. Such deferred assessment roll, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such deferred assessment shall be payable in full upon further subdivision of such property; or the expiration of 30 years, whichever event occurs first, and shall bear interest at the rate of 0 percent per annum from the date of the adoption of this deferred assessment resolution. 3. If the adopted deferred assessment differs from the proposed assessment as to any particular lot, piece, or parcel of land, the City Administrator shall mail to the owner a notice stating the amount of the adopted assessment. The administrator must also notify affected owners of any changes adopted by the Council in interest rates or prepayment requirements from those contained in the notice of the proposed assessment. 4. The owner of any property so assessed may, at any time prior to certification of the assessment to the county auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City Administrator, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution. The owner may at any time thereafter, pay to the County Auditor the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the succeeding yeara 5. The City Administrator shall forthwith prepare and transmit a certified duplicate of this assessment to the County Auditor to be extended on the property tax lists of the county. Such assessments shall be collected and paid over in the same manner as other municipal taxes. ADOPTED BY THE CITY COUNCIL OF THE CITY OF ARDEN HILLS THIS 29th DAY OF JUNE, 2009. Stanley D.
