Background 1. Overview of Request: The applicant, Ramsey County, has requested a CUP Amendment to construct a 1,800 square foot addition to the Ramsey County Sherriff Patrol Station. This is Building 5 of the Ramsey County Public Works Facility (RCPWF), a 35 -acre complex of five buildings also containing the City of Arden Hills Public Works Garage. The proposed addition would create space for a new Disaster Recovery Computer Center within the existing patrol station. This recovery center would not require any additional staff on site; it would be a remotely monitored data storage site utilized only in emergencies. The 1,800 square foot addition to the Ramsey County Sherriff Patrol Station (Building 4) will not affect conformance with the zoning requirements. The height of the addition will be just over 17 feet and greatly exceeds all the setback requirements. The proposal will also have a minimal impact on surface coverage. The portion of the site occupied by structures will increase from 18.6 percent to 18.9 percent while total impervious surface coverage will increase from 759 to 76.0 percent. R. Landscaping and Tree Preservation — Meets Requirements Because the proposed plans do not increase the area of the facility by more than ten percent, the City's landscaping requirements are not impacted. The addition will not require the removal of any trees or established vegetation from the site and the original landscaping plan will remain in effect. C. Lighting — Meets Requirements The location and arrangement of lighting on the site will not change as part of the expansion. No additional exterior lighting will be required as part of the proposal. D. Screening — Meets Requirements No new rooftop equipment will be installed as part of the proposal. E. Parking and Traffic —Meets Requirements The number of parking stalls will not be changed by the proposal. No changes to traffic to and on the site are expected as the recovery center will be remotely monitored while the expansion will not impact any internal roads or paved surfaces within the site. Conditional Use Permit — Section 1355.04 Subd 3 Section 1355.04 Subd 3 of the Arden Hills Zoning Code lists the criteria for evaluating a Conditional Use Permit. The Planning Commission and City Council shall consider the effect of the proposed use upon the health, safety, convenience and general welfare of the owners and occupants of the surrounding land, in particular, and the community as a whole, in general, including but not limited to the following factors: 1. Existing and anticipated traffic and parking conditions; 2. Noise, glare, odors, vibration, smoke, dust, air pollution, heat, liquid or solid waste, and other nuisance characteristics; 3. Drainage; 4. Population density; 5. visual and land use compatibility with uses and structures on surrounding land; adjoining land values; 6. Park dedications where applicable; and the 7. Orderly development of the neighborhood and the City within the general purpose and intent of this ordinance and the Comprehensive Development Plan for the city. 3. Additional Information The Public Works Director, City Engineer and Building Official have all reviewed the project and have expressed no objections to the proposal. Findines of Fact Staff offers the following twenty findings for consideration: General Findings: 1. The proposal is for a 1,800 square foot addition to the south side of the Ramsey County Sherriff Patrol Station. 2. The additional is to create space for a new Disaster Recovery Computer Center. 3. The recovery center would not require any additional employees on site. 4. The addition would maintain the same height and design as the existing Ramsey County Sherriff Patrol Station. 5. Public uses are a conditional use in the Civic Center District. 6. The Ramsey County Public Works Facility was approved through a CUP (PC# 03-008). 7. The Ramsey County Sherriff Patrol Station was approved through a CUP Amendment (PC# 03-026). 8. An amendment to the CUP is required because of the proposed exterior modifications to the building and site. 9. The proposal does not impact the City's landscaping or tree preservation requirements. The proposal will not impact existing external lighting on the site. 11. No new rooftop mechanical equipment would be added as part of the proposal. 12. The proposal will not affect the amount of parking on the site. 13. The proposal is not expected to have any affect on traffic to the site or on-site traffic circulation. On the Conditional Use Permit Evaluation Criteria: 14. The proposed plan would not have any expected impact on traffic or parking conditions. 15. The proposed plan will not produce any permanent noise, glare, odors, vibration, smoke, dust, air pollution, heat, liquid or solid waste, and other nuisance characteristics. 16. The proposed plan will not impact drainage because the drainage is not being altered. 17. The proposed plan will not impact population density because the proposed use is not residential. 18. The proposed plan is not expected to have a significant impact on visual and land use compatibility with uses and structures on surrounding land or adjoining land values because the use is not changing and the visual impacts of the proposed changes are an improvement to what is existing. 19. Park dedications are not applicable. 20. The proposed plan does not conflict with the general purpose and intent of the Zoning Code or the Comprehensive Plan for the City. Notice Notice was published in the Arden Hills/Shoreview Bulletin and notice was prepared by the City and mailed to residents within three -hundred fifty (350) feet of the subject property. Public Comments At this time the City has not received any comments from the public regarding this project. Staff Recommendation Staff recommends approval of Planning Case #09-010 for a Conditional Use Permit Amendment at 1411 Paul Kirkwold Drive subject to the following three conditions: 1. The project shall be completed in accordance with the plans submitted as amended by the conditions of approval. Any significant changes to these plans, as determined by the City Planner, shall require review and approval by the Planning Commission and City Council. 2. A Conditional Use Permit Amendment drafted by the City Attorney shall be signed by the applicant, and the property owner, prior to the issuance of any building permits. The City may, with the consent of the applicant, extend the review period beyond the initial 120 days. Filing & Information Reauirements The City requests that you make a pre -application meeting with the City Planner to discuss the application process, requirements, and deadlines. Unless waived by the City Planner or Planning Commission, a certified survey of the property is required for all applications. CompletefincomgIete Applications An incomplete application will delay the processing of land use requests. The application approval time commences and an application is considered officially filed when the City Planner has received and examined the application and determined that the application is complete. A decision on whether the application is complete or incomplete shall be made within fifteen (1 5) working days following the submittal of the application. Ramsey County Property Management Ramsey County Disaster Recovery Computer Center Project May 4, 2009 Project Description Ramsey County Property Management is proposing to remodel approximately 1,250 SF in the Sheriff Patrol Station for a Disaster Recovery Computer Center, and add approximately 1,800 SF i of office space at the Ramsey County Sheriff Patrol Station. This addition will replace the office space lost by the Sheriff s Volunteers In Partnership with the Sheriff (VIPS) unit, to the Disaster Recovery Computer Center. The County Board has determined the need for a computer disaster recovery site to protect the integrity of the Ramsey County computer system. The distance from the main downtown main computer center coupled with the availability of standby generator/UPS power and the security of the Sheriff site,, make this the prime location for this project. The Disaster Recovery Computer Center is referred to as a "dark site" and will have no staff assigned to the site. The computers and equipment are monitored remotely. The site only becomes "active' in the event of catastrophic failure of the primary computer site. The interior of the computer center and the YIPS addition will match the existing building interior in terms of design, colors, and materials. The exterior of the addition will match the existing brick and windows in pattern, color and materials. Landscaping surrounding the addition will also remain consistent with the existing landscaping. Background In light of the recent application to erect a cellular tower on the Bethel University Campus, Staff has had an opportunity to review the City's current regulations regarding cellular antennas and new antenna structures. In an effort to better clarify where, and under what circumstances, new antennas may be installed and antenna towers be constructed, Staff is recommending a number of changes to Section 1325.09 of the Zoning Code. One of the goals of this amendment was to require collocation of cellular antennas whenever feasible and to prioritize where in the City new antennas can be installed. In addition to location requirements, Staff is recommending several other amendments to the Code for the purpose of clarification and to update language to meet current technology practices and standards. The proposed ordinance amendment (Attachment A) is the result of this review. Discussion The current regulations on antennas, dish antennas, and towers allow these devices on any property within the City with a conditional use permit. In order to place an antenna on a property, the owner must comply with a number of conditions that provide for screening, height limitations, and placement constraints of the antenna or tower. Each property within the City is treated the same in terms of preference for tower and antenna locations, with the exception of City water tower sites, which, in addition to the normal requirements, must meet a number of additional design and placement conditions. In addition to small changes that clarify the existing regulations and update some language to better account for current technology, a number of proposed amendments have been made that would significantly impact where antennas and towers may be placed within the City. Section 1305.04 Definitions The definition for Antennas has been amended in order to remove terms not used within the ordinance and to eliminate redundancy. The definition for Tower is located elsewhere in this Section and would remain unchanged. Exemptions Small dish television antennas are currently exempted in the regulations. The language for these was updated to reflect current uses of these devices. In addition the number of exempt small dish antennas was increased from one to two on residential lots. Antennas and antenna support structures used by the City were added to this paragraph so that they too would be exempt. T.nnntin" The proposed amendment would require that all new antennas be located on City water tower sites unless this is not feasible from an engineering standpoint. It would be the responsibility of the applicant to show that these locations would not work. In the event that one of the City water tower sites would not be feasible the proposed ordinance outlines a list of preferred alternate locations in order of priority. Existing towers and structures are listed as a higher priority than locations that would require new towers to be constructed. Screening shall be provided so as to prevent direct view of a dish antenna from any street or from a public or private property within six hundred (600) feet of the dish, as follows: 1. Ground Mounted Dishes. Screening for ground mounted dishes shall consist of a fence, wall, earth berm or landscaping, or a combination of these devices. 2. Roof or Wall Mounted Dishes. Screening for roof- or wall - mounted dishes shall be in accordance with Section 1325.05 Subd 4 3. Antennas. Antennas shall be ain.ted the color of the structure to which they are attached. Subd. 8 Special Requirements for City Water Tower Sites. The placement of licensed commercial wireless telecommunication services including cellular, personal communication services (PCS), specialized mobilized radio (SMR), enhanced specialized mobilized radio (ESMR), paging and similar services on water tower sites will be allowed only when the City is fully satisfied that the following requirements are met: A. The applicant's access to the facility will not increase the risks of contamination to the City's water supply; B. There is sufficient room on the structure to accommodate the applicant's equipment and all equipment ' (antennas, exterior cables, etc) attached to the structure is painted to match the color of the structure; C. The presence of the equipment will not increase the water tower or reservoir maintenance costs to the City; D. The presence of the equipment will not be harmful to the health of workers maintaining the water tower or reservoir. E. Cin City, water towers, antennas placed on the top of the tower shall. not exceed the height of the tallest existing antenna. F. There is sufficient room on the site to accommodate all ground equipment and the following requirements for ground equipment are met: 1. The base transceiver station and all other ground equipment shall be housed in an existing on-site equipment building whenever possible. If an existing equipment building is unavailable, a new equipment building may be constructed. If the equipment is to be housed in a weather-proof cabinet -like structure in lieu of a building, it shall be mounted upon a suitable concrete pad. 2. If there is an equipment building constructed on site, it shall be subject to City rp oval. 3. To the extent possible, the equipment building or cabinet shall be located adjacent to or near existing on-site buildings. 4. The equipment building or cabinet shall be screened from view of adjacent properties by suitable vegetation, except where non -vegetative screening (e.g., a decorative wall or fencing) better reflects and complements the character of the neighborhood. The City shall require a suitable financial surety to ensure future removal of the equipment building or cabinet upon termination of the lease. 5. 6. All applicants for the City's water towers must include a sig1jed report from a State . ---- registered. engineer showin compliance with all applicable codes, standards and structural .requirements of how the additional antennas will affect the water tower structure. This ordinance requires that rental properties be registered with the City in order to legally operate. Letters will be going out to all non - homestead properties in the City within the next several weeks informing the property owners of the new regulations. June 29, 2009, City Council Meeting The City Council unanimously adopted Ordinance 09-009, an ordinance that adds Ash Trees to the list of protected shade trees. This amendment allows the City Forester to identify and require q the removal and disposal of Ash Trees infected with Emerald Ash Borer. The City Council voted (3-1) to table Planning Case 09-009 for a Conditional Use Permit Amendment at Bethel University to allow for the installation of a cellular tower and related antennas and equipment to be owned and operated by AT&T Wireless. The item was tabled for additional information relating to the location options reviewed by AT&T. It is scheduled too back g to the City Council for review at their July 13, 2009, meeting.
