Approve Planning Case 09-010 for a Conditional Use Permit Amendment at 1411 Paul Kirkwold
Drive Based on the Findings of Fact and the Submitted Plans as Amended by the Three
Conditions in the July 13, 2009, Memo to the City Council.

The applicant, Ramsey County, has requested a CUP Amendment to construct a 1,800 square
foot addition to the Ramsey County Sherriff Patrol Station. This is Building 5 of the Ramsey
County Public Works Facility (RCPWF), a 35-acre complex of five buildings also containing the
City of Arden Hills Public Works Garage. The proposed addition would create space for a new
Disaster Recovery Computer Center within the existing patrol station. This recovery center
would not require any additional staff on site; it would be a remotely monitored data storage site
utilized only in emergencies. The addition would utilize the same design and height Gust over 1 7
feet) as the existing building with dimensions of approximately 59 feet by 31 feet. It would be
located at the southern end of the patrol station, extending towards Hamline Avenue (see
Attachment C). The applicant has submitted an application, letter describing the project,
rendering, plans, and a survey (Attachment C).

Findin!!s of Fact
The Planning Commission offers the following twenty findings of fact for review:
General Findings:
1. The proposal is for a 1,800 square foot addition to the south side of the Ramsey County
Sherriff Patrol Station.
2. The additional is to create space for a new Disaster Recovery Computer Center.
3. The recovery center would not require any additional employees on site.
4. The addition would maintain the same height and design as the existing Ramsey County
Sherriff Patrol Station.
5. Public uses are a conditional use in the Civic Center District.
6. The Ramsey County Public Works Facility was approved through a CUP (PC# 03-008).
7. The Ramsey County Sherriff Patrol Station was approved through a CUP Amendment
(PC# 03-026).
8. An amendment to the CUP is required because of the proposed exterior modifications to
the building and site.
9. The proposal does not impact the City's landscaping or tree preservation requirements.
10. The proposal will not impact existing extemallighting on the site.
11. No new rooftop mechanical equipment would be added as part of the proposal.
12. The proposal will not affect the amount of parking on the site.
13. The proposal is not expected to have any affect on traffic to the site or on-site traffic
circulation.
On the Conditional Use Permit Evaluation Criteria:
14. The proposed plan would not have any expected impact on traffic or parking conditions.
15. The proposed plan will not produce any permanent noise, glare, odors, vibration, smoke,
dust, air pollution, heat, liquid or solid waste, and other nuisance characteristics.
16. The proposed plan will not impact drainage because the drainage is not being altered.
17. The proposed plan will not impact population density because the proposed use is not
residential.
18. The proposed plan is not expected to have a significant impact on visual and land use
compatibility with uses and structures on surrounding land or adjoining land values
because the use is not changing and the visual impacts of the proposed changes are an
improvement to what is existing.
19. Park dedications are not applicable.
20. The proposed plan does not conflict with the general purpose and intent of the Zoning
Code or the Comprehensive Plan for the City.

Recommendation
The Planning Commission reviewed Planning Case 09-010 and unanimously recommends
approval (7-0) of the Conditional Use Permit Amendment based on the findings of fact and the
submitted plans as amended by the following three conditions:
1. The project shall be completed in accordance with the plans submitted as amended by
the conditions of approval. Any significant changes to these plans, as determined by
the City Planner, shall require review and approval by the Planning Commission and
City Council.
2. A Conditional Use Permit Amendment drafted by the City Attorney shall be signed
by the applicant, and the property owner, prior to the issuance of any building
permits.
3. A building permit shall be obtained for all proposed building and site alterations.
Options
1. Approve the proposal as submitted.
2. Approve the proposal with conditions.
3. Deny the application with reasons for denial. If the City denies the petitioners request, "... it
must state in writing the reasons for the denial at the time it denies the request."

Deadline for Al!encv Actions
The City of Arden Hills received the completed application for this request on May 22, 2009.
Pursuant to Minnesota State Statue, the City must act on this request by July 21, 2009 (60 days),
unless the City provides the petitioner with written reasons for an additional 60 day review
period. The City may, with the consent of the applicant, extend the review period beyond the
initial 120 days.

Ms. Beekman reported that the applicant requested a Conditional Use Permit

Ms. Beekman provided background, described the project, and stated that, based
on the findings, the Staff recommends approval of Planning Case #09-010 for a
Conditional Use Permit at 1411 Paul Kirkwold Drive, subject to the following
three conditions:
1. The project shall be completed in accordance with the plans submitted as
amended by the conditions of approval. Any significant changes to these
plans, as determined by the City Planner, shall require review and approval by
the Planning Commission and City Council.
2. A Conditional Use Permit Amendment drafted by the City Attorney shall be
signed by the applicant, and the property owner, prior to the issuance of any
building permits.
3. A building permit shall be obtained for all proposed building and site
alterations.
Ms. Beekman stated that, if approved by the Planning Commission, this would go
before the City Council at their meeting on July 13, 2009.
Chair Larson inquired whether the Planning Commission had any questions of
staff. None did.
Chair Larson opened the Public Hearing at 6:42 p.m.
There being no public input, Chair Larson closed the Public Hearing at 6:43 p.m.
Chair Larson invited Mr. Thompson, Assistant Director for Ramsey County
Property Management, to approach the podium to answer any questions raised by
the Planning Commission.
Commissioner Zimmerman inquired whether the emergency data center, which
would normally not be occupied unless there was an emergency, act as the
County's command center in the event of an emergency?
Mr. Thompson replied that it would not. He stated that in the event of a wide
spread emergency other parts of the Public Works Facility building have been
designed to be the command center.
Commissioner Holewa inquired as to the adequacy of parking on site in the event
of a wide spread emergency.
Mr. Thompson replied that in that event, other Public Works activities would be
suspended and therefore would vacate much of the required parking areas.
Commissioner Thompson inquired whether the vacated portion of the building
that would be relocated to the new addition would open up space for additional
office.
Mr. Thompson stated that some office space will actually be moved into the
addition and the vacated portion of the building would be used to house the
emergency data recovery center. He noted that the proximity to the Sherriff
Station and its location internal to the building made it an ideal place because of
security concerns. He stated that no additional office space would be created due
to the addition.
Motion by Commissioner Holewa, seconded by Commissioner Modesette, to
approve Planning Case 09-010 for a Conditional Use Permit Amendment to
construct a 1,800 square foot addition at 1411 Paul Kirkwold Drive, based on the
findings of fact, submitted plans and the three conditions in the July 8, 2009,
Planning Report.
The motion carried unanimously (7-0).

CONDITIONAL USE PERMIT AMENDMENT
PC# CASE NO. 09-010
1.0 Recitals.
A. The County of Ramsey, a political subdivision of the State of Minnesota
("Ramsey County") is the record fee owner of the following described
property situated in Ramsey County Minnesota:
The south 1425 feet of the east 1572.47 feet of the southwest
quarter of Section 15,Township 30 north, Range 23 west, Ramsey
County, Minnesota, Escept the north 810 feet of the east 626 feet
thereof. Subject to County State Aid Highway (C.S.A.H.) 96 right of
way.
B. On the 22nd Day of May, 2009, Ramsey County submitted a completed
Land Use application for a CUP Amendment ("Application").
F. At a public hearing on July 8, 2009, the Arden Hills Planning Commission
reviewed the Application; the report and comments of the Arden Hills staff;
the reports and comments submitted by Ramsey County and its
representatives; the comments of members of the public; and
recommended approval of a CUP Amendment for Planning Case 09-010
subject to certain conditions.
2.0 Approval of Conditional Use Permit Amendment. On the 13th Day of July,
2009, the Arden Hills City Council;
A. Reviewed the Application, the recommendations of the Arden Hills
Planning Commission, the reports and comments of the Arden Hills staff,
the comments Ramsey County, and the comments of members of the
public who chose to speak.
B. Considered the effects of the proposed use of the Property upon the
health, safety, convenience and general welfare of the owners and
occupants of the surrounding land, in particular, and of the community as
a whole, in general, including but not limited to the following factors:
existing and anticipated traffic and parking conditions; noise, glare, odors,
vibrations, smoke, dust, air pollution, heat, liquid or solid waste, and other
nuisance characteristics; drainage; population density; visual and land use
compatibility with uses and structures on surrounding land; park
dedications where applicable, and the orderly development of the
neighborhood and the City within the general purpose and intend of its
Zoning Code and Comprehensive Plan.
C. Made the following findings:

shall be signed by the applicant, and the property owner, prior to
the issuance of any building permits.
3. A building permit shall be obtained for all proposed building and site
alterations.
3.0 Priority. Where the terms of the Conditional Use Permit Amendment are
inconsistent with the terms of the Original SUP, the terms of this CUP
Amendment shall apply.
4.0 Compliance. Ramsey County, for its self and its successors and assigns,
hereby agrees to comply with all of the conditions of approval.
