Planning Cases are available online at: http://www.ci.arden-hills.mn.us/planningcases ltw-- ,,,--ARQEN HILLS MEMORANDUM DATE: August 5, 2009 TO: Planning Commission FROM: Meagan Beekman, City Planner SUBJECT: Report from the City Council July 13, 2009, City Council Meeting The City Council unanimously adopted Planning Case 09-010 for a CUP Amendment to the Ramsey County Public Works Facility to allow a 1,800 square foot addition on the south side of the Sheriff s Station. The Planning Commission unanimously recommended approval of this item at their July 8, 2009, meeting. The City Council voted (4-1) to approve the Master PUD, Final PUD for Phase I, and Preliminary and Final Plat for the redevelopment of Arden Plaza and the construction of a Walgreen's Pharmacy. The City Council added a few conditions, including reducing the Planning Commission's recommended amount of wall signage on Building #1 down to 99 square feet, requiring the signage on Building #5 to be cleaned up prior to the issuance of any building permits, and limiting the hours in which the "bell tower" may be lit. The Planning Commission unanimously voted to recommend approval of this item at their June 3, 2009, meeting. The City Council voted (3-2) to deny AT&T's application to construct a cellular tower and related equipment on Bethel University's Campus. The Planning Commission unanimously voted to approve this application at their June 3, 2009, meeting. July 27, 2009, City Council Meeting The City Council unanimously approved a request from CMK Arden Holdings to extend the deadline for application of building permits for Phase I of the Traverse Business Center until July 30, 2011. The Planning Commission and City Council first approved this project in 2006. The City Council unanimously approved amendments to Section 1305.04 and Section 1325.09 of the City's Zoning Code regarding antennas and towers. Staff did make a few changes to the proposed amendment after the Planning Commission review and public hearing in order to bring the regulations into conformance with the FCC regulations. The City Council unanimously voted to approve Planning Case 09-012 for a variance request at 1126 Benton Way to construct a 585 square foot addition to the south side of the existing home. The Planning Commission unanimously recommended approval of this item at their July 8, 2009, meeting. TCAAP Update The City Council has held a number of work sessions regarding TCAAP and also met with the GSA and Army on July 15 to discuss the future of the property. The GSA continues to move forward with the public auction process and intends to hold a bidder's conference in the fall of this year. The bidder's conference is an opportunity for interested parties to gather information on the property and access it in order to do testing and take soil samples. The GSA has indicated that their intention is to move forward with auctioning the property in the late spring or early summer of next year. The City Council and Staff are moving forward with a number of projects to get the Comprehensive Plan and Zoning in line with the City's vision for the property in time with the GSA's schedule. No formal action will be taken. The proposed amendments would impact three sections of the Zoning Code: • Section 1305.04, Definitions • Section 1330, Shoreland Regulations • Section 1325.07, Performance Standards In addition to the ordinance as a whole, Staff is requesting thoughts, feedback, and direction on the specific items that are highlighted in the draft ordinance in Attachment B. These items are as follows: 1. Permitting one accessory storage shed within the rear yard of lake shore lots under certain conditions. 2. The treatment of setbacks on undeveloped lots when both adjacent lots have existing structures. 3. Prohibiting items that are in a state of disrepair, inoperable, or otherwise unusable from being stored outdoors on lake shore lots. 4. Limiting the amount of vegetative clearing and grading within the shore impact zone. 5. Allowing a credit on impervious coverage when pervious pavers and other such materials are used. 6. Allowing a detached garage on the street side front yard of lake shore lots under certain conditions. City of Arden Hills Planning Commission Work Session for August 5, 2009 C: IDOCUME—IIMEAGAN—I.BEEILOCALS—II TempIELF7E1080509 -PC Work Session - Shoreland Regulations.doc Page 1 of 5 Shoreland Ordinance Update Process This item first came before the Planning Commission at their work session in February 2009. At that meeting the Planning Commission discussed the desired goals and objectives for the Shoreland Regulations amendment. The goals that were identified at that meeting were as follows: • Utilizing appropriate use management • Managing potential impediments to shorelands (i.e. geese) • Minimizing runoff from parking lots • Addressing neglected yards in shoreland lots • Clarifying regulations for residential vs. non-profit institution shoreland properties • Ensuring participation of institutions on shoreland properties (i.e. Bethel and Northwestern Colleges) • Continuing to discourage water orientated accessory structures A Community meeting was held on May 21, 2009, to discuss the shoreland regulations and to invite a greater voice from the community. Direct comments taken from residents at that meeting are included in Attachment D. A number of residents at the shoreland meeting questioned the need for changes and if additional regulation is necessary, though staff acknowledges that other residents in the past have expressed concern over the aesthetics and maintenance of the shoreland. Background The current set of shoreland regulations was updated in early 2002 as part of the re -codification of the overall City Code and to address certain requirements in the Minnesota Department of Natural Resources (DNR) shoreland regulations. While that ordinance update did address some of the technical requirements set by the DNR, there were a number of holes and unaddressed issues remaining after that update. Concurrently, Staff has been faced with a number of questions and concerns expressed by local property owners that are not explicitly addressed in the existing ordinance. These scenarios have introduced the need for greater clarification to the City's shoreland ordinance so that it may be able to promptly address common issues and concerns as they pertain to public waters and wetlands. The DNR has started an update process to the statewide shoreland regulations, which is the foundation for shoreland regulations in virtually all cities. Based on conversations with the DNR, final updates could still be a number of years away pending state approval; however, Staff does have a draft of the new shoreland regulations and has incorporated that into our research. While future changes to the statewide regulations may impact the City's ordinance, Staff recommends moving forward with our update process so that local needs can be addressed. City of Arden Hills Planning Commission Work Session for August 5, 2009 C: IDOCUME—IIMEAGAN—I.BEEILOCALS—IITempIELF7E1080509 -PC Work Session - Shoreland Regulations.doc Page 2 of 5 Identified Issues As part of this update project, Staff, in combination with the Planning Commission, City Council, and the public, has identified a number of open issues and concerns. While some of these concerns can be addressed with existing DNR regulations and guidelines, others do not have official guidance from the DNR or are not adequately addressed by the DNR. Staff has gathered a considerable amount of research. In addition to consulting with neighboring communities as well as the Cities of Minnetonka and Eden Prairie, Staff worked with the DNR, the City Attorney, and residents to shape the attached draft of the ordinance. NOTE: The attached draft is in black -lined form and Staff has highlighted areas that specifically require additional discussion; however the entire document is open for change, feedback, and discussion as well. Definitions (Attachment jJ Amended pages from Section 1305 have been included in this packet. These are the definitions that are proposed to be added or amended with the adoption of the Shoreland Management Ordinance. Most of the changes come directly from the DNR regulations and are required to be changed to bring the City regulations into compliance with the DNR. A number of definitions have been deleted that are not reference in the City's ordinance as well. Shoreland Reulations (Attachment B) Section 1330 has been included in its entirety. This section of the City Code is the most significantly altered by this proposed amendment. Parts of this section have been updated to reflect current DNR regulations, other parts have been amended to better clarify current enforcement practice in the shoreland area, and still other areas have been added to reflect growing concern amongst City Council and other residents about issue facing the shoreland. Below is a list of significant changes to the regulations. This list is by no means all inclusive of the amendments proposed at this time. • Little Johanna was reclassified from a General Development Lake to a Recreational Development Lake due to reclassification by the DNR. The regulation pertaining to nonconforming lots were amended to conform to changes in State Statute. Subd. 5, Exceptions to Structure Setback Requirements, was amended to expressly include language pertaining to docks, fences, accessory structures, stairways, lifts, and landings. More specifically, the draft includes language that would now permit up to one accessory storage shed within the typical structure setbacks from the lake under certain circumstances. Staff requests feedback on which of the two is most appropriate. Subd. 6, Maintenance of the Shoreland, was also added and regulates the storage of items on the lakeshore. The use of docks has been clarified, though not significantly changed. The biggest change is an added regulation that would require items that are in a state of disrepair or inoperable to be prohibited from being stored outdoors. Staff request additional discussion and feedback on this item. Shoreland alterations have been clarified and consolidated into one area of the ordinance; however, no significant changes have been made. Language used from the DNR model ordinance was incorporated into this section. A regulation was added that would allow permeable surfaces that are not used as driving surfaces, to reduce the amount of landscaped area required in direct proportion to the permeability of the surface. This is a change to existing regulations and Staff requests additional comment on the opinion of the Council on such a change. Detached Accessory Garages would now be permitted in the front yard of lakeshore lots under certain circumstances and with Staff approval. This change relates to a current concern of Staff s regarding what is appropriately the "front" versus "back" yard of a lake lot. This change provides some flexibility to construct accessory garages on lake lots, which are currently limited to side yards and rear yards outside of the structure setback from the lake. This is also a significant change to the existing regulations and Staff requests additional discussion and feedback on this item. A section on wetland setbacks is not yet complete and needs additional research. Staff is proposing that a wetland buffer and subsequent building setbacks be created within the Code. This item will require additional review and discussion at a later date. Performance Standards (Attachment Q Section 1325.07 includes regulations on lakefront lots that have been removed from Section 1325 and reincorporated into Section 1330. This is only for the purpose of clarity as the regulations have not altered. As we draft new or revised existing ordinances, it is critical that we focus on clarity and enforceability. While it is virtually impossible to gain 100 percent conformance with the regulations, it is important to adopt regulations that have a reasonable ability to be enforced. In the process of reviewing these regulations, it is likely that new issues will be added while others may not need to be regulated. In instances where there are not guidelines from the DNR and no trends amongst other cities, we should evaluate if new or additional regulations are actually needed. Dish Antenna: A parabolic -shaped antenna (including all supporting apparatus) which is used for transmitting or receiving telecommunication, television or radio signals, which is located on the exterior, or outside, of any building or structure. 1. Class I: Dish Antenna under thirty (30) inches or more in diameter; six (6) feet in surface area; or six (6) feet in height. 2. Class II: Dish Antenna thirty (30) inches or more in diameter; six (6) square feet or more in surface area; or six (6) feet or more in height. B. (Lot area, net buildable, is more limiting as other deductions are included). Subd. 97 Lot, corner. A lot situated at and abutting on the intersection of two (2) or more streets having an angle of intersection of not more than one hundred thirty-five (135) degrees. A lot abutting upon a curve street shall be deemed a corner lot if the tangents to the curve at its point of beginning within the lot or at the points of intersection of the side lot lines with the street line intersect at the interior angle of less than one hundred thirty-five (135) degrees. A corner lot shall maintain front yard requirements for each street frontage. Subd. 98 Lot coverage. The total allowable amount of lot area, expressed as a percentage, which may be covered by a principal use and its accessory structures. Subd. 99 Lot depth. The mean horizontal distance between the mean front road and the mean rear lot line. The greater frontage of a corner lot is its depth, and its lesser frontage is its width. Subd. 100 Lot line. A property boundary line of any lot held in single or separate ownership or separately described; except that where any portion of the lot extends into the abutting street or alley, the lot line shall be deemed to be the street or alley line. Subd. 101 Lot line, front. The boundary of a lot abutting a street. On a corner lot, the shortest street lot line shall be the front lot line. Subd. 102 Lot line, rear. The lot line most nearly parallel to and most remote from the front lot line. Subd. 103 Lot line, side. Lot lines other than front or rear lot lines. On a corner lot, the longest street lot line shall be a side lot line. Subd. 104 Lot, interior. A lot other than a corner or reversed corner lot. Subd. 105 Lot, reversed corner. A corner lot, the rear of which abuts upon the side of another lot whether across an alley or not. Subd. 106 Lot of record. A lot existing as of April 10th, 1993, date of this Code or approved by the city as a lot subsequent to such date, and includes non -conforming lots. Subd. 107 Lot, shoreline. A lot having one (1) or more lot lines fronting on public waters. Subd. 108 Lot, through. A lot that has a pair of opposite lot lines abutting two (2) substantially parallel streets, and which is not a corner lot. Subd. 124 Off-street parking areas. Structures or areas of ground used for the storage or parking of motor vehicles. Subd. 125 Open sales lot. Any land used or occupied for the purpose of buying and selling any goods, materials, or merchandise, and for the storing of same under the open sky prior to sale. Subd. 126 Open space. (See landscape lot area.) Subd. 127 Ordinary High Water Level. The boundary of public waters and wetlands, and shall be an elevation A mdelineating the highest water level which has been maintained for a sufficient period of time to leave evidence upon the landscape and as determined by the Minnesota Department of Natural Resources. The ordinary high water level is commonly that point where the natural vegetation changes from predominantly aquatic to predominantly terrestrial. Subd. 128 Parking space. A land area of such shape and dimensions and so prepared as to be usable for the parking of a motor vehicle, and so located as to be readily accessible to a public street or alley. Truck loading and unloading space shall not be included in such area. Subd. 129 Pathway, pedestrian way. A public or private way, running across or located within a platted lot or block or an unplatted parcel of land, used primarily for pedestrian traffic. Subd. 130 Pawnbroker. (a) Except as provided in paragraph (b), "pawnbroker" means a person engaged in whole or in part in the business of lending money on the condition that it may be redeemed or repurchased by the seller for a fixed price within a fixed period of time. (b) The following are exempt from the definition of "pawnbroker." Any bank regulated by the State of Minnesota, the comptroller of the currency of the United States, the Federal Deposit Insurance Corporation, the board of governors of the Federal Reserve System, or any other federal or state authority and their affiliates; any bank or savings associations; whose Deposit Insurance Corporation of any successor to it and all affiliates or those banks and savings associations, any state or federally chartered credit union; and any industrial loan and thrift company or regulated lender subject to licensing and regulation by the Department of Commerce. Subd. 131 Person. Any individuals, firm, partnership, corporation, company, association, joint stock association or body politic; includes any trustee, receiver, assignee or other similar representative thereof. Services customarily rendered for compensation. Such services shall only involve minor storage and related sales of products and supplies related to the service offered and for customers ordinarily utilizing the service offered. Typical personal services include but are not limited to: apparel tailoring and cleaning; hair styling, trimming and cutting; beauty services; photographic services; and other services of a similar nature. Subd. 133 Planned Unit Development (P.U.D.). The development of a tract of land in a unified manner, pursuant to a development plan specifically approved by the city. Subd. 134 Planning Commission. The planning agency of Arden Hills as prescribed in Minnesota Statutes Chapter 462.3 54. It is advisory to the City Council on all matters related to the Comprehensive Plan and all official controls that implement the Comprehensive Plan, and all other matters referred to it by the City Council. Subd. 135 Protected Waters. Any waters of the State as defined by State law. However, no lake, pond or flowage of less than ten (10) acres in size and no river or stream having a total drainage area less than two (2) square miles shall be regulated for the purposes of these regulations. Subd. 136 Public use. The use of any lot, parcel of land and any structure or building thereon exclusively for public purposes by any department or branch of government, federal, state, county or city, excluding independent school districts, without reference to the ownership of said lot, parcel of land, building or structure. Subd. 137 Public waters. Means a body of water capable of substantial beneficial public use. This shall be construed to mean, for the purposes of these regulations, any body of water, which has the potential to support any type of recreational pursuit or water supply purpose. A body of water created by a private user where there was no previous shoreland, as defined herein, for a designated private use authorized by the commissioner of natural resources, shall be exempt. Subd. 138 Railroad right-of-way. A strip of land with tracks and auxiliary facilities for track operation, but not including depots, loading platforms, station, train sheds, warehouses, car shops, car yards, locomotive shops or water towers. Subd. 139 Reach. A hydraulic engineering term to describe a longitudinal segment of a stream or river influenced by a natural or man-made obstruction. In an urban area, the segment of a stream or river between two consecutive bridge crossings would most typically constitute a reach. Subd. 140 Recreation, commercial. Recreational facilities which are operated for profit or render a service which is customarily considered as a business. Subd. 141 Recreation, residential. Motor vehicle sales, motor vehicle leasing and rentals, exterior equipment rental and sales lots, repair garages, and open sales lots are not included in this definition of retail sales. Subd. 153 Roadway. The entirety of a private street and that portion of a public street extending from the back of the curb (i.e., the curbline) on one side to the back of the curb (i.e., the curbline) on the other side, used primarily for vehicular traffic. Subd. 154 Schools, bus terminal. School bus terminal shall be a building or space engaged primarily in the transportation and activities associated with the transportation of students. Subd. 155 Schools, general education. Nursery, primary, elementary and secondary schools. Subd. 156 Schools, higher education. Junior colleges, colleges and universities approved by the Minnesota Higher Education Coordinating Board for the Minnesota Department of Education. Subd. 157 Schools, special education. Trade, vocational, business, barber, beauty, art, music, dancing, driving and other professional schools, with or without on-site housing. Subd. 158 Service station. A place where gasoline, kerosene, diesel or other motor fuel or lubricating oil or grease for operating motor vehicles are offered for sale to the public and deliveries are made directly into motor vehicles. Includes greasing and oiling, one -bay motor vehicle wash and the sale of automobile accessories on the premises. No land shall be subdivided which shall be held unsuitable by the City for the proposed use because of flooding, inadequate drainage, soil and rock formations with severe limitations for development, severe erosion potential, unfavorable topography, inadequate water supply or sewer access, or any other feature likely to be harmful to the health, safety, or welfare of future residents of the proposed subdivision or of the community. Subd. 9 Planned Unit Developments. Planned unit developments may be permitted in accordance with this Code and the City of Arden Hills Zoning Code, provided that preliminary plans are approved by the Commissioner of Natural Resources prior to their approval by the City, and further provided that: A. Open ' space is preserved through the use of restrictive deed covenants, public dedications, or other methods. B. The following factors shall be carefully evaluated to ensure the increased density of development shall be consistent with the resource limitations of the protected water: 1. Suitability of the site for the proposed use; 2. Physical and aesthetic impact of increased density; 3. Level of current development; 4. Amount and ownership of undeveloped shoreland; 5. All materials and equipment shall be stored within a building or be fully screened so as not to be visible from adjoining lots, except for the following: Laundry drying and recreational equipment, construction and landscaping materials currently (within a period of twelve (12) months) being used on the premises; agricultural materials and equipment if these are used or intended for use on the premises; off-street parking of passenger cars and pickup trucks. A. Location for Buildings Housing Farm Animals. Any building in which farm animals are kept shall be located a distance of two hundred (200) feet or more from any lot line. Any open structure in which farm animals are kept shall be a distance of four hundred (400) feet or more from any lot line. B. Number of Animals Allowed. Up to four (4) domestic animals, excluding birds and fish, are permitted in any dwelling unit, but without a residential dog kennel license not more than two (2) may be dogs. EN HILLS City of Arden Hills .Planning Commission Work Session for August 5, 2009 Comment Cards General • Ordinance is satisfactory as written except for enforcement • Biggest concern — is water quality of the lake — each year it is so bad that for weeks are available to swim • Good information — but would have been helpful to let people voice their concerns + hear what others have to say • Issues stated on Arden Hills newsletter were not addressed — except in passing • Appeared to be a hidden agenda + doubt there was one but meeting seemed to avoid what it was stated it would address • Docks + boat structure issues about removal is ridiculous • It is hard to evaluate changes without information on what want to change. • Looks like "community input" but this meeting felt unproductive to me. You will do what you want regardless of "community events." • Thank you! • We don't necessarily need new laws & regulations. Whatever is added/deleted from existing should be fairly reviewed by the concerned public as well • Enforcement — we lack that now — not a "police force" but adherence to reg. • My concern is the run off going directly into the lake — west side — NW College — what happened when they applied for their new roads + bldgs? • Last year the City Council agonized over + withdrew their token goose -round up contribution of $300.00. I was present at the work session. This program needs to continue + both the city and the county should be helping out. I can remember how bad + messy it was in years past, before the roundups. It was a very serious water quality + health issue. Only you can prevent goose slime!
