SUBJECT:
Emergency Vehicle Pre-emption (EVP) Project
BACKGROUNDIDISCUSSION
At the March 9, 2009, meeting, the City Council approved the City of Arden Hills' participation in
Ramsey County's Emergency Vehicle Pre-emption (EVP) Project for the following intersections:
· Lexington Avenue and 1694 South ramp
· Lexington Avenue and 1694 North ramp
· Lexington Avenue and Grey Fox Road
· Lexington Avenue and Red Fox Road
· County Road E and TH 51 West ramp
· County Road E and TH 51 East ramp
· County Road E and Pine Tree Drive
The intersection of West Round Lake Road and CSAH 96 was removed from the project by the City
Council at the March 9 meeting; Ramsey County's construction plans reflect this change.
Attached is a copy of the Cooperative Agreement that Ramsey County has prepared for this project.
The agreement identifies the scope of the project, as well as the costs to be paid by the City. The
City Attorney has reviewed the agreement and has no objections.
FINANCIAL IMPLICATIONS
The estimated construction costs for the above-listed intersections are $23,500. The agreement also
states that the City is responsible for construction engineering fees in the amount of eight percent
(8%) of the construction costs, which is $1,880. This project will be funded using the City's State
Aid Funds.

THIS AGREEMENT, ("Agreement") is hereby entered into by and between the City of
Arden Hills, a municipal corporation, hereinafter referred to as the "City," and Ramsey County, a
political subdivision of the State of Minnesota, hereinafter referred to as the "County.";
WITNESSETH:
WHEREAS, the City and the County desire to install Emergency Vehicle Preemption
(EVP) at the signalized intersections of County Road E & TH 51 East and West Ramps, County
Road E & Pine Tree Drive, Lexington Avenue & Grey Fox Road, Lexington & Red Fox Road,
Lexington Avenue & 1-694 South and North Ramps; and
WHEREAS, County Road E is designated County State Aid Highway 15 and Lexington
Avenue is designated County State Aid Highway 51 and are in the City; and
WHEREAS, the County has determined that it is feasible, practical, and technically proper
to provide for the EVP installation at the above mentioned intersections; and
WHEREAS, the County has prepared or will prepare the necessary designs, plans,
specifications, estimates, proposals and approvals in accordance with funding requirements to
install the EVP systems; and
WHEREAS, this project has been designated as eligible for MSAH funds, reimbursement
as S.A.P. 187-030-001; and
WHEREAS, the City construction cost participation for the EVPs is included in this Agreement
and the ownership, maintenance and operation of the signals is covered in existing agreements
89025-County Road E & TH 51 West Ramp, 89026-County Road E & TH 51 East Ramp, 89027 -
County Road E & Pine Tree Drive, 89029-Lexington Avenue & Grey Fox Road, 89030-Lexington

& Red Fox Road, 89031-Lexington Avenue & 1-694 SIN Ramps between the City and County and
Shoreview; and
WHEREAS, the project includes, in addition to other things, EVP installation;
NOW, THEREFORE, IT IS HEREBY MUTUALLY AGREED AS FOLLOWS:
1. Prior to construction, the County shall first receive concurrence from the City for the City's
participation in the cost of construction.
2. The County shall perform or contract the performance of the construction inspection.
3. All City owned rights of way and easements within the limits of the project are hereby
granted to the County for project use during construction.

5. The County and City shall participate in the costs of construction in accordance with the
adopted Ramsey County Public Works cost participation policy.
6. The City shall reimburse the County 50% of the cost of the EVP installation at Lexington
Avenue & 1-694 South and North Ramps, Lexington Avenue & Grey Fox Road and Lexington &
Red Fox Road.
7. The City shall reimburse the County 100% of the cost of the EVP installation at County
Road E & TH 51 East and West Ramps and County Road E & Pine Tree Drive.
8. The estimated construction cost of the project for Arden Hills is $23,500.00. The costs will
be paid by Municipal State Aid Highway funds.
9. Upon substantial completion of the work, the County shall prepare a revised estimate of
cost participation breakdown based upon the contract unit prices and the actual units of work
estimated to have been performed and submit a copy to the City.
10. The City shall reimburse the County eight percent (8%) of its share of the construction cost
as determined by the final amount due the contractor as a construction engineering fee.
11. The City and County shall indemnify, defend and hold each other harmless against any and
all liability, losses, costs, damages, expenses, claims, or actions, including attorney's fees, which
the indemnified party, its officials, agents, or employees may hereafter sustain, incur, or be
required to pay, arising out of or by reason of any act or omission of the indemnifying party, its
officials, agents or employees, in the execution, performance, or failure to adequately perform the
indemnifying party's obligation pursuant to this Agreement. Nothing in this Agreement shall
constitute a waiver by the County or the City of any statutory or common law immunities, limits, or
exceptions on liability.

This Agreement shall remain in full force and effect until terminated by mutual agreement of the
City and the County, or until completion of the project, whichever occurs first.
WHEREFORE, this Agreement is duly executed on the last date written below.
