Background 1. Overview of Request: First Student operates under an existing Conditional Use Permit (CUP) that was granted in 1994, in Planning Case 93-015, to Reco, Inc, the previous property owner. The CUP allows the property to be used as a school bus terminal under certain conditions. The bus terminal has been in existence in this location for several decades. The CUP approved as part of Planning Case 93-015 was an attempt to minimize the impacts of the business on surrounding residential properties. Staff is currently working with the property owner to bring the property into compliance with the original CUP on a number of areas, including resurfacing and demarcating the parking lot and installing additional landscaping. Additionally, an onsite inspection found that the numbers and types of vehicles permitted by the CUP are not being met by existing conditions at the property. In response to this realization, First Student is requesting a CUP amendment that would more accurately reflect the existing needs of the facility. First Student is requesting to amend their CUP to state that the number of buses allowed to operate and park at this location is limited to 150 large buses and a maximum of 175 buses from September 1 through June 15, and a maximum of 150 buses during the remainder of the year. The existing CUP states that the number of buses allowed to operate and park at this location is limited to 150 buses and 20 vans from September 1 through June 15 and 125 buses and 20 vans during the remainder of the year. According to First Student, school districts no longer have a need for vans and their business has moved towards a greater demand for smaller buses instead. According to First Student there are currently 37 small buses and 133 large buses that are stored on site. First Student is not proposing to increase the number of vehicles that operate out of this facility at this time. The applicant has submitted a letter addressing the reason for the request (Attachment A). Also attached is an aerial photo and photographs of the site (Attachment B) and the original CUP (Attachment Q. 2. Conditional Use Permit Amendment Criteria — Section 1355.04 Subd 3 Section 1355.04 Subd 3 of the Arden Hills Zoning Code lists the criteria for evaluating a Conditional Use Permit. When evaluating Conditional Use Permits, the Planning Commission and City Council should consider the effect of the proposed use upon the health, safety, convenience and general welfare of the owners and occupants of the surrounding land, in particular, and the community as a whole, in general, including but not limited to the following factors: 1. Existing and anticipated traffic and parking conditions; 2. Noise, glare, odors, vibration, smoke, dust, air pollution, heat, liquid or solid waste, and other nuisance characteristics; 3. Drainage; 4. Population density; 5. Visual and land use compatibility with uses and structures on surrounding land; adjoining land values; 6. Park dedications where applicable; and the 7. Orderly development of the neighborhood and the City within the general purpose and intent of this ordinance and the Comprehensive Development Plan for the City. 2. Additional Review The Code Enforcement Officer has been working with First Student and the property owner as well to bring the property into conformance with the existing CUP. He has reviewed. this request to amend the CUP and has no objections to the request. FindinLys of Fact Staff offers the following fourteen findings of fact for the University Commons for the Planning Commission's consideration: General Findings: 1. The applicant is proposing to amend their CUP to state that the number of buses allowed to operate and park at this location is limited to 150 large buses and a maximum of 175 buses from September 1 through June 15 and a maximum of 150 buses during the remainder of the year. 2. The existing CUP states that the number of buses allowed to operate and park at this location is limited to 150 buses and 20 vans from September 1 through June 15 and 125 buses and 20 vans during the remainder of the year. 3. There are currently 37 small buses and 133 large buses parked at the bus terminal facility. 4. The bus terminal is a conditional use in the R-1 Zoning District 5. The bus terminal was originally approved through a CUP in Planning Case #93-015. The property owner is working with Staff to bring the parking lot and landscaping into compliance with the original CUP. 7. The terms of the original CUP would continue to apply with the exception of Condition 4.7, which will be amended with approval of this planning case. On the Conditional Use Permit Amendment/Site Plan Review: 8. The requested amendment would not increase the number of vehicles operating out of this facility, therefore it is not anticipated that the amendment would have any impact on existing traffic and parking conditions; however, traffic and parking were concerns raised by residents in regards to this application. 9. Noise, air pollution, and odors have been concerns raised by residents in regards to this application. First Student is not requesting an increase in the total number of vehicles currently located on site; however diesel powered buses would produce more noise and odors than gas powered vans. 10. It is not anticipated that the proposed amendment would have any impact on any additional levels of permanent glare, vibration, smoke, dust, air pollution, heat, liquid, or solid waste. 11. The requested amendment will not alter drainage patterns. 12. The requested amendment is not expected to have any impacts on population density. 13. The park dedication fee is not applicable to this application. 14. Approving this amendment does not conflict with the City's Comprehensive Plan or the intent of the Zoning Code Notice Notice was published in the Arden Hills/Shoreview Bulletin and notice was prepared by the City and mailed to residents within three -hundred fifty (350) feet of the subject property. Resident Comments Staff has received two calls from residents in regards to this planning case. Concerns raised were increased noise, air pollution, and fumes from the diesel buses; increased traffic along Lake Valentine Road; and a concern about potential future expansion of the bus terminal to the east. Staff Recommendation The findings of fact in this planning case do not clearly support a recommendation to approve or deny. While the actual number of buses operating out of the facility is not proposed to increase as a result of this request, and therefore would not increase the existing impacts of the use, the function of allowing additional buses in lieu of vans does have an impact on noise and fumes. If the Planning Commission chooses to make a recommendation for approval Staff recommends the following five conditions: 1. The applicant shall continue to abide by the conditions of all previous permits and reviews. 2. The applicant will implement a pavement improvement plan, subject to the approval of the City Planner, within six months of the approval of the CUP Amendment. 3. The applicant shall implement a landscaping plan substantially similar to the originally approved landscaping plan, subject to the approval of the City Planner, within six months of the approval of the CUP Amendment. 4. Buses shall not be permitted to be parked on any surface other than the hard surface of the designated parking area. 5. The designated parking area of the facility shall not be expanded in any way. Recommend Approval as Submitted: Motion to recommend approval of Planning Case #09- 018 for a Conditional Use Permit Amendment at 1901 Lake Valentine Road based on the findings of fact as presented in the October 7, 2009, planning case report. 2. Recommend Approval with Conditions: Motion to recommend approval of Planning Case #09-018 for a Conditional Use Permit Amendment at 1901 Lake Valentine Road based on the findings of fact, as amended by the five conditions, which effectively mitigate any significant impacts of the facility, as presented in the October 7, 2009, planning case report. 3. Recommend Denial: Motion to recommend denial of Planning Case #09-018 for a Conditional Use Permit Amendment at 1901 Lake Valentine Road based on the following findings: findings to deny should specifically reference the reasons for denial and why those reasons cannot be mitigated. 4. Unless waived by the City Planner or Planning Commission, a certified survey of the property is required for all applications. The Planning Commission and/or City Council may still require a certified survey. A checklist for other required information is also available. Complete/Incomplete Applications An incomplete application will delay the processing of land use requests. The application approval time commences and an application is considered officially filed when the City Planner has received and examined the application and determined that the application is complete. A decision on whether the application is complete or incomplete shall be made within fifteen (15) working days following the submittal of the application. When the application is deemed to be "complete" it shall be placed on the agenda of the first possible Planning Commission meeting provided that all required public notices have been sent and published. Pavment of Fees The undersigned acknowledges that she/he understands that before a land use application can be deemed complete, all required information and fees (including all deposits) must be paid to the City. If additional fees are required to cover costs incurred by the City, the City Planner has the right to require additional payment from one or more of the undersigned, who shall be jointly liable for such fees. Such expenses may include (but are not limited to) direct city payroll and overhead costs, fees paid to consultants and other professionals, and the cost of printing, mailing, and supplies. The City may withhold final action on a land use application, withhold building permits, and/or rescind prior action until all miscellaneous fees have been paid. Applicants are advised that an escrow deposit is required at the time of the submittal of the land use application to offset costs associated with the proposed project. Next year will be the 50 year anniversary of our facility operating as a bus terminal, and serving the families and students of the Mounds View School District ISD #621 since it was constructed and first commenced operation in 1960. This is necessary due to the continually growing special needs transportation in our schools. This changing mix from large buses to small buses appears to be long term. Next year will be the 50 year anniversary of that facility operating as a bus terminal, and serving the families and students of the Mounds View School District ISD #621 since it was constructed and first commenced operation in 1960. In 1994, Reco, Inc. was granted a Special Use Permit by the City of Arden Hills to continue the operations of its tenant, Ryder Student Transportation, in conformance with plans submitted to the City. The successor to Reco, Inc. is SOR Real Estate, LLC. The successor to Ryder is First Student, Inc. On page 3 of Special Use Permit Case #93-15A, dated 7/21/94, Clause 4.7, permission is given to operate one hundred fifty (150) buses and twenty (20) vans from September 1 through June 15. First Student requests that this language be changed to t1a maximum of one hundred fifty (150) large buses and a total maximum of one hundred seventy five (175) buses. The reason for this change is that most school districts have experienced growth in the Special Needs transportation area, and some decline in the "regular" transportation area. The Special Needs portion almost always calls for small buses that hold few passengers and may also use a wheelchair lift. These small buses take up much less room than the large buses, usually about half of the space. Vile are asking for an increase of five total buses because the actual student capacity has been reduced due to smaller buses becoming the norm. There will be no visual impact, due to the reduced size of the buses. Also, our buses are quieter and cleaner than they have ever been before, certainly much quieter and cleaner than when the original CUP was requested in 1994. In addition to the improved technology on our buses that reduce diesel smells and emissions, First Student has joined the "Green Fleet" project and has upgraded our fleet to dramatically improve the diesel exhaust emissions. This project is a partnership among businesses, government agencies and nonprofit organizations to reduce pollution emitted from Minnesota school buses to protect children's health. Project Green Fleet helps school bus operators reduce emissions by installing pollution -control equipment on Minnesota school buses to make them cleaner and safer for our communities. That such application complied with the City's zoning regulations; 3. That the application was reviewed by the City's Planning Commission on the 6th day of July, 1994-Y and, 4. That the application, supporting data, and Planning Commission's recommendations were reviewed by the City Council on the 25th day of July, 1994, at which time the City Council granted the Special Use Permit which allows the Permitteb, its successors and assigns, to operate a school bus terminal at 1901 West County Road F subject to the following conditions: 4.1 All signage needs to be approved through the City of Arden Hills Sign ordinance/Permit process. 4.2 The underground fuel tank is to be replaced and upgraded to meet the Minnesota Uniform -Fire Code and federal pollution requirements by the year 2000 or no later than required by local, state or Federal law. At which time this is undertaken, the tanks should be properly screened per City Code. 4.3 All parking in the east lot, from approximately thirty (30) feet south of the northern most edges of the building south to the property line, shall be terminated. The lot should be barricaded and landscaped from traffic use by September 5, 1994. 4.4 The abandoned east parking lot shall be maintained as a buffer area between the current business and neighboring residential distr.ict. By September 5, 1994, this area shall be landscaped with the use of top soil, grass, seeding, trees and shrubs as identified in the landscape plan. The landscaping improvements shall be maintained by the applicant. 4.5 All parking areas, but not limited to the parking lot north of the building, shall be asphalted and striped for parking stalls by September 5, 1994. ton 4::�/ 2841917 Special Use Permit Case #93-15A Page 3 7/21/94 4.6 The maintenance and/or storage of rental vehicles and -equipment owned or leased by Ryder Student Transportation, not associated with the bus operation, shall be allowed only as long as Ryder Student Transportation is the primary tenant at 1901 West County Road F. No major overhauls will be allowed on this equipment, and all vehicles must be parked within the existing building and removed from the site within seventy-two ( 72 ) hours, 4.7 The number of buses allowed to operate and park at this location is limited to one hundred and fifty (15 0 ) buses and twenty ( 2 0 ) vans from September 1 through June 15 and one hundred and twenty five (125) buses and twenty ( 2 0 ) vans during the remainder of the year. 4.8 All site plan improvements are approved by Rice Creek Watershed District and a copy of this approval permit be provided to the City. 4.9 At such time that County Road F is improved by Ramsey County or the City of Arden Hills, the property owner/tenant shall submit, within 90 days of notification of the road improvement project, a plan for approval and undertake improvements required by the zoning ordinance concerning landscaping, screening and parking setbacks along County Road F. If within one year the County Road F improvements aren't undertaken, the parking within the setback area shall cease, and the landscaping improvements be made. 4.10 The bus terminal provides to the City a copy of all approved applicable County and State permits for the area of hazardous waste. 4.11 The property owner and tenants shall begin a process of making improvements and continue an ongoing maintenance program to the building to improve upon the appearance of the building, so the building shall not detract from the visual 2841917 Special Use Permit Case #93-15A Page 4 7/21/94 appearance of the area. These improvements shall include painting, landscaping or other improvements as undertaken and approved by the City of Arden Hills. 4.12 A performance bond for 125t of the estimated costs for the proposed landscaping improvements shall be provided to the City, 4.13 Emission or creation of noise, odors, vibrations, glare, dust, heat, and toxic or noxious fumes shall conform to such standards as are from time to time established by the Minnesota Pollution Control Agency. 4.14 The bus terminal will provide occasional reminders through maps, internal memorandums, and staff meetings to encourage its employees to reduce travel along County Road F in the neighboring residential districts. The terminal shall monitor the bus traffic travelling east and take appropriate actions to ensure that only those buses which need to travel east are allowed to do SO. 4.15 The company will investigate and discuss with City Staff by December 1, 1994 the options in the area of engine warmers and electrical plug -ins or other options which will reduce the need for the vehicles to run extended periods of time. These options would address monitoring and reducing potential air pollution due to running vehicles for an extended period of time in cold weather. 4.16 The Special Use Permit will be subject to review if the above conditions are not met, other concerns are observed or a change in the bus terminal operator occurs. Any violation by Permittee, its successors or assigns, of the provisions of this Special Use Permit shall be deemed a violation of the Arden Hills Zoning Regulations entitling the City of the various remedies provided therein. 6. A certified copy of the Special Use Permit shall be filed by the City Administrator with the Ramsey County Recorder or Registrar of Titles. If the Subject Property is torrens, the Permittee shall provide the City with the Owner's Duplicate Certificate of Title in order to allow the City to file a certified copy of this Special Use Permit. 7. The developer requested a letter of support from the City for a housing tax credit application with the Minnesota Housing Finance Agency (MHFA). The letter of support indicated that the City was interested in the project and willing to look at public assistance in the form of tax increment financing. The letter in no way indicates an approval for the project. If the developer received the tax credits a full application will likely come before the Planning Commission for review in January. September 21, 2009, City Council Work Session The City Council reviewed the proposed changes to the City's Shoreland Regulations and provided several comments regarding specific issues that Staff presented. The Council directed Staff to bring the regulations, along with the feedback from the Council, to the Planning Commission for an official public hearing and recommendation. The draft regulations will likely go before the Planning Commission for an official review at the November 4, 2009, meeting. September 28, 2009, City Council Meeting The City Council unanimously voted to approve Planning Case 09-017 for a variance and site plan review at 3413 Snelling Avenue to construct an 816 square foot detached garage in the front yard. The Planning Commission unanimously voted to approve this item at the September 9, 2009, meeting.
