SUBJECT: Addendum to the engineering services agreement for the Old City Hall
trail erosion correction project.
Back�round
At the July 13, 2009 City Council meeting an engineering services agreement was
approved with Bolton and Menk Inc. for work related to a trail erosion issue. To date
survey work and preliminary cost estimates have been completed for three different
solutions to the erosion issue.
At the September 20, 2009 City Council work session staff, Bolton and Menk Inc., and
resident Mr. Ron Nelson discussed the three possible solutions with the Council. The
consensus of the Council was to continue forward with the option of building a retaining
wall to correct the erosion issue.
Under the original scope of services agreement, Bolton and Menk Inc. viewed this as a
trail re-design proj ect. With the Council's direction to move forward with the retaining
wall option, Bolton and Menk is requesting an addendum to the original scope of services
in the amount of $3,800. Their request is primarily based on adding the design of the
retaining wall and additional meetings to the original scope of services. See attached
memorandum from Marcus Thomas of Bolton and Menk Inc. for a more detailed
explanation.
Recommendation
It is recommended that Council approve the addendum with Bolton and Menk Inc. for the
amount of $3,800 which will bring the costs for Engineering Services for this project to
$8,700.

Subject: Keithson Drive Trail Drainage — Retaining Wall Design Services
I appreciate your and the City Council's recognition of the additional work that is required of us to move
forward with the retaining wall design for Mr. Nelson's property along Keithson Drive. As you recall,
our original agreement provided for one resident meeting along with the design of a trail improvement.
As we have proceeded with the project, we have provided additional services including attending a
second resident meeting, attending a City Council work session, and completing an alternative analysis of
a trail improvement versus a retaining wall improvement. As we move forward in accordance with last
night's Council directives, we will be proceeding with a more detailed retaining wall design rather than a
trail design, and we anticipate additional resident and City Council meetings in order to prepare a final
design which meets Mr. Nelson's expectations. To account for the additional services completed to date,
along with the additional work expected to complete the retaining wall designs including three additional
meetings, completion of plans and specifications, and bidding assistance, we are respectfully requesting
that our agreement fee be increased by $3,800. Any additional meetings beyond the next three expected
with Mr. Nelson and the City Council would be invoiced at $121 per hour.
