CITY COUNCIL TCAAP WORK SESSION MEETING
OCTOBER 12, 2009
5:00 P.M. - ARDEN HILLS CITY COUNCIL CHAMBERS
CALL TO ORDER/ROLL CALL
Pursuant to due call and notice thereof, Council Member David Grant called
to order the City Council TCAAP Work Session meeting at 5:00 p.m.

APPROVAL OF THE AGENDA
City Administrator Moorse noted he had one item to add to the agenda called
Concurrent Jurisdiction related to TCAAP. Councilmember Grant indicated this
would be added as Item 1 C.
Councilmember Holden indicated she would like to add an item as well discussing
the GSA and the information sent to the City. Councilmember Grant indicated this
would be added to the agenda as item 1 D.
It was the consensus of the Council to approve the agenda as revised above.

1. AGENDA ITEMS
A. Preparation for Joint Work Session with County Board
City Administrator Moorse presented the City Council with information on the
joint work session meeting that would be held with the County Board on October
20th. He reviewed a power point presentation and asked for comments from the
Council.
Councilmember Holden suggested a slide be added to the presentation with
historical information on the TCAAP site.
City Administrator Moorse indicated he would also be explaining why the City
was approaching the County while explaining there was also a public sale of the
property that was proceeding.
Councilmember Holden asked for an additional slide dividing the property along
a line extending from County Road H, along with pointing out the limited access to
the site. She asked that the infrastructure issues be separate from the access issues.
Discussion ensued regarding the public sale of the land versus transfer through
special legislation.
Councilmember Grant wanted to assure the County Board that they would be able -
to take a portion of the land for parks even if they were not interested in taking all
535 acres.
Councilmember Grant asked that an additional slide be added to the presentation
to review the Ryan Companies land use concept to make the County aware of the
potential use of the site if not used for park land.
Further discussion ensued regarding the clean up. The Council wanted to require
that the County be responsible for ensuring the cleanup and for obtaining the
funding for cleanup of the site.
Councilmember Grant encouraged staff to add a point within the presentation that
the Council was looking for the County to take the land, develop a parks and open
space plan for its active use and implement the plan. The land was not to be vacant
for the next 100 years. He stated this site was an asset to the region and should be
used.

Councilmember Holden suggested the Environmental Cleanup slide regarding the
Early Transfer should be renamed because FOSET was confusing.
Further discussion ensued regarding various changes to the slide wording.
The Council suggested the slides be removed regarding the soil samples and
residential standards, as time may not allow for this level of detail at the County
meeting.
Councilmember Holden indicated additional details could be brought to the
County if so requested.
Councilmember Holmes stated that Special Legislation would likely include
appropriations, along with other State funding, and grants from McKnight and
other foundations. She indicated it would be good for the City to gather
information on the County Board's level of interest in the TCAAP site becoming a
regional park after meeting with them on the 20th
Councilmember Grant agreed stating that after this meeting, it would open the
door for further conversations between the City and the County. He asked that a
bullet be added near the end for Next Steps.
The Council discussed who would be giving the presentation. It was the consensus
of the Council to direct Community Development Director Lehnhoff to give the
presentation to the County Board.
B. TCAAP Reimbursables — Direction for Moving Toward Resolution
City Administrator Moorse presented the City Council with information on the
TCAAP reimbursables. He asked for additional direction from Council for his next
sit-down meeting with Ryan Companies as the parties work towards resolution.
Councilmember Grant questioned when the next meeting was scheduled.
City Administrator Moorse stated he did not have a meeting scheduled at this
time, but would do so after gathering further direction from the Council.

City Administrator Moorse indicated if both parties were not agreeable to any
certain terms that the next step would be mediation. He noted the expense of
mediation would be roughly $5,000 for each party.
City Administrator Moorse explained that it may be possible to reach a resolution
at $75,000.
Councilmember Holden suggested the City offer $53,000 to Ryan Companies as
this was the middle ground.
The Council agreed to proceed with the $53,000 number and to discuss the
reimbursables further at the next meeting if there was not an agreement as the
Council may have to pursue mediation.
C. Concurrent Jurisdiction
City Administrator Moorse presented the City Council with information on
concurrent jurisdiction on the TCAAP property. He explained that some criminal
activity has taken place on the TCAAP site, which at this time was federal land. In
order to prosecute the offenders, it would need to happen at a federal level. It was
suggested by the Army that the City have concurrent jurisdiction specifically for
these types of offenses to prosecute offenders at a local level.
Councilmember Grant stated he felt this would be a rare occurrence and that if
the City was not able to police the site, they should stay off of the TCAAP site and
let the Army handle their own security. Councilmember Holmes agreed.
Discussion ensued regarding the fire protection on the TCAAP site. The Council
asked that this be investigated further.
It was the consensus of the Council to direct staff to follow up with the Sheriff and
the Army, explaining to them the City was not interested in concurrent jurisdiction
over the TCAAP site.

D. GSA Update
Councilmember Holden questioned when the next GSA teleconference would be
held.
City Administrator Moorse stated it would be held on Thursday, October 15 th at
2:00 p.m.
2. COUNCIL COMMENTS AND REQUESTS
Councilmember Holden questioned if the City has signed off on the new contract
with Mike Comadeca.
City Administrator Moorse stated this would be before the Council for approval
at their next meeting.
Councilmember Holden explained that she would like Mr. Comodeca to receive
the public auction information from the GSA for his review. She asked that he also
review the leasing of the FOSET areas.
Councilmember Holmes stated there was an article in the Twin Cities Business
Journal indicating that the motorcross sports group was interested in the TCAAP
property. This information led to her receiving several emails.
Councilmember Grant indicated the Shoreview/Arden Hills bulletin had an
article regarding the Council review of the liquor ordinance. He stated Mike
Comodeca was quoted in the article, which was a misprint.
The Council requested Community Development Director James Lehnhoff to
prepare a response to the motocross article for Council use.
Councilmember Grant adjourned the City Council TCAAP Wo ession
