The proposed amendments impact three sections of the Zoning Code: • Section 1305.04, Definitions (Attachment A) • Section 1330, Shoreland Regulations (Attachment B) • Section 1325.07, Performance Standards (Attachment C) Discussion At the November 4, 2009, public hearing a number of concerns and questions were raised by both the Planning Commission and residents. The Planning Commission voted to table the proposed Zoning Code amendments to a work session in order to further discuss the issue and provide direction to staff on how to proceed with the proposed amendments. A revised draft of the proposed Section 1330, Shoreland Regulations, has been included in this packet in black -lined format (Attachment A). Any revisions to the draft since the November 4, 2009, meeting have been highlighted, as well as items that require further discussion. Below is a list and summary of concerns raised at the November 4, 2009, meeting. While the focus of tonight's discussion will focus on these items, the entire document remains open to revision and discussion. Patios —Patios are currently classified as structures and are therefore not permitted within the structure setback to the lake (50 feet on Lake Johanna). Landings to stairways are currently permitted up to a certain size. Should patios be permitted? How big? How close to the lake? 2. Stairway width — The proposed ordinance limits the width of stairways accessing the lake to four feet. Is this appropriate? What would be a more appropriate width? 3. Stairway landings —The proposed ordinance limits the square feet of landings within the structure setback to the lake to 25 feet. Is this adequate? 4. Storage sheds —The proposed ordinance permits one accessory storage shed within the structure setback to the lake provided that it is not located within the shore impact zone (25 feet on Lake Johanna), remains unlit and not connected to electricity, and does not exceed 25 square feet in size or eight feet in height. a. Lighting and electricity —Should storage sheds have access to light and electricity? What is an appropriate amount of light? b. Size — Is 25 square feet and eight feet in height a reasonable size? What is an appropriate size? Subd 5 —Maintenance of the Shoreland 1. Dock setbacks — The proposed regulations do not include setbacks for dock placement at the shoreline. Lakeshore property lines generally end at the ordinary high water level; however, in practice it is not uncommon for lakeshore lot owners to extend the imaginary lot lines out into the water immediately in front of a lakeshore lot for the purposes of lake use. In order to discourage docks from encroaching into this area would a setback be appropriate at the point of contact with the shore? If so, how much? Subd. 1 Purpose and Intent. The uncontrolled use of shorelands of the City of Arden Hills affects the public health, safety and general welfare not only by contributing to pollution of public waters, but also by impairing the local tax base. Therefore, it is in the best interest of the public health, safety and welfare to provide for the wise development of shorelands of public waters. The Legislature of Minnesota has delegated responsibility to the municipalities of the State to regulate the subdivision, use and development of the shorelands of public waters and thus preserve and enhance the quality of surface waters, preserve the economic and natural environmental values of shorelands, and provide for the wise utilization of waters and related land resources. This responsibility shall hereby be recognized by the City of Arden Hills. Subd. 2 Statutory Authorization. It shall not be intended by this Section to repeal, abrogate or impair any existing easements, covenants or deed restrictions. However, where this Section imposes greater restrictions, the provisions Of this Section shall prevail. . Subd.4 Appli Jurisdiction. Subd. 1 Classification of Lakes. In order to guide the wise development and utilization of shorelands of protected waters for the preservation of water quality, natural characteristics, economic values and general health, safety and welfare, certain protected waters in the City have been given a shoreland management classification. A. Structures shall be placed at an elevation consistent with the City's flood plain management controls as set forth in Section 1335 of this Code. B. In areas not regulated by flood plain management controls, the elevation to which the lowest floor, including basements, shall be placed shall be determined as follows: 1. For lakes, ponds, and flowages, by (a) an elevation of available flood information and consistent with ``Statewide Standards and Criteria for Management of Flood Plain Areas of Minnesota," or (b) placing the lowest floor at a level at least three (3) feet above the highest known water level. Subd. 4 Exceptions to Structure Setback Requirements.__ No structure shall be placed within the structure setback requirements of the shorel and management district. The shoreland shall present a neat and not unsightly qppearance from the water and shall be protected from adverse conditions affecting the public. A. The removal of natufal-vegetation shall be restricted to prevent erosion into protected waters, to consume nutrients in the soil, and to preserve shoreland aesthetics. No land shall be subdivided which shall be held unsuitable by the City for the proposed use because of flooding, inadequate drainage, soil and rock formations with severe limitations for development, severe erosion potential, unfavorable topography, inadequate water supply or sewer access, or any other feature likely to be harmful to the health, safety, or welfare of future residents of the proposed subdivision or of the community. �Subd. 8 Planned Unit Developments.
