Backiround In 1993, the City of Arden Hills approved Tax Increment Finance (TIF) District No. 3 to facilitate the development of Cottage Villas, which is a 60 unit apartment building for low to moderate income seniors at 3744 Cleveland Avenue. The building was completed in 1994. Along with federal housing tax credits, the TIF District was a primary component in financing the project to create the affordable units. For the basics of TIF, please see the below section and attachment B. Under State Statute, a housing TIF District can be up to 25 years in length. However, the City originally limited the Cottage Villas TIF District to 15 years because it was determined that the financial contribution to Cottage Villas would be paid off within that time. The 15 year period is completed in December 2009, and the City's contribution to Cottage Villas will have been satisfied. If extended, the revenue generated by the district could be used elsewhere in the community to fund housing projects for low to moderate income households. Cottage Villas would not receive any additional revenue from the TIF District. On October 12, 2009, the City Council adopted Resolution 2009-028 to begin the process of modifying TIF District No. 3 to extend the district an additional ten years. The City Council will be holding a public hearing on December 14, 2009, to consider approval of the TIF District extension. Prior to that, the Planning Commission must review the extension to make a recommendation on whether the proposed extension is in compliance with the recently adopted 2030 Comprehensive Plan. The Planning Commission is not evaluating the use of TIF for any particular project, the merits of using TIF, or whether TIF should be used in the future. Tax Increment Financing Basics The State Statutes related to TIF are complex and have many different provisions. Abasic outline that was prepared by the Minnesota Legislature explaining how and why TIF is used is attached (Attachment B). A TIF District basically uses a portion of the property taxes generated by the development to finance the development. For example, assume that a property is generating $5,000 per year in property taxes prior to being redeveloped. Then assume the property will generate $50,000 per year in property taxes after redevelopment. A tax increment financing district essentially allows a city to use the new increment of $45,000 to help finance the redevelopment. The original $5,000 is still distributed to the appropriate taxing authorities, including the City, County, and the school district. The information in Attachment B explains how the new increment is used to cover the costs of development. All TIF requests undergo a detailed financial analysis by the City to determine if and how much public financing is needed for a project to move forward. Even if a project demonstrates a need for public financing, using TIF is still at the discretion of the City. Cities are not obligated to use TIF; however, it can be a powerful and flexible tool when used appropriately. 2030 Comprehensive Plan Review As noted, the Planning Commission is being asked to determine if the TIF extension is in conformance with the Comprehensive Plan. Revenue generated by the proposed TIF extension could only be used to create low to moderate income housing. Develop and maintain a strong, vital, diverse and stable housing supply for all members of the community. To achieve this housing goal, the following policies are proposed: o Promote the development of a variety of housing options by preserving and increasing high- quality housing opportunities that are suitable for a mix of ages, incomes and household types. o Encourage the incorporation of affordable, life -cycle, and work force housing into new development and redevelopment where feasible. o Maintain the quality, safety, and unique character of the City's housing stock. o Preserve and strengthen the community's neighborhoods to maintain a high-quality of life for residents. o Encourage housing development and redevelopment that is complimentary to and enhances the character of the City's established neighborhoods. The full 2030 Comprehensive Plan can be downloaded at www.ci.arden-hills.mn.us/compplan. As part of the comprehensive planning process, the Metropolitan Council calculates target numbers for the construction of new affordable housing units in all cities in the seven county metropolitan region. The target number for Arden Hills is 288 new housing units by 2020 (this number assumed that a portion of the Twin Cities Army Ammunition Plant would be used for housing). The target number is calculated using a formula that considers such items as available land, population growth, and job proximity. Section 7.6 of the Comprehensive Plan Housing Chapter, Implementation Strategies, encourages the City to pursue grants or other opportunities that promote the construction of affordable housing. TIF is one of the tools that could be used to help the City achieve the target number for new affordable housing units. The City can only use the revenue generated by the TIF District for projects with the Development District shown in Attachment A. The Arden Village proposal to construct 55 affordable apartment units at 1296 County Road F, which is within the Development District, has requested TIF from the City to help finance the project. While the Arden Village request will still need to undergo a detailed financial analysis, the revenue from the TIF extension could be used for that project. Other eligible properties include future projects on the former City Hall site at 1450 West Highway 96 and in the B2 Zoning District. Recommendation Staff recommends the approval of Resolution 2009-001. Given the goals and policies in the 2030 Comprehensive Plan, it can be concluded that the proposed TIF extension is in conformance with the Comprehensive Plan. The 2030 Comprehensive Plan supports the creation of new affordable housing units, and this TIF extension is a tool that could help advance that goal. Tax increment financing (TIF) uses the increased property taxes that a new real estate development generates to finance costs of the development. In Minnesota, TIF is used for two basic purposes: • To induce or cause a development or redevelopment that otherwise would not occur e.g., to convince a developer to build an office building, retail, industrial, or housing development that otherwise would not be constructed. To do so, the increased property taxes are used to pay for costs (e.g., land acquisition or site preparation) that the developer would normally pay. • To finance public infrastructure (streets, sewer, water, or parking facilities) that are related to the development. In some cases, the developer would be required to pay for this infrastructure through special assessments or other charges. In other cases, all taxpayers would pay through general city taxes. How does TIF When a new TIF district is created, the county auditor certifies (1) the current work? net tax capacity (i.e., property tax base) of the TIF district and (2) the local property tax rates. As the net tax capacity of the district increases, the property taxes (i.e., the "tax increment") paid by this increase in value is dedicated and paid to the development authority. The tax increment is limited to the tax derived from the certified tax rate. Increases in value that generate increment may be caused by construction of the development or by general inflation in property values. The authority uses the increment to pay qualifying costs (e.g., land acquisition, site preparation, and public infrastructure) that it has incurred for the TIF project. Three basic financing techniques are used to finance these upfront costs: Bonds. In some cases, the authority may advance money from its own funds (e.g., a development fund or sewer and water fund) and use the increments to reimburse the fund. Pay-as-you-go financing. The developer may pay the costs with its own funds. The increments, then, are used to reimburse the developer for these costs. Background At the City Council's August 17, 2009, work session, Sand Companies, Inc (SCI) presented their concept for a four-story, 55 -unit, workforce housing development at 1296 County Road F and requested a letter of support from the City as they attempted to secure housing tax credits from the Minnesota Housing Finance Agency (MHFA). The Council's letter of support is included with this packet (Attachment B). Sand Companies, Inc has secured a purchase agreement for the property and has since submitted a request to the MHFA for tax credits. They will be notified by the end of January 2010 if they will receive the tax credits; however, they are moving forward with the planning review process and are seeking Planning Commission and City Council approval of their application. The request for City financial assistance will be reviewed separately. The proposal requires the property to be rezoned from the current I-1, Limited Industrial District, to R-4, Multiple Dwelling District. In order to rezone the property, the City's future land use map in the 2030 Comprehensive Plan must also be amended to reflect the new Multiple Family use for the property, which is currently identified as Utility in the City's Comprehensive Plan. This requires Metropolitan Council approval as well as City approval. In addition to the rezoning of the property and the Comprehensive Plan Amendment, the applicants are also requesting a Preliminary and Final Plat to subdivide the property into two parcels, and a Master and Final PUD for the development itself. The property currently operates under a Conditional Use Permit (CUP) that was approved in 1972. Because the CUP encompasses the entire property it will need to be amended as well to reflect the proposed legal description for the subdivided lot. The City Council will hold the public hearing for the CUP Amendment because notice was not published in time for this meeting; however, the applicant is requesting the Planning Commission recommend approval of the CUP Amendment at this time. Project Proposal and Process 1. Planned Unit Development (PUD) Process: The PUD process is a tool that provides additional flexibility for developments that an underlying zoning district would not otherwise allow. For example, a PUD may change the setbacks, lot coverage, lot sizes, parking requirements, building height, building materials, landscaping requirements, etc. Additionally, the PUD process allows the City to negotiate certain aspects of the development to help achieve City goals. With any development, the conditions imposed on the project must have a rational basis related to the impacts of the development. The process is meant to create a better development than the standard regulations may otherwise allow. While each PUD process is unique, it is a common process used by many cities. The PUD process cannot be used to permit uses that would not otherwise be permitted in the underlying zone. Project Description The 2.76 acre site currently includes a communications tower and a 1,600 square foot equipment building on the south side of the lot. The applicant proposes to subdivide the property into two lots and maintain the existing tower and equipment building separate from the housing development. The proposed four-story building would consist of 55 housing units with one to three bedrooms, a 55 stall underground parking garage, and a 55 stall surface parking lot. The development would include a tot lot playground and picnic area for residents. As part of the park dedication requirement, the applicant is proposing to construct an approximately 1,680 foot trail along the south side of County Road F that connects their property with the sidewalk Land O' Lakes completed last year, which connects to Lexington Avenue. The details of this trail are still being worked out with the County and the developer. This proposal technically includes seven requests: 1. Conditional Use Permit Amendment of CUP 72-024 2. Rezoning and Comprehensive Plan Amendment The City's 2030 Comprehensive Plan lays out the future land uses that are anticipated for all properties within the City. Based on the future land uses, the City can plan for improvements, anticipate infrastructure needs, and create appropriate land use regulations. The City's Zoning Code identifies specific zoning districts through which the land uses and goals in the Comprehensive Plan can be implemented. The zoning cannot conflict with the future land use designation. State Statute requires that in order to change a property's zoning district, the future land use of the property in the Comprehensive Plan must also be amended to reflect the new anticipated use. The Metropolitan Council has the final determination as to whether to allow a comprehensive plan amendment or not, though they provide great deference to the City as long as the proposed land use change does not have a negative impact on a regional system (i.e. transportation, sanitary sewer, and regional parks) A City has broad discretion when reviewing whether or not to rezone a property or amend its Comprehensive Plan. Questions to consider are whether or not the proposed project forwards the broader goals and vision for the City? Would the rezoned property allow for a better development then the current zoning would permit? Is the proposed zoning district appropriate to that particular location? Would the proposed change forward the goals of the comprehensive plan? If the City approves the Comprehensive Plan amendment one of the conditions of approval will be that the project is contingent on approval from the Metropolitan Council. The request for the future land use amendment will be submitted to the Metropolitan Council by the City at that time. The Metropolitan Council then has 60 days to review the application, though due to the small size of the project and the lack of negative impacts, the City will be requesting a shortened review timeline of 14 days. Once the Metropolitan Council completes their review they will notify the City of their decision. If the land use amendment is approved the applicant can move forward with filing the final plat and pulling permits. 2. R-4 Zoning Regulations Review As noted, this project is being reviewed through the Planned Unit Development (PUD) process. The following section reviews the project based on the R-4 regulations and notes where flexibility is being requested. Section 1320 — District Provisions A. The applicant is proposing to subdivide it into two lots. Lot 1 will consist of the housing development and is proposed to be rezoned to R-4 from I-1. In support of the rezoning, the applicant is requesting a Comprehensive Plan amendment for this lot to change its future land use designation from "Utility" to "Multiple Family." Lot 2 will consist of the communications tower and equipment building. This lot would remain in its current zoning district and land use designation. The use of this lot will be limited to the existing tower through the development agreement. For the purposes of calculating landscaping and density, the two lots are considered as one. Lot 2 exceeds the minimum landscape requirements for the I-1 District which are 35 percent. Lot 1 is proposed to have 53 percent landscaping plus an additional 6 percent pervious paver coverage. City Code requires 65 percent landscaping for residential districts. Together the two lots would have 58 percent landscaping plus 6 percent pervious pavers for a total pervious area of 64 percent. The Zoning Code does not directly address the use of pervious pavers, but pervious pavers do help drainage on the site and the use of green materials is encouraged. B. Building Height and Density — Flexibility requested The maximum building height in the R-4 District is 35 feet. The maximum density is 12 units per acre. The proposed building would be four -stories and 54 feet four inches tall, and have a density of just under 20 units per acre. The location of this site amongst office uses and adjacent to Highway 694 makes it a suitable location for a higher intensity of use. Functionally, the site is more similar to the B-2 District, which allows residential up to 20 units per acre and 50 feet in height along with office, commercial, and light industrial. C. Setbacks — Meets Requirements The minimum building setbacks in the R-4 District are 40 feet in the front yard, 30 feet in the rear yard, and five feet in the side yard, with both sides adding up to 15 feet. Landscaping and Tree Preservation - Section 1325.05 Subd. 1 and 1325.055 Landscaping and Tree Preservation Plans were submitted by the applicant and are included in Attachment E. Based on the square footage of the proposed building, the City Code requires 241 caliper inches of trees to be planted; however, existing and preserved trees on the site are permitted to count towards this requirement. The following table outlines these numbers and the additional requirements of the tree preservation ordinance pertaining to tree removal. City Code requires a certain number of caliper inches to be planted. If larger trees are planted then fewer trees would be required. This is a heavily wooded lot that presents challenges for meeting the tree preservation requirements. While the total number of trees on site is proposed to increase, the number of caliper inches would be reduced. City Code requires a replacement of 557 caliper inches based on the number of significant trees currently on site and the number of trees proposed to be removed. The applicant is proposing to replace 195 caliper inches. Most of the trees being removed are considered undesirable trees because of their species (i.e. Ash, Cottonwoods, Box Elder, and Silver Maples). Section 1325.055of the Zoning Code identifies several situations in which the City has the discretion to reduce the number of replacement caliper inches required for a particular development; providing affordable housing is one of them. The applicant has requested a reduction in the number of replacement caliper inches required from 557 to 195 in order to maintain the affordable housing component of the project. This reduction is at the discretion of the City Council and Planning Commission. Trees along Street Frontage — Meets Requirements City Code requires that a minimum of one tree be planted along the right-of-way for every 40 feet of street frontage. The Arden Village property has 209 feet of frontage which would require five trees to be planted; however, a preexisting utility easement for Xcel Energy City ofArden Hills Planning Commission Meetingfor December 9, 2009 IIMetro-inet.uslardenhillslPlanninglPlanning Cases 12009109-021 Arden Village PUD, Plat, Rezoning (Pending)112-09-09 - PC Report - Arden Village.doc Page 6 of 14 limits the ability to plant trees along the street frontage. A condition has been added that five additional trees be incorporated in to the front yard area of the development in lieu of being located along the right-of-way. These trees would be in addition to those identified in the tree counts in the above section and would increase the number of trees the application has proposed to plant. The applicant is aware of this requirement. Perennials and Shrubberies — Meets Requirements City Code requires that at least ten percent of the total landscaped area shall be covered with perennials and/or shrubbery. Code requires 6,013 square feet of perennials and shrubbery. The applicant is proposing 8,490 square feet. Planting Islands — Flexibility Requested City Code requires that at least ten percent of the parking area be occupied by planting islands that are at least 150 square feet in size and have at least one tree, which equates to 1,938 square feet of planting islands. The applicant is providing 886 square feet. The configuration of the parking lot and proximity to the building make parking islands difficult to place. Residential developments in general require less parking then commercial developments making less room for planting islands. Tree Selection — Meets Requirements Of the 75 trees proposed to be removed 35 are ash trees. The rest are primarily box elder, silver maple, and cottonwoods, all undesirable species. The proposed trees to replace these are extremely divers and include; Red Maples, American Lindons, Hackberry, Dogwoods, Black Hills Spruce, Scotch Pine, Eastern Pine, and Tannenbaum Pine. All of these species are appropriate for urbanized locations and would grow well in their proposed locations. C. Parking — Section 1325.06 — Meets Requirements The City Code requires two parking stalls for every dwelling unit. The proposed development would meet this requirement with 55 underground parking stalls and 55 surface parking stalls. 3. Design Standards — Section 1325.05 Subd. 8 The proposed zoning district for this property is R-4, Multiple Dwelling District. This zoning district does not include design standards such as those that have been adopted for the B-2 and B-3 Districts. However, at the suggestion of the City Council at the August work session, Staff has reviewed the application as if the design standards from those districts were in place. The discretion offered the Planning Commission and City Council through the PUD review process allows additional scrutiny when needed to ensure a high quality development. Additionally, examining the development through the lens of the B-2 District design standards will help assist the Planning Commission and City Council in understanding City of Arden Hills Planning Commission Meeting for December 9, 2009 I Wetro-inet.uslardenhillslPlanninglPlanning Cases 12009109-021 Arden Village PUD, Plat, Rezoning (Pending)112-09-09 - PC Report - Arden Village.doc Page 7 of 14 how the development will fit into the broader context of the City. The full analysis of the design standards is included in Attachment C. Staff has found that the proposed project significantly conforms to the design standards laid out in Section 1325.05 Subd 8 of the City Code. 4. Conditional Use Permit Amendment Criteria — Section 1355.04 Subd 3 Section 1355.04 Subd 3 of the Arden Hills Zoning Code lists the criteria for evaluating a Conditional Use Permit. When evaluating Conditional Use Permits, the Planning Commission and City Council should consider the effect of the proposed use upon the health, safety, convenience and general welfare of the owners and occupants of the surrounding land, in particular, and the community as a whole, in general, including but not limited to the following factors: 1. Existing and anticipated traffic and parking conditions; 2. Noise, glare, odors, vibration, smoke, dust, air pollution, heat, liquid or solid waste, and other nuisance characteristics; 3. Drainage; 4. Population density; 5. Visual and land use compatibility with uses and structures on surrounding land; adjoining land values; 6. Park dedications where applicable; and the 7. Orderly development of the neighborhood and the City within the general purpose and intent of this ordinance and the Comprehensive Development Plan for the City. The property operates under an existing conditional use permit (72-24). The CUP references the legal description for the property as well as plans for the towers construction at the time the application was made to the City. The tower was originally intended as a microwave dish tower, and while the CUP itself does not make mention of a particular number of antennas allowed on the tower, the submitted plans at the time showed seven dish antennas. Over the past 38 years new antennas have been installed and old antennas have been abandoned. Verizon Wireless, one of the users on the tower, submitted a Structural Analysis Report of the tower dated August 5, 2009. According to the report, there are 34 antennas located on the tower. Many of these antennas are no longer operational and Verizon has begun the process of removing them. A report is being prepared to show the remaining functional antennas to determine if the tower remains out of compliance with the original CUP. That report was not available when this report was finished. As part of the conditions of approval for this application, Staff is recommending that the tower be brought into compliance with the original CUP or they submit a CUP amendment to determine if any of the new antennas can remain on the tower. Resolving the CUP and the number of antennas will be required prior to the issuance of any building permits for Arden Village. City of Arden Hills Planning Commission Meeting for December 9, 2009 IlMetro-inet.uslardenhillslPlanninglPlanning Cases l2009109-021 Arden Village PUD, Plat, Rezoning (Pending)112-09-09 - PC Report -Arden Village.doc Page 8 of 14 Sand Companies, Inc has not taken ownership of the property at this time and is still in the process of negotiating the details of the tower with the existing owner. The current manager for the property is a representative of the Reiling Estate that has owned the property since the original CUP was approved. Neither the current manager nor Sand Companies was aware of the noncompliance with the original conditional use permit; nevertheless, the representative for the Reiling Estate acknowledges that this issue needs to be resolved. 5. Traffic Study and Transportation Improvements. The City ordered SRF Consulting to perform a traffic study for the proposed development. The City has received the draft report, and the final report will be forwarded to the Planning Commission as soon it is received. The draft report indicates that except for the County Road F and Hamline Avenue/Highway 51 intersection, the other intersections near the property operate at level of service D or better, which is considered acceptable. Furthermore, SRF Consulting found that the proposed development alone would not have any discernable impact on traffic at any nearby intersections. The draft study proposes minor upgrades to the County Road F and Lexington Avenue intersection, which is being reviewed by the County, and Staff is awaiting comment. The County Road F and Hamline Avenue/Highway 51 intersection need to be reconstructed and have a traffic signal added, but the Arden Village project is not considered the impetus for that improvement and will not make the current situation worse. As part of the Minnesota Department of Transportation's future plans for the Interstate 694 and Highway 51 interchange reconstruction, they have included a traffic signal at County Road F, though the timeline is not yet known. Future development of the Boston Scientific campus, in accordance with their previously approved Master Plan, would impact traffic significantly at a number of key intersections. SRF Consulting has made a number of recommendations, including the installation of a traffic signal at Hamline and County Road F, for such time when Boston Scientific moves forward with their long term plans. Traffic improvements are included as conditions of approval for future expansion at Boston Scientific. Finally, the draft traffic study did not have concerns about the access to the property or the proposed parking. 6. Sign Code The applicants have proposed a monument sign at the entrance to identify the development. The location of the sign is indicated in the attached plans; however, the applicants have not yet determined the design of the sign. The sign will need to meet all requirements of the Sign Code and will require a separate sign permit prior to construction. Park Dedication (1130.08 Subd 2) For a subdivision that results in new dwelling units in excess of four units per acre, Section 1130.08 Subd. 2 of the Subdivision Ordinance permits the City to require the applicants to dedicate up to ten percent of the buildable land area in the subdivision or to pay a park dedication fee of up to ten percent of the property's land value at the time the final plat is approved. According to information provided by the applicant, the current value of the property has been determined to be $750,000. In 2009, Ramsey County assigned an assessed value of approximately $710,000. State Statutes require the City to use the value of the property prior to development when determining park dedication requirements. This means that the park dedication requirement, if it were paid in a fee, would be an estimated $75,000. In order to meet this obligation, the applicants have proposed to construct a 1,680 foot sidewalk along the south side of County Road F across the length of their property and connecting to the existing sidewalk at the entrance to Land O' Lakes. This would create a pedestrian connection to Lexington Avenue and complete a gap in the City's sidewalk system. Moreover, the City Council and staff were concerned about the inadequate pedestrian access to this property from Lexington Avenue or other parks. This sidewalk helps to alleviate those concerns. The cost of the sidewalk is currently estimated at approximately $85,000; however, the details of the trail that will impact the final cost and are still being negotiated with the County. At this time, staff anticipates the developer will cover the gap between the park dedication requirement and the cost of the sidewalk. 7. Additional Review A. Building Official, Fire Marshal, Public Works Director, and Civil Engineer The Building Official, Fire Marshal, Public Works Director, and City Engineer have reviewed the application and do not have any objections to the proposed project. The Public Works Director and City Engineer are recommending an eight foot wide trail, rather than a six foot trail, as proposed by the developer. All final grading and utility plans will be subject to the Engineer approval prior to the issuance of any permits. All final plans will be subject to the Fire Marshal approval prior to the issuance of any permits. B. Ramsey County Review Ramsey County has reviewed the application and offered comments regarding the proposed trail. Ramsey County is recommending an eight foot wide trail with a four foot boulevard for the majority of the length of the trail. The applicant is aware of these comments. Due to the terrain, utilities, and costs, negotiations with the County are ongoing. Any trail will need to be approved by Ramsey County prior to the issuance of any building permits. Surrounding Jurisdictions As part of the requirements for amending the City's Comprehensive Plan, notice of the proposed plan amendment has been sent to the adjacent cities and the Mounds View School District, Minnesota Department of Transportation, and Ramsey County. Comments have not yet been received. Findings of Fact: This project includes seven requests: An amendment to CUP 72-024, a rezoning of the property from I-1 to R-4, a Comprehensive Plan Amendment to amend the future land use designation of the property form Utility to Multiple Family, the Master PUD, the Final PUD, the Preliminary Plat, and the Final Plat. Staff offers the following twenty-eight findings of fact for this proposal: General Findings: 1. The Arden Village property is 2.76 acres in size. 2. The Arden Village property is currently located in the I-1 Light Industrial District 3. The Arden Village property currently has a future land use designation of Utility in the 2030 Comprehensive Plan. 4. The applicant is proposing to re -plat the property into two parcels; Lot 1 and Lot 2. 5. The applicant is proposing to construct 55 units of workforce housing on Lot 1. 6. The applicant is proposing to maintain the current use of Lot 2 as a communications tower and related equipment. 7. The proposed development requires park dedication. 8. The applicant has indicated that the market value of the property is $750,000. Ramsey County has an assessed market value for 2009 of $715,600. 9. The park dedication requirement for this application is 10 percent of the land in dedication or a fee of 10 percent of the market value. 10. The applicant is proposing to construct 1,680 feet of trail along the south side of County Road F at a cost of approximately $85,000. Rezoning and Comprehensive Plan Amendment Findings: 11. The application is proposing to rezone Lot 1 to R-4 Multiple Dwelling District and amend the City's future land use map to designate the property as Multiple Family. The future land use designation for Lot 2 will remain unchanged. 12. The proposed redevelopment is a permitted use in the R-4 District. 13. Lot 2 would be limited to its existing use and is considered legally non -conforming in the I-1 District. The proposed Comprehensive Plan Amendment would advance the City's goal to promote the development of a variety of housing options by preserving and increasing high-quality housing opportunities that are suitable for a mix of ages, incomes and household types, and encourage the incorporation of affordable, life -cycle, and work force housing into new development and redevelopment where feasible. 16. The proposed development forwards the Metropolitan Council's target of 288 new affordable housing units by 2020 in Arden Hills. 17. The completion of the proposed trail associated with the project will advance the Active Living goals outlined in the City's Comprehensive Plan by extending the City's pedestrian connectivity. 18. The proposed rezoning and use would not be incompatible with the adjacent land uses. PUD Review Findings: 19. The application is in substantial conformance with the requirements of the City's Zoning Code for the proposed R-4 District. 20. The application is in substantial conformance with the City's Zoning Code. 21. The application is in substantial conformance with the City's Design Standards for the B2 District. 22. The applicant is requesting flexibility from the Zoning Code through the PUD process on landscaping, tree replacement, building height, density, and parking lot planting islands. 23. The application is not anticipated to create a negative impact on the immediate area or the community as a whole. 24. A traffic study to evaluate the proposed use was completed. The application is not anticipated to create a negative impact on traffic in the area. Conditional Use Permit Criteria Findings: 25. The proposed CUP amendment is not anticipated to negatively impact traffic or parking conditions because it is an amendment to the legal description of the property only. 26. The proposed CUP amendment is not anticipated to negatively impacts Noise, glare, odors, vibration, smoke, dust, air pollution, heat, liquid or solid waste, other nuisance characteristics, drainage, and population density because it is an amendment to the legal description of the property only. 27. While park dedication is applicable to the project as a whole, the proposed CUP amendment itself does not require park dedication. 28. The proposed CUP amendment is in keeping with the orderly development of the neighborhood and the City within the general purpose and intent of this ordinance and the Comprehensive Development Plan for the City, as expressed in previous findings. The project shall be completed in accordance with the submitted plans as amended by the conditions of approval. Any significant changes to these plans, as determined by the City Planner, shall require review and approval by the Planning Commission and City Council. 2. Executing the Final Plat and publishing the rezoning shall be contingent upon the Metropolitan Council's approval of the Comprehensive Plan Amendment. 3. A development agreement shall be prepared by the City Attorney and subject to City Council approval. The development agreement shall be executed prior to execution of the Final Plat, the issuance of any permits, or site preparation. 4. The applicant shall file the Final Plat with Ramsey County within 180 days of the approval from the City. 5. The applicant shall obtain a building permit within one year of the Final PUD approval or the approval shall expire unless extended by the City Council prior to the approval's expiration date. Extension requests must be submitted in writing to the City at least 45 days prior to the expiration date. 6. The applicant shall submit a financial surety in the amount of 125 percent of the cost of the landscaping improvements prior to the issuance of any building permits. 7. The applicant shall obtain approval from the Rice Creek Watershed District and all other applicable permitting agencies prior to the issuance of any permits. Copies of such permits shall be provided to the City prior to the issuance of any permits. 8. The plans shall be subject to Fire Marshal approval before building permits are issued. 9. Final grading, drainage, and utility plans shall be subject to approval by the Public Works Director and City Engineer prior to the issuance of any building permits. 10. The existing tower shall be brought into compliance with Conditional Use Permit 72- 24 or an amended CUP prior to executing the Final Plat and the issuance of any building permits. 11. An updated structural analysis report shall be conducted on the tower and submitted to the City prior to the issuance of any building permits to confirm compliance with the Conditional Use Permit and City regulations. 12. The applicant shall construct approximately 1,680 feet of trail along the south side of County Road F, subject to the approval of the City Engineer and Ramsey County, which will connect their property with Lexington Avenue. 13. The applicant shall provide the required number of ADA parking spaces. The ADA parking space locations shall be subject to Building Official approval. 14. The applicant shall install an additional five trees between County Road F and the development outside of any easements or right-of-way. The building is a mix of one, two and three bedroom units. Each unit is equipped with full kitchen and one or more bathrooms. All units have exterior decks or patios at grade. An area for mail boxes is provided near the main entrance and a small lobby serves a management office and meeting room. A Community Room and public toilet are also located on first floor. Trash and recycling rooms are provided at each floor with a trash chute leading to a compactor at the garage level. Trash dumpsters are stored inside until pick-up. PRELIMINARY DESIGN STANDARDS: The building has a vertical composition that fits the heavily wooded surrounding terrain. The multiple stepped roof lines keep the scale of the building user friendly. The forms are familiar to residential architecture but fresh and modern. The main entrance element is prominent from the site entrance with an inviting canopy. A separate "move -in" route is provided to keep the main entrance and lobby available to residents, while the office locations provides an "eyes on the street" presence. A parking island provides a location for a moving truck to park for unloading. All the exterior materials are consistent with the requirements of "Additional Design Standards for new developments in the 132 and 133 Districts", and all facades are treated equally. The building facades are strongly modulated both horizontally and vertically and the partially exposed garage level and lower portion of the ground floor are strongly expressed by the use of integrally colored textured masonry in an ashlar pattern. Cement fiber siding panels are the basic exterior material above the masonry base, with heavily textured accent colored shakes used at gable ends and projecting living room elements. Carpet used in all units except the handicapped accessible is a frieze style made from recycled plastic bottles while the vinyl flooring has recycled content as well. All flooring products will carry the Green Label Certification. Units will be furnished with water saving front loading washers and electric dryers. MECHANICAL AND ELECTRICAL Heat is to be supplied to the building by a high efficiency gas fired hot water boiler system and distributed to units by fin tube radiation. Individual meters for each unit will be located in the same area. Distribution panels will be located in each apartment unit. A structured media center will be located in the entry closet of each unit and data cabling, voice cabling and television cabling will be distributed to recessed devices from that point. SITE DEVELOPMENT The site will be entered from County Road F with entrance to the parking garage south of the building. Surface parking will be located on the east side of the building. The asphalt parking lot will have concrete curbs and gutters with sidewalks to access the building entrances and exits. Sidewalks will be extended to County Road F and along County Road F to connect to existing sidewalks to the east near Lexington Avenue and to the intersection at Hamline Avenue. Paving and roof drainage will be directed to infiltration basins (rain gardens) south and east of the building. Some of the parking lot run-off will be infiltrated through pervious concrete paving in the car parking area. Extensive landscaping will be provided in buffer yards and around the building. One of the primary purposes of a community is to. serve as a place of residence for its citizens. Assuming this charge, offering a mix of life cycle housing opportunities becomes a challenge for local governments, especially in suburban markets. The City has a strong desire to support affordable and work -force housing and is an active participant in the Livable Communities Program. The City's 2030 Comprehensive Plan sets goals that emphasize the development of a variety of housing types that are suitable for a mix of incomes, including work -force housing. Developers and the City must be partners to cooperatively develop housing plans to provide life cycle housing in Arden Hills. The City of Arden Hills proposes to use local financial assistance for this project as pari of its participation and endorsement. If the project is selected for funding, the City Council supports the use of tax increment financing (TIF) for the project. The TIF structure is proposed to be pay-as-you-go with a projected tax exempt bond amount of $400,000 with 90 percent of increment returned to the project until the bonds are repaid. As part of the TIF, the project will need to meet all state guidelines for TIF, including the "but for test:." The project must also be reviewed under the City's business subsidy policy as well as conform to the City's development standards. Along with its financial endorsement of Arden Village, the City is supportive of offering flexibility in site development standards such as density and zoning code requirements as the project moves through the development approvals of the City. Although the project will be required to meet all building code requirements, the building officials will, to the best of their abilities, work with project to allow for fast-track pennitting approvals. The proposed development is an excellent opportunity for the City of Arden Hills to meet a large portion of its housing goals. This endorsement is based upon the findings that the project will meet locally identified housing needs and that the proposed housing is in short supply in the local housing market. This need is evidenced by the gap between the local supply and demand for the proposed type of housing. The purpose of this review is to examine the proposed development through the lens of the design guidelines for the B2 and B3 Business Districts. while the proposed project would be located outside of these zoning districts, it is being reviewed through a PUD process, which allows the City to impose greater design review scrutiny in exchange for other flexibilities in the Zoning Code. Findings Summary This project is in substantial conformance with the City's design guidelines. Findings: Section 1325.05 Subd. 8 — Additional Design Standards for the B2 and B3 Districts A. Building Materials. Buildings shall be constructed of materials that are enduring, timeless, and well -detailed. 1. At least seventy-five percent (75%) of the exterior building materials shall be of brick, stone, decorative concrete plank, transparent glass or any combination thereof. This requirement has been met. The majority of the building would be constructed o� f concrete plank, transparent glass, and shakes. Trim and other accent or decorative features may be metal, wood, or EIFS. Other high- quality materials that increase the variety and appeal of buildings may be considered as accents. Metals shall have a matte finish and neutral or earth tone colors. Metals that are used on exterior walls shall have visible corner moldings and trim. This requirement has been met. Trim would consist of steel fascia and aluminum. 3. Undesirable materials shall include simulated brick or stone, vinyl or aluminum siding, sheet metal, corrugated metal, concrete blocks, materials that have no pattern or relief when applied to large walls, brightly colored metal roofing or canopies, and pre -cast tilt - up walls. Extensive use of mirrored or tinted glass on the first floor and materials that represent corporate colors or trademarks that are not in conformance with approved building materials are also undesirable. Vinyl siding is proposed for a portion of the building. B. Building Design. The arrangement, geometry, massing, materials and colors shall work to create a high quality development that is responsive to existing buildings, site features, and site design on adjoining sites in the district. 1. At least fifty percent (50%) of the largest building on each site shall be constructed at the front setback line. This requirement has been met. The majority of the building line is setback 40 feet from the front property line. 2. Facade treatment shall be carried around all sides. Architectural elements such as, but not limited to, windows, shutters, awnings, doors, masonry exterior veneers, cornice detailing, window casings, and other architectural details should demonstrate consistency on all sides of the structure that are reasonably visible to the general public. Plain flat walls shall not be permitted when viewable from the public right-of-way or public areas. This requirement has been met. The architectural details carry around all four sides of the building. 3. To avoid long unbroken expanses and to increase visual interest from the street, buildings of more than 40 feet in width shall be divided into smaller increments (between 20 and 40 feet) through articulation of the facades to convey the impression of individually - constructed small storefronts or, in the case of housing, housing units. This requirement has been met. The building has architectural details that break up the walls and create articulation around all sides. This is done with changes to the siding treatments. Page 2 of 9 4. Awnings or overhangs shall be provided at entryways to provide shelter from the sun and rain. The awnings shall be opaque so as not to create a glowing effect with lights under the awnings. Awnings shall be constructed of durable, protective, and water repellant material; however, plastic or fiberglass awnings shall not be permitted. This requirement has been met. Awnings are present over all entrances. 5. Any multi-level building shall distinguish the ground floor level from the upper floors by use of any or a combination of these techniques: an intermediate cornice line, difference in building materials or details, awnings trellis or arcade, special window details, or brick corbels or quoins. A strong base and top for multi -story buildings shall be established; middle layers shall be simpler. Detail shall be an integral part of the architecture rather than a series of applied elements. This requirement has been met. Architectural details are present the break up the height of'the building into smaller segments. 6. Franchise architecture identified with a particular chain shall be discouraged unless it is architecturally integrated into the district and conforms to these design standards. Not Applicable. 7. Entrances shall have convenient access to the street frontage and to parking serving the use. For those properties along County Road E, access to the street frontage shall be given priority where feasible. Not Applicable. C. Commercial Fagade Transparency — Not Applicable 1. Fifty percent (50%) of the first Level facade that includes the primary store entrance and/or faces a public street shall be made of transparent windows and doors that are recessed at least one inch rather than being flush with the facade. If the building is a one story design and the first floor elevation exceeds twelve (12) feet, then only the first twelve (12) feet shall be included in calculating the facade area. 2. At least twenty percent (20%) of the remaining sides that are reasonably visible to the public shall be window coverage, half of which may be simulated windows (i.e. spandrel glass). If additional transparent glass is used on the remaining sides, the City may consider a proportional reduction in the transparent window and door requirement on the primary store entrance and/or public street fagades. 3. For buildings with a use or function that does not readily allow windows (e.g. cooler or freezer areas, mechanical rooms, security areas, storage areas) the transparent window Page 3 of 9 standards may be reduced at the discretion of the City Council. However, the architectural detailing must be provided by the use of upper level windows, which may include the partial use of simulated windows, or architectural detailing that provides arches, patterning, recesses, and shadowing that provide aesthetic interest. Architectural detailing may include such things as change in materials, change in color and other significant visual relief provided in a manner or at intervals in keeping with the size, mass, and scale of the wall. D. Building Color. Colors shall be harmonious. Building colors shall consist of muted colors with low reflectance. Recommended colors include browns, grays, tans, beiges, and dark or muted green, blues, and reds. Bright or brilliant colors and sharply contrasting colors may be used for only accent purposes occupying a maximum of five percent (5%) of building fagades. This requirement has been met. The building colors are tans and greens E. Fences. Fences shall blend into the landscape, be compatible with other materials used on site, and be made of a material that minimizes corrosion. Finished and treated wood, brick, stone or wrought iron is encouraged. This requirement has been met. Fences on site shall meet this requirement. F. Signs. 1. Business signs shall be architecturally compatible with the style, composition, materials, colors and details of the building and should be an integral part of the building. Signs shall be incorporated into the fagades of the buildings rather than extending past the roof line and should not project more than twelve (12) inches beyond the plane of the fagades. Retail business wall signs shall be located in a position above the front window that is located consistently among stores. Not Applicable 2. All other provisions in Chapter 12, Sign Code, shall apply. This requirement will be met. G. Site Furnishings and Seating Areas. 1. Site furnishings shall be provided based on the scale of the project. The site furnishings may be spread out on the site or clustered to provide a more formal area. These areas may be shared by multiple tenants on a property or adjacent properties and may include tables, chairs, benches, plantings, and other outdoor amenities such as a plaza. Trash and recycling equipment, materials, and containers shall be fully enclosed and integrated into the architecture of the buildings. This requirement has been met. 2. Due to a utility easement along the front of the property it is not possible to plant street trees. The applicant has agreed to add additional trees in the front yard area instead. J. Parking. 1. Placing parking between the street right-of-way and a building shall be discouraged. This requirement is met. There is no parking between the building and the street. 2. No more than fifty percent (50%) of the parking on a site may be between buildings or in the side yards. This requirement is net. 50 percent of the parking is below ground. 3. Sufficient parking shall be provided to accommodate the reasonable hourly peak on a given site. Shared parking is encouraged to reduce land devoted to parking. Hourly variations among different types of land use may be considered when estimated parking demands. Not Applicable 4. Plantings shall be used to soften and shade parking lots and parking structures. Parking and service areas shall be visually screened from street views with plantings and architectural treatments. This requirement is met. The parking is adjacent to the building and landscaping and grade will shield it front view of the street. 5. Parking lot islands shall be used to distribute large parking fields into separate "outdoor" rooms that have visual relationship to the buildings they serve. Parking lot islands shall be planted with trees or include infiltration basins and plantings. Entry drives shall be defined by trees and shrubs. This requirement is not met, and flexibility has been requested. 6. A concrete curb shall be provided around the periphery of all parking lots and access roads, except where the City Engineer determines that a curb would impede drainage. Parking adjacent to streets should be screened from views with landscaping, including but not limited to trees, hedges, flowers and other bushes and/or decorative masonry walls. A traffic study shall be required for all new developments, redevelopments, and significant modifications to existing sites unless waived by the City Council. This requirement has been net. A traffic study has been ordered by the City and is enclosed. L. Lighting. Exterior lighting shall be provided for the safety and convenience of occupants and visitors. 1. A lighting plan shall be submitted that shows location, type of illumination and design. A photometric analysis of site and building shall be submitted for City approval with all new construction or redevelopment projects. This requirement has been met. 2. Exterior lighting shall be consistent in type, design, scale, and color to create unity in the Districts. High-pressure sodium lighting and other similar types of lighting color may be required by the City to promote a unified lighting color throughout the Districts. Other lighting colors may be considered during the City review process. This requirement has been met. 3. Exterior lighting for parking lots and buildings shall not be excessive and shall be directed at their intended purposes. This requirement has been met. 4. Lighting under a gasoline station canopy shall not be directly visible from the street but shall be recessed into the canopy or otherwise shielded. Not applicable. 5. Light washing of buildings and accent lighting may be permitted through the City review process provided that it does not negatively impact residential areas or traffic safety and is complementary to the district as a whole. Pedestrian and bicycle improvements shall be installed in accordance with the City of Arden Hills Comprehensive Plan and the local guiding plan and shall be in conformance with the following: 1. Site design shall facilitate pedestrian connections and mobility within and between building, sites, and uses by providing clear visual indicators through door placement, signage, striping, raised pathways, and integrating landscaping components. other features or materials may be considered that enhance and provide a safe pedestrian experience. This requirement is met. 2. A sidewalk shall link the primary entrance of each building on site with the public sidewalk network. In the event a building is subdivided into multiple separated tenant spaces, a sidewalk must link the primary entrance of each separated tenant space with the public sidewalk network. This requirement is met. 3. Bike racks shall be required near a public entrance of all buildings. This requirement has been met. Bike racks have been provided near the garage entrance and at each underground Barking stall. 4. Internal sidewalk systems shall connect with adjacent planned or developed public sidewalks or trails. This requirement is met. 5. The grades of all walks, parking spaces, terraces, and other paved areas shall conform to the requirements of the Americans with Disabilities Act. This requirement will be met. 6. Where there is new building construction or renovation where the renovation value is thirty percent (30%) or more of the pre -renovation value of the structure, a minimum six foot concrete sidewalk adjacent to or in all rights-of-way shall be provided. The location of the sidewalk shall be prescribed by the Public Works Director. The new sidewalks shall connect to sidewalks on adjacent properties if they exist. At the discretion of the City Council, the property owner may, in lieu of constructing the sidewalk, pay the City an amount equal to the cost of constructing the sidewalk to satisfy the obligations of this section. Said payment shall be used by the City to further maintain and construct the pathway system within the City. This requirement has been met. The applicant is proposing a 1,680 foot pathway along the south side of County Road F to connect their property with Lexington Avenue. When there is more than one building on a site, a sidewalk must link the primary building entrances of each building to one another. Not applicable. The plan must be approved by the Rice Creek Watershed District, other agencies as required, and the engineer assigned by the City. If a Planning Commission meeting should run beyond three hours a motion to extend the meeting and a majority affirmative vote from the Planning Commission would be required. November 30, 2009, City Council Meeting The City Council approved a motion to table planning case 09-020 for additional information. This application was from Clear Wireless for a CUP to install antennas on the existing Country Insurance building located at 2 Pine Tree Drive. This item will likely go back to the City Council at their December 14, 2009, meeting. The Planning Commission unanimously recommended approval of this planning case at the November 4, 2009, meeting. TCAAP Update On Wednesday, November 19, 2009, the GSA held a bidder's conference at Fort Snelling. The purpose of the meeting was to share information about the property with any and all parties interested in purchasing the entire 585 acre site for redevelopment. The meeting included a summary of the history of the property, and explanation of the known contaminants remaining on the site, and a discussion about the transfer process and how the GSA would ensure that all required clean up occurs. There were approximately 50 people in attendance. It is unknown how many were potential bidder's. Most of the City Council was in attendance. The Reuse Statement is attached to this update. The City is moving forward with beginning the process of adopting zoning standards for the property. Staff has begun working out how this process will unfold. More information will be provided as it is available. The Planning Commission will be part of the zoning process and will review and make a recommendation on any changes that are proposed to the Zoning Code. The City is also working with Ramsey County to determine how much of the 585 acres will be transferred to the County from the purposes of park and open space, including the Wildlife Corridor and Primer -Tracer areas. The City is also working on a north -south trail concept that will connect Highway 96 to the wildlife corridor. City Administrator Ron Moorse will be leaving the City on January 10, 2010. The City Council will appoint an acting City Administrator until an interim City Administrator can be found. The City Council has begun the process of recruiting a new City Administrator. The TCAAP site provides a unique opportunity to start with a blank slate and create a singularly exceptional new future for the site. The TCAAP Reuse Statement sets out the City's baseline expectations for the reuse of the property. It is the City's strong desire to work with a buyer who will use the City's expectations as a starting point, and will bring the creativity and commitment necessary to accomplish a truly exceptional development. The recently adopted 2030 Comprehensive Plan is set to guide the community over the next twenty years. The primary purpose of the Comprehensive Plan is to support and implement the City's vision: Arden Hills is a strong community that values its unique environmental setting, strong residential neighborhoods, vital business community, well-maintained infrastructure, fiscal soundness, and our long-standing tradition as a desirable City in which to live, work, and play. Arden Hills is a strong community with established neighborhoods, an extensive park and open space system, and stable business community. Except for the former Twin Cities Army Ammunition Plant (TCAAP) property, the City is almost fully developed. The TCAAP property occupies a significant portion of Arden Hills and its potential reuse offers both benefits and challenges. Reuse of the TCAAP property must be able to benefit the community and region without placing financial burden on existing residents. The General Service Administration (GSA), on behalf of the Army, is selling the land in an industrial condition. The condition of the property varies, and there are portions that meet, exceed, or are below the industrial condition. The City will expect the property to be remediated to allow for the land uses described in the Comprehensive Plan. The remediation must be in conformance with the Minnesota Pollution Control Agency (MPGA) requirements for the approved land uses. City of Arden Hills — TCAAP Reuse Statement November 18, 2009 Page 1 of 4 The 2030 Comprehensive Plan provides guidance for the future of the TCAAP property and includes the following goal for the reuse of the TCAAP property: Develop TCAAP in a way that accommodates a mix of land uses that is sensitive to the natural environment, economically sustainable, and a benefit to the community. The Comprehensive Plan will form the basis of the land use regulations; however, the City reserves the right to amend the Comprehensive Plan to ensure that the former TCAAP property becomes a positive contribution to the established part of the community and the region. The regulations will also need to recognize the inherent limitations of the property. The City is in the process of preparing land use regulations, densities, design standards, and a list of permitted uses for the TCAAP property. The 2030 Comprehensive Plan currently divides the TCAAP property into four land uses, which are shown on the attached future land use map and defined as: Mixed Residential (-240 acres) — provides for a variety of housing types and densities in close proximity, including single-family detached homes, single -attached homes, condominiums, townhomes, apartments, and senior housing options. The anticipated average density is 10.4 units per acre with a minimum average density of six units per acre up to a maximum density of 46 units per acre. This land use is designated for the proposed TCAAP redevelopment, and the density is subject to change once a final land use plan is selected. Mixed Business (-220 acres — areas designated for a variety of businesses, including commercial, certain light industrial uses, warehousing, office, general business, retail. This designation will be used for the future business uses on the TCAAP property. Park and Open Space (-76 acres) — areas designated as public parks. Park Preserve (149 acres) — areas designated as natural or scenic areas that are to be preserved for public use or open space. The "Mixed Residential" and "Mixed Commercial" categories have the potential to allow a broad variety of land uses. Additionally, the mixed residential and mixed commercial areas must also have accommodations for parks, open spaces, and pathways integrated with those uses. While the future land use boundaries and acreage may be adjusted depending on the proposal and benefit to the community, the future land uses are anticipated to form the basis of the zoning, design, and use regulations. City of Arden Hills — TCAAP Reuse Statement November 18, 2009 Page 2 of 4 Reuse Expectations and Considerations With any reuse scenario, the City has expectations that must be met. Additionally, it must be understood that there are other limitations that need to be considered when preparing a reuse concept. The following list of expectations is not all-inclusive and is not listed in order of importance: Expectations • An environmental plan that remediates all of the land to the required standards to accommodate the land uses outlined by the City. The plan will meet all Minnesota Pollution Control Agency and Environmental Protection Agency requirements, including financial commitments to ensure that all contamination remediation requirements are met. • Environmental remediation of the land in a timely manner is a top priority to the City. A reuse plan will need to include timeline information related to the remediation and redevelopment. A reuse plan that selectively uses or "cherry picks" parcels while ignoring other parcels will not be considered. • A bike and pedestrian trail corridor from the Highway 96 Regional Trail to the Rice Creek North Regional Trail to allow a connection to the southern portion of Arden Hills. • Substantial park and open space requirements will be incorporated within the mixed business and mixed residential uses to provide parks and open space areas and amenities to serve the community and the development. • The City will require designated park land, park land dedication, and/or park dedication fees. • The City has a tree preservation and landscaping ordinance in the Zoning Code. The City will expect substantial landscaping and trees, and the requirements may be enhanced for the TCAAP property. • All utilities, including electric service, will be installed underground. • All Rice Creek Watershed District requirements will be met. • The on-site storm water ponding could be incorporated into the open space amenities. • The redevelopment will incorporate green building and design principles where feasible, such as Leadership in Energy and Environmental Design (LEER) standards. This could include using the Army's water treatment process to develop a geothermal energy generation capability and/or the use of some land for solar or wind energy generation. • Buildings must be constructed from high-quality, long-lasting materials. • All roads and paths must meet City requirements if they are dedicated to the City. • The redevelopment must be able to pay its own way and demonstrate that its tax base will support the long-term maintenance of the on-site infrastructure and support City services including, but not limited to, police, fire, inspections, and maintenance of roads and parks. • A reuse scenario must seek to create a walkable environment that is pedestrian and bicycle friendly. City of Arden Hills — TCAAP Reuse Statement November 18, 2009 Page 3 of 4 • The residential and commercial areas must be connected by sidewalks and trails to each other and other parks and open spaces. Residential sidewalks and commercial sidewalks/trails will be privately maintained. • The reuse must consider opportunities for transit connections. • The design and construction of any bridge over Rice Creek must be coordinated with Ramsey County and respectful to the adjacent open space. • The Wildlife Corridor, the Primer/Tracer area, and a north -south trail corridor will be dedicated for park and open space related uses separate from any park dedication requirements. • All costs related to consultants to facilitate the redevelopment will be the responsibility of the developer. Additional Considerations • The City will seek to diversify its commercial tax base and generate high quality jobs (i.e. high technology, medical). The City is interested in a corporate campus to help diversify the City's existing commercial tax base. • The City will seek to establish viable retail groupings to enhance long-term sustainability. • The City will seek to provide a variety of housing options on the site to accommodate the current and future needs of Arden Hills. This may include affordable housing and market rate housing with a focus on owner occupied housing. • The City will seek to have uses that generate property taxes. • The City has not guaranteed the use of Tax Increment Financing (TIF) or any other type of financial incentive for the redevelopment of the property. • The only access points to the property are at County Road 96 just west of Snelling Avenue and at the intersection of Interstate 35W and County Road H. The development capacity of the TCAAP property is limited by the capacity of these two access points. The City does not have funds to upgrade these intersections. • All development and permitting fees in the City's fee schedule apply. • In addition to the Metropolitan Council sewer and water access charges, the City charges a sewer and water access charge. • The United States Army operates a network of wells, underground pipes, and a treatment plant to remediate the groundwater contamination. This groundwater treatment must be able to continue along side any redevelopment. • Additional information, such as environmental data, is an asset of, and available from, RRLD, LLC.
