The applicants have submitted an application requesting a Conditional Use Permit (CUP) to
install communications antennas and related equipment on the existing Country Insurance
building at 2 Pine Tree Drive. The City Council first reviewed this application at their
November 30, 2009, meeting. At that time, the City Council voted to table this item for
additional information, specifically the color coverage maps and the letter from the applicant's
engineer indicating why the City water tower sites were not feasible. Additionally, the Council
requested an independent engineer review the application to examine the proposed location at 2
Pine Tree Drive compared to the City water tower sites.
For the independent review, Staff contacted OWL Engineering, an independent engineering firm
that Roseville has used in the past in issues relating to cellular and wireless antennas. Staff
contacted Garrett Lysiak, of OWL Engineering and requested a quote. Staff provided Mr.
Lysiak with the requested information supplied by Clear Wireless regarding their application.
Mr. Lysiak prepared an engineering report analyzing the data for gaps in the existing and
proposed coverages based on antenna locations at the two City water tower sites and 2 Pine Tree
Drive (Attachment A).
While Clear Wireless may apply for an additional antenna location at 1296 County Road F in the
future, this application review is only for the proposed antenna at 2 Pine Tree Drive and must be
reviewed on its own merits. Approval or denial of this conditional use permit does not indicate
approval or denial of any other future applications for any other antenna sites. If Clear Wireless

moves forward with an application for the antenna at 1296 County Road F, the City will have
OWL Engineering prepare a review to determine if the same coverage can be provided at the
Fernwood Street or Red Fox Road water towers.
Application
The proposed antennas would be located in the center of the building, on top of the penthouse
roof structure, at a height of 73 feet. The related equipment would be located on the main roof
structure, to the southeast of the penthouse structure. The existing building, measured from the
penthouse, is 60 feet in height and the proposed equipment would extend 13 feet above this
elevation. Please refer to the Planning Case Report from November 30, 2009, for detailed
elevations and plans of the proposed antennas. Clear Wireless LLC would lease the required
space from Country Insurance.
The applicant has submitted an application, engineer letter, coverage map, and search ring map
explaining their proposal and addressing the location choice for the antennas (Attachment B).
Country Insurance operates under an existing CUP; however, the permit does not address the use
of antennas on the site. The Zoning Code requires a CUP for all antennas to be located in the
City. The proposed antennas would be accessory to the principal commercial use on the
property.
OWL EnOneerint! Review
Mr. Lysiak prepared an engineering report based on information and a system map provided by
Clear Wireless. As part of the report, Mr. Lysiak prepared:
• Figure 1 - An existing coverage map,
• Figure 2 - The Clear Wireless proposed coverage map including the proposed antenna at
2 Pine Tree Drive site (site 034),
• Figure 3A - A coverage map of the proposed antenna if it were located on the Red Fox
water tower instead of at Site 034.
• Figure 3B — A coverage map of the proposed antenna if it were located on the Fernwood
Street water tower instead of at Site 034.
• Figure 4 — A prepared future coverage map for Clear Wireless. Site 071 is Arden Tower,
located at 1777 Gateway Boulevard, and Site 451 is the Reiling Tower, located at 1296
County Road F. City approval has not yet been granted for either of these sites. A
building permit is required for additional antennas, up to a maximum of 31, on the Arden
Tower. A Conditional Use Permit will be required for any additional antennas at 1296
County Road F.

Mr. Lysiak's report concluded that if Clear Wireless installed antennas on either the Fernwood
Street water tower or the Red Fox Road water tower instead of at 2 Pine Tree Drive, a significant
gap in coverage would remain. This gap is indicated on Figures 3A. and 3B. It also indicates
that the gap in coverage is significantly reduced with antennas located at the proposed location at
2 Pine Tree Drive. Future applications to the City for additional antennas will be reviewed at the
time of submittal in the same manner.
Findings of Fact
The Planning Commission offers the following fourteen Endings of fact for review:
General Findings:
1. The applicant has submitted documentation that addressed the use of the City's water
tower sites. This documentation indicates that the water tower sites would not meet the
location needs to provide coverage in this area of the City.
2. The proposed antennas would be located on an existing structure.
3. The proposed antennas would be located within the B-2 — General Business District
Zone.
4. The proposed antennas would be at a height of 73 feet.
5. The antennas would be located approximately 380 feet from the nearest property line.
6. The antennas would be painted to match the color of the structure to which they are
attached.
7. Towers and antennas are a conditionally accessory use in the B-2 Zoning District.
On the Conditional Use Permit Evaluation Criteria:
8. The proposed plan would not have any impact on traffic or parking conditions.
9. The proposed plan will not produce any permanent noise, glare, odors, vibration, smoke,
dust, air pollution, heat, liquid or solid waste, and other nuisance characteristics.
10. The proposed plan will not impact drainage.
11. The proposed plan will not impact population density.
12. The proposed antennas will likely be visible from some locations both on and off the
property; however, they are not anticipated to have an impact on land use compatibility
with uses and structures on surrounding land or adjoining land values.
13. Park dedications are not applicable.
14. The proposed plan does not conflict with the general purpose and intent of the Zoning
Code or the Comprehensive Development Plan for the City.

Recommendation
The Planning Commission reviewed Planning Case 09-020 on November 4, 2009 and
unanimously recommended approval (7-0) of the Conditional Use Permit based on the findings
of fact and the submitted plans as amended by the following five conditions:
1. The project shall be completed in accordance with the plans submitted as amended by
the conditions of approval. Any significant changes to these plans, as determined by
the City Planner, shall require review and approval by the Planning Commission and
City Council.
2. A building permit shall be obtained for all proposed antennas prior to installation.
3. A building permit shall be obtained for all proposed structures prior to installation.
4. A Conditional Use Permit drafted by the City Attorney shall be signed by the
applicant and the property owner prior to the issuance of any building permits.
5. The antennas and equipment shall be painted to match the structure to which they are
attached.
Options
1. Approve the proposal as submitted.
2. Approve the proposal with conditions.
3. Deny the application with reasons for denial. If the City denies the petitioners request, "...it
must state in writing the reasons for the denial at the time it denies the request."
4. Table for additional information.
Deadline for Agency Actions
The City of Arden Hills received the completed application for this request on October 23, 2009.
Pursuant to Minnesota State Statue, the City must act on this request by December 22, 2009 (60
days), unless the city provides the petitioner with written reasons for an additional 60 day review
period. The City may, with the consent of the applicant, extend the review period beyond the
initial 120 days.

Engineering Statement
In reviewing the submitted data it was determined that additional information for nearby Clearwire
Communications telecommunications sites was needed in order to make a signal coverage study
determination. The requested information was provided and the data was 'analyzed. This analysis shows
how Clearwire Communications has designed its communications facilities in the Arden Hills area with
several surrounding sites providing area wide coverage.
Figure 1 shows the results of the coverage study analysis using the data for this proposed site in addition
to the data supplied by Clearx.,vire Communications for the nearby system sites. The analysis was then
repeated with the proposed site removed from the analysis in order to determine if there is any gap in
coverage in the Clearwire Communications system in the proposed coverage area. Figure 2 shows that a
gap in coverage does exist and is identified.
An area of concern expressed by the city was to determine if the two (2) existing water towers could be
used to provide the required coverage area for the Clearwire communications system. In reviewing the
locations of the water towers and the communications facilities locations, the water tower on Cummings
Park Drive (WTI) is too far to the north, from the proposed new Clearwire site and cannot provide the
required coverage area to eliminate the signal coverage gap. It is also predicted to cause harmful
interference to an existing site used by Clearwire.
The analysis was repeated using the Red Fox Road water tower (WT2) as the location of the
communications system. Figure 3 shows there would be a significant gap in coverage for the
communications system, It is also predicted to cause harmful interference to an existing site used by
Clearwire.
In reviewing the Clearwire communications system it is noted that they used a microwave system tV#
provide data and other required information between the various system' sites. The particular problem
with these microwave systems is that they require direct line -of -sight and path clearances between them,
This further complicates the location of system sites since they also have to consider this problem in
locating the various communications sites in their system.
In summary, the proposed communications site at 2 Pine Tree Drive eliminates a gap in coverage and the
use of the existing city water towers would not eliminate the gap in coverage for the Clearwire
communications system in the Arden Hills area.

This letter is to prove why Clearwire cannot lease space on the existing water towers at 121 CLIIIII-Ilings
Park Drive (45-04-13.24 / -93-09-06.53) and 1.1230 Red Fo/-%,, Road 93-09-09.22).
The alternative location is a Guyed tower and lattice tower in the same area 111LIC11 taller than the water
tower in that area. Since both water towers are very low in height compared to the guyed and lattice
tower, if we choose water tower we will lose coverage substantially immaterial of �.vliat design methods
we choose for our network.
I have provided a comparison Picture of RIF coverage maps to Steve TrUeniall, our Site acquisition 2UV')
showing our coverage objective and missing coverage if we choose water tower instead of Guyed/Lattice
tower. Blue shade IS Our coverage in the piCtUres.

CONDITIONAL USE PERMIT
CASE NO.09-020
1.0 Recitals.
A. Mutual Service Life Insurance Company ("Perm ittee"), fee owner of the
following real property in the City of Arden Hills, Ramsey County,
Minnesota ("Arden Hills"):
All of the Northeast one -quarter of the Northwest one -
quarter of the Northeast one -quarter (NE 1/4 of NW
1/4/ of NE 1/4) of Section 34, Township 30 North,
Range 23 West, except the following two (2)
described parcels:
A) The West one hundred twenty (W. 120) feet of the
East three hundred forty-seven (E. 347) feet of the
North two hundred eighty-three (N. 283) feet thereof;
and
B) The North three hundred forty-three (N. 343) feet
thereof lying West of a line, being a continuation of
the Westerly line projected on a Southerly direction, of
the West one hundred twenty (W. 120) feet of the
East three hundred forty-seven (E. 347) feet of the
North two hundred eighty-three (N. 283) feet of said
NE % of NW % of NE %.
B. On the 23rd day of October, 2009, Clear Wireless LLC, represented by
Steve Trueman ("Applicant"), submitted a completed application on behalf
of the Permittee requesting that it be granted a conditional use permit to
allow the installation of communications antennas and related equipment
in strict conformance with plans and specifications in the attached Exhibit
A (the "Project").
C. At a public hearing on the 4t" day of November, 2009, the Arden Hills
Planning Commission reviewed the Project, the report and
recommendations of the Arden Hills City Planner, the comments made at
the public hearing, and recommended approval of the conditional use
permit (the "CUP") for the Project subject to certain conditions.
2.0 Approval of CUP Amendment. On the 14th day of December, 2009, the Arden
Hills City Council considered the recommendations of the Arden Hills City
Planner, the recommendations of the Planning Commission, the effects of the
proposed Project on the health, safety, convenience and general welfare of the
owners and occupants of the surrounding land, and the community as a whole;
and passed a motion approving a CUP for Planning Case 09-020. The approval
of the City of Arden Hills is subject to the following conditions.
A. The Project shall be completed in accordance with the plans submitted as
amended by the conditions of approval. Any significant changes to these
plans, as determined by the City Planner, shall require review and approval
by the Planning Commission and City Council.
B. A building permit shall be obtained for all proposed antennas prior to
installation.
C. A building permit shall be obtained for all proposed structures prior to
installation.
D. The antennas and equipment shall be painted to match the structure to which
they are attached.
3.0 Compliance. Permittee hereby agrees to comply with the conditions of approval
for this Conditional Use Permit.
