EN HILLS MEMORANDUM DATE: January 25, 2010 TO: Mayor & City Council FROM: Meagan Beekman, City Planner SUBJECT: PC #10-001 Easement Vacation Arden Plaza 3585 Lexington Avenue North Back�round On July 13, 2009, the City Council approved Planning Case 09-011 for a Master Planned Unit Development (PUD), Preliminary and Final Plat, and Final PUD for Phase I of the Arden Plaza Redevelopment proposal. In the process of �ling the Final Plat Ramsey County informed the developer that there was an issue with one of the existing easements located on the property. The easement, as recorded with Ramsey County, describes an area that runs east-west along the northern portion of the Arden Plaza property. The easement is described as an Underground Electric Utility Easement and Pedestrian and Bicycle Way Easement. Minnesota Statute only allows drainage and utility easements to be recorded with a final plat. Easements for road or pedestrian ways are required to be dedicated as right of way. Since the easement in question is in part a pedestrian and bicycle way easement it is technically an easement for public way, the land affected by the easement would then need to be dedicated as a public way on the plat. The proposed site plan is situated such that dedicating this land as a public way would be a hindrance to the proposed development. The southerly line of the easement, especially the portion that juts to the south to go around the electric transformer box lies within the area that has been designed as the northerly drive isle around the proposed building to the drive up window, a retaining wall, and a stairway to the path along County Road E. It is the desire of the developer to keep these improvements outside the public right of way. The applicant has provided documentation illustrating the proposed changes. An easement vacation requires a public hearing before the City Council. The public hearing was noticed in the Shoreview-Arden Hills Bulletin prior to this evening's meeting. Recommendation Staff recommends approving the vacation of the easement, described in resolution 2010-005 (Attachment B), subject to the following conditions: 1. Arden Plaza shall record a new trail easement with the Arden Plaza Final Plat that encompasses the trail along the northern and eastern sides of the Arden Plaza Preliminary Plat. 2. Arden Plaza shall file the Final Plat within 60 days of the approval of this vacation request from the City. Requested Action Motion to approve Resolution 2010-005 for the vacation of the Underground Electric Easement and Pedestrian and Bicycle Way Easement on the Arden Plaza property subject to the two conditions in the January 25, 2010, Planning Case Report to the City Council. Deadline for Agenc_y Actions The City of Arden Hills received the completed application for this request on December 28, 2009. Pursuant to Minnesota State Statute 462.3 5 8 Subd 3.b, the City must grant �nal approval within 60 days of the completed submittal.
