ILLS MEMORANDUM DATE: February 3, 2010 Item l.A TO: Mayor and City Council FROM: Meagan Beekman, City Planner SUBJECT: Planning Case#09-003 Zoning Code Amendment Shoreland Regulation City_of Arden Hills Background The current set of shoreland regulations was updated in early 2002 to address certain requirements in the Minnesota Department of Natural Resources (DNR) shoreland regulations. While that ordinance update did address some of the technical requirements set by the DNR, there were a number of holes and unaddressed issues remaining after that update. Concurrently, Staff has been faced with a number of questions and concerns expressed by local property owners that are not explicitly addressed in the existing ordinance. These scenarios have introduced the need for greater clarification to the City's shoreland ordinance so that Staff may _ be able to promptly address common issues and concerns as they pertain to public waters and wetlands. Over the past year Staff has met with the Planning Commission, the City Council, and the community to discuss amending the City's Shoreland Regulations. Over the course of several work sessions, Staff was able to identify common goals shared by the Planning Commission and the City Council for the revised regulations. A community meeting was held on May 21, 2009, to discuss ideas for the amendments with those individuals who lived within the Shoreland District. Approximately 80 lake shore lot owners attended the meeting. Once the initial input was gathered, Staff began drafting the proposed amendments. As revisions were made the City website was updated with new information, and new drafts were emailed out to participants of the community meeting. The Planning Commission reviewed the proposed draft at both their July and August work sessions. At these meetings the Planning Commission discussed the proposed changes to the regulations and provided Staff with feedback. The goal was to broaden the context of which the amended regulations were drafted. In addition to internal discussion, Staff discussed the amendments with the City Attorney, the DNR, Ramsey County Conservation District, and the Rice Creek Watershed District. At their September 21, 2009, work session the City Council reviewed the proposed draft, made additional comments, and directed Staff to bring the ordinance to the Planning Commission for a public hearing and recommendation. At the November 4, 2009, public hearing a number of concerns and questions were raised by both the Planning Commission and residents. The Planning Commission voted to table the proposed Zoning Code amendments to a work session in order to further discuss the issue and provide direction to staff on how to proceed with the proposed amendments. The Planning Commission met at a work session on January 6, 2010, to discuss the concerns raised at the previous meeting. A revised draft was prepared based on the discussions at the previous work session. At that time Staff also included an amendment to the "Adjacent Lots"regulation based on input from the Planning Commission, researching neighboring communities, and internal discussions. On February 3, 2010, the Planning Commission held a second public hearing on the proposed regulations. The major concern brought up at that meeting was in regards to the "Adjacent Lots" regulation and in particular one aspect of the proposed amendment that would remove a shoreline property owner's ability to construct an addition within 50 feet of the lake when adjacent properties exceeded this amount. The proposed language would require all new construction to meet the average setback of the adjacent properties, minus ten feet, as illustrated in Attachment A. The Planning Commission, while agreeing that the vast majority of the proposed changes would be to the benefit of the community as a whole could not find consensus on the adjacent lot change in the ordinance. The Planning Commission chose to move the ordinance forward to the City Council with no recommendation. Proposed Amendments Definitions (Attachmentd Amended pages from Section 1305 have been included in this packet. These are the definitions that are proposed to be added or amended with the adoption of the Shoreland Management Ordinance. Most of the changes come directly from the DNR regulations and are required to be changed to bring the City regulations into compliance with the DNR. A number of definitions have been deleted that are not used anywhere in the City's ordinance. This section includes the most number of changes. The changes were included to reflect current DNR regulations, clarify current enforcement practice in the shoreland area, and to reflect growing concern amongst City Council and other residents about issues facing the shoreland. Revisions to the draft since the November 45 2009, meeting have been highlighted. Below is a list and summary of changes made to the Shoreland Regulation Section 1330. Staff also has prepared a handout with diagrams that summarizes the proposed changes (Attachment A). 1. Purpose—A purpose statement was added that clearly lists the goals of Section 1330. 2. Adjacent Lots— Staff is proposing an amendment to the regulation that addresses construction on lots when there are two adjacent developed lots that exceed the minimum setback to the lake (50 feet on Lake Johanna). The proposed regulation would require that new construction, and additions to existing homes, have a minimum setback that meets the average setback of the two adjacent lots minus ten feet. The existing regulations require new homes in this situation to meet the average setback - of the two adjacent properties; however, additions to homes need only meet the minimum setback to the lake. In essence this has created a"loophole"within the Code. The proposed amendment would remove the loophole that allows additions to be constructed up to the minimum setback line, thus reducing property rights that lakeshore lot owners currently enjoy. In order to inject some flexibility into the Code, Staff is proposing that all new construction, including additions, meet the average of the two adjacent homes, minus ten feet. A ten foot expansion would continue to protect sightlines for neighboring properties owners, but allow lakeshore lot owners some flexibility when improving their properties. Dwellings would still be required to meet the minimum lake setback. The fact that most properties around the City's lakes are nonconforming in some way makes improving lots difficult. Many lots are substandard and have homes that already encroach into the existing setback requirements. One of the questions that the City must grapple with is how to address the balance between maintaining the quality of housing stock and community character that Arden Hills' enjoys while still allowing people to continue to improve their homes. Staff feels that the proposed amendment allowing the "minus ten feet" flexibility provides a middle ground that maintains the site lines of homes on the lake while allowing existing lakeshore lot owners to improve their homes if they choose. 3. Exceptions to Structure Setbacks—The proposed regulations broaden and clarify what structures are permitted within the normal structure setback to the lake. Additionally,patios, stairways, access lifts, landings, fences, and one accessory storage shed are now permitted within the structure setback to the lake under certain circumstances. a. Patios—A regulation permitting uncovered patios within the structure setback to the lake, under certain circumstances, has been added to the regulations. The patios must be uncovered, located at grade, and remain outside of the Shore Impact Zone. b. Stairway landings—The proposed ordinance limits the square feet of landings within the Shore Impact Zone to 40 feet. c. Storage sheds—The proposed ordinance permits one accessory storage shed within the structure setback to the lake provided that it is not located within the shore impact zone (25 feet on Lake Johanna) and does not exceed 64 square feet in size or eight feet in height. The structures can be connected to electricity and lighting is permitted. Separate regulations within the Code limit glare as a nuisance. 4. Dock setbacks—The proposed regulations include a five foot setback for dock placement - at the shoreline. There is also an added provision that would allow the Zoning Administer to alter this regulation if topography or lot width created a significant limitation on dock placement on a particular lot. 5. Mitigation—A mitigation plan similar to the one used by Shoreview has been added in place of the permeable surface credit that was proposed previously by Staff. The new language would require all properties seeking special approval from the City through a variance or conditional use permit to provide a mitigation plan to the City. The mitigation plan would also be required if a property wanted to increase the impervious coverage by up to five percent with a pervious hard surface. Performance Standards (Attachment Q Section 1325.07 included regulations on lakefront lots; however, that section has been removed from Section 1325 and reincorporated into Section 1330. These regulations have not otherwise been altered. The City is proposing a number of amendments to these regulations in order to bring the City's regulations into compliance with DNR standards, improve water quality, increase the enjoyment of the lakes for everyone in our community, and clarify the language to make en- forcement of the Citv's regulations an easier task. Below is a brief summary of the most notable changes being proposed. Summary of Proposed Changes to Section 1330, the City's Shoreland Regulations Shore Impact Zone-This is a new definition within the regulations that refers to the land located between the lake and one-half of the structure setback. In the case of Lake Johanna, the lakeshore setback is 50 feet, so the Shore Impact Zone would be the first 25 feet along the shoreline. Exceptions to Structure Setback Requirements -The proposed regulations would now allow docks, fences,stairways, accessibility-lifts, patios; and landings within the Shore Impact Zone, under certain condi- tions. The current City-regulations do not expressly allow these items; however, it has been practice to allow them in the past. Additionally, the proposed regulations include language that would now permit up to one accessory storage shed mthin the lakeshore setback under certain circumstances. Adjacent Lots — The existing regulations treat the construction of new homes and additions to existing homes differently. Under the existing regulations, a new home cannot be closer to the lake than the average setback of the two adjacent homes. The primary-purpose of this limitation is to protect the views of the lake for existing homes. However, a loophole in the existing regulations allows additions to be constructed up to the minimum structure setback line regardless of the two adjacent homes. The proposed regulations require - that new homes, and additions to existing homes, meet the average setback of the two adjacent lots minus ten feet. This change removes the loophole for additions but provides some flexibility for lake lot owners to improve their homes. The minimum structure setback to the lake would still apply regardless of the setbacks of adjacent homes. For an illustration, please see the other side of this document. Maintenance of the Shoreland — The proposed regulations would require items (i.e.; bouts, boatlifts, docks) that are in a state of disrepair or inoperable be prohibited from being stored outdoors. The proposed ordinance does not include specific restrictions on storing non-motorized watercraft,such as canoes,kayaks, etc. Dock setbacks —The proposed regulations include a five foot setback for dock placement at the shoreline. The Zoning Administrator may alter this regulation if topography or lot width created a significant limitation on dock placement for a particular lot. Permeable Surface Credit —The proposed regulations would permit permeable surfaces in excess of the maximum hard cover requirement, in direct proportion to the permeability of the surface, in exchange for an approved mitigation plan. Permeable surfaces can be a green component to building projects. Mitigation Plan — The proposed regulations would require all properties seeking special approval from the City through a variance or conditional use permit to provide a mitigation plan to the City_ The mitigation plan would also be required if a property wanted to use the Permeable Surface Credit. The uncontrolled use of shorelands of-within the City of Arden Hills affects the public health, safety and general welfare not only by contributing to pollution of public waters, but also by impairing the local tax base. Therefore, it is in the best interest of the public health, safety and welfare to provide for the wise development of shorelands of public waters. The Legislature of Minnesota has delegated responsibility to the municipalities of the State to regulate the subdivision, use_,. and development of the shorelands of public waters and thus preserve and enhance the quality of surface waters, preserve the economic and natural environmental values of shorelands, and provide for the wise utilization of waters and related land resources. This responsibility shall hereby be recognized by the City of Arden Hills. Subd. 2 Purpose. For streams, by an evaluation of available flood information and consistent with "Statewide Standards and Criteria for Management of Flood Plain Areas of Minnesota." Subd.4 Adjacent Lots. Where two existing adjacent dwellings have shoreline setbacks that exceed the minimum setback from the ordinary high water level by ten (10) or more feet, the shoreland setback for a new dwelling unit, or an addition to a dwelling, shall not be less than the average of the shoreland setbacks for such existing adjacent dwellings minus ten 10 feet. However, in no case shall the new structure or addition be within the minimum setback from the ordinar.�gh water level as stated in Section 1330.03 Subd 1. Subd. 5 Exceptions to Structure Setback Requirements. No structure shall be placed within the structure setback requirements of the shoreland management district. The following_are not classified as structures for the purposes of this section: A. "k.7"h�uses; einc., Docks and Boatlifts. Location of docks and boatlifts shall be controlled by applicable State and local regulations. B. Stairways, access lifts, and landings. Stairways and access lifts are the preferred alternative to major topographic alterations for achieving access up and down bluffs and sty slopes to shore areas. Stairways, access lifts and landings located within the Shore_ aet Zone shall meet the following design standards 1. Landings for stairways and lifts shall not exceed 40 square feet in area. 3:-2. Canopies or roofs are not allowed on stairways, access lifts or landings. C. An escrow fee that shall be held for a minimum of two years shall also be submitte 61. The mitigation plan shall include at a minimum two of the following practices. 1. Vegetation Restoration. Vegetation restoration areas m y_ be established which at a minimum shall include land within the shore and the bluff impact zones or steep slopes. Land area shall be restored from lawn beach or other disturbances using native or natural landscaping. a. _Steep Slope/Bluff Restoration. Steep slopes and bluffs that are v etated with turf may be restored with deciduous and ornamental trees, evergreens and shrubs that are native to the area. b. Shoreline .Buffer Restoration. A buffer zone of at least 25 feet from and parallel to the ordinary high water mark shall be planted or restored and maintained with vegetation native to the area to fullest practicable extent possible with effective erosion and sediment control. Exist__ ing natural beaches or beaches which have been permitted by the DNR shall be allowed to continue and be maintained. A minimum of 30 percent% of the lot's shoreline area shall be restored. This restoration area shall be contiguous unless otherwise approved as part of the mitigation plan. 2. Architectural Mass. The use of natural color(s) and/or materials on the exterior of the structure shall be used to reduce the visual impact. Natural colors are shades of brown, gray, and green. Natural materials include wood or stone that complement the setting of the structure. 3. Removal of Nonconforming Structures. The mitigation plan may include the removal of structures that do not comply with the required structure setbacks from the ordinary high water line or are located within a shore impact zone or bluff impact zone. 4. Reduction of Impervious Surface Coverage. The mitigation plan may include a minimum five percent-°% reduction of the existing impervious surface _coverage.,The preferable location of this reduction is within that portion of the lot that drains to the lake. No land shall be subdivided which shall be held unsuitable by the City for the proposed use because of flooding, inadequate drainage, soil and rock formations with severe limitations for development, severe erosion potential, unfavorable topography, inadequate water supply or sewer access, or any other feature likely to be hannful to the health, safety, or welfare of future residents of the proposed subdivision or of the community. Planning Case 09-003; Zoning Code Amendment Regarding Shoreland Regulations; City of Arden Hills—Public Hearing City Planner Beekman reported that the proposed amendments impact three sections of the Zoning Code. She then provided background information and stated the purpose of this update is to clarify the regulations, introduce a reasonable amount of flexibility for unique situations, and enhance the City ability to enforce the regulations. She reviewed the existing regulations and the proposed amendments in Sections 1305.04, 1330, and 1325.07 and stated Staff is recommending the following two revisions: 1. Section 1330.031 Subd. 1 — Note should refer to Section 1330.03, Subd. 4, rather than Subd. 5. 2. Section 1330.031 Subd. 4 — the words "or more'' should be removed from the first sentence. Chair Larson opened the floor to Commission questions. Commissioner Holewa asked for clarification on the Section 1330.03, Subd. 4. City Planner Beekman explained that a new home construction or new addition would need to meet the average setback of the two adjacent homes minus ten feet. This is to protect the sight lines of the properties. Commissioner Holewa asked if other cities have this type of language in their codes. City Planner Beekman stated that other cities do have similar language. The language being presented is modified from the..Shoreview regulations and the "minus ten feet" language was used in that City's ordinance. Commissioner Modesette asked if the"minus ten feet" was a common distance in other cities. City Planner Beekman stated she did not find any cities that used a greater distance than ten feet. She clarified that the intent of this regulation is to create a minimum setback and that homes could always be constructed with a greater setback to the shoreline. Commissioner Holewa clarified if three houses were twenty feet from the lake and the middle home was reconstructed, it would have to meet the fifty foot setback amount versus the twenty feet it was previously at. City Planner Beekman explained that State Statutes regarding non-conforming structures would apply and this states that the home could be unproved, replaced, or repaired but it could not be expanded in any way. The home could be rebuilt at twenty feet from the lake if they used the exact same footprint of the original house. If the homeowner wanted a larger home then they would need to meet the fifty foot setback. Commissioner Thompson asked for clarification regarding the removal of vegetation. City Planner Beekman explained that trimming of vegetation was permitted but clear cutting was not. If the soil is exposed then erosion control measures would need to be taken as long as the soil is exposed. This is further explained in Chapter 15 of the City Code regarding grading and erosion. Commissioner Holewa asked if this planning case were approved if it would go to the City Council for approval_ City Planner Beekman explained due to the complexity of the planning case the City Council will be reviewing it at a work session before approving it. If a recommendation is made by the Planning Commission the City Council will review the planning case at their February 16 work session and depending on this meeting could go to the City Council for a vote at their February 22, 2010, meeting. Chair Larson opened the public hearing at 7:12 p.m. Chair Larson invited anyone for or against the application to come forward and make comment. Mr. Mark Johnson, 3124 Hamline Avenue N, Arden Hills, expressed concerns about the setback towards the lake. He stated that the language including the "minus ten feet" allowed homes to move closer to the lake. This would have an adverse effect on other property owners and their sight lines. Mr. Steve Nelson, 3475 Siems Court, Arden Hills, stated concerns that the front and side setbacks are not being addressed by the regulations. He also stated that grade changes that are created by bringing in additional fill are not addressed by the regulations. Ms. Ann Stanton, trustee to the property at 1569 Edgewater Avenue, stated she supports the setbacks but does not agree with the "minus ten feet" language. This would reduce the setbacks even more. She stated that this amendment would adversely affect the lakeshore owners. She clarified that she supports the initial efforts that the City made in closing a loophole for new homes and additions. Changing the code will change the setback. Michael Mergens, Larkin Hoffman, representing Mr. and Mrs. Bauer at 1563 Edgewater, presented the Commission with a visual that illustrated the"creeping" of homes toward the fifty foot setback using the"minus ten feet" language that is currently being proposed in the regulations. He stated. the City could have flexibility with the other setbacks but should remove this language from the shoreline setback. Angela Hames, 1839 Venus Avenue, Arden Hills, stated she is supportive of the language being proposed. This would not have a negative impact on the property value of neighboring homes as has been presented. New home buyers would see it as a positive that they could build closer to the lake by utilizing the setbacks of the adjacent properties. She also agrees that the same standards should be applied to new constructions and additions. She further clarified that any "creeping" that would take effect would not happen overnight, but over several decades. Chris Stanton, Arden Hills, stated every neighborhood has its own character and the character of the neighborhood on Edgewater Avenue is one with large backyards and no fences. If homes were allowed to move toward the lake this would reduce the backyard size and also the sight lines that are enjoyed by the residents of this neighborhood. Mary Ellen Stanton, Arden Hills, stated if one home moves closer to the lake this would affect the views of the entire neighborhood on Edgewater Avenue. Chair Larson closed the public hearing at 7:40 p.m. Commissioner Holewa asked City Planner Beekman if it were possible for homes to ``creep'' closer to the lake over time. City Planner Beekman stated this was a possibility. Commissioner Zimmerman stated he would support the regulations but he does not support the "minus ten feet" language. He clarified by stating the language was not necessary. Commissioner Modesette stated she would support the"minus ten foot" language. This provides the City with greater flexibility to new home constructions within existing neighborhoods. Commissioner Reiff stated he would agree with Commissioner Modesette. He stated the City should not be too restrictive and even without the"minus ten foot" language the effect of homes "creeping"toward the lake will happen. Chair Larson pointed out that the only portion of the proposed regulations is the "minus ten feet" in Section 1 330.03, Subd. 4. He asked if the City Council would be having a public hearing regarding this planning case. City Planner Beekman stated that this was the public hearing and the City Council would not be having another one. Commissioner Holewa pointed out that during the discussions on the Comprehensive Plan it was noted that Arden Hills is an aging community. As people get older they have less money and may not be able to rebuild their homes closer to the lake as the homes surrounding them do. He stated this would not be fair to the homeowner who did not have the resources to build closer to the lake. Chair Larson stated that the regulations are being reviewed and updated in order to clarify points. Commissioner Modesette pointed out that no matter what the regulations will not satisfy everyone. While the Stantons are generally supportive of efforts to close potential loopholes in the Adjacent Lot Setback Rule, they object to two phrases of the recently proposed language as unnecessary and against public interest. Specifically, the Stantons object to the recent changes in the definition of adjacent dwellings to include "two or more" dwellings and the language that would allow new dwellings or additions to be built 10 feet closer to the lakeshore than-existing adjacent dwellings. Other than the phrases "or more" and"minus ten (10) feet," the Stantons support the proposed amendment. Adjacent Lot Setback Rule and Evolution of Proposed Amendment As it sits today, the Adjacent Lot Setback Rule states: Adjacent Lots. On undeveloped shoreland lots that have two (2) adjacent lots with existing principal structures on both such adjacent lots, any new residential structure may be set back the average setback of the adjacent structures from the ordinary high water mark or fifty(50) feet, whichever is greater, provided all other provisions of the shoreland management districts are complied with. Since at least May 2009, the City has been considering an amendment to the Adjacent Lot Setback Rule as part of a broader update of shoreland regulations. As the matter has come before the Planning Commission on July 8, 2009,November 4, 2009, and February 4, 2010, the stated purpose of the review was to alleviate "a number of holes and unaddressed issues remaining" in the shoreland regulations following a 2002 update. In November 20091, City Staff prepared relatively minor, but important, proposed changes to the Adjacent Lot Setback Rule as follows: Arden Hills, Minnesota 55112 February 2, 2010 Page 2 Adjacent Lots. On shoreland lots that have two (2) adjacent lots with existing principal structures on both sides, any new residential structure shah be set back the average setback of the adjacent structures from the ordinary high water level or the structure setback for the lake, whichever is greater, provided all other provisions of the Shoreland Management Districts are complied with. The Provision may be modified by the City's Zoning Administrator for unique topographical features. The minutes of the November 41 2009 Public Hearing show that, other than question of what fell within the term"structure," there was little discussion or opposition to the proposed changes to the Adjacent Lot Setback Rule. Specifically, there was no request to allow new dwellings to be built closer to the shoreline than the two adjacent homes, or to base the average setback on more than the two adjacent dwellings, which appears to have traditionally been calculated using the "string line" approach. Despite the lack of opposition to maintaining the shoreland setback based on a string line approach of the two adjacent home, the new proposal, issued just last week, is to dramatically amend the Adjacent Lots Setback Rule to read as follows: Subd. 4 Adjacent Lots. Where two or more existing adjacent dwellings have shoreline setbacks that exceed the minimum setback from the ordinary high water level by ten (10) or more feet, the shoreland setback for a new dwelling unit, or an addition to a dwelling, shall not be less than the average of the shoreland setbacks for such existing adjacent dwellings minus ten (10) feet. However, in no case shall the new structure or addition be within the minimum setback from the ordinary high water level as stated in Section 1330.03 Subd 1. Addition of the Phrase "Two Or More" and "Minus Ten (10) Feet" Are Neither Necessary Nor in the Public Interest. According to the City's Procedural Manual, the required submissions for a zoning code amendment includes a statement as to why the proposed amendment is "necessary and in the public interest." Given the significant changes that are being proposed for the Adjacent Lots Setback Rule, the proposed changes should meet this same standard to demonstrate it is not arbitrary, capricious, or unreasonable. See, e.g., In re Excess Surplus Status of Blue Cross & Blue Shield of Minn., 624 N.W.2d 264, 277(Minn. 2001) (appellate court may reverse an administrative decision if it is not supported by substantial evidence or is arbitrary and capricious); Horbal v. City of Ham Lake, 393 N.W.2d 5, 7 (Minn. App. 1986) (holding courts determine whether the zoning action was "reasonable and not arbitrary or capricious in light of applicable zoning ordinances"). Under the relevant dictionary definition, "adjacent" means " having a common endpoint or border<adjacent lots><adjacent sides of a triangle>" www.merriam- webster.com/dictionary/ad acent(last visited February 1, 2010). On a linear plane, such lots along a shoreline, a lot can have only two other lots that have lake frontage and share common boundaries. Therefore, applying the accepted dictionary definition of adjacent, there cannot be more than two adjacent dwellings. But if the common dictionary meaning is not going to be used, which will happen if the "or more" language is adopted, it will create a question of what is the meaning of"adjacent." If "adjacent dwellings" is not properties with common borders, then what is the limit? Adopting such language will simply create many more questions than it answers.. For example, would a dwelling three lots away from an applicant's lot be considered an adjacent dwelling for purpose of Rule? Further, if more than 2 dwellings are used, how is the average measured? If it the City intends to continue use of the string line test, how is that accomplished with more than two dwellings? Where can be perhaps no better demonstration of the problems adding"or more" creates then the recent variance request for 1563 Edgewater Avenue. In their application, the new owners of Lot 14 requested the average shoreland setback be determined by using a string line from what was described as Lot 13 and Lot 161 conveniently leaving Lot 15 out of the string line average. Lot 16 is an anomaly from what is an otherwise consistent neighborhood setback of approximately 100 feet. Using a string line average from Lot 16 to Lot 13 would result in an substantially different"average" setback than a string line average between Lot 15 and Lot 131, or the median average of all dwelling setbacks in the neighborhood. In fact, allowing what most would consider the non-adjacent Lot 16 to be used to calculate the average setback of Lot 14 could, depending on the method, provide Lot 14 with a substantially different setback standard than nearly any other property along Lake Johanna; arguably creating a spot zoning effect. Given the uncertainties "or more" creates, a court would have little difficulty declaring the language to be ambiguous. As a matter of law, any ambiguity in the Zoning Code would be construed against the City. See Amcon Corp. v. City of Eagan, 348 N.W.2d 66 (Minn., 1984). Amending a clear section of the Adjacent Lot Setback Rule in a manner that creates ambiguity is neither necessary nor in the public interest. i In discussingthe proposed changes the Adjacent Lots Setback Rule the February 3 2010 p p g J � Y Memorandum to the Planning Commission states, "Staff is proposing an amendment to the regulations that addresses construction on lots with two adjacent developed lots." (Emphasis added). Further, the Stantons were unable to locate any Planning Commission Meeting Minutes that contain a discussion that there should, or could, be more than two adjacent homes for purposes of determining the shoreland setback average. Arden Hills, Minnesota 55112 February 2, 2010 Page 4 b. History Does Not Suggest That The "Minus Ten (10) Feet" Language Is Necessary to Allow a Proper Use of Lake Front Lots. For the lots along Edgewater Avenue that front on Lake Johanna(the "Edgewater Neighborhood"), the existing Adjacent Lot Setback Rule has resulted in a nearly uniform shoreland setback of approximately 100 feet.2 As new homes have been built in the Edgewater Y Neighborhood, the owners have honored the Zoning Code and maintained a consistent shoreland setback of approximately 100 feet. What this shows is the lack of a general need to allow new dwellings or additions to move 10 feet closer to the shoreline. On the other hand, if the "minus ten(10) feet" language is directed at a particular project or projects rather a general need, then the proposed amendment would fall with the purview of the Minnesota Environmental Policy Act("MEPA"), or may run afoul of the prohibition on spot zoning. p. See Minn. R. 4410.4600, subp. 26.3 At this point, it is unclear from the record what the driving force behind the "minus ten(10) feet" language is since it was unveiled mere days ago and there has been no public discussion of the language.. But if the action is not exempted from MEPA, it may call for environmental review because a reduction in shoreland setbacks for structures will reduce the shore impact zone, which is defined as the"land located between the ordinary high water level of a public water and a line parallel to it at a setback of 50 percent of the structure setback." Minn. R. 6120.2500, subp. 14c. In certain cases, impacts to shore impact zones require mandatory environmental assessment worksheet. Minn. R. 44 10.10001 subp. 2 and 4410.4300, subp. 36a. Of course, more information would be needed before any determination could be made whether the proposed amendment comes within the purview of MEPA or whether any form of environmental review is required or appropriate; however, it is an issue that needs to be flushed out given the lack of available information on the inclusion of the "minus ten (10) feet" language. C. Allowing New Dwellings or Additions to Existing Dwellings to Reduce the Shoreland Setback, And Consequently the Shore Impact Zone, Is Not in the Public Interest. When the City began the process of potentially amending the Adjacent Lot Setback Rule, the purpose was to eliminate what the City considered a loophole because the Rule referred to "undeveloped shoreland lots." Based on the Ad'lain language of the Adjacent Lots Setback Rule, it is designed to assure that sight pJ lines of lake and shoreline from existing homes are maintained. It cannot be forgotten that lakeshore homes are generally designed to maximize lake views, are built with the expectation that other builders will likewise be held to the same standard, and have a value that is inextricably tied to lake views. The public interest is best served by maintaining these investment-backed expectations. In addition, having a hard setback line is the only way to maintain the character of existing neighborhoods that have substantial green space between dwellings and shoreland. Significant and consistent ace green s provides for a more aesthetically pleasing views, both looking in from g p the lake and outward from shore, plus the potential for enhanced public safety. The increased green space can also lead to improved water quality of City lakes by limiting the amount of imperious surfaces and by having greater pervious areas between dwellings and lake shore to absorb and filter runoff. --- In contrast, if the concern driving the "minus ten(10) feet" language is unique topographical features of a particular lot that need a shorter setback, such concerns are properly addressed by seeking a variance. In the variance procedure, the City has the opportunity to review the specifics of anyp articular case to determine whether there are topographical features that justify p moving closer to the shoreline while assuring any such change is done in a manner that maintains the character of the neighborhood and the spirit of the Zoning Code. The same simply cannot be said for a blanket amendment of"minus ten(10) feet" for any new construction, which will foster a race to the 50-foot setback mark. Conclusion Rather than create new questions and new issues, the City needs to stay focused on what is necessary an n d i the public interest. For the Adjacent Lots Setback Rule, that means adopting an amendment that fix the potential"addition loophole" while preserving the character of existing lakeshore neighborhoods and the expectations of those that have invested their hard earned dollars to construct homes, in reliance on the Zoning Code, that maximize lake views. To accomplish those goals, the Stantons recommend the following deletions (strikethrough) in the proposed amendment to the Adjacent Lots Setback Rule should be as follows: Subd. 4 Adjacent Lots. Where two or-mere existing adjacent dwellings have shoreline setbacks that exceed the minimum setback from the ordinary high water level fnefe the shoreland setback for a new dwelling unit, or an addition nonconformity." Based on the basic grammar, an addition cannot be added to a nonconforming structure since it would undeniably cause the dwelling to occupy a greater area or height on the lot. The Stantons are generally supportive of efforts to close potential loopholes in the Rule. But they, like many other residents of the City, object to the recently proposed"minus ten(10)feet"language I that would allow new homes or additions to be built 10 feet closer to the lakeshore than existing adjacent homes, effectively violating the setback.2 So there is no question,the Stantons are not here to stand in the way of development. Indeed,the evidence shows that many lakeshore lots are being redeveloped consistent with the present Rule. Like so many of their neighbors,the Stantons take issue with language that, while unnecessary for redevelopment,will have significant negative impacts on existing homeowners and overall lake quality. 1 In advance of the February3 2010 Planning Commission Hearin (the"Public Hearin "� g g Hearin""), the undersigned counsel submitted a February 2, 2010 letter containing an objection to language defining adjacent properties to include"two or more"properties. The"or more" language was editorially deleted from the proposed amendment by City staff prior to the Public Hearing and was,therefore, not a point of discussion. The Stantons assume that"or more"is no longer before the Council with the proposed amendment. But if it is going to be considered,we refer the Council to the discussion in my earlier letter demonstrating its impropriety and our stated objections. 2 The"minus ten(10)feet"lan a e was the oint of considerable debate at the Public � g p Hearing, including my February 2, 2010 letter. The objections raised in that letter remain and I would refer the Council to that letter for additional discussion. The point of this letter is to provide additional information to assist the City Council in reaching a proper decision. Arden Dills City Council February 11, 2010 Page 2 a. There Is No Evidence of a Need for the"minus ten (10) foot"Language. Because the Adjacent Lots Setback Rule presently refers to "undeveloped shoreland lots"the City was concerned that the Rule, as written,contains a loophole that would allow additions to existing homes to be built closer to the lakeshore than new homes. Closing this loophole and clarifying what"structures"must meet the setback requirement were the stated reasons to amend the Rule. The"minus ten(10)feet"language is wholly unrelated to, and unnecessary to accomplishing these goals. The potential loophole can quite easily be closed with amendments to existing language as follows(idelti and additions)and definitional clarifications of "dwelling": Adjacent Lots. On shoreland lots that have two (2) adjacent lots with existing* ' -es dwellings on both such ad j acent lots, any new residential stf u etur-e dwelling unit,or an addition to an existing dwelling,may shall be setback at least the average setback of the adjacent stmetw e dwellings from the ordinary high water mark or fifty(50)feet,whichever is greater, ---- provided all other provisions of the shoreland management districts are complied with. The only apparent basis for including the "minus ten(10) feet"language is a perceived need to have flexibility to allow development to occur. A review of the evidence,however, quickly dispels this perceived need. There is no evidence in the public record evidencing a need or request to allow new homes or additions to move 10 feet closer to the lakeshore than the adjacent homes. The language was not introduced to the public until mere days before the Public Dearing and at a time when many lakeshore owners were not home to receive notice of the change or to submit comments. Yet, even under those circumstances,the vast majority of public response has been to oppose the"minus ten(10) foot"language. More importantly,there is no evidence to support a conclusion that such language is necessary to allow redevelopment of lakeshore property with new,modern homes. In fact,the opposite is true. Redevelopment of existing lots with new, large,modern homes has occurred without the need to move 10 feet closer. For example,in the Edgewater Avenue area of Lake Johanna, homes have recently been built at 1505 Edgewater Avenue(1999) and 153 5 Edgewater Avenue (1997)that maintained the adjacent lot setback of approximately 100 feet . Attached hereto are PID Reports for both homes showing basic characteristics of the homes and their assessed values. Further,I have conducted a preliminary plat search of other areas of Lake Johanna. Even this cursory search revealed that significant redevelopment with large home has occurred under the existing Adjacent Lot Setback Rule. I have attached hereto PID Reports for some of the new homes (post 1990)that have been built on Lake Johanna. while this is not a complete or thorough analysis of lakeshore development in the City, it is undeniable evidence that new homes can be, and have been,built without the need to move 10 feet closer to the Lakeshore. Arden Hills City Council February 11,2010 Page 3 b. The"Minus Ten (10)foot"Language Is Not in the Public Interest. On the other end of the scale is the negative effects to existing homeowners and lake quality that will result from allowing new home after new home to creep 10 feet closer to the minimum 5 0- foot setback,3 Lakeshore homeowners position their homes and design layouts to achieve the best sightlines and lake views This includes numerous recent new homes whose owners have expended significant resources to construct homes consistent with neighboring lakeshore setbacks. The plain purpose of the Adjacent Lots Setback Rule is to assure that existing lakeshore owners who have invested their hard earned dollars to maximize their lake view will not have those views blocked every time a neighboring lot is redeveloped. But if the Rule is amended to allow the 10- foot creep towards the shoreline, existing homeowners who wish to maintain their open sightlines and wide lake views would be left with only one option: move closer to the lake and hope that their neighbors do not in turn move even closer. Of course,many lakeshore residents do not have the desire or financial wherewithal to redevelop or expand their homes. And even if there were unlimited resources to continually remodel or replace existing homes,it simply is not --- good public policy to force existing homeowners to continually expend significant amounts of money just to maintain what they have today. Finally,the Stantons would like to address a suggestion that the"minus ten(10) feet"language will increase property value as suggested by a real estate agent during the Public Hearing. In my practice,I focus considerable time on real estate valuation and I do not agree with the overly broad claim that property values are generally based on redevelopment potential. Assessed values are generally determined based on the value of the existing improvements and the value of the land with those improvements in place. It is hard to imagine how the value of an existing home is not reduced when what had once been a view of green space and lakeshore is now completely blocked by a neighboring home. Further,as a matter of basic appraisal techniques, the only time that the"redevelopment"approach to valuation would be proper is when the value of the land for redevelopment exceeds the value of the land and existing improvements. Certainly for those property owners who have invested in excess of$500,000 on a new home,the market value of their property does not derive from its potential to be redeveloped 10 feet closer to the lakeshore. Of course,the redevelopment value of any lot presupposes that the owner wishes to sell or remodel. In addition,the real estate agent's theory assumes that the greatest factor in setting the value of any lakeshore lot for redevelopment is how close proposed redevelopment can occur to the shoreline. Again, I disagree with such a blanket statement. While there may be some who will focus on shoreland setbacks,there are many more who will pay a premium price based on lake frontage,lake quality and the aesthetic environment of the neighborhood. Specifically,owners savvy enough to research shoreland setback requirements will also understand that the "minus ten(10)foot"language e --- � creates the very real possibility that after they spend significant sums building a home maximizing sightlines and lake views,they will face the very real potential that ad j acent lots will be redeveloped even closer to the lakeshore thereby blocking the views that their home was designed to capture. If the Rule is going to be amended,it should be done to benefit the shoreland owners in general and not simply to respond to an unexpressed and factually incorrect need for flexibility. But even accepting the theory that a single lot value increased because a new home could be built closer to the lake than the neighboring homes,that increase in value would be achieved to the detriment of the adjacent homes who would lose the sightlines and lake views their homes were designed to capture. Further, as demonstrated by the level of objection to the"minus ten(10) foot"language, for many the premium value lies not in the closeness to the lake shore,but in the overall aesthetic environment of the neighborhood around the lake. Allowing a neighborhood _ character, cherished by present City residents,to be destroyed in the name of speculative benefits to a few unidentified potential owners is not good public policy and is not in the City's public interest. Conclusion Although the Stantons are in favor of closing potential loopholes in the Zoning Code,the Stantons believe the focus for any amendment to the Adjacent Lot Setback Rule should be to close that loophole and not include unnecessary language that is contrary to the public interest. I am writing to comment on and in opposi . g tion to some of the language in the proposed amendment. My specific objections are: (1) the words "minus ten(10) feet"that would allow a shoreline setback that is less than the average setback for existing adjacent dwellings, and(2)the words "or.more"that potentially Y expand the commonly understood meaning of adjacent structure. The amendment, as drafted, seems innocuous on first reading but its effect is insidious. The likely and almost inevitable result is that eventually all of the homes on the lakes in Arden Hills will have setbacks no greater than the required minimum of 50 feet. That will clearly change the character of our neighborhoods—substantially reducing backyard green space between homes and lakes, blocking the site lines to the lakes, and resulting in increased density . g Y that will impact the environment. My first objection is to the amendment language"minus ten(10) feet"that will allow a setback that is less than.the average of the setbacks for existing adjacent dwellings. At the meeting of the Planning Commission on November 4, 2009, the language the public was invited to comment on did not include the concept of"minus ten(10) feet; rather, it simply said that a structure"...shall be set back the average setback of the adjacent structures...", which is the concept of`string line setback' used to protect site lines for existing structures. Indeed the first time the "minus ten(10) feet" concept appears is in the City Planner's Memorandum dated February 3, 2010 which only recently became available and so the public has not had the opportunity to be aware of and consider this detrimental change. The February3 rd Memorandum notes that the proposed change ' p p ange in regulation would remove the apparent loophole that might allow additions to structures to be constructed up to the minimum shoreline setback line. That is a good clarifying change. But reducing the average setback by ten feet will result in lower and lower average setbacks as homeowners tryto extend their structures so that their views to the lake are not blocked. The logical and eventual result is that every Arden Hills shoreline home will be built to the minimum required setback. Of course, that would negatively impact the quality of life and environment around the lakes. What started as an apparent attempt to preserve site lines to the lake will have resulted instead in destroying Y g the character of the Arden Hills community. My second objection is to the inclusion of language that could arguably increase the manner in which the average of the setbacks for adjacent dwellings is calculated. The prior Arden Hills language was straightforward and clear: "the average setback of the adjacent structures" which is the string line setback, the purpose of which is to protect site lines for existing structures. The new language is cleverly ambiguous: defining average setbacks with g reference to"two or more existing adjacent dwellings." It is hard to understand how more than two buildings can be adjacent along the shoreline since adjacent is defined as meaning next door to, sharing the same boundary, contiguous. Nonetheless the notion of"two or more existing adjacent dwellings" opens the door for a party who is looking for a way to decrease the calculation of"average setback." As the Commission will recall, in Planning Case#09-022(a request for variance by the Ranallos) heard on January 6, 2010, the petitioners attempted to reduce the string average e g setback, saying in their filing papers: "we have created an average setback by g drawin a line from the adjacent Lot 13 to the east and Lot 16 to the west, (skipping the adjacent Lot 15 to the west)." This was clearly not permissible under the current regulation, as was pointed out at the meeting, but would arguably be permissible if the proposed language were to be adopted. The skipped Lot 15 is the lot of the Stanton family residence where my mother lives. The setback calculated by skipping my mother's home would have resulted in a substantial reduction in the required setback from the customary string line setback. My mother's view to the lake would have been significantly impaired and from some viewpoints lost entirely. As drafted, the proposed amendment proposed is very detrimental to the quality of life in Arden Hills and will have long-term and irreversible effects. I encourage the Planning Commission either to Recommend Denial or to Recommend Approval with Changes,namely the deletion of the words "minus ten(10) feet"and the deletion of the words "or more" from the proposed Section 1330.03, Subd.4—Adjacent Lots. The current requirement of basing setbacks on the average of existing adjacent dwellings has served the neighborhood well for over fifty years and should be retained. When the original residents of Arden Hills built their homes, and the initial setback regulations were formulated, it was with very practical purposes in mind. The result was an --- expansive unobstructed backyard area that was common to all shoreline residents. This allowed homes on fairly narrow lots to enjoy a sweeping view of the lake that was not only aesthetically pleasing but of significant importance to public safety. When you live on a lake it is essential that residents be able to keep a watchful eye on children, teens, visitors, and each other. There were numerous legendary occasions when watchful neighbors prevented serious lakeside disasters, by overconfident swimmers, reckless boaters, and unsupervised children alone on docks,or walking on thin ice. Arden Hills has a wonderful safety record and it would be shame to spoil it by eliminating one of the primary sources of its success. It was also common practice for neighbors to share their backyard space with others for family or neighborhood picnics and games. It was sharing like this that created a community spirit that encouraged families to look out for one another and seek assistance from each other when needed. All of this could be lost and replaced with unnecessary resentments if new residents are allowed to put their own self interest ahead of established community standards. I oppose the amendment. I have discussed this matter with several of my neighbors who, like me,are very unhappy that you are proposing changes to setback requirements. Residents of Arden Hills simply do not know that a major zoning change like this is in the works. It is true that shoreline regulations were discussed at public meetings in the fall, but those discussions did not include proposals to reduce shoreline setback requirements. Arden Hills residents with lake fronts are very sensitive to any changes and would much prefer that no change take place. Let me also say that very few lake front property owners are in Minnesota in February,so to many residents this amendment will seem like a stealth effort to push through a major change without their being informed about it.
