Back�round
At the February 16, 2010, City Council worksession, staff presented a draft set of zoning
regulations for the Twin Cities Army Ammunition Plant (TCAAP) property reuse area. The
purpose of the TCAAP zoning regulations is to implement the mixed use concept described in
the 2030 Comprehensive Plan. The proposed zoning regulations will create a process and
parameters for developing a detailed TCAAP master plan at a later date the regulations Will be
a"plan to create a plan."
To help refine and strengthen the draft zoning regulations, staff also proposed to contract with a
planning and legal consulting �rm at the February 16 meeting. Due to the unique nature of the
TCAAP property, an additional planning and legal perspective on the proposed zoning language
will help put the City in a better position both for the public auction and for the longer term
master planning process. The City Council subsequently directed staff to issue a request for
proposals (RFP) for planning and legal services to assist in the preparation and review of the
TCAAP zoning regulations.

Proposal Review
The TCAAP zoning regulations RFP requested assistance to complete the folloWing:
• Evaluate the proposed regulations for consistency with City goals;
� Assess the proposed regulations to determine the potential positive and negative
outc ome s;
• Review the proposed regulations for consistency with Minnesota laWs to help ensure that
the regulations are legally enforceable; and,
• Research and recommend language to enhance the proposed regulations.
The RFP encouraged partnerships between land use planning consultants and land use attorneys
in order to provide a balanced revieW between best planning practices and legal enforceability.
The proposals were required to provide an estimated number of hours to complete the requested
services and the hourly billing rates. Reimbursements Will be based on the actual number of
hours spent on the proj ect. The RFP also included a copy of the proposed zoning regulations, the
TCAAP Reuse Statement, and applicable sections of the 2030 Comprehensive Plan.

After reviewing the �ve proposals, staff is recommending the Cuningham Group for this proj ect
(Attached). In staff's opinion, their proposal demonstrated the best understanding of the services
requested by the City for the TCAAP zoning preparation project. Their proposal included a clear
work program with speci�c deliverables that specifically addressed the services requested in the
RFP. While all of the proposals included a planning review, the Cuningham Group proposal
provided the broadest legal review due to their partnership with CR Planning, which is a legal
firm that focuses on land use and planning. Finally, the broad project experiences listed by Ms.
Rhees and Ms. Coleman �t the needs of this proj ect. Ms. Rhees also took the time to visit City
Ha11 and meet with staff to gain a better understanding of the history of the TCAAP property,
past planning efforts, and the purpose of the zoning project.
Staff contacted the references listed in the proposal and contacted other cities listed under their
proj ect experience. All references were very positive. The City of Roseville is currently
working with Ms. Rhees and the Cuningham Group to update their entire zoning code. The
Roseville City Planner recommended the Cuningham Group due to the breadth of their
knowledge and ability to customize zoning to �t the needs of the community.

Financial Implications
As noted above, the hours and cost in the proposals is an estimate. The �nal cost will be based
on the actual number of hours spent on the proj ect, and it could be higher or lower than the
estimate. The Cuningham Group estimated a cost of $12,660. Staff is recommending a cap of
$13,000 should a couple additional hours be needed to attend a City meeting, which was not a
required of the RFP. Staff will closely monitor the hours spent on the proj ect and keep the City
Council informed so that the budget is not exceeded or if additional hours become necessary.
The 2010 TCAAP budget included $70,000 for professional services. To date, the City has spent
$476.10 from this budget leaving $69,523.10 remaining.

Request for Proposal: TCAAP Zoninq Preparation Assistance

Purpose
The City of Arden Hills is seeking proposals to assist the City in preparing and evaluating zoning
regulations for the former Twin Cities Army Ammunition Plant (TCAAP) property.
Background
In 1941, the United States Army purchased approximately 2,400 acres of land for what would become the
Twin Cities Army Ammunition Plant (TCAAP). During a 16 month period, over 300 buildings were
constructed to manufacture and test munitions for World War II. At its peak, TCAAP employed more than
25,000 people. The TCAAP property was included in the City of Arden Hills' borders when the City
incorporated in 1951.
Befinreen 1974 and 1985, the Army decommissioned most of the operations at TCAAP. The federal
government formally declared 774 acres of the original TCAAP property as excess property in 1994.
Since then, much of the original TCAAP property has been transferred or leased to other public entities,
including the Minnesota Department of Transportation, Ramsey County, and the Minnesota National
Guard. With much of the original TCAAP property dedicated to other uses, only 585 acres remained for
sale and potential redevelopment.
The City partnered with a private developer to purchase and redevelop the remaining 585 acres in 2007.
Building off of previous planning efforts, the City embarked on a community planning process to create a
master plan for the TCAAP property. However, the developer withdrew from the project in May 2009
before the planning process was completed and a plan adopted. When the developer withdrew from the
project, the offer to purchase the property was terminated. The General Service Administration (GSA), on
behalf of the Army, subsequently initiated a process to sell the TCAAP property through a public auction
process. The sale is tentatively set for June 2010.
Although a TCAAP master plan has not been adopted, the City's 2030 Comprehensive Plan supports a
mix of residential, business, park, and open spaces uses for the TCAAP property. The existing zoning
needs to be updated because it does not support the future land uses described in the 2030
Comprehensive Plan.
The City continues to support the mixed use concept in the 2030 Comprehensive Plan, but a detailed
master plan will not be completed prior to the public auction. In order to support the mixed use concept,
the City has initiated a rezoning process for the TCAAP property to bring the zoning into conformance
with the Comprehensive Plan. Due to the unique nature of the property and the auction, the primary
purpose of the new zoning will be to layout a process and parameters for creating a master plan in the
future it will be a"plan to create a plan." The new zoning must provide flexibility, encourage creativity,
and advance the City's goals for the property.

Requested Services
The City has drafted the TCAAP zoning regulations and is seeking planning and legal assistance to refine
and strengthen the proposed regulations. At a minimum, the City is seeking assistance to:
• Evaluate the proposed regulations for consistency with City goals;
• Assess the proposed regulations to determine the potential positive and negative outcomes;
• Review the proposed regulations for consistency with Minnesota laws to help ensure that the
regulations are legally enforceable; and,
• Research and recommend language to enhance the proposed regulations.
The City would consider an alternative format or concept to the regulations that have been drafted. The
City welcomes partnerships between land use planning consultants and attorneys to provide the
requested services.
Pro�ect Schedule
The proposed schedule is as follows:

This schedule is approximate and subject to change. Additional Planning Commission and City Council
worksessions will be held to review the zoning regulations. Attendance at the Planning Commission
and/or City Council worksessions may be necessary.
Proposal Contents
The Consultant shall provide an estimated number of hours and cost to assist the City for the requested
services. Recommendations for additional services for this project may be included must be listed
separately. Reimbursement shall be based on an hourly rate of actual hours spent. The hourly rates
shall be included in the proposal. Resumes of those working on the project shall be provided.
Please provide two paper copies of the proposal in letter format (not bound) by 4:00 P.M. Wednesday,
March 3, 2010. In an effort to save paper, please make double-sided copies and be concise with your

Dear Mr. Lehnhoff:
Cuningham Group Architecture, P.A. (Cuningham Group) and CR Planning are pleased to respond to
your request for proposals to assist the City in formulating zoning regulations for the TCAAP property.
The TCAAP has a fascinating history both as a World War II ammunition plant and as a long-running
planning saga. Almost 20 years of plans and studies have resulted in agreements for public use of much
of the origina12,400-acre property. Sensitive environmental areas have been set aside for public open
space or for permanent protection. However, the future of the remaining 585 acres remains unsettled
since the withdrawal of the private developer in May 2009. The General Services Administration has
proposed a sale of the property by public auction in June 2010.
The impending auction of the TCAAP property makes it imperative that appropriate zoning is
established and put in place. The Comprehensive Plan has established policies and land use categories
for the property: a Mixed Residential and a Mixed Business area, in combination with parks and open
space. Yet the lack of an adopted master plan for the property means that the zoning regulations must
establish a process for master planning within the broad parameters established by the Comprehensive
Plan. The zoning regulations must:
• Establish the ground rules from which discussions between the City and a future developer can
proceed;
• Establish requirements for environmental remediation to be completed to a level that will
support the proposed uses;
• Protect sensitive natural areas and promote preservation of regionally signi�cant open space
resources on the property.
The new regulations are also intended to create well-connected, walkable districts providing a variety of
land uses and housing options within an attractive and sustainable built environment. The regulations
may enable, but not require, traditional neighborhood design, with elements such as narrow tree-lined
streets and pedestrian-oriented building frontages.
Constraints that will affect the site include limited access, whether from Highway 10 or from Highway
96 and County Road H, and the lack of detailed information on contaminated "hot spots."
We recognize that the intensive involvement of Arden Hills citizens in the previous planning efforts
have resulted in some degree of "planning fatigue," and that a large-scale public involvement effort is
not needed for this proj ect. However, it will be important to present the proposed regulations to the
public in a concise and understandable way. The Planning Commission and City Council will also need
sufficient time to review and comment on the draft and final regulations.

The City's initial approach to drafting the regulations, using the PUD process as a foundation for master
planning, is a sound one. Other Metro cities, including St. Louis Park and Roseville, have used the PUD
process for mixed use and business park districts that are anticipated to be developed there in a unified
and cohesive manner. However, PUD regulations must be structured carefully to ensure that the
resulting master plan meets the City's goals for the site. An initial review of the draft regulations
indicates some of the questions that remain to be answered and issues to be resolved, including:
• Which land uses are appropriate in each district as permitted, conditional or accessory uses,
and how broadly or narrowly should those land uses be de�ned?
• What are the limits of the districts in terms of the number of housing units that can be
supported, the percentage of multi-family units, and the desired mix of uses? Should there be
any requirements for minimum percentages of speci�c land uses to promote a"variety" of uses
and housing types?
• Can a high level of connectivity — interconnected streets and paths — be encouraged or required
as a component of the master plan? Can other transportation improvements such as transit
connections and stops or stations be incentivized through the regulations?
• What percentage of the site should be incorporated into an integrated park and open space
system, and how should that system be structured in terms of public or private ownership and
management?
• Which other elements of the regulations can be "calibrated" to foster a master plan that will
produce the desired results? For example, should speci�c landscape standards, low impact
development standards, or green building design standards be included in the regulations?
We believe that our team is highly quali�ed to assist the City with the process of developing, reviewing
and re�ning the proposed regulations. Suzanne Rhees and Jean Coleman each have over 20 years of
experience with zoning in urban, suburban and rural environments. They have collaborated on many
projects and are widely recognized for their zoning expertise and facilitation skills. Suzanne would act
as project manager and primary code writer/reviewer, while Jean would provide legal review and
overview of draft work products. Andrew Dresdner, Urban Designer at CGA, would assist with
illustrations of desired results.
Approach and Work Program
Our general approach to the proj ect as outlined in the RFP as follows. We recognize that the time frame
for completion is short, and that an efficient but carefully considered work program will be key.
Therefore, we suggest breaking the process into a series of tasks that match the elements outline in the
RFP:
1. Analysis and Issue Identification: This task includes the following components, which we believe
are closely related:
• Evaluate the proposed regulations for consistency with City goals
• Assess the proposed regulations to determine the potential positive and negative outcomes
Recognizing that the Comprehensive Plan and the TCAAP Reuse Statement clearly deliniate the City's
goals, we would outline those goals alongside the proposed regulations in order to identify any gaps or
inconsistencies and to determine possible outcomes, both positive and negative. As part of this task we
will also review the previous planning documents that, while no longer expressing adopted City policy, C U N I N G H A M

can provide insights into the opportunities and constraints presented by the TCAAP property.
Summary of Tasks
• Meetings: One work session with planning staff. We have used work sessions of this type
effectively as part of our Roseville proj ect as a way to share information and develop a
consensus approach between staff and consultant.
• Deliverable: Memorandum outlining findings of the analysis and recommendations for
changes or additions to the regulations
2. Legal Review: Review the proposed regulations for consistency with Minnesota laws. This task
will be focused at two points during the schedule: an initial review of the currently proposed regulations
(simultaneous with Task 1) and a subsequent review of the �nal draft regulations, towards the end of
Task 3. Legal review will focus on several issues:
• The consistency of proposed and �nal draft regulations with Minnesota land use and
contracting statutes and case law; including municipal authority in zoning, subdivision, master
planning, and development agreements. As well as the consistency of proposed and draft
regulations with environmental remediation rules and agreements.
• The reasonableness of the requirements for the master plan as speci�ed in the regulations,
including the requirements for environmental remediation and for traf�c studies. Assuming the
results of these studies may affect the development opportunities presented by the site to
varying degrees, how can this potential uncertainty be communicated in the regulations?
• The relationship between the zoning regulations and any future developer agreements limiting
the uses on the site or requiring specific public improvements; con�rming that such
agreements do not conflict with the intent or language of the regulations.
Summary of Tasks
• Meetings: One separate meeting with planning staff; participation in one work session with
planning staff
• Deliverables: Memorandum outlining potential legal issues with the currently proposed
regulations and recommendations for revisions. Review and mark-up of �nal draft regulations.
3. Recommendations: Research and recommend language to enhance the proposed regulations.
This task encompasses much of the proj ect budget and schedule. It will include a number of different
components:
• Two work sessions with planning staff. The first session focuses on recommendations for
enhancements to the regulations; the second session focuses on re�ning a�nal draft.
• Research and drafting assistance. We will provide examples of similar ordinances or
approaches to master planned districts and suggest language and illustrations that will help
meet the City's goals. Illustrations are an optional but potentially useful part of the regulations.
• Review and refinement. We will work with staff to finalize the language and organization of
the regulations.
• Optional: Public presentations. This o tional task would involve assisting staff with
presentations at public information meetings, Planning Commission meetings and/or Council
meetings. We suggest that consultants could attend up to four meetings, if desired — one public
information meeting and two meetings with Council or Planning Commission — to be billed at
our regular hourly rates.
Summary of Tasks
• Meetings: Two work sessions with planning staff (including final legal review)
• Deliverables: Example language; recommended language, mark-ups of preliminary and final
draft; assistance with presentation materials
• Public Presentations: As needed (optional element)

The following estimate is presented as a stipulated sum of $12,660. The optional elements can be
included in the total if desired. Additional tasks could be added at the speci�ed hourly rates. Hourly

an I-394 Mixed Use Zoning Distr•ict to
impl.ement t1�e plan. Both the plan and
the zoning district introduce a vanety of
housing types, thus achieving mor.e bal-
anced t� affic flows through the corridor.
Three building height zones concentrate
the tal�est buildings close to the freeway
and step dow�n to a neighborhood scale
at t11e edges. St.reet ty�pes and landscape
�reatments are defined to improve the
con�idor's identit� and connectedness.

agreed to use the model ordinances as the
base for their ordinance update process to test
the viabiliiy af the model language.
