Back�round
The Federal Emergency Response Agency (FEMA) recently conducted a Flood Insurance Study
for I�amsey County. As part of that study FEMA updated the flood insurance rate map panels
for all jurisdictions in Ramsey County. Flood insurance rate map panels are created by FEMA
for each community in the United States. The maps identify which properties are located within
a floodplain. This is important both for insurance reasons, and because properties within
floodplains are subj ect to additional regulations to minimize any potential flood damage that
might occur. The new maps have been sent out to communities and will become effective on
June 4, 2010. The revised maps are available in an electronic format at
ftp://ft�.dnr.state.mn.us/pub/waters/flood�lain/County data/Ramsey. The last time Arden Hills
received updated map panels was in 1981. The u dated ma s are substantiall similar to the

previous maps in terms of what areas are determined to be within a floodplain.
As part of the Flood Insurance Study and adoption of the new flood insurance rate map panels
each community in Ramsey County is required to adopt floodplain regulations that are com liant

Staff has been working with the State Coordinator for the National Flood Insurance Program and
the City9 s area DNR I-�ydrologist to draft flood plain regulations that are in compliance with both
the Federal and DNR regulations. Staff has submitted the draft regulations to both agencies for a
preliminary review and has received a conditional approval letter (Attachment C), subj ect to the
final adoption of the regulations by the City Council. Attachment C includes a black-lined
version of the proposed changes.
Recommendation
The I'lanning Commission reviewed this application and held a public hearing at their April 7,
2010, meeting. The Planning Commission unanimously recommended approval (7-0) of
Ordinance 2010-2008 in Planning Case 10-006 to amend Sections 13 05.04 and 13 3 S of the
Zoning Code to update the City's Flood Plain Regulations as presented in the April 7, 2010,
Planning Case Report.

Cit� Planner Beekman reported this req�est vvas for consideration of Planning
Case 10-006 to amend Sect�ons � 3QS.Q4 and 1335 af the Zoning Cade to update
the City's F�oad Plain Regu�ations as presented in the April 7, 2010, Planning
Case report. She provided the Cornm�ssion with bac�ground inf�rr�ation and she
outlined the recommended changes an each section. She stated S�aff reeom�nends
approval of P�anning Case 1 a-006 to amend See��ons 1305.04 and 1335 of the
Zor�ing Cade.

Chair Larson asked if the new maps and bou�daries affeeted any properties in the
C�t}�.
City Planner Beekman exp�ai�ed when eon�pared to the oId maps the flood plain
bounda�ies have not changed significantly. If anything the� have lessened for
some property ov�ners. The biggest ch�nges occurred in the classification of
proper�l es.
Com�nissioner Zimme�nan asked if there were properties in Arden Hills that may
have previously been e�assified as being In the flaod plair� bu� are no Ionger
c�assified as sucho �e a.lso asked who wo�Id be responsible �or not�fying these
residents �f they were no �onger in what would be cons�dered a flooc� plain.
City Plar�ner Bee�man stated there were a few properties ir� Arden Hills �hat may
no longer be �n what is cons�dered a fload plain. She wauld e�eck with the DI�R
as far as notif cat�on ta t�ese property av�ners.

Definitions.
Subd. 1 Acre. A quantity of land con�aining forty-three �housa�d, five hundre� and

Subd. 1 F�oodwa}� District. The floodway District shal� include those areas designated

we�lands and other basins, the �loodway D�strict shall include those �reas desig�.ated as

c. To allaw for �he equaiization of hydros�a�ic pressure, there must
be a min�mum t�� tvvo "au�omattc" openings in the outs�de �va�ls of
the s�ructure having a t�tal net area of not �ess ��an one square inch
for every square foot of enclosed area subject to floadin�. T�ere m�st
be openings on at least two sides of th� structur� and the �ottor� of aIl
openir�gs �ust be no h�ghe�- than one foot above the lovvest adjacen�

removable from the area within the t�me a���lable after a fload war�ing

G. Structural works for #laod contro� t�at will change �he course, cu�-rent or
cross section of protected �vetiands or �ub�ic �v�ters shall be subject �o the
prov�sions of Mir�esota Stat�te, Section 1�3G. Con�r�unity-wide �t�-c�etural
wor�s for flood contral intended to rer�ove areas fro� the �-egulatory �1ood
piair� shal� no� be allowe� in �he floodway.
H. A levee, dike or floodwall constructed in the floodway shall not caus� an
increase to t�e 100-}�ear or regio�al flood and the technica� anatys�s �hal�
ass�rne equal conveyance or �torage loss on both sides of a stream.

A. Al� new principal structures shall �ave �ehicu�ar access at or above an
elevation not rno�-e t�an two (2} fe�t be�ow the Regulatory Flood �'rotect�on
E�evati�n. �f a variance to this requirement �s granted, the Board of
Adjust�nent sha�l speci� l�m�tations on the period of use or occupar�cy of the
struc�ure for �irnes of flood�ng and only af#er deterrnining that adequate flood
vvar�ning time and local flood em�rgency response procedures exist.
�. Commerc�a� Uses. Accessory lanc� uses, such as �ards, railroad t�-acks, and
parking lo�s may be at elevations lower than the Regulatory �lood Protection
�Ieva�io�. However, a per�i� for s�ch facilities to be used by ��e employees
or the general public shall not be gran�ed in the absence of a flaotl warn�r�g
s}�stem tha� pro�ides adequat� time for evacuation if tl�e area wou�d be
inundated to a c�ept� anc� veloci�y such that when multiplying the depth {i�

�rotracted flaod durat�ons. �ertain accessory land uses such as yards and
parking lots may be at lovver eteva�io�s �ubjeci to requirements set out i�
�'aragraph B above. In considering permit applications, d�e cons�derat�on
shall be given to needs of an industry vvhose business requires t�a� i� be

F�ood�vay ar Flood Fringe Distri�t and to determine the Regu�atory Fl�od
�'rotection Elevation. Pracedures consistent with M�nneso�a Re�u�ations
� 983, Par�s 61 �fl.54�0-f� 120.f�2�� and 44 Code of Federal Regulations Part
55 shall be �ol�owed �n �his expert evaluation. T'he designated engineer or

C. T�e City Adm���strator shai� present the �ec�nica� eva�uation and findings
of the c�esignated e�g�n�er or ex�er-t to the City Cou�c�l. Th� Cit� Co�ncil

1335.33 Adm�nistra�ion. Tl�e City Administrator ar other off cial designated �y t�e City Counc��
sh�ll administer and en�ar�e this Section. �f t�e C�t}� �1d�ninis�rator finds a violation of the provisions
of ��is Sec��fln the Ci�y Ad�inistrator shail �otify �he person respo�sible for the violation in
accordance vvith the procedures.
Subd. 1 Permit Required. � Permit �ssued by the �ity Adrninistrator i� canforrnity
with t�e provis�ons of this Section shal� be secured prior to the e�-ec�ior�, addition,
modification, rehabi�i�ation {ir�cluding normal maintenance and �-epair), or alteration of
any bui�ding, struct�re, or �ortit�n there�f; prior to the eons�ruc�i�n of a dam, fence, or
on-site septic systerr�; prior to the change or extension of a non�onforr�ing use; prior to
the repair of a st�cture that has been damaged b� fload, fire, �ornado, or any other
source; and prior to the p�ace�nen� of fi�I, excava�ion of materials, or the storage of
n�ateria�s or equipn�en� within the flaod p�ain.
�ubd. 2 1�pplica�ion for Pern�it. A�plication for a�ermi� shail be �ade in du�I�ca�e to
t�e City Ad�inistrator on f�rms �urnished by tl�e Cit}� Adrninistrator and shail include
the foll�wing where applicab�e: p�a�s in dup�ica�e dravvn to sca�e, s�owing the nature,
location, dimensions, ar�d e��va��on� of the lot; ex�stir�g or pro�osea s�ructures, �li, or
sto�-age of n�aterials; and t�e loeation of the foregoing in relation �o tl�e stream channele
�ubd. 3 State and Federal Permits. �'rior to gra�ting a Permit or processir�g a�
a�plicatior� for a Condi��o�a� t.1�e Permit or Variance, t�e City Admin�stra�or shall
de�e�nine that the applicant ha.s obta�ned al� necessary State and �ederal �'errr�its.

or cons�ruction at v�riance v�ith that a�tho�ized shall be deemec� a vioiation of this

Subd. 6 Ce�tif cation. The applicant sha�� be required to subm�t ce�tifcatifl� by a
registered professiona� engineer, registered archit�c�, �r register�d �and su�-veyor �ha# the
fini�hed f Il and buiid�ng e�ev�ti�ns vvere accompl�shed in comp�ia�ce w�th th�
�rovisions af this Section. Flood �r�o�ng measures shall be cer�if ed by a registered
�rofessional engir�eer or registered architec�.
Subd. 7 Record of First �loor E�evation. �'1�� Zo�ing Administrator shall rnair�tain a
r�card of the ele�ation a�t�e lowest floo� (ineluding base�nent) of al� new st�ctures and
a��erations or addi�ions t� exist�ng struct�res in the flood p1a�n_ T�e Zoning
�d��nistrator shall also maintain a�-ecord of �he eleva�ion to which structures or
alterat�ons �.nd aclditio�s to structures are flood proofed.
Subd. 8 Notifications for Watercourse A�tera�ions. The Zoning Administrator shall
�otify, in �iverine situations, ad�aeent com�nunizies and the �omrn�ssic�n�r of the
�e�ar�mer�t of N`aturai Resources prior ta the camrnunity authorizi�g any a�terat��n or
r�Iocation of a watercourse_ If ��e appiiean� has applied far a pe�nit to work �n �he beds
�f pub�ic waters pursuant to Minnesota Statute, Cha�ter 1 Q3C, t�is sha�� suf��e as
adequate notice to the Cornmissione� of �atural Resaurces. A�opy of sa�d notif ca�ion
sha�l a�so be submitted to the Cl�icago Regionai Office af the �ederal Emergency
�ar�agement Ageney (�EMA}.
Subd. 9 �otifcation to FEN�A When �hysical Changes Increase or Decrease the 14�-
year Flood Elevat�ar�. As soon as is practieable, but r�ot �ater than six (6} months af#er the
�ate such suppa�ing in�orn�ation becornes availab�e, the Zoning Adrninistrator s�a�l

of all variance �c�ions. A commur�ity sha�� maintain a record of a�� variance

�ational F1aod Insuranee P�-ogram.

e�gi�eer or other expert person or agency for techni�a� assistance, wh�re
necessary, in �valuating �he proposed project in reiation �o f�ood heig��s and
veloc�ties, the se�io�sr�ess of flood c�arr�age to the �se, �he adequacy o� t�ie
plans �or protection, a�� other �echnica� matters.
E. Based upon t�e tech�icai e�a�uat�on of the designatec� eng�neer or expe�t,
�he Cit� Cour�cil shai� determi�e the specif c flood �.azard at the site and
eva��ate the suita�il��y of the proposed use in relatian to t�e f�ood l�azard.
Subd. 10 Fac�ors upon �hich the Decision of the City Counc�l s�al� be based. In
pass�r�g upon cor�ditiona� use a���ications, the C�ty C�un��l shall consit�er a�� relevant
factors specified in t��s Sectio�, a�d:

before tl�e passage or amendrnen� of this Code b�� which shall not be i� �onfor�nity with the
�rovisions of this Section s�a�l be subject to the following. His�oric structures, as c�ef ned in Sectio�
� 305.04, Subd_ 182, s�all be su���c� ta t�e prov�sions of Subds. 1��i 5 of t�is Section
�ubd. 1 No such use s�all be expanded, changed, enlargec�, or altered in a way that
�ncreases its nonconfor�i�y.
Su�d.2 Any st�ctural a�teration or addition to a nonconf�r�ming structure or
�or�conforming use vvhich vvou�d resu�t in increasing the flood dan�age patentia� of �hat
s�ructure or use sha�l be protected to the Regulatory Flood Pr�tectian Elevation in
accordance vvith any ofthe elevation on f 11 or fload proofing techniqu�s (i.e., �P-1 thru
FP-4 floodproofing classi�ications� a��owa�le in the State Building Code, except as
�u.r�her �-es��c�ed �n Subd 3 and Subd 5��lovc�.
�ubd. 3 The cost t�f alI structural alterations or additiar�s to any nonco�forming
st�-ucture over the life of the structure sha�l nat exceed SQ percen� of t�e rr�arket value of
the structure un�ess �he condit�ons of this Section are satisf ed. �`he cos� of all structural
al�erations and addi�ions �ust i�clude a�I costs suc� as constructian materials a�c� a
�reasor�ab�e cost piaced on aIl rnanpower or lab�r. If the cost of a�i previous and proposed
alt�rat�ons and additior�s �xceeds 50 percent of the rn�r�et va�ue of the structure, then the
structure rnust meet the sta�dart�s of Sections 1335.2� and 1335.2� of th�s Ordina�ce for
�ew structures depending upon whet�er the struc�ure is in the Floodway or Flood F�nge
Dist�ct, res�ect�ve�y.
Subd. 4 If an� nfl�confo�rnin� use is diseontinued �or 12 consecuiive �nonths, any
�uture �se of the bu�lding premise� s�al� cor��orm to t�is �rd�r�ance. The Assessor s�a��
no��fy �he Zoning Adm�n�strat�r in writir�g of instanees �f nonconformi�g uses �hat have
bee� discan�inued for a period of 12 mo�ths.
S�bd. 5 �f any nonconform�ng use or structure is substant�ali}� darnaged, as de#ined in
this Ordinance, �� shal� �o� be reconstr�.�c�ed excep# �n confor�i�y with the p�-ovis�o�s a�

�335.36 Enforcen�ent and Pena�ties for V�o�at��n.
Subd. 1 Misderr�ear�or. �i�iation of t�e �rovisions of th�s Ordir�an�e or failure to
c��ply wit� any of its requ�rements {ineludir�g vioiatians of ct�nditi�r�s and safeguards
estab�is�ed in connection w�th grants of variances o�- condition�l uses) shall cor�stitu�e a
misde��anor and s�al� be �unisha�le as defined by state law.
Subd. 2 (�ther Rernec�ies. 1�Iothing contained shal� �reven� the City �-on� taking any
other lawfu� ac�io� as is necessary to prevent or reme�ly any ��alation. Such actions r�ay
include but shall not be lir��ted to:
A. In res�anding �o a suspect�d Code violat�an, the C�ty Ad���isrrator a�d
City Counci� may u��l}ze the ful� array of enfo�cement aetions available to �t,
includ�ng but not l�mited to, prosecution ar�ci fines, in�ur�ctior�s, af#er-the-fac�
perr�nits, ord�rs for �orrective measures or a req�est to t�e National ��ood
�nsurance Prograrr� for denial of flood insurance a��ilability to the guilty
part}�. The �'i�y shal� act in go�d faith to enforce these offic�al con�rals and �o
cflrrect Code �io�at�ons to the extent possib�e so as not to jeopardize iis
eligibility in the Na�1o��1 �'lood Insurance �'rogram.
B. When a Code violation �s ei�her disco�ered �y or brought to the attention
of the City Adminis�rator, the C�ty Ad�ninistrator sha�l irr��edia�ety
investigate t�e �io�atit�n of the o�f cial control. As soo� as is reasfl�a�ly
�oss�ble, this �nformat�on sha�� be sub�itted to the a��ropriate I�epa�ment of
�atural Resources� a�cl F�dera� Er�ergency Manageme�.t Ager�cy �eg�onal
��f ce a.�ong v�i�h the C�ty's plan of act�t�n �o cor-�-ect the viola�ion to th�
degree �oss�ble.
C. T�e C�ty Administrator shall noti� �he suspec�ed pa�ty of the
�-equ�rements of th�s Sect�o� and a11 other Off cial Co��rols and the nature and
exter�t of �he suspectec� v�o�ation of these contrals. If the st�ct�re and/or use
is under eonstruct�an o� development, the �ity� Aclmi�istrator rr�ay order the
�onst�-uction or de�elopr�e�t immedia�ely �a��e�i unti� a proper per�ni� or
app�-c�val is granted by the City. If the construction or develo��nent is alr�ady
comp�eted, then the City A�r�inistrator may either:

t�e speci f ed respor�se periad not� �y �he �and owner to res�ore t�e Ia�d to the
co�di�io� which ex�sted p�ior to the �iolation of this S�ctian.
1.335.37 Amencin�ents.
Subd. � D�sigr�ation Removal. The flood plain designation of the Off cial Zoning Map
sha�l �ot �be rernoved from flood plain a�-eas unless it can be s�o�vn t�at t�e designati�n is
in error or that t�e a�ea �as been � lled to o�- above ��e elevatior� of the regulator� #�ood
��otec�ion elevat�on and �s contiguous to lands outside �he flood plain. Speeial exce�tions
�o this �le may �e permitted by the Cammissioner of �3atu�-al Resources if he or she
determ�nes that, �hrough other measures, lanc�s are adeq�a�ely protec�ed for �he intended
use.
Agency Approval. A1} amendments �o this Section, including a�nendments to the �fficia� Zoning
1V�ap, shall �e subn�itteci �o and approved by the �o�r�issia��er of Natural �esouree� p�ior to
adoption. Changes in t�e 0#�f c�al Zoning 1VIap shail rneet the Fe�eral Ernergency Management
Ager��y's (�EMA) Teehnica� Conditions and Criter�a and �hal1 receive prior FEMA a roval before
