Background 1. Overview of Request The applicants own the property located at 1146 Waldon Place, which is located in the southwest part of the City in the R-1 Zoning District. The property is situated at the end of a cul-de-sac. There are six other homes that also access onto Waldon Place. The homes on - Waldon Place were all constructed in the mid to late 1970s. The applicant's home was constructed in 1976 and is a split-level home with no formal entryway. At this time the applicants are proposing to construct a ten foot by ten foot entryway addition in the front of there home that would allow more efficient and improved access into the home. Lot Coverage—Meets Requirements The existing lot coverage for the property is 14.6 percent. The proposed home increases the impervious coverage to 14.9 percent. City Code limits impervious coverage to 35 percent. D. Structure Height—Meets Requirements - While the exact height of the new structure has not been calculated, it would not exceed the height of the existing home, and would be well within the maximum height limit of 35 feet. The height is calculated by measuring from the average grade to the average slope of the pitched roof. 2. Flood Plain,Wetlands, and Easements The proposed addition is outside of any flood plains,wetlands, or easements. 3. Tree Preservation No trees would be impacted by this project. 4. Additional Review The Building Official has done a preliminary review of the submitted materials and has no objections to the application. A building permit will be required prior to any construction taking place. Variance Evaluation Criteria The criteria listed below must be used to evaluate each of the variance requests. A. Variance Review Criteria—Section 1355.04 Subd. 4.C: Variances from the literal provisions of the Zoning Code may be granted in instances where the strict enforcement would cause undue hardship because of circumstances unique to the individual property under consideration. Variances shall only be granted when it is demonstrated that such actions will be in keeping with the spirit and intent of the Code. "Undue hardship," as used in connection with the granting of a variance, means: ■ The property in question cannot be put to a reasonable use under conditions permitted by the Zoning Code; ■ The plight of the landowner is due to circumstances unique to the property not created by the landowner; City of Arden Hills Planning Commission Meeting for May 5, 2010 C:I DOCUME-1 I MEAGAN L BEET LOCALS-1 I Temp I ELFI D 105-05-10-PC Report-Goldman Variance.doc Page 3 of 6 ■ The variance, if granted, will not alter the essential character of the locality; and, ■ Economic considerations alone shall not constitute an undue hardship if reasonable use for the property exists under the terms of the Code. Findings of Fact Staff offers the following eighteen findings of fact for review: General Findings l. The lot size meets the requirements of the R-3 Zoning District. 2. The existing home meets all required setbacks. 3. Dwellings are permitted structures within the R-3 Zone. 4. The proposed addition would encroach eight feet into the required front yard setback. 5. The proposed addition would not encroach into any other setbacks. 6. The structure coverage meets Zoning Code requirements. 7. The minimum landscape area requirements meet Zoning Code regulations. 8. The dwelling with the proposed addition would not exceed the 35 foot height limit. — 9. The existing dwelling and the proposed addition are outside of the 100-year flood plain, wetlands, and easements. 10. There is no proposed tree removal for this project. Variance Findings: 11. Single-family homes are a reasonable use within the R-3 Zoning District because they are permitted within the Zoning Code. 12. The property itself is not unique in the City. The way the home is situated on the lot could be considered unique, as it limits any alternative locations for the addition. 13. The circumstances of the property were not created by the landowner because the lot was platted prior to their taking ownership. 14. The proposed addition would not alter the essential character of the neighborhood because the existing homes have inconsistent front yard setbacks, the neighbors are in favor of the project, and the addition would improve the front fagade of the home. 15. The proposed plans and setback variance for the dwelling do not appear to be based on economic considerations alone. Recommendation The findings of fact for this variance request do not specifically support a recommendation for denial or approval. A single family home is a permitted use in the R-3 Zone, and the addition of an entryway into the home is not an unreasonable use. The issue at hand is not whether a front entryway is a reasonable use, since the home already has a front door that functions as an entryway that does not encroach into the front yard setback; rather, the variance request is for an City of Arden Hills Planning Commission Meeting for May 5, 2010 C:IDOCUME-IIMEAGAN-LBEETLOCALS IITempIELFIDW5-05-10-PC Report-Goldman Variance.doc Page 4 of 6 addition to the home that would function as a more efficient and functional entryway that suits the needs of a growing family. This variance is unlikely to create a negative impact on the neighborhood or City because the homes around the cul-de-sac do not have consistent setbacks, the neighbors are in favor of the project, and it would certainly enhance the appearance of the front fagade of the home. It does not appear that the variance is based on economic considerations alone. _ As is often the case, the evaluation criterion that states "The plight of the landowner is due to circumstances unique to the property not created by the landowner," is the difficult evaluation criterion. The property itself is not unique; however,the way the home is situated on the lot could be considered unique since there are no alternatives available to the property owners to improve access to their home in a way that would not require a variance. The applicant purchased the home after it was built. Before making a motion for approval or denial, this specific variance evaluation criterion must be addressed for the official record. If the Planning Commission recommends approval on this variance, Staff recommends the following five conditions: 1. The project shall be completed in accordance with the plans submitted as amended by the conditions of approval. Any significant changes to these plans, as determined by the City Planner, shall require review and approval by the Planning Commission. 2. The applicant shall use best management practices (BMPs) to control erosion at all times during construction. 3. The applicant shall obtain approval or a waiver from the Rice Creek Watershed District prior to the issuance of any building permits. 4. The structure shall conform to all other regulations in the City Code. 5. The addition will match the color and siding of the existing structure. Options The findings in this report are not specific enough to fully support approval or denial of the variance. With a motion to approve or deny, the findings or the reasons for the motion must be stated. The following criterion must be addressed: ■ The proposed home will/will not alter the essential character of the neighborhood or the City because... Once the findings are stated, a full motion to approve or deny can be made. If there is a motion to table, it is not necessary to state the findings. 1. Recommend Approval with Conditions: Motion to recommend approval of Planning Case 10-007 for a variance at 1146 Waldon Place based on the findings of fact and the submitted plans, as amended by the five conditions in the May S, 2010,planning case report. Resident Comment The City has not received any calls or emails regarding this application. -- Deadline for Agency Actions The City of Arden Hills received the completed application for this request on April 2, 2010. Pursuant to Minnesota State Statute,the City must act on this request by May 31, 2010 (60 days), unless the City provides the petitioner with written reasons for an additional 60 day review period. When we purchased the home in 1992,we had not started our family. Upon the birth of our fourth child in 2002,we added on to the back of our house two additional bedrooms and 3rd car garage without a need for a variance because we have a pie wedge lot with a ver y ry deep backyard but a very short front yard. Because of the growth of our family and the needs for our family and any guests to safely enter and exit our dwelling,we are requesting a variance to add at the most a 10' by 10' front entry addition. This addition would be at the most 6' within the 40' front setback. We currently are not able to open the front door and have access to our front closet and have more than one person within the current front entry. This new addition would enable us to utilize this space in a safe and efficient manner. 2) With the property being a pie wedged lot,the property is unique in that we would not be able to add any additional space for an entrance to our house. We could add on to the back of the house again but that would defeat the purpose of an entrance. 3) The variance would still be conforming with all the rest of the properties in our cul de sac. The houses in our cul de sac all vary as to the distance from their front setbacks. The first house that was constructed on our cul-de-sac (1148 Waldon Place)is 50 feet from the front setback. Background 1. Overview of Request _ In June 2009 the Planning Commission and City Council approved a redevelopment application for the Arden Plaza retail center. The approved Master PUD includes the demolition of the existing office pod buildings, subdivision of the parcel into four lots g p , and the construction of four new buildings. As the project was approved, Building 1 is 14,600 pp , g square feet and would be a Walgreen's store. Building 3 would be attached to Building 1 and would be anticipated to be a retail and/or restaurant use of 4,700 square feet. Building 2 would be a 6,000 square foot single restaurant user, and Building 4 would be 18,000 with a user that was yet to be determined. The first phase was for Buildings 1 and 3. The applicant included an Initial Phase Development Plan(Attachment B) which details what aspects of the Jro'ect will p be constructed with Phase I. While the Final PUD for Phase I has been approved, future approvals for Phase II and III will require review before both the Planning Commission and City Council. Since the approval of the Master and Final PUD for Phase I the developer has been in negotiations with Walgreens Pharmacy. The terms of their agreement will include Walgreens purchasing the parcel that the Walgreens store will be built on. This is made slightly more complicated by the existence of Building 3 with would be attached to the Walgreens store, but located on a separate parcel of land with a zero lot line runningalong g the wall that divides the stores. At this time the applicants are requesting an amendment to the approved Master and Final PUD for Phase I that would allow an alternate development option that excludes Building 3. The applicants would like to maintain the option to construct Building 3 at a later date, reserving the space in the interim as a landscaped green space (Attachment Q. The applicants feel that the ability to move forward with the construction of Phase I without the inclusion of Building 3 will greatly assist in their negotiations with Walgreens and allow the g g development to take place. In essence the applicants are requesting the inclusion of an alternate build out scenario; the original approval of the Final PUD for Phase I which includes Building 3 would remains in place, and a second option that excludes would also be possible. Everything else about the development application would remain unchanged from the original approval. -- Given the delays of the project due to unforeseen market conditions and extended negotiations with Walgreens, the applicants are also requesting a one year extension for filing g the Final Plat with the County and for submitting for building permits for each of the three — phases. The Applicants have submitted a letter describing their request Attachment A as well as a site plan of how the green space would be programmed (Attachment C . 2. Planned Unit Development(PUD) Process The PUD process is a tool that provides additional flexibility p for developments that an underlying zoning district would not otherwise allow. For may example, a PUD change the p Y g setbacks, lot coverage, lot sizes,parking requirements, signage, building height, building materials, landscaping requirements, etc. The process is meant to create a better development than the standard regulations may otherwise allow. The PUD process allows the City to negotiate certain aspects of the development; however, any conditions imposed on the PUD must have a rational basis related to the impacts of the development. The PUD process cannot be used to permit uses that would not otherwise be permitted in the underlying zone. If a property is subdivided into multiple properties during the PUD process, it is still often viewed as one continuous development. The development as a whole would be expected to meet the landscaping, stormwater, and other similar requirements. For example, one property in the PUD may have 90 percent building coverage; however, the development as a whole does not exceed 80 percent building coverage to maintain conformance with the underlying zone. In order to maintain shared amenities such as landscaping and stormwater ponds, the development is required to create a legal entity to manage and maintain the shared amenities. The Planned Unit Development(PUD)process is typically at least a two step process. The first step is the Master PUD, which is a detailed concept plan for the entire development proposal, often outlining individual phases for development over a specified period of time. p The second step is the Final PUD for each phase, which is a more detailed review as each development phase moves forward. During the Master PUD stage, the Cityworks with the applicant to set an overall design framework or standard for a proposed development. These standards are then written into a development agreement which generally includes the design - g Y g standards, a list of conditions,the size of the development, and what, if any, deviations from the underlying zoning district will be permitted. Once the Master PUD is approved, the applicant then creates a development that conforms to the development agreement for each subsequent Final PUD phase. The level of detail is guided by the type and scale of the development as well as the guidance or flexibility within the Zoning Code. 3. The amount of perennial and shrubbery planting would be increased as a result of this application because of the addition of the green space that is to replace Building 3. D. Parking— Section 1325.06 The parking demand for the proposed Arden Plaza redevelopment site will be reduced by the proposed alternative development option. The parking stalls provided would remain the same at 455 stall; however the parking ratio would be increased from 4.85 to 4.94 stalls per 1,000 square feet of retail space. The north wall would continue to have wrap-around - architecture and glass treatments that match the rest of the building. 3. Sign Code The proposed alternative development option would result in a net decrease in the amount of 93 square feet of signage. No additional signage is proposed for this side of the building. g Findings of Fact: Staff offers the following five findings of fact for this proposal: 1. The applicant recognizes that over the long term the market may shift such that an additional 4,700 square feet of retail would be a viable and beneficial addition to the Arden Plaza center. Given the current market demand and the strongreference that p Walgreen's has to own and operate their own properties, unencumbered b the presence of other Y attached third party retail space, it may be appropriate to grant the applicant's request. In addition to the increased landscaped area, reduced parking demand, and reduced signage,the proposal would also reduce the amount of traffic demand to the site. Traffic management has g _ been a long running concern regarding the redevelopment of Arden Plaza. The applicant shall continue to abide by the conditions of all previous Master PUD and Final PUD for Phase I,permits, and reviews, except as hereinafter amended. 2. The project shall be completed in accordance with either the original Master PUD and Final PUD for Phase I, or the submitted alternative development option consistent with the plans as described in the three exhibits dated March 29, 2010, as amended by the conditions of approval. Any significant changes to these plans, as determined by the City Planner, shall require review and approval by the Planning Commission and City Council. 3. The property owner of lot 3 shall maintain the option in the future to construct Building 3 as approved by the original Master PUD and Final PUD for Phase I. 4. The applicant shall file the Final Plat with Ramsey County by June 1, 2011. 5. The applicant shall obtain building permits for Phase I of the redevelopment project no later than June 1, 2011. 6. The applicant shall obtain building permits for Phase II of the redevelopment project no later than June 1, 2013 7. The applicant shall obtain building permits for Phase III of the redevelopment project no later than June 1, 2014 8. Filing & Information Requirements The City requests that you make a pre-application meeting with the City Planner to discuss the application process, requirements, and deadlines. Unless waived by the City Planner or Planning Commission, a certified survey of the property is required for all applications. Complete/Incomplete Applications An incomplete application will delay the processing of land use requests. The application approval time - commences and an application is considered officially filed when the City Planner has received and examined the application and determined that the application is complete. A decision on whether the application is complete or incomplete shall be made within fifteen (15) working days following the submittal of the application. When the application is deemed to be "complete" it shall be placed on the agenda of the first possible Planning Commission meeting provided that all required public notices have been sent and published. — Payment of Fees The undersigned acknowledges that she/he understands that before a land use application can be deemed complete, all required information and fees (including all deposits) must be paid to the City. If additional fees are required to cover costs incurred by the City,the City Planner has the right to require additional payment from one or more of the undersigned, who shall be jointly liable for such fees. Such expenses may include (but are not limited to) direct city payroll and overhead costs, fees paid to consultants and other professionals, and the cost of printing, mailing, and supplies. The City may withhold final action on a land use application, withhold building permits, and/or rescind prior action until all miscellaneous fees have been paid. Applicants are advised that an escrow deposit is required at the time of the submittal of the land use application to offset costs associated with the proposed project. Unused portions of an escrow are returned to the applicant upon successful implementation of an approved plan. Walgreens, as well as CVS, have indicated a desire to not have what has been shown as Building#3 at the Arden Plaza PUD. Building#3 was proposed to be an approximate -- 4700 square foot retail or restaurant building attached to the south side of the pharmacy building. In addition, the economy has significantly delayed the decisions by pharmacies to construct new stores. Consequently, we are also asking for some deadline extensions in the Arden Plaza PUD. 1 Specifically, we request the following modifications to the conditions set forth in your - letter to Arden Plaza, LLC dated July 29, 2009 which specifies the various conditions of the PUD approval: Condition 1: We request that the plans be amended to reflect that Building #3 is no longer required in Phase I or any subsequent Phases. Building#3 is optional to the owner of Lot 3. Instead of constructing Building#3 as part of Phase I, the plans would be amended to require in Phase I the construction of a landscaped gathering place on Lot 3 and the construction of the south end of the pharmacy building in accordance with the plans submitted with this Application consisting of three sheets dated March 29, 2010. The Planning Commission unanimously recommended approval of this planning case at the April 7 meeting. The City Council unanimously voted to approve Planning Case 09-022 for a variance at 1563 Edgewater Avenue to allow Mr. and Mrs. Ranallo to construct a new home that encroached 5.1 feet into the side yard setback. The Planning Commission unanimously recommended approval of this planning case at the April 7 meeting. The City Council unanimously voted to approve Planning Case 09-023 for a CUP Amendment and Zoning Code Amendment regarding the Reiling Tower at 1296 County Road F. The Planning Commission unanimously recommended approval of this planning case at the April 7 meeting. The City Council unanimously voted to approve Planning Case 09-019 for a CUP Amendment to allow an additional six antennas to be placed on the Reiling Tower at 1296 County Road F.
