SUBJECT: Request for Night Time Construction Activity Waiver; Land O'
Lakes
BACKGROUND
Land O' Lakes has submitted an application for a Night Time Construction Activity Waiver to
assist them in completing a parking lot rehabilitation proj ect located at 4001 N. Lexington
Avenue. Per City Code which was modified on March 29, 2010, notification of all property
owners within 500 feet of the proposed proj ect is required. Staff sent the attached notice to the
eight properties located within the 500 foot requirement. All night time construction activity
waivers are issued by the City Council.
The parking lot is approximately 7.3 acres and accommodates parking for 770 vehicles on the
site. Due to the number of vehicles that use this parking lot on a daily basis, Land O' Lakes is
requesting this waiver of section 630.10 of the City Code to allow for night time construction
activites to occur to be able to complete this proj ect with the least amount of impact to their
regular daily operations. Land O' Lakes is currently proposing start of constuction to occur on
July 9, 2010 with completion by August 30, 2010.
Land O' Lakes has submitted the required request waiver form and fee and has also submitted the
attached letter outlining their proj ect.
RECOMMENDATION
Approval of the request for a night time construction activity waiver for Land O' Lakes on

Background: Land O' Lakes has submitted an application for a Night Time Construction

Location: The property is located at 4001 N. Lexington Avenue, which is generally
located north of Interstate 694, south of County Road F, west of Lexington Avenue, and
east of Highway 51 /Hamline Avenue.

This letter is a written on behalf of Land O' Lakes to request City of Arden Hills approval to perform
after hour construction activities on the Land t�' Lakes parking lot loca.ted at 4001 Lexington Aver�ue
l�orth, �rden �Iills, Minnesota.
Pro�e1 ct TY�e
The approximate 7.3-acre parl�ing lot/drive is�es are approximately 30-years old and �ave had several
biturninous overlays and seal coats over the years. The 4�� � Lexington Avenue North �,and O' I�akes
facility emp�oys $50 people. Approximately 750 employees work between the ho�rs of 6:Q0 A.M.
and 5:00 P.M. The parking lot facilitates approximately 770 vehicles and is fully utiiized on a daily
basis during weekday daytime hours. The proposec� maintenance project includes rer��oving ai� the
�ituminous in the parking and drive areas {including the Vi��tor Drive� for approximately �,500
cubic yards of export and 4,10� cubic yards of i�port, approximately 2,600 lineal feet of concrete
curb and gutter rernova�lreplacer�ent, approximately 2,100 cubic yards of subgrade correction, and
some storm sewer �anhole and catch basin mainienance. No parking lot �xpansiot� andlor d�ive isle
expansions are proposecl.
Proposed �'orking �iours
The proposed �naintenance project will be perfor�ned in phases during evenings and weekends wher�
the parking lots and drives have lirnited usage. �ons�ru�tion work is ant�c�pated to b�gin at
approxin�ately b:0� P.1VI. and end ap�roximately b:00 A.M. A majority of the ti�veekend work is
ar�ticipated to �e be�ween $:00 A.M until 9:00 �.1V�.

Reasons for Waiver Request
The benefits of perrnittin� Land O' Lakes to perforr� a r�ajority of the construction during the
evening hours are as foliows:
• No on-streei parking is proposed with this construction. The selected coniractor will be
direc�ed to phase the project so that �he disturbed parking area and/or drive isle can be
restored to grave� base at the co�n�letion of the evening Work. This will allow the Land
t)'Lakes staff to utilize the parking lot and drive isles during dayiime working hours.
� No need for a remote parking location ar�d sh�ttle service. As mentianed above, by� phasing
the project and bringir�g all disturbed areas up to gravel, aln�ost the entire area will be able to
�e used for parking a�d drive �anes.
�t should be r�oted that should the parking lot rehabilitation pro�ect be lin�ited to daytime
hours and weekends, the phasing would resu�t in approxim.ately 20� vehicles being �elocated
to a�emote �ocations and the employees shuttled in from the remote location. Shuttling
employees fro� �. remote location is very expense and will increase t�e �raffic flow on the
.
surroun �ng streets.
•�'hasir�g the co�struct�on activity will reduce the amount of exposed soils. BKBM has
reviewed �he scope of work witl� a c�uple of coniractors. The contractors and BKBM
anticipate constructing the project ir� phases and placing the fir�t lift o�bitumint�us prlor to
start of the next phase. This procedure �vil� reduce the amount of exposed soils and gravei
base, therefore reducir�g the impacts of erosion and construction delay due to rainfall.
� Public safety will be greatly increased by performing the construction activity during the
e�ening l�ours. BKBM esiimates a combined total of approxima�ely 14,000 cubic y�ards of
material will need io be exported and imported for� �his project. This f gures to be
appr�ximately 1,500 10-cubic yard durnp trucks turning onto �o�nty Road F and impacting
the County Road �lLexington Avenue intersection as well as the Lexington Avenue/694
�ntersection. By performing ihe v�ork i� the evening hours, traff c flow on these r�ads are
greatl� reduced, a reduced risk of accidents, and less tirr�e delays for folks using the roadway
and construction equipment.
• No construction traffic will be �ern�itted to ingress or egress the site from the west on Count�T
Road F. Land O'Lakes ur�derstands there are residential units lo�ated west of the subject
property on County Road F. In order to reduce the amount of impact frorn construction
traffic noise on Land O'Lakes neighbor�, Land O'Lakes wil� restrict construc�ion traffic from
e�tering or �eavir�g the site from the west on County Road F.
��oncreie batc� planis typically do not operate during the evening hours. Most of the
concrete curb and gutter work wil� need to occur during daytime hours which will involve
closing sor�.e parking s�alls. The number ofstalls closed �vill depend on how the project is
phased and where the curb work is to occur. For example, curbed islands that need repair
may need only 3 0� 4 stalls closed off, u�hi�e longer stretch�e�l of curb work rriay require i�p to
10 stal�s closed off. Again, no or�-street park�ng will be permitted and Land O'Lakes will

more strongly encourage car pooling. It is an�icipated that Land O'Lakes employees will be
up�ated by rr�anagen�.ent on a regular basis in regarcls to stall closur�s and construction
schedule.
• Project construction tirne wil� be greatly reduced by permitting construction activity to occur
during evening h�urs. �Iaving the parking lots and drive isles vacated of vehicles during the
evening hours great�y �mproves the efficiency of construction and safety of �and O'Lakes
ernployees. The contractor will be aliowed to work wi�hou� major concerns of Land O' Lakes
employees entering the construct�on zone and consiruction vehicles will be perr�itted to drive
aroun� the site without major conflict �f Land O'Lakes er�ployee ve�icles.
Proposed Construction Start and End Dates
