Resolution 2010-028. �.� EN HILLS MEMORANDUM DATE: May 24, 2010 TO: Honorable Mayor and City Council Members Patrick Klaers, City Administrator FROM: Sue Iverson, Finance Director/Treasurer SUBJECT: Patrick Klaers Election to be Excluded from PERA Back�round Minnesota Statute 353.028 allows City Managers and City Administrators to opt out of PER.A if they choose this election within the first six months of employment. By choosing this option they agree that they will not seek any authorization to purchase service credit for any period of the excluded service and that this election is irrevocable. Discussion Since State Statute does allow City Managers and City Administrators to opt out of PERA within the first six months and our employment contract specifies that we will contribute to either PERA or an alternative plan, Patrick has opted to participate in the ICMA-RC plan at the same contribution level as would have been required under PERA by both himself and the City. There is not impact on the budget as a result of this election. PERA requires formal City Council approval of this election. I have elected to be excluded from PERA. I will not seek to purchase PERA credit for any period of my service with the City. My alternative plan will be with ICMA-RC. EN HILLS CITY OF ARDEN HILLS COUNTY OF R.AMSEY STATE OF MINNESOTA RESOLUTION NO. 2010-028 A RESOLUTION APRROVING ELECTION OF PATRICK KLAERS TO BE EXCLUDED FROM THE PUBLIC EMPLOYEES RETIREMENT ASSOCIATION WHEREAS, Patrick Klaers, has notified the City Council of his election to be eXcluded from membership in the Public Employees Retirement Association and has provided this Council with a copy of his written election to do so, all as authorized by Minnesota Statutes 353.028. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ARDEN HILLS, MINNESOTA AS FOLLOWES: l. The Council makes the following findings: a) Patrick Klaers is the City Administrator of the City of Arden Hills, Minnesota. b) That position is provided for in the ordinances of the City of Arden Hills. c) He was duly appointed to serve in that position effective May 3, 2010. d) The City Administrator is the chief administrative officer of the City of Arden Hills. e) Acting under Minnesota Statutes 353.028 he has elected to be excluded from membership in the Public Employees Retirement Association, effective upon his filing such election with the Executive Director of that association. � In making this election, he has agreed that he will not at any time in the future seek any authorization to purchase service credit for any period of excluded service. He has further agreed that this election is irrevocable. 2. Said election is therefore approved. 3. A certified copy of this Resolution shall be provided to the Executive Director of said association. ADUPTED BY THE CITY COUNCIL OF THE CITY OF ARDEN HILLS THIS 24th DAY OF MAY, 2010. Stanley D.
