1320.04, 1320.05, and 1320.06 of the City Code and adding Section 1320.135 to the City Code
regarding the TCAAP Zoning Regulations as presented in the June 28, 2010, report to the City
Council, and authorize the publication of a summary of Ordinance 2010-010.
Back�round
At the February 16, 2010, City Council work session, staff proposed a TCAAP zoning regulation
concept that was based on the mixed use vision adopted in the 2030 Comprehensive Plan. The
City Council directed staff to proceed with the concept and to initiate a process to review the
regulations with the City Council; Planning Commission; Economic Development Commission;
and the Parks, Trails, and Recreation Committee. The City's goal was to adopt or be close to
adopting the zoning regulations prior to the TCAAP public auction. After several months of
preparation, the Planning Commission held a public hearing on June 9, 2010, where they
recommended approval of the regulations to the City Council.
A primary purpose of these zoning regulations is to inform potential bidders of the City's vision
for the TCAAP reuse area. Since there is not a specific reuse plan for the TCAAP reuse area, the
regulations are essentially a"plan to create a plan". Once the property is sold, this process will
be used by the City and a developer to create a master plan. While the regulations are based on
the vision in the Comprehensive Plan, the City recognizes that there may be other ideas that
would benefit the City but are not specifically identified within the proposed zoning regulations.

If an innovative and beneiicial idea is proposed for the TCAAP property, the City has the ability
to modify the regulations if needed.
2030 Comprehensive Plan
The Arden Hills 2030 Comprehensive Plan was adopted in September 2009 and sets a twenty
year vision for the community. For the TCAAP redevelopment, the Comprehensive Plan
includes the following goal:
Develop TCAAP in a way that accommodates a mix of land uses that is sensitive to the
natural environment, economically sustainable, and a benefit to the community.
To help accomplish this goal, the 2030 Future Land Use Map divides the TCAAP redevelopment
into four categories:
• Mixed Residential (�220 acres 1) — provides for a variety of housing types and densities in
close proximity, including single-family detached homes, single-attached homes,
condominiums, townhomes, apartments, and senior housing options. The anticipated
average density is 10.4 units per acre with a minimum average density of six units per
acre up to a maximum density of 46 units per acre. This land use is designated for the
proposed TCAAP redevelopment, and the density is subject to change once a final land
use plan is selected.
• Mixed Business (�240 acres) — areas designated for a variety of businesses, including
commercial, certain light industrial uses, warehousing, office, general business, retail.
This designation will be used for the future business uses on the TCA.AP property.
• Park and O�en S�ace (�76 acres) — areas designated as public parks.
• Park Preserve (�49 acres) — areas designated as natural or scenic areas that are to be
preserved for public use or open space.
While these land use categories were based on the mixed use development concept that was
being prepared with the former developer, these categories still serve as the basis for a TCAAP
redevelopment plan and allow the City to update the land use regulations for the TCAAP
property. However, a comprehensive plan does not include such details as setbacks, design
standards, landscaping requirements, or sign regulations that is the job of the Zoning Code.
The Comprehensive Plan lays the foundation for the Zoning Code, and State Statute requires the
zoning code to be in conformance with a city' s comprehensive plan.
If necessary, the future land use map and categories can be amended at a later date, subject to
Metropolitan Council approval. As it stands, housing would be limited to the Mixed Residential
area and businesses would be limited to the Mixed Business area.

TCAAP Zonin� Re�ulations
In summary, the proposed zoning regulations are designed to do the following:
• Create two new zoning districts for the TCAAP reuse area: Mixed Residential (MR) and
Mixed Business (MB);
• Define a process for creating a detailed master plan for the MR and MB zoning districts
through the Planned Unit Development (PUD) proces s;
• Implement design standards for the MR and MB Districts;
• Ensure that the necessary environmental remediation requirements are included in the
master plan; and,
• Update and add definitions to support the TCAAP zoning regulations.
The proposed zoning regulations affect six parts of the zoning code (the page numbers of where
each section is located in the attachment are included):
1305.04 — Definitions (pages 1-26): The definitions section is utilized by all sections of
the Zoning Code. Because the entire definitions section is included, the new or revised
definitions are underlined. At this point, the definitions do not have any discernable
impact the other zoning districts. However, some of the new definitions overlap with
existing definitions. Since this project focuses on TCAAP, the older deiinitions cannot
be removed yet. Once the TCAAP zoning project is complete, staff will review the
definitions section to recommend definition updates for the existing zoning districts so
that the existing definitions are brought up to date where needed.
1320.01 — Zonin�Ma� (pa�e 27): The zoning map will be updated to reflect the newly
created Mixed Residential (MR) and Mixed Business (MB) zoning districts.
1320.04 — Pur�ose of Districts (pages 28-29): All of the zoning districts have a purpose
that is listed in this section. When a city adopts a zoning regulation, the purpose is the
foundation and the rational basis for creating the district. While the statements are
somewhat general, they are intended to advance the community goals in the 2030
Comprehensive Plan.
1320.05 — Land Use Chart (pa�es 30-31): The land use chart lists the permitted,
accessory, conditional, and conditional accessory uses for each zoning district in the City.
If a use is not on the chart of if a use has the "__" symbol, the use is considered
prohibited. Some of the uses, notably "office" and "retail", have very broad definitions
that allow for a wide variety of uses. Section 1320.135 Subd S.B provides further
clarification for the MR and MB districts for certain types of uses that may fit under the
"retail" or "office" definitions but are not appropriate for the TCAAP reuse area.
1320.06 — District Requirements Chart (�a�e 31): For the other zoning districts, the
district requirements chart defines such items as minimum lot size and setbacks. Since a

specific master plan is not yet completed for TCAAP, it is difficult to determine exactly
what would be an appropriate lot size or setback. These requirements will be defined
during the master planning process outlined in Section 1320.135. The known
requirements, including height and overall density, are included. The density limitations
and park/open space requirements ensure that there will be adequate landscaped area.
1320.135 — S�ecial Rec�uirements for the Mixed Residential and Mixed Business Districts
�pa�e 34-50): This section is the workhorse of the new MR and MB districts. This
section includes the Planned Unit Development (PUD) process and the components that
will be used to create a detailed TCAAP master plan.
Subd. 1— General Procedure (pages 32-33). This section is a summary of the
overall planning and review procedure for the PUD.
Subd. 2— PUD Concept Plan Review (page 33). Applicants will be required to
meet with the City and discuss a non-binding concept before an official PUD
Master Plan application can be submitted. The concept review process includes
the Planning Commission and City Council and is intended to help facilitate
discussions between a developer and the City.
Subd 3— Public Engagement Plan (pages 33-34). Due to the potential impact on
the community, public input and participation is important for creating the master
plan. This section requires the applicant to implement a public engagement plan
to help create and review a PUD Master Plan.
Subd 4— PUD Master Plan (pages 34-35). This subdivision describes the process
and information requirements for submitting an application to create the TCAAP
master plan. Part C is particularly important because it defines when a PUD
Master Plan application is deemed complete. Once an application is complete, the
City is subject to the statutory 120 day review process. In order to consider the
application complete, the applicant would need to complete the components in
subdivisions five through 15. Most of the Master Plan review will actually occur
before the application can be considered complete, which will help ensure that the
Master Plan is providing the necessary information and meeting City
requirements.
Subd 5 to 15 (pages 35-46) — These eleven components list the information and
performance requirements that will be used to design the PUD Master Plan. The
PUD Master Plan will be a detailed plan for the entire TCAAP reuse area. The
City can allow adjustments through the PUD process; however, these components
set the direction for the City and a developer. This is where the City can work

with a developer to balance flexibility with requirements that are important to the
community.
The eleven planning components are Section 1320.135 Subdivisions:

Subd. 16. PUD Final Plan (page 47-48). This is the final phase of the PUD
process and is used when a developer actually starts construction on a particular
phase. The PUD Master Plan will be a plan for the entire TCAAP property, but
construction is likely to occur over time in stages. The PUD Final Plan is used to
finalize the construction detail for a specific stage of development and to ensure
that each construction stage is in conformance with the provisions of the PUD
Master Plan.
Plannin� Commission Review
The Planning Commission voted (6-1) to recommend the proposed TCAAP regulations at their
June 9, meeting. As part of their discussion, the Planning Commission recommended four items
for amendments or additional research:
• Review the definition for "Daycare facility" and "Schools, general education" to ensure
that there was clear distinction between the two definitions and that a preschool or
nursery school was clearly defined. The definition for "Daycare facility" has been
amended to remove the reference to schools in order to provide a clearer distinction
between schools and daycares. Section 1305.04 Subd. 4� (page 6) � Subd 1 �1 (page 20).
•
Add the words "or leased in its entirety" to the definition of "Residence hall, dormitory".
The intent was to include structures owned by third parties, but leased in their entirety by
a high school, college, university, or seminary, within the definition. Section 1305.04
Subd 164 (page 18).
• Review the definition for Ofiice showroom and Office warehouse, both of which are
limited to no more than 15 percent of the building floor area in the Mixed Business
District. The definitions for office showroom and office warehouse, however, seemed to

be inconsistent with the intent of the 15 percent limit and allowed a greater portion of the
buildings to be warehouse or showroom. In order to address the inconsistency, the
definition for office showroom and office warehouse have been merged to limit those
types of buildings to no more than 50 percent showroom and/or warehouse. The 15
percent limit remains unchanged; just the definition was revised. Section 1305.04 Subd
135 (page 1 S).
• Review suggestions from Lyle Salmela for the Environmental Sustainability section for
possible incorporation into the zoning regulations.
Except for Mr. S almela' s suggestions, the proposed changes above have been incorporated into
the proposed TCAAP zoning regulations. Mr. Salmela's suggestions along with other potential
amendments are provided in the next section.
Possible Amendment Options
Based on comments provided at the Planning Commission meeting and additional research, Staff
has prepared possible additions that can be incorporated into the proposed TCAAP zoning
regulations. The below options have not been included into the attached regulations. However,
the potential additions can be added by the City Council with a motion for approval. For
simplicity, a motion for approval could include a reference to option 1, option 2, andlor option 3
in this memorandum instead of restating all of the language in each option.
Option 1: Environmental Sustainability Component — Suggestions from Lyle Salmela
As noted above, Mr. Lyle Salmela spoke at the Planning Commission meeting and submitted
several suggested amendments to Subdivision 11, the Environmental and Sustainability
Component (page 44-45). The Planning Commission requested Staff review Mr. Salmela's
proposed changes and present them to the City Council for consideration. Staff has reviewed the
suggestions and is supportive of the new language. Only the portions of Subdivision 11 that
would be modified are shown:
Subd. 11 Environmental Sustainability Component. The PUD Master Plan shall
incorporate green building and design principles where feasible, and shall meet the
following requirements:
A. Building design. New buildings over fifteen thousand (15,000) square
feet in gross floor area shall incorporate at least two of the features in the
following section. All buildings with 15,000 or fewer square feet,
includin� residential units, are recommended to meet these buildin�

requirements.

2. Meeting a green building performance standard such as LEED, B3,
EnergyStar, or passive desi�n.
4. Energy Efficiency: A minimum of a thirty-five (35%) percent
increase in overall building energy efficiency as compared to the
Minnesota Energy Code. Energy efficiency is to be defined by the
use of purchased (generated or refined at a separate site) or on-site-
generated fuels consumed per square foot of occupied space.
Calculations can take into account the use of the following:
a. On-site generated renewable energy, including photovoltaic or
wind tricity; passive solar systems using
solar heat or light; geothermal source; or other use of renewable
fuels displacing the use of non-renewable fuels in the building's
systems.
B. Stormwater management. Low-impact development techniques shall
be employed within each phase of the PUD Master Plan, to include, but
not limited to:
3. Integration of green roofs and roof gardens on buildings where
feasible to control rainwater and other benefits.
Option 2: Environrrcental Sustainability Component -
At the Council worksession on May 24, there was a direction to increase the minimum building
size that triggers the environmental sustainability requirements in Subdivision 1l. The building
size increased from 10,000 to 15,000 square feet. After the meeting, however, it was noted that a
15,000 square feet is slightly larger than many types of typical nationwide businesses, notably
restaurant chains, pharmacies, and other similar size uses. Since nationwide companies often
have a greater ability to implement sustainability components due to their larger size and
resources, it was suggested that chain stores be required to meet the sustainability requirements
at a lower threshold.
Subd. 11 Environmental Sustainability Component. The PUD Master Plan shall
incorporate green building and design principles where feasible, and shall meet the
following requirements:

nationall,y shall incorporate at least two of the features in the followin�
section. All new buildings over fifteen thousand (15,000) square feet in

requirements .
Option 3: Park Dedicatzon Requirement Amendment
When the park dedication section was being written, the City preliminarily agreed to limit the
park dedication requirement to 10 percent provided that Ramsey County received their requested
land for park and open space. Assuming the transfers to Ramsey County take place, there would
be 430 acres available for sale at the public auction. If, however, Ramsey County did not receive
the land, the City reserved the right to increase the park dedication requirement to compensate
for the loss. At the June 21 City Council worksession, there was a suggestion to modify the
language to provide some flexibility should Ramsey County not receive their land request.
Additionally, it was noted that the proposed language in Subd 7.A included the words "at least
10 percent", which is not consistent with the City's support of the Ramsey County land transfer
request. Staff is recommending that the following language replace the proposed regulations:
Subd. 7. Park, Recreation, Pathways, and Open Space Component.
A. Park, Recreation, Pathway, and Open Space Needs. In order to meet the needs of the
development and population on TCAAP, the applicant shall dedicate developable land to
create an integrated, park, recreation, pathway and open space system that is open to the
general public. Private landscaping; private pathways; and rights-of-way, including
landscaped medians and boulevards shall not count toward the park, recreation, pathway,
and open space requirement. The park dedication requirement shall be based on the total
acreage of former TCAAP property made available for sale by the General Service
Administration, on behalf of the United Siates Army. This total area may exceed the
combined area of the Mixed Business and Mixed Residential Zoning Districts. The park
dedication shall be as follows:

In lieu of the dedication of the land for recreational purposes, the City Council may
require the developer to pay to the City, as an equivalent contribution, an amount in cash
equal to the percentage of the land required to be dedicated, multiplied by the fair market
value of land remediated to MPCA Tier II Residential SRV. The park dedication may be
divided between a land dedication and cash contribution at the discretion of the City.
Option 4: House of Worship
Staff contacted Jean Coleman, the attorney working with the Cuningham Group,
regarding the House of Worship use on the land use chart. The proposed regulations do
not list House of Worship as a permitted use in the MB or MR Districts. Ms. Coleman
expressed concern about not allowing House of Worship in those districts. She is
preparing a letter for the Council explaining her concern. The letter was not ready in
time for this printing; however, staff will provide it upon receipt to the Council. She
recommends that the City reconsider allowing House of Worship as a permitted use on
the land use chart.
�indin�s of Fact
The Planning Commission offers the following findings of fact for this proposal:
l. The proposed Mixed Residential (MR) and Mixed Business (MB) advance the vision for
the TCAAP reuse area stated in the 2030 Comprehensive Plan.
2. The proposed MR and MB zoning districts are in conformance with the 2030
Comprehensive Plan Future Land Use Map.
3. The proposed uses in the MR and MB zoning districts are in conformance with the 2030
Comprehensive Plan future land use categories.
4. The proposed density for the MR district is in conformance with the 2030
Comprehensive Plan future land use category.
5. The proposed zoning additions and amendments are in keeping with the spirit, purpose,
and intent of the City's zoning regulations because it promotes the general welfare, public
health, safety, and comfort of the inhabitants of the City.
Recommendation
The Planning Commission recommends (6-1) approval of Ordinance 2010-010 in Planning Case
10-009 amending Sections 1305.04, 1315.01, 1320.04, 1320.05, and 1320.06 of the City Code
and adding Section 1320.135 to the City Code regarding the TCAAP Zoning Regulations as
presented in the June 28, 2010, report to the City Council, and the authorization of publishing a
summary of Ordinance 2010-010.

desired.

Noticed was published in the Shoreview-Arden Hills Bulletin, mailed to all properties within 500
feet of the property, and to the planning departments of the adjacent communities.
Deadline for A�encv Action
Although this application does not have a legal deadline, the City's goal is to have the TCAAP
land use regulations adopted prior to the TCAAP public auction, which is anticipated to take
place in July or August 2010.
